BE IT REMEMBERED that the City Council of the City of Beaumont , Texas ,
met in regular session this the 30th day of March, 1982 , with the fol-
lowing present :

Prior to the regular session of City Council convening, the Ceremony
for presentation of the David Cargill sculpture "Winning" by Sampson
Steel Corporation located in the Civic Center Plaza was held.

The regular City Council session was called.
The Invocation was given by the Reverend Clinton M. Jordan , St . Paul 's
United Methodist Church.
The Pledge of Allegiance was led by Councilman Combs.

Donation of trees :
MAYOR MEYERS :
Jim Noon represents the Breakfast Lion' s Club and the International Pre-
sident of the Lion ' s Club requested that each Lion Club member throughout
the world plant a tree during 1982. Now, there are approximately 3 ,500
Lions Club members in the area and the Beaumont Breakfast Lions Club
has donated over 1 ,000 small pine trees to the City of Beaumont . They
have also donated trees to Lamar University and to the Beaumont and South
Park Independent School Districts and the donation of these trees is in
appreciation of the support of the citizens of Beaumont have given the
Lions Clubs over the last 65 years. I ' d like to ask Jim Noon to come for-
ward if he would at this time , and , Jim, on behalf of the Beaumont City
Council , we want to thank you very much for the thought of yours and the
rest of the Lions Clubs ' members . I know that you have already I believe
picked up 1 ,000 of these trees and I think it would be appropriate if
you might take a moment to express a little bit of the clubs' thought and
yours relative to what you've been doing.
MR. JIM NOON:
Well , the Champion. Timberland' s Paper Company in Livingston has a nursery
and they had some trees they needed to be placed throughout the area and
of course up in East Texas it is a little bit hard getting rid of pine
tree$ ; but for beautification purposes they allowed us to have as many
of these trees as we wanted and, yes , we did give the City 1 ,000 and there
are 2 ,000 more on the was as a result of the conversation with a couple
of people in the City. These trees are a special hybrid pine tree called
"Slash Pine" and they grow to full maturity in anywhere from 7 to 8 years
which means between 30 and 50 feet high. We figure that the City could
use these and it would be a standing thank you to the citizens of the
community for all the support that over the past 65 years they have given
to all of the Lions Clubs in the area.

MAYOR MEYERS :
Jim, on behalf of Council and the citizens , we extend a thank you to you
and all of your club members of the Lions Club. As you know, Council
has been directing; a lot of attention to focal point beautification spots
and other areas , mediums , and so on , where they are trying to approve
the appearance and beauty of the City so I am sure the trees that were pre-
sented by the Club were very enthusiastically received and if you would
convey to your club our deepest appreciation and thanks for thinking about
the City and convey that to all the members . Thank you very much.

Mayor Meyers issued the following proclamation : "Gene and Mr . Lonnie' s
4th Annual Chili Cook-off" - April 17 , 1982 , being held to aid Cancer
research , and naming Mayor Meyers "Honorary Chairman_ , 1982. "

Presentation of "Driver of the Year" Award:
CITY MANAGER RILEY:
Annually , as part of the safety program at which time the City attempts
to enhance the program that we have of improving our safety performance ,
we make an award and we recognize the "Drive of the Year. " Literally
hundreds of thousands of miles are driven each year by employees of the
City in vehicles in all the departments and rather than dwelling on the
times that we have the accidents , we would like to recognize individual
drivers who have performed over a period of years without accidents.
Today, we would like to recognize the "Driver of the Year" selected for
performance for the past year , 1981. The "Driver of the Year" was se-
lected by the City ' s Safety Performance Evaluation Committee made from
nominations in a number of departments. I ' d like to introduce to Council ,
Mr. Junies Smith, "Driver of the Year" from the Water Utilities Department .
Mr. Smith has been an employee of the City for over 28 years and he has
just completed 28 .years as an equipment operator without a preventable ac-
cident . We feel that this is an outstanding performance on the part of
a City employee and we would like to recognize him - commend him - and,
I believe that you have an Award Certificate and a $100 Savings Bond to
be presented. This is very unusual performance to complete that many years
without a preventable accident .
MAYOR MEYERS :
The certificate reads , Junies , "The City of Beaumont Certificate of Ap-
preciation. This is to certify that Junies Smith is presented the City
of Beaumont , Texas , Driver of the Year Award for 1981 . " And, for 28 years
that record I think speaks very well for the attention that you pay to the
work that you do. I am pleased to present on behalf of Council this Cer-
tificate to you and then as well this $100 Savings Bond which I think you
certainly have earned and I think the selection had to be easy when some-
one has a record like that . So, we congratulate you and appreciate your
service very much. And, feel free to make any comment that you'd like to.
MR. SMITH:
I 'm nervous . I ' d like to thank the Mayor, City Manager, Council and De-
partment Heads that I work for and the employees that I work with and it
is really an honor and I appreciate it. I just don't know what to say.
Now I know how Henry Fonda felt last night .

