CITY COUNCIL - CITY OF BEAUMONT
HELD MAY 26, 1981
BE IT REMEMBERED that the City Council of the City of Beaumont , Texas ,
met in regular session this the 26th day of May , 1981 , with the follow-
ing present :

The Invocation was given by Dr. Jack Dark, pastor of the Westwood Bible
Church.
The Pledge of Allegiance was led by Councilman Lord.

Mayor Meyers issued the following proclamations : "Interfaith Day in
Beaumont" - May 28, 1981 ; "Confederate Air Force Days in Beaumont" -
May 30 and 31 , 1981 ; "Management Week in Beaumont" - June 1-7 , 1981 ;
"Parks & Recreation Month in Beaumont" - June, 1981 ; and "June Klein Day
in Beaumont" - May 26 , 1981 .

The following Consent Agenda items were considered :
Approval of the Minutes of the regular City Council session held May 19,
1981 ;
Resolution 81-220 accepting street and utility ty improvements in Ferguson
Development Park (Clearwater Court from IH-10E Frontage Road south ap-
proximately 150-feet to dead end) ; C,
Resolution 81-221 authorizing purchase of a portable traffic signal con-
troller from Trans-Tronics , Inc . , at a cost of $1 , 750. 00; and
Resolution 81-222 authorizing purchase of materials for use in the main-
tenance of freeway lighting from M & I Electric Company at a cost of
$1 , 273 . 58 .
The Consent Agenda was approved on a motion made by Councilman Turner and
seconded by Councilman Williams .

An application for rezoning northwest of Bigner Road and Nelkin Lane plus
a specific use permit for radio towers, and a recommendation of the City
Planning Commission concerning the application were considered:
Councilman Williams made a motion to deny an ordinance changing the zoning
from RS and R-3 to RCR for 40. 172 acres and granting the special use permit;
motion died for lack of a second.
An ordinance changing the zoning to RS for the 40 acres zoned R-3 with
denial of the special use permit as recommended by the Planning and Zoning
Commission could not be considered because of notification and public hear-
ing requirements .

Mayor Meyers made a motion to defer the item at the request of the appli-
cant ; motion was seconded by Councilman Turner.

An ordinance changing the zoning from R-3 to RCR for a tract 0. 371 of an
acre at 4302 Concord Road and granting a specific use permit (requested
by Lindsey Walker on behalf of the owner to use this property - a vacant
gas station - for storage of tools and equipment , for personal automobiles
and boats, personal belongings and to construct living quarters for a
night watchman on the property) was denied on a motion made by Councilman
Williams and seconded by Councilman Lord.

Ordinance No. 81-38 granting a specific use permit for an. establishment
for the on-premises sale and consumption of alcoholic beverages on a
7. 93-acre tract on the northwest corner of the intersection of Calder
and Dowlen Road (requested by Carroll Dubose) was considered:

The ordinance was approved on a motion made by Councilman Lord and sec-
onded by Councilman Turner.

Ordinance No. 81-39 changing the zoning from R-3. to RS for areas included
in the Concord Road Zoning Study was considered:

BY CHANGING PROPERTY DESCRIBED AS THE CONCORD REZON-
ING STUDY, SECTION I , BEAUMONT, JEFFERSON COUNTY,
TEXAS, AS HEREINAFTER DESCRIBED, PRESENTLY ZONED R-3
(MODIFIED TWO FAMILY AND MULTIPLE DWELLING DISTRICT)
TO RS (RESIDENTIAL SINGLE FAMILY DISTRICT) ; PROVID-
ING FOR SEVERABILITY; AND PROVIDING A PENALTY.
The ordinance was approved on a motion made by Councilman Williams and sec-
onded by Councilman Lord.

tract at 7335-45 Fannett Road (requested by Mrs. Sarah Morrison) was con-

ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE
CODE OF ORDINANCES OF BEAUMONT, TEXAS , AND IN
PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS
AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS ,
BY CHANGING A 8. 17 ACRE TRACT OUT OF THE BROOKLAND
FARMS ADDITION, UNIT II , BEAUMONT, JEFFERSON COUNTY,
TEXAS , AS HEREINAFTER DESCRIBED, PRESENTLY ZONED "RS"
(RESIDENTIAL SINGLE FAMILY DISTRICT) TO "GC-MD" (GEN-
ERAL COMMERCIAL-MULTIPLE DWELLING DISTRICT) ; PROVID-
ING FOR SEVERABILITY; AND PROVIDING A PENALTY.
The ordinance was approved on a motion made by Councilman Williams and
seconded by Councilman Turner .

