HELD JULY 20 , 1982
BE IT REMEMBERED that the City Council of the City of Beaumont , Texas ,
met in regular session this the 20th day of July , 1982 , with the fol-
lowing present :

The Invocation was given by the Reverend J. D. Baugus , pastor of New
Life Tabernacle.
The Pledge of Allegiance was led by Councilman Deshotel .

The following Consent Agenda items were considered :
Approval of the Minutes of the regular City Council session held July 13 ,
1982 ;
Resolution 82-254 authorizing payment of $1 , 148. 65 to Strand Book Store
for books purchased for the Beaumont Public Library;
Resolution 82-255 authorizing purchase of a lawn tractor with rotary
mower for use by the Water Reclamation Plant for ground maintenance from
International Harvester in the amount of $3 ,496. 00 ; and
Resolution 82-256 authorizing dismissal of a lawsuit styled Meyers , et al
V. Baldridge , MDL 444 , pending in U. S. District Court for the District
of Maryland, and authorizing payment of $1 ,264. 66 as the pro rata share
of fees and expenses assessed in connection with the case to John E.
Flaherty, Jr. , National Lead Counsel.
The Consent Agenda was approved on a motion made by Councilman Deshotel
and seconded by Councilman Cox.

Resolution 82-257 authorizing execution of a contract with Troy Dodson
Construction Company , Inc. in the amount of $538, 398. 00 for construction
of the FY 82 Street Rehabilitation Program, Project II , was approved on
a motion made by Councilman Turner and seconded Councilman Deshotel.

Ordinance No. 82-74 amending Section 23-9 and adding subsection 23-8. f .
of the City Code of Ordinances relating to street standards was considered:
Section 23-9 amended to read "All streets within the city and those within
the extraterritorial jurisdiction of the city shall be constructed or re-
constructed in accordance with the official street and highway plan of the
city , the official street construction standards of the city . . .

Subsection 23-8(f ) defines "Minor Residential Streets. "
ORDINANCE NO. 82-74
ENTITLED AN ORDINANCE AMENDING CHAPTER
23 OF THE CODE OF ORDINANCES OF THE
CITY OF BEAUMONT BY ADDING SUBSECTION
23-8(f) ; AMENDING SECTION 23-9 ;
PROVIDING FOR SEVERABILITY; PROVIDING
FOR REPEAL; AND PROVIDING A PENALTY.
The ordinance was approved on a motion made by Councilman Turner and se-
conded by Councilman Cox.

Resolution 82-258 authorizing the filing of an application for partici-
pation in a Rental Rehabilitation Demonstration Program under the Depart-
ment of Housing and Urban Development and authorizing use of $150 ,000. 00
of Community Development Block Grant funds for the program (this applica-
tion will allow the Public Housing Authority to leverage those funds
against Section 8 and must be used in the Charlton Pollard Neighborhood)
was approved on a motion made by Councilman Turner and seconded by Coun-
cilman Cox.

Resolution 82-259 authorizing execution of a contract with Winter King &
Son in the amount of $248 ,988. 00 for reroofing and repairs for the Tyrrell
Historical Library Building was approved on a motion made by Councilman
Deshotel and seconded by Councilman Lord.

Resolution 82-260 accepting the work performed under the contract with
Merrill Construction Company for construction of an exercise trail on
Babe Zaharias Park and authorizing payment to the contractor in the amount
of $11 , 500. 00 was approved on a motion made by Councilman Lord and secon-
ded by Councilman Turner.

Resolution 82-261 authorizing purchase of Parcel #5-B from Dr. & Mrs.
Gary J. Randolph in the amount of $11 , 863. 00 for the Phelan Boulevard
Extension right-of-way was approved on a motion made by Councilman Lord
and seconded by Councilman Deshotel.

Resolution 82-262 scheduling a public hearing for August 24 at 1 :00 p.m.
on an increase in rates for monthly transit passes (adult passes from
$10. 00 to $15. 00 and Reduced Fare passes from $5. 00 to $7. 00) was approved
on a motion made by Councilman Turner and seconded by Councilman Lord.

Resolution 82-263 approving the FY 83 Comprehensive Manpower Plan for the
South East Texas Employment and Training Program and amending the Manpower
Consortium Agreement to extend through FY 83 was approved on a motion made
by Councilman Deshotel and seconded by Councilman Turner.

Resolution 82-264 authorizing employment of Meyer Joiner & Associates
for architectural services for developing plans for a restroom at Klein
Park and a shelter with restroom and concessions area at Babe Zaharias
Park at a firm fee of $9 ,800. 00 was approved on a motion made by Coun-
cilman Turner and seconded by Councilman Deshotel .

Mr. J. T. Johnson , 1408 Johns , addressed Council to complain about trash
pickup in his area.
Mr. Alvin Spikes , 3210 Roberts Avenue, addressed Council to request al-
location of funds in the fiscal year 1983 budget for construction of sec-
tions of six (6) streets in the Fourth Street Acres Addition under the
Assessment Paving Program.
Mr. Eugene Whittington , 1368 Doucette , addressed Council to request help
in solving problems encountered in having his home repaired under the
Community Development Block Grant Home Rehabilitation Program.
