BE IT REMEMBERED that the City Council of the City of Beaumont , Texas,
met in regular session this the 12th day of October , 1982 , with the fol-

The Invocation was given by the Very Reverend Edward Chiffriller , Our
Mother of Mercy Catholic Church.
The Pledge of Allegiance was led by Councilman Cox.

Government Students . from Westbrook Senior High School were welcomed to
the meeting.
The following proclamations were issued: "Day in Court for Legal Secre-
taries in Beaumont" - October 13 , 1982 , and "Martial Arts Week in Beau-
mont" - October 10-16, 1982 .

The following Consent Agenda items were considered:
Approval of the Minutes of the regular City Council session held October
5, 1982 ;
Resolution 82-378 authorizing withdrawal of $4,080,000. 00 in securities
pledged by Texas Commerce Bank of Beaumont as collateral for city bank
deposits (total pledged - $45 ,495, 000. 00) ;
Resolution 82-379 appointing Carolyn Broussard, Madeline Hardy and Tom
Peterson to the Clean Community Commission , terms to expire September 30,
1984;
Resolution 82-380 appointing Raymond Ambres to the Transit Advisory Com-
mittee, term to expire June 30, 1984 ;
Resolution 82-381 appointing Olivia Gonzales to the CDBG Citizens Advisory
Committee, term to expire May 31, 1984;
Resolution 82-382 authorizing payment of $1 ,Q40. 30 for books purchased
for the library from Strand Book Store;
Resolution 82-383 authorizing a contract with Fittz, Crozier & Shipman ,
Consulting Engineers, for the surveying and mapping services for the
Fire Department Training Grounds in an amount not to exceed $4,260. 00;
Resolution 82-384 granting a combination overhead and underground ease-
ment to Gulf States Utilitdes Company for an electrical distribution line
to serve the Sewage Treatment Plant and

Resolution 82-385 granting a 30-foot by 40-foot easement to Southwestern
Bell Telephone Company across the 23rd Street Lift Station property.
The Consent Agenda was approved on a motion made by Councilman Lord and
seconded by Councilman Cox.

Messrs. Jess Fuller and Tommy Langston , representatives of the Y.M.B.L. ,
presented South Texas State Fair tickets to Council and staff.

Ordinance No. 82-122 changing the zoning from GC-MD and R-3 to NC, RS,
RM-H, GC-11D and PUD in the area covered by Section V of the Highland
Avenue/South Park Rezoning Study was considered:

THE CODE OF ORDINANCES OF BEAUMONT, TEXAS,
AND IN PARTICULAR THE BOUNDARIES OF THE ZONING
DISTRICTS AS INDICATED UPON THE ZONING MAP OF
BEAUMONT, TEXAS, BY CHANGING PROPERTY PRESENTLY
ZONED GC-MD (GENERAL COMMERCIAL - MULTIPLE DWEL-
LING) AND R-3 (MODIFIED TWO-FAMILY AND MULTIPLE
DWELLING) DISTRICTS TO NC (NEIGHBORHOOD COMMERCIAL)
RS (RESIDENTIAL SINGLE FAMILY) , RM-M (RESIDENTIAL
MULTIPLE DWELLING - MEDIUM DENSITY) , GC-MD (GEN-
ERAL COMMERCIAL - MULTIPLE DWELLING) AND PUD

The ordinance was approved on a motion made by Councilman Deshotel and
seconded by Councilman Lord.

Ordinance No. 82-123 granting a specific use permit for a child day care
center at 4360 Park (application made by Mrs. Elsie Kennett ) was consid-
ered:

ENTITLED AN ORDINANCE FOR THE ISSUANCE OF A
SPECIFIC USE PERMIT FOR A DAY CARE CENTER ON
PROPERTY LOCATED AT 4360 PARK STREET.
Councilman Turner made a motion to deny the ordinance; motion failed for
lack of a second.
Councilman Deshotel made a motion to approve the ordinance with an amend-
ment to change the privacy fence to a chain link fence; motion died for
lack of a second.
Councilman Lord made a motion to approve the ordinance as submitted; mo-
tion seconded by Councilman Deshotel.

Resolution 82-386 authorizing a contract with Garrod and Dartez, Consult-
ing Engineers, for engineering services for design and construction of
the Crockett Connector - Liberty-Laurel Connector/T. I .P. , Phase I - fee
not to exceed $160,000. 00, was approved on a motion made by Councilman
Turner and seconded by Councilman Deshotel.

Resolution 82-387 authorizing a contract with Calloway Chemical Company
for furnishing a year' s supply of liquid polymer flocculant for the Water
Reclamation Department at the Sewage Treatment Plant for sludge dewater-
ing at $0. 73 per pound ($14. 60 per ton of sludge or approximately $26,645
for the year' s supply) was approved on a motion made by Councilman Lord
and seconded by Councilman Deshotel .

Ordinance No. 82-124 terminating the assessment paving program was con-
sidered:
ORDINANCE NO. 82-124
AN ORDINANCE AMENDING THE CODE OF ORDINANCES
TO REPEAL SECTION 23-11 CONCERNING RESIDENTIAL
PAVING ASSESSMENT; AND PROVIDING FOR SEVERA-
BILITY.
The ordinance was approved on a motion made by Councilman Turner and se-
conded by Councilman Cox.

Resolution 82-388 authorizing a cost participation agreement for con-
struction of a 12-inch water main in the vicinity of Interstate 10 and
Walden Road (approximately 900 feet - City cost 1-1 times cost of mater-
ials at $6, 600. 00 or $9, 900. 00) was approved on a motion made by Council-
man Deshotel and seconded by Councilman Turner.

Mr. J. T. Johnson , 1408 Johns, addressed Council to complain about the
noise created by the whistle-blowing of the Atchison , Topeka & Santa Fe
trains in his area.
Mr. J. C. .Leggett , 1849 Washington Blvd. , complained of poor drainage in
his area.

There being no further business, the meeting was recessed before continu-
ing with the Workshop Session.
