CITY COUNCIL - CITY OF BEAUMONT
HELD FEBRUARY 3 , 1981
BE IT REMEMBERED that the City Council of the City of Beaumont , Texas ,
met in regular session this the 3rd day of February , 1981 , with the
following present :

The Invocation was given by Mr . Bob Griffin .
The Pledge of Allegiance was led by Councilman Turner.

Mayor Meyers recognized Mr . John Conway and his Kelly High School Govern-
ment Class and welcomed them to today ' s session.
MR. JOHN CONWAY :
We have some gifts for you that we 've brought you this morning. Catholic
Schools Week is a special time set aside by the Diocese of Beaumont to
honor all those who make Catholic education a special pleasure . The
Student Council of Kelly High School , representing the School Board , the
Administration , the Faculty and the parents of Kelