Tom Combs Jr. Councilman, Ward I Evelyn M. Lord Councilman, Ward II Absent : Calvin Williams Councilman, Ward III Wayne Turner Councilman, Ward IV Ray Riley City Manager Kenneth Wall City Attorney Myrtle Corgev City Clerk -o00- The Invocation was led by the Reverend W. F. Lescallette, Highland Avenue Baptist Church , The Pledge of .Allegiance was led by Mr . J. C. Leggett . -000- Mayor Meyers issued the following proclamations : "Civil Air Patrol Week in Beaumont" - December 14-20, 1981 and ''Bill of Rights Day in Beaumont" December 15, 1981 . -000- The Minutes of the regular City Council session held December 8 , 1981, were approved on a motion made by Councilman Combs and seconded by Coun- cilman Lord. Question : Ayes : All Nayes : None -000- Resolution 81-519 authorizing advertisement forbids on construction of the Chinn Lane TIP Project (from Old Voth Road to Homer Drive) was ap- proved on a motion made by Councilman Lord and seconded by Councilman Combs. Question : Ayes : All Nayes : None -000- Resolution 81-520 autborzing final payment of $111 ,037 . 26 on the contract with W. R. Boyd, Inc. for construction of Proj,ect.. III of the FY 81 Street Rehabilitation Program (total project - $695; 059. 29) was approved on a motion made by Councilman Combs and seconded by Councilman Lord . Question : Ayes : All Nayes : None -000- Resolution 81-521 authorizing final payment of $175, 178 . 83 to W. R. Boyd, Inc. for construction of Project IV of the FY 81 Street Rehabilitation Program (total project - $952 , 067 . 66) was approved on a motion made by Councilman Lord and seconded by Councilman Combs. Question : Aves : All Nayes : None -000- -194- December 15 , 1981 Resolution 81-522 authorizing a. Certification Statement to the Texas State Department of Highways & Public Transportation for installation of railroad crossing warning signals on Fourth Street at an approximate cost of $2 ,800. was approved on a motion made by Councilman Lord and seconded by Council- man. Combs. Question : Ayes : All Nayes : None -000.- Ordinance No. 81-101 amending Chapter 23 , Section. 23-29 of the Code of Ordi- nances to authorize the painting of street address numbers on curbs was considered: ORDINANCE NO, 81-101 ENTITLED AN ORDINANCE AMENDING CHAPTER 23 , SECTION 23-29 TO ALLOW THE PAINTING OF HOUSE NUMBERS ON CURBS; PROVIDING FOR SEVERABILITY; PROVIDING TOR REPEAL:, AND PROVIDING FOR A PENALTY. The ordinance was approved on a motion made by Councilman Combs and seconded by Councilman Lord, Question : Ayes : All Nayes : None -000- Resolution 81-523 authorizing acquisition of right-of-way easements for the Segment 70 Interceptor - Tract 10 from C. B. Holland at a cost of $163 . 00; Tract 11 from J'oshiia Dean at $475. 00; Tract 12 . from Leland Randall at $150. 00 and donation of Tract 14 from Bessie Knighton and Tract 15 from M & E Food Mart , Inc. , #2 - was approved on a motion made by Councilman Lord and seconded by Councilman Combs . Question : Ayes : All Nayes : None -000 Resolution 81-524 authorizing payment of $6 ,349.44 to Gulf States Utilities Company for relocation of underground utilities on Parcel #156 for the Major Drive-Calder Intersection Project was approved on a motion made by Councilman Combs and seconded by Councilman Lord. Question : Ayes : All Nayes : None -000_ Resolution 81-525 granting two utility easements to Gulf States Utilities Company (1 . to provide service to the remodeled City Auditorium and 2. to provide service to the R. C. Miller Memorial Library) was approved on a motion made by Councilman Lord and seconded by Councilman Combs. Question : Ayes : All Nayes : None -000- Resolution 81-526 letting a contract for furnishing oyster shell to Rad- cliff Materials, Inc . at a, cost of $10. 20 per cubic yard was approved on a motion made by Councilman Combs and seconded by Councilman Lord. Question : Ayes: All Nayes : None -000- Resolution 81-527 authorizing the purchase of three ice machines to be used by the Street and Sani_tations Departments from C & L Ice Company at a cost of $6, 992 . 00 was approved on a motion made by Mayor Meyers and seconded by Councilman Combs. Question : Ayes : All Nayes : None -000- -195- December 15, 1981 Councilman Combs asked the status of proposed landscaping along Brickyard Lake and cleanup for the Water Department/Traffic & Transporti.on area long Interstate 10. He also asked that a small triangle of land located on the southeast side of the Freeway downtown - whether it be City or State- be cleared. COUNCILMAN LORD: I ' d like to pick up on a couple of things I read in the newspaper this morning that Tommy Warren had to say, . if I might , and I had planned some- thing similar and maybe I 'll just add to some of the things that he said. Certainly agreeing that the ordinance ought to be altered to reflect the true situation on that Specific Use Permit , you know, what happens to it if not acted upon in sixty days. And, I also wondered about the possibility of considering defining, if it 's possible - and , if not , I 'd welcome the explanation so I ' ll understand why it might not be possible - of defining "substantially changed" on a zoning request to mean "that no second request for the same zoning on the same tract of land. " Maybe that would be a definition that would make it very clear to people. And, again, as I say, if it isn 't realistic or too restrictive, I 'd welcome the rationale on it . I a.lsq think that thelines of communication or intent can be fortified be- tween Council and Commission and I was wondering towards that end if we might have something like you've done before, Ray, well , may be even a retreat or a workshop where Council. could get together with the Commission and go over the Code as we've adopted it . We all spent hours and hours in workshops , you know - things that were adopted, things that weren 't . And, I think it would probably be a good idea if we sat with what we 've actually have now before us and had a workshop on the whole and how exceptions re- late to each other and what kind of situations that are likely to come up under it as we are facing now. Perhaps we could look down the road and see some of the problems that are going to be facing us and face it more intel- ligently and even if we don't end up all agreeing or having the same opin- ions, at least we' ll all have the same understanding of what is our tool in this area. -000- Mr. Joe Wilson, 1855 Euclid, addressed Council to complain about the poor condition- of streets crossing Houston Avenue and to request stop signs being replaced, especially on Euclid. Reverend W. F. Lescallette requested turn lanes being striped at the in- tersection.. of Virginia and Highland. Mrs. Delia Harrington, 815 Willow Street , addressed Council to compliment the placing of the signal light at Hazel at Willow Streets . Mr. J. C.
