The Pledge of Allegiance was led by Councilman Lord. -000- The Minutes of the regular City Council session held August 10 , 1982 , were approved on a motion made by Councilman Deshotel and seconded by Councilman Cox. Question : Ayes : All Nayes : None -000- Ordinance No. 82-88 amending Section 30-24 of the City Code by adding a local passenger transportation subgroup to the Table of Permitted Uses was considered: ORDINANCE NO. 82-88 ENTITLED AN ORDINANCE AMENDING SECTION 30-24(B) OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT BY ADDING SUBGROUP NO. 4119 - LOCAL PASSENGER TRANSPORTATION, NOT ELSEWHERE CLASSIFIED, AS A PERMITTED USE IN CERTAIN DISTRICTS ; PROVIDING FOR SEVERA- BILITY.; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. Subgroup No. 4119 - Local Passenger Transportation ( including ambulance service, chauffeur service and sightseeing buses) , Not Elsewhere Classi- fied, amends the Code of Ordinances by adding as a permitted use in GC-MD (General Commercial - Multiple Dwelling) , CBD (Central Business District ) , C-M (Commercial - Manufacturing) , LI (Light Industrial) , and HI (Heavy Industrial) Districts and as a use permitted by specific use permit in PUD (Planned Unit Development ) Districts. Ordinance No. 82-88 was approved on a motion made by Councilman Lord and seconded by Councilman Turner. Question : Ayes : All Nayes : None -000- -136- August 17 , 1982 Ordinance No. 82-89 amending the definition of home occupation day care centers in Section 30-4 of the City Code was considered : ORDINANCE NO. 82-89 ENTITLED AN ORDINANCE AMENDING CHAPTER 30, SECTION 4, OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT BY CHANGING THE DEFINITION OF "HOME OCCUPATION; " PROVIDING FOR SEVERA- BILITY; PROVIDING FOR REPEAL; AND PROVIDING A PENALTY. Section 30-4(f) reads : " . . . . . the keeping of up to five (5) children under the age of sixteen (16) years at any one time apart from their parents , guardians or custodians for regular periods of time for compensation , provided that the total number of children under the age of sixteen (16) years on the premises at any one time , including those kept without compensation and those who re- side on the premises , shall not exceed eight (8) . " Councilman Cox made a motion to approve the ordinance; motion was seconded by Councilman Deshotel . Question : Ayes : Mayor Neild Nayes : Councilman Lord Councilman Cox Councilman Turner Councilman Deshotel -000- Ordinance No. 82-90 amending wrecker provisions in Section 29 of the City Code to include auto loading carrier trucks was considered : ORDINANCE NO. 82-90 ENTITLED AN ORDINANCE AMENDING CHAPTER 29 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT, TEXAS , BY AMENDING SECTION 29-79(7) RELATING TO WINCH AND BOOM REQUIREMENTS FOR WRECKERS; PROVIDING FOR REPEAL; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. Section 29-79(7) is amended by adding the sentence : "The winch and boom requirements contained herein shall not apply to an auto-loading wrecker with a hydraulically-operated bed. " Ordinance No. 82-90 was approved on a motion made by Councilman Deshotel and seconded by Councilman Turner. Question : Ayes : All Nayes : None -000- Ordinance No. 82-91 amending provisions of Section 26-24 of the City Code relating to reduced speed school zones was considered : ORDINANCE NO. 82-91 ORDINANCE AMENDING CHAPTER 26 , SECTION 26-24 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT BY CHANGING THE HOURS FOR CERTAIN SPEED LIMITS; ADDING AND DELETING CERTAIN ZONES; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PRDVIDING A PENALTY. Schedule A provides prima facie speed limit of twenty (20) miles per hour between the hours of 7 : 15 a.m. and 8 : 15 a.m. and 2 :00 p.m. and 3 :30 p.m. , Monday through Friday on school days; Schedule B between the hours of 8 :00 a.m, and 9 :00 a.m. and 3 : 00 p.m. and 4 :00 p.m. , Monday through Friday on school days ; and Schedule C between the hours of 7 : 15 a.m. and 9 :00 a.m. and 2 :00 p.m. and 4:00 p.m. , Monday through Friday on school days. -137 August 17, 1982 Ordinance No. 82-91 was approved on a motion made by Councilman Lord and seconded by Councilman Deshotel. Question : Ayes : All Nayes : None -000- Resolution 82-303 appointing Chester Sassine to the Transit Advisory Committee for a term expiring June 30 , 1983 was approved on a motion made by Councilman Cox and seconded by Councilman Lord. Question : Ayes : All Nayes : None -000- PUBLIC HEARING LAND USE COMPONENT OF THE COMPREHENSIVE PLAN CITY MANAGER: The next item is a public hearing to be conducted concerning the Land Use