Resolution 81-223 authorizing a contract with Southwestern Laboratories
for testing in connection with construction of the Service Center at an
estimated cost of $3 , 100. 00 was approved on a motion made by Councilman
Lord and seconded by Councilman Turner .

Resolution 81-224 approving additional water and sewer lines for construc-
tion of the Sarah Street TIP Project (from Fatima to Fannett) and authori-
zing an amendment to the contract with Garrod and Associates to provide
engineering services for the project was approved on a motion made by
Councilman Williams and seconded by Councilman Turner.

A resolution reversing stop signs at the intersection of Lamar and Port
Streets from Port to Lamar was considered. Councilman Williams made a
motion to approve the resolution ; motion was seconded by Mayor Meyers .
A lengthy discussion was held before the vote was called.
The resolution failed to pass on the following vote :
Ayes : Councilman Williams Nayes : Mayor Meyers
Councilman Turner Councilman Lord
Mayor Meyers requested that "the item be put back on the agenda when we
would have a full compliment of Council and put the matter to rest one way
or the other.

Resolution 81-225 authorizing purchase of a roof top air conditioning unit
for the Best Years Center from A-1 Sheet Metal & Air Conditioning Company
at a cost of $5, 975. 00 was approved on a motion made by Councilman Williams
and seconded by Councilman Turner.

Resoluiton 81-226 authorizing purchase of an underground piercing tool for
the Traffic and Transportation Department from Boehck & Gardner Equipment
Company, Inc. at a cost of $6,400. 00 was approved on a motion made by
Councilman Lord and seconded by Councilman Turner.

Resolution 81-227 authorizing a one-year contract with Dr. Typewriter-Xylog
for maintenance of electric typewriters at a cost of $40. 00 each was ap-
proved on a motion made by Councilman Williams and seconded by Councilman
Turner.

The regular City Council session was recessed so that a public hearing on
dilapidated structures could be held.
PUBLIC HEARING
DILAPIDATED STRUCTURES
Mr. George Gardner , Urban Rehabilitation Administrator, told Council that
all the below-listed structures are in violation of Article III , Sections
14-50 and 14-51 of the Dangerous Structures Ordinance of the City of
Beaumont , Texas, and that all notification procedures have been met :
1386 BROCKMAN - B. M. Sarles , Gdn Chars and M. Sarles (Mrs. LeBlanc re-
possessing) , owners (12 violations) , recommendation to raze within 30
days; 1448 CEDAR - Tony Tortoris , owner (12 violations) , recommendation
to raze within 30 days; 665 LINCOLN ALLEY - Minnie Gibson , owner (16 vio-
lations) , recommendation to raze within 30 days ; 4450 N. MAJOR DRIVE -
Don Monson, et ux, owner (15 violations) , recommendation to raze within
30 days; .3530 NELSON - Ross Watts, owner (17 violations) , recommendation
to raze within 30 days ; and 3360 TALIAFERRO - Henry W. Eglin , owner (11
violations) , recommendation to raze within 30 days.
The recommendations were approved on a motion made by Councilman Turner
and seconded by Councilman Lord.

Ordinance No. 81-41 declaring certain dilapidated structures to be public
nuisances and ordering their repair or removal was considered :

ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES
TO BE PUBLIC NUISANCES, ORDERING REPAIR OR DEMOL-
ITION FOR CERTAIN STRUCTURES ; ORDERING DEMOLITION
BY THE CITY UNDER CERTAIN CONDITIONS; PROVIDING
A PENALTY; AND PROVIDING FOR SEVERABILITY.
The ordinance was approved on a motion made by Councilman Turner and se-
conded by Councilman Lord.

The public hearing was closed and regular session reconvened.
Mrs . Lois Martin , 1760 Franklin , complained that contractors have not com-
pleted construction work authorized for her home under the Community De-
velopment Block Grant Rehabilitation Loan Program. Study will be made of
the project and report given .
Mr. J. C. Leggett , 1849 Washington Blvd. , addressed Council to again re-
quest drainage work be done on Washington Boulevard near the railroad
tracks.