The following Consent Agenda items were considered :
Approval of the Minutes of the regular City Council sessions held
March 16th and 23rd, 1982;
Resolution 82-112 authorizing purchase of Dresser Style 160 and 60 repair
clamps for the Water Distribution Division from SPI Municipal Supply of
Lafayette , Louisiana at $8,530.68;
Resolution 82-113 authorizing a six-months contract for repair parts and
labor for Ford vehicles from Kinsel Ford, Inc. ; and
Resolution 82-114 authorizing a six-months contract for repair parts and
labor for Chevrolet vehicles with Beaumont Motor Company.
The Consent Agenda was approved on a motion made by Councilman Lord and
seconded by Councilman Turner.

An ordinance changing the zoning from RS to RM-H and GC-MD for property
near the intersection of Old Voth Road and RFD Road was considered:

ING FROM RS (RESIDENTIAL SINGLE FAMILY) DIS-
TRICT TO GC-MD (GENERAL COMMERCIAL-MULTIPLE
DWELLING) DISTRICT AND RS (RESIDENTIAL SINGLE
FAMILY) DISTRICT TO RM-H (RESIDENTIAL MULTIPLE

Turner and seconded by Councilman Lord.

Resolution 82-115 accepting as completed the work performed under the con-
tract for construction of the Lindbergh Drive TIP Project and authorizing
final payment to Gulf Coast Industrial Contractors , Inc. at $50,087.63
(total project - $320 ,240. 39) was approved on a motion made by Councilman
Lord and seconded by Councilman Combs.

Resolution 82-116 awarding a contract with McCullough Contracting Company
for construction of a 24-inch well water transmission line and improve-
ments to the Loeb high service pumping station located in Hardin County
at a cost of $1 , 144 , 796. 00 was approved on a motion made by Councilman
Turner and seconded by Councilman Combs.

Resolution. 82-117 authorizing an oil , gas and minerals lease on property
(63 acres) in Morgan Park with Sun Exploration & Production_ Company ( lease
bonus at $175. 00 per acre or $11 , 107. 25; annual rental at $20.00 per acre
or $1 ,269.40 ; and Royalty 1/4) was approved on a motion made by Council-
man Lord and seconded by Councilman Combs .

Ordinance No. 82-31 establishing a school zone on East Lavaca was con-
sidered:

ENTITLED AN ORDINANCE AMENDING SECTION 26-24
OF THE CODE OF ORDINANCES OF THE CITY OF
BEAUMONT BY ADDING A 20 MILE PER HOUR SCHOOL
ZONE ON EAST LAVACA; PROVIDING FOR SEVERABILITY;
PROVIDING FOR REPEAL AND PROVIDING A PENALTY.
The ordinance was approved on a motion made by Councilman Combs and se-
conded by Councilman Turner.

Resolution 82-118 consenting to the making and acquisition of home
mortgages by Jefferson County Housing Finance Corporation within the
City of Beaumont and assigning to Jefferson County the authority to
issue housing bonds for home mortagages prior to June 1 , 1982 , was ap-
proved on a motion made by Councilman Williams and seconded by Councilman
Combs .

Resolution 82-119 authorizing city participation ($30 ,000 for materials)
in a project for the extension of Callaghan Street from Florida Avenue to
Cardinal Drive (Lamar University to supply right-of-way and Jefferson
County Precinct #4 to furnish labor and equipment) was approved on a mo-
tion made by Councilman Turner and seconded by Councilman Lord.

