HomeMy WebLinkAboutMIN MAR 16 1982 REGULAR SESSION CITY COUNCIL - CITY OF BEAUMONT HELD MARCH 16 , 1982 BE IT REMEMBERED that the City Council of the City of Beaumont , Texas , met in regular session this the 16th day of March, 1982 , with the following present : HONORABLE : Maurice Meyers Mayor Tom Combs , Jr. Councilman, Ward I Evelyn M. Lord Councilman , Ward II Calvin Williams Councilman, Ward III Wayne Turner Councilman , Ward IV Ray Riley City Manager Hugh Earnest Asst . City Manager Kenneth Wall City Attorney Myrtle Corgey City Clerk -000- The Invocation was given by the Reverend J. R. Johnson , Northwood Christian Church. The Pledge of Allegiance was led by Councilman Combs . -000- Mayor Meyers announced that Mrs. Albert "Martha" Klein , a life-long Beaumont resident , in memory of her husband Albert who is now deceased, has very graciously offered a $50,000-direct contribution to the City for the development of the park in the northwest section of our com- munity. "Albert Klein was the kind of individual who always thought more of others than he did himself and I think was a shining example of what we like to see in good citizens and neighbors and it ' s with that thought in mind that Martha Klein felt moved to do something that would assist others in the community. " The 26-acre multi-purpose park will be under construction in the near future and it will offer a wide variety of recreational resouces -- exercise trails , athletic facility , tennis courts , picnic shelters , playgrounds and other activities . A resolution officially naming this park Klein Park will be placed on next week's agenda. -000- Mayor Meyers issued the following proclamations : one to Arthur Stevie Harris for Heroic act and one to the Hebert High School Panthers' Basket- ball team; ARTHUR STEVIE HARRIS : "WHEREAS, it is characteristic of the good citizen and humanitarian to endeavor to be of assistance to others in time of distress or peril ; and, WHEREAS, all of us have reason to be grateful to others we know only as fellow human beings who stopped to render aid or lend a hand when we needed it and di so characteristically , as a matter of course, expecting no thanks or special recognition for their efforts ; and, WHEREAS,, by contrast with these day-to-day difficulties and emergencies that somehow bring out the best in us in the small kindnesses that we give and receive when the need arises , there sometimes occurs an act of such outstanding valor and selflessness that it commands the admiration and gratitude of all of us ; and, -41- March 16, 1982 "WHEREAS , such a situation occurred on March 9 , 1982 , on the grounds of the Beaumont Public Library when Arthur Stevie Harris , a passerby , wit- nessed an act of violence in perpetration , and, disregarding his own per- sonal safety , intervened physically to prevent injury to the victim who was under attack with a deadly weapon ; and, WHEREAS , when he glimpsed a young woman being assaulted by a man who was striking her with a length of pipe , Mr. Harris went immediately to the woman ' s defense. Armed only with a tennis racket he chanced to have with him, he distracted and engaged the attacker , driving him away from the injured person and forcing him across the parking lot toward the Police Station and into the building where he was taken into custody : Mr. Harris then returned to the scene to render aid and remain until medical atten- tion arrived; and, WHEREAS , Mr. Harris demonstrated a high order of personal courage , mental acuity and concern for others along with a strength and nobility of char- acter that should serve as a model for us all . NOW, THEREFORE, be it resolved that Arthur Stevie Harris is hereby com- mended by the City Council of the City of Beaumont , and we call upon all citizens to join in recognition of his heroism and exemplary good citi- zenship. IN WITNESS WHEREOF, I have hereunto set my hand and have caused the Seal of the City of Beaumont to be affixed. " /s/ MAURICE MEYERS -MAYOR- HEBERT HIGH SCHOOL PANTHERS : "WHEREAS , the Hebert High School Panthers on Saturday , March 13 , 1982 , made Texas Basketball history by winning their third State Championship in a row before a crowd of 11 ,000 in Austin ' s Superdome ; and, WHEREAS , the Panthers thus became the first Class 4A team ever to win the Texas UIL Championship three consecutive years ; and, WHEREAS, Their thundering victory in Austin gave the Panthers a won/loss record of 110 and 7 for the three-year period and made them. the first Beaumont team ever to win three State Championships ; and, WHEREAS , the Panthers under the able leadership of Coach Fred Williams have attained a high degree of physical , mental , and moral development characterized by poise and discipline in team play and academic excellence; and, WHEREAS , their accomplishments in the class room as well as on the court symbolize a culmination of Hebert ' s best traditions in scholarship and athletics ; and WHEREAS , the Panthers ' victory in the UIL 62nd season in which they have triumphed over odds and the loss of key players supplies a crowning achievement for Hebert ' s last year of existence. NOR, THEREFORE, I , Maurice Meyers , Mayor of the City of Beaumont , do hereby proclaim Wednesday , March 17, 1982 , as "Panthers ' Tripple Crown Day in Beaumont , and urge all citizens to join me in expressing pride in these fine young men and in their outstanding Coach, for their great team effort and