City Manager Lane Nichols Asst. City Attorney Myrtle Corgey City Clerk -000- The Invocation was given by Mr . Charles Prince , Westgate Church of Christ. The Pledge of Allegiance was led by Councilman Turner . -000- The following proclamations were issued : "Sandy Bond Licht Day in Beau- mont" - January 27 , 1982 and "Catholic Schools Week 1982 in Beaumont" - January 31 - February 6 , 1982 . -000- A tribute to Mr. Richard "Dick" Ledyard , an active member of the Clean Community Commission (Executive Committee and the Business 8 Industry Committee) and Community Appearance Committee of the Chamber of Commerce , who is moving to Grand Rapids after living in Beaumont about seven (7 ) years, was led by Councilman Lord. Fellow Clean Community Commission members, Messrs. Arden Loughmiller and Josh Allen, presented a photo- graph of Mr. Ledyard aboard his moped directing "cleanup" efforts and a beribboned dustpan. Councilman Lord presented him with a certificate naming him a "volunteer par excellence. " -000- The following Consent Agenda items were considered : Approval of the Minutes of the regular City Council session held January 19 , 1982 ; Resolution 82-22 authorizing the purchase of 50 ,000 parking citations from Moore Business Forms at a cost of $1 ,181. 13; and Resolution 82-23 approving payment for repairs to a lift station pump serving the Irving Avenue Underpass under Emergency Order #61 to General Electric Company in the amount of $1, 992 . 00 . The Consent Agenda was approved on a motion made by Councilman Turner and seconded by Councilman Lord. Question: Ayes : All Nayes : None -000- -12- January 26 , 1982 Ordinance No. 82-9 changing the zoning from R-3 and GC-MD to RS and RM-H for property in the Live Oak Rezoning Study Area was considered : ORDINANCE NO. 82-9 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT , TEXAS , AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS , BY CHANGING PROPERTY DESCRIBED ON EXHIBIT "A" AND KNOWN AS THE LIVE OAK REZONING STUDY FROM GC-MD (GENERAL COMMERCIAL - MULTIPLE DWELLING) DISTRICT TO RS (RESIDENTIAL SINGLE FAMILY) DISTRICT, AND R-3 (MODIFIED TWO-FAMILY AND MULTIPLE DWELLING) DISTRICT TO RM-H (RESIDENTIAL MULTIPLE DWELLING - HIGH DENSITY) DISTRICT; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING FOR A PENALTY. The ordinance was approved on a motion made by Councilman Lord and se- conded by Councilman Turner. Question: Ayes : All Nayes : None -000- Ordinance No. 82-10 changing the zoning from R-3 to RS , RM-H and GC-MD for property in the Concord Road Rezoning Study Area, Section III was considered : ORDINANCE NO. 82-10 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS , AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS , BY CHANGING THE ZONING OF PROPERTY KNOWN AS THE CONCORD ROAD REZONING STUDY, SECTION III , FROM R-3 (MODIFIED TWO-FAMILY AND MULTIPLE DWELLING) DISTRICT TO RS (RESIDENTIAL SINGLE FAMILY) , RM-M (RESIDENTIAL MULTIPLE DWELLING - MEDIUM DENSITY) , RM-H (RESIDENTIAL MULTIPLE DWELLING - HIGH DENSITY) AND GC-MD (GENERAL COMMERCIAL - MULTIPLE DWELLING) DISTRICTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. The ordinance was approved on a motion made by Councilman Turner and se- conded by Councilman Lord. Question: Ayes : All Nayes : None -000- Resolution 82-24 authorizing advertisement for bids for the construction of the Phelan Connector Project was approved on a motion made by Council- man Lord and seconded by Councilman Turner. Question: Ayes : All Nayes : None -000- Resolution 82-25 authorizing final payment to Richard Building 8 Contract- ing Company of $10 ,891 . 12 for construction of sidewalk, street and drainage improvements in the Fletcher Neighborhood , Census Tract 20 (CDBG - total cost - $105 , 541. 55) was approved on a motion made by Councilman Turner and seconded by Councilman Lord. Question: Ayes : All Nayes : None -000- -13- January 26 , 1982 Ordinance No. 82-11 providing for a prompt payment discount for hotels and motor hotels remitting room occupancy tax collections to the City was considered : ORDINANCE NO. 82-11 ORDINANCE AMENDING CHAPTER 25 OF THE CODE OF ORDINANCES BY PROVIDING REIMBURSEMENT FOR THE COST OF COLLECTING HOTEL OCCUPANCY TAX; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL; AND PROVIDING A PENALTY. The ordinance was approved on a motion made by Councilman Lord and secon- ded by Councilman Turner. Question: Ayes : All Nayes : None -000- Resolution 82-26 authorizing the purchase of 15 CRT ' s for data processing from David Jamison Carlyle Corporation at $11,625 . 00 (originally authorized to purchase from System Technology on 12-22-81 but units proved incompati- ble with existing system) was approved on a motion made by Councilman Tur- ner and seconded by Councilman Lord. Question: Ayes : All Nayes : None -000- Resolution 82-27 authorizing purchase of police uniforms from Factory Sales at a cost of $31,378 . 00 was approved on a motion made by Councilman Lord and seconded by Councilman Turner. Question: Ayes : All Nayes : None -000- Resolution 82-28 authorizing a one-year contract beginning February 1 , 1982 , for supplying approximately 76 ,500 gallons; of aviation fuel for Municipal Airport from Exxon Company, U. S.A. was approved on a motion made by Councilman Lord and seconded by Councilman Turner. Question: Ayes : All Nayes : None -000- A public hearing to consider dilapidated structures was called : Mr. George Gardner, Urban Rehabilitation Administrator, told Council that the below-listed structures are in violation of Article III, Sections 14-50 and 14-51 of the Dangerous Structures Ordinance of the City of Beaumont, Texas , and that all notification procedures have been met : 999 AVENUE E - I. Gonzales, owner (13 violations - fire damaged) , recom- mendation to raze or repair within 30 days ; 1950 CABLE (FRONT with 19 violations and REAR with 17 violations) , C. E. Davis , et us , owner, re- commendation to raze within 30 days; 470 FLOWERS - Lester Chevis , owner (15 violations) , recommendation to raze or repair within 30 days ; 745 LINCOLN - Laura Lanier , owner (19 violations) recommendation to raze within 30 days ; 2995 PINE - Thurston House , , owner (11 violations) , recom- mendation to raze or repair within 30 days ; 2605 SANTA FE - Georgie Lee Ento , owner (17 violations) , recommendation to raze within 30 days; 3239 WASHINGTON - John Payne Estate , c/o A. Teal , owner (8 violations) , re- commendation to raze within 30 days. There being no citizens wishing to address Council concerning the above listed structures , the public hearing was closed. Ordinance No. 82-12 declaring certain dilapidated structures to be pub- lic nuisances and requiring their repair or removal was considered : ORDINANCE NO . 82-12 ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES, ORDERING REPAIR OR DEMOLI- TION FOR CERTAIN STRUCTURES ; ORDERING DEMOLITION BY THE CITY UNDER CERTAIN CONDITIONS; PROVIDING A PENAL'T'Y; AND PROVIDING FOR SEVERABILITY. -14- January 26 , 1982 The ordinance was approved on a motion made by Councilman Lord and seconded by Councilman Turner. Question: Ayes : All Nayes : None -000- Resolution 82-29 endorsing and supporting the efforts of various groups and agencies to retain the Port Arthur office of the U. S . Coast Guard , licensing division, was approved on a motion made by Councilman Turner and seconded by Councilman Lord . Question: Ayes : All Nayes : None -000- Mr. Joe Deshotel , member of the Multi-Family Finance Corporation , welcomed to today' s session. -000- Mrs .