Component of the Comprehensive Plan. I believe the Council received the report at its workshop last week and is aware of the consideration of the Land Use Plan over the number of months that it ' s been under consideration both by the Planning Commission and the Joint City Development Committee. I would ask, if you would like , Mr. Norman Whitaker might summarize the Plan prior to the public hearing but he is available here to provide any information to the Council as part of the public hearing or afterwards. MAYOR NEILD : Well , at this time , I would call the public hearing on the Land Use Com- prehensive plan and anyone would like to come and speak in connection with that , please come to the podium and give us your name and address. MR. J. C. LEGGETT, 1849 Washington Boulevard: Just one question. Define that for me. I don ' t understand. MAYOR NEILD: Define the Comprehensive Land Use Plan? All right . Jesse , would you like to . . . . . . I would be glad to do it but I might take an hour and they may be able to- do it in five minutes or less. MR. JESSE TORRES , Asst . Planning Director : Mr. Leggett , the Comprehensive Lane Use Plan is an inventory that we took of all the land within the City limits and what we feel is the best pro- jected use of that land. That is as quick as I can make it . . I can go longer . . . . . . ? MAYOR NEILD: We had a number of public hearings and you were here last week, weren 't you, when we had the . . . ? Oh, you weren 't . Gosh , I 'm sorry you missed it . MR. LEGGETT: Well , it don' t pertain to drivers parking and so on , does it? -138- August 17, 1982 MR. TORRES : No, sir. It ' s more for land use than anything else. MR. LEGGETT: But , it don ' t pertain to drivers whatsoever as to where they park? MR. TORRES : No, if I understand you correctly. MR. LEGGETT: Okay. That ' s all I wanted to know. MAYOR NEILD : Is there anyone else that would like to speak in connection with the Land Use Plan? If not , I will declare the public hearing closed. -000- Resolution 82-304 adopting the Land Use Component of the Comprehensive Plan was approved on a motion made by Councilman Cox and seconded by Councilman Deshotel. Question : Ayes : All Nayes : None MAYOR NEILD: I would like just to take a minute, Mr. Riley , and say that I think that the work that the staff has done in connection with bringing this Land Use Plan to the citizens speaks very highly of the quality of work that 's being done by that department and the tremendous amount of time and effort to put on these public hearings for the benefit of the citizens and, of course, we are always privileged to have the response at those public hearings . Unfortunately, some of these were not well attended and appar- ently the job was well done , Norman , and we are looking forward to moving on to the next part of our planning studies. So, congratulations. -000- Councilman Deshotel related that the Phone Company contractor installing underground cables in City ditches along Lela Street is leaving the pro- perty in poor condition and requested that it be brought to the attention of Southwestern Bell Telephone Company. Councilman Turner questioned the status of the proposed dog ordinance. City Attorney Wall told Council that he had met with representatives of kennel clubs and various dog owners and should have something ready for Council in the near future. A brief discussion was held concerning the use of flashing warning signs in addition to posted school zone signs on major streets. City Manager Riley told Council that, in any place where there is a large volume of traffic on major streets, some type of warning device other than just a sign is appropriate and when the need of flashing signs is clearly demon- strated, an attempt will be made to install them as part of the Traffic Signal Program this year. COUNCILMAN TURNER: I really want to applaud the work of the Transportation Department on this school zone ordinance that we 've acted on today because of the way that they've approached it and went to the schools themselves and met with those officials and PTA representatives which is I think a very significant step toward acting on a resolution to a problem that is different in each locale so I think they did a good job. -139- August 17 , 1982 Mrs. Delia Harrington , 815 Willow Street , addressed Council to request that employees doing necessary tree/bush trimming from street right-of- way be properly trained so that no harm is done to them. Mr. J. C. Leggett , 1849 Washington Boulevard, addressed Council to ask the status of the Gulf States Utilities Company rate increase.