display of dedication . " /s/ MAURICE MEYERS -MAYOR- -42- March 16 , 1982 The Minutes of the regular City Council session held March 9 , 1982 , were approved on a motion made by Councilman Lord and seconded by Councilman Turner. Question : Ayes : All Nayes : None -000- Ordinance No. 82-24 changing the zoning from R-3 (Modified Two-Family and Multiple Dwelling) to RS (Residential Single Family) , RM-H (Residential Multiple Dwelling-High Density) , NC (Neighborhood Commercial) and GC-MD (General Commercial - Multiple Dwelling) located in the 4500-6000 Blocks of Concord Road was considered: ORDINANCE NO. 82-24 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT , TEXAS , AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS T.NDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS , BY CHANGING PROPERTY DEPICTED ON EXHIBIT "A" FROM R-3 (MODIFIED TWO FAMILY AND MULTIPLE DWELLING) DTSTRICT TO RS (RESIDENTIA.L SINGLE FAMILY) , RM-H (RESIDENTIAL MULTTPLE DWELLING-HIGH DENSITY) , NC (NEIGHBORHOOD COMMERCIAL) AND GC-MD (GENERAL COMMERCIAL-MULTIPLE DWELLING) DISTRICT; PROVIDING FOR SEVERABILITY; PRO- VIDING FOR REPEAL AND PROVIDING FOR A PENALTY. The ordinance was approved on a motion made by Councilman Turner and se- conded by Councilman Lord. Question : Ayes : All Nayes : None -000- Resolution 89-96 authorizing execution of a contract with Watkins Construc- tion in the amount of $32 ,800. 00 for construction modifications to the ceilings , door and wall of Fire Station #3 located on Kenneth at Brockman to allow storage of the new 100 ' aerial ladder apparatus was approved on a. motion, made by Councilman Williams and seconded by Councilman Combs . Question : Ayes : All Nayes : None -000- Resolution 82-97 accepting the work performed under the contract with Watkins Construction for construction of the Carroll Street_. Day Care Center Building and authorizing final payment in the amount of $26 ,800. 00 (total project - $268 , 800. 00) was approved on a motion made by Councilman Lord and seconded by Councilman Turner. Question : Ayes : All Nayes : None -000- Resolution 82-98 authorizing a contract with the Southern Pacific Trans- portation Company for a permit to install a 24-inch water line to be located on the Southern Pacific right-of-way in Hardin County and auth- orizing payment to SP of $1 ,950. 00 for the permit was approved on a motion made by Councilman Lord and seconded by Councilman Combs. Question : Ayes : All Nayes : None -000- Ordinance No. 82-25 amending Section 30-28-D. 3 of the City Code relating to setbacks for advertising signs was considered: ORDINANCE NO, 82-25 ENTITLED AN ORDINANCE AMENDING SECTION 30-28D. 3 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT BY REDUCTING THE SETBACKS FOR COMMERCIAL ADVERTISING SIGNS ; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. -43- March 16 , 1982 The ordinance was approved on a motion made by Councilman Turner and se- conded by Councilman Combs . Question : Ayes : All Nayes : None _000- Resolution 82-99 authorizing purchase of Parcels #7B & 7C for needed right- of-way for the construction of the Phelan Boulevard Extension project from Gary R. &. Sharon K. Sibley at $15 ,000. 00 was approved on a motion made by Councilman Combs and seconded by Councilman Lord. Question : Ayes : All Nayes : None -•000- Resolution 82-100 authorizing the purchase of three (3) modular ambulance units from Texas Superior of Austin , Texas , at $113,220. 00; eight (8) Ton Voice Pagers at $2 , 376. 00 , one (1) Encoder at $293. 00 , and three (3) Mobile Radios at $4,275. 00 from General Electric of Houston , Texas ; and four (4) Portable Suitcase Radios at $20 , 996. 00 , two (2) Auto Telephone Interconnects at $39 ,950.00 and two (2) Biotelemetry Consoles at $21 ,000.00 from Pioneer Medical Systems of Melrose , Maryland was approved on a motion made by Councilman Lord and seconded by Councilman Williams. Question : Ayes : All Nayes : None -000- Councilman Turner proposed a possible change in the zoning ordinance to allow Specific Use Permits for Day Care Centers in single family resi- dential zones. After a brief discussion , Council requested that Staff furnish information concerning both sides of the issue for study. -000- Councilman Combs asked for a study or report of the economic impact for , the area being considered for the relocation of the Sanitary Landfill . Further discussion was held for data concerning ingress,.//egress into the site; proximity to the nearest development , whether residential or com- mercial ; engineering and technical data relative to the development and operation of the landfill - data that ' s been prepared to support the application for the relocation of the landfill. City Manager told Coun- cil that an overview-report would be included in Friday's work packet to Council and the item would be placed on the Workshop agenda for review. -000- Mrs. Mabel Jefferson , 3150 Taliaferro, again addressed Council to com- plain about the depth of ditches along Taliaferro and the lack of side- walks in the area. City Manager assured Mrs . Jefferson the ditches ,would be checked to see if the proper grade had been dug. -000- There being no further business , the meeting was recessed before continu- ing with the City Council Workshop Session. -000- I , Myrtle Corgey , City Clerk of the City of Beaumont , Texas , certify that the above is a true copy of the minutes of the regular City Council ses- sion held March 16 , 1982 .