Resolution 82-120 authorizing Change Order No. 1 in the amount of $20 ,650.0
to the contract with Hycon Construction Company for rehabilitation of san-
itary sewer lines where existing internal obstructions block passage (in-
creasing contract costs from $452 ,724. 16 to $473 ,374. 16) was approved on
a motion made by Councilman Combs and seconded by Councilman Turner.

Ordinance No. 82-32 relating to participation by city employees in politi-
cal campaigns was considered :

ENTITLED AN ORDINANCE AMENDING CHAPTER 21 OF
THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT
BY ADDING SECTION 21-15; REGULATING POLITICAL
ACTIVITIES OF CITY EMPLOYEES; PROVIDING FOR
REPEAL; PROVIDING A PENALTY; AND PROVIDING AN
EFFECTIVE DATE.
A motion to -approve the ordinance was made by Councilman Williams and se-
conded by Councilman Turner.
A discussion was held concerning the ordinance and the effective date.
Because of publication requirements , the ordinance would not be in effect
before the April 3rd General Municipal Election but would probably effect
a possible run-off in the election.

A motion to amend the ordinance to change the effective date of the ordi-
nance from and after April 19 , 1982 , was made by Councilman Combs and se-
conded by Councilman Williams.

Ordinance No. 82-33 authorizing publication of notice of sale of $15
million in prior lien waterworks and sanitary sewer system revenue bonds
was considered:

- Resolution 82-121 authorizing purchase of asbestos cememt pipe and fit-
tings for the Water Utilities Department from Big State Utility Supply
of . Lufkin and Municipal Pipe and Fabricating of Houston was approved on a
motion made by Councilman Turner and seconded by Councilman Combs.

The regular City Council session was recessed and a public hearing for
dilapidated structures was opened:
PUBLIC HEARING
DILAPIDATED STRUCTURES
Mr. George Gardner, Urban Rehabilitation Administrator, told Council
that all the below-listed structures are in violation of Article III ,
Sections 14-50 and 14-51 of the Dangerous Structures Ordinance of the
City of Beaumont , Texas , and that all notification procedures have been
met :
10790 Vinson : Mr. Foster C. Wilson , 3315 N. Willowood Lane , addressed
Council to say that he has no interest in the structure located at
10790 Vinson and has been notified in error. After much discussion,
Council deleted consideration of this structure until proper owner-
ship/trusteeship could be determined.
2995 Gulf Street - Kresco Enterprises, owner (16 violations - fire
damage) , recommendation to raze or repair within 30 days; 1377 Liberty -
Joseph M. Mikesic, Sr. , owner (17 violations) , recommendation to raze
or repair within 30 days ; 1974 Liberty Street - William G. Kelley, owner
(8 violations - fire damage) , recommendation to raze within 30 days ; and
3235 Washington - Norman Steward, Jr. , owner (11 violations) , recommenda-
tion to raze within 30 days.
Mr. Albert Harrison , 1163 Evalon , addressed Council to complain about
trash and debris from others on his property.
A motion to approve the above recommendations and deleting 10790 Vinson
from consideration was made by Councilman Lord and seconded by Councilman
Turner.

There being no further business , the public hearing was closed and the
regular City Council session reconvened.
Ordinance No. 82-34 declaring certain dilapidated structures to be public
nuisances and requiring their repair or removal was considered:

The ordinance was approved on a motion made by Councilman Lord and se-
conded by Councilman Turner.

Brief discussion was held concerning the proposed Litter Ordinance to
be considered at next week' s Council Session .

Three other City employees received Honorable Mention for the Driver
Safety Award and were remembered for the Minutes of the meeting :
John D. Holland, Transportation Department ; Arnold W. Kidd, Fire Depart-
ment ; and Bob Shaw, Sanitation Department .

Mrs. Lessie Fontenot , Director of the National Association for the Ad-
vancement of People , addressed Council to complain of recent home bur-
glaries and harrassment .
John Hurt , Channel 12 TV, complimented Council for cooperation received
by news media.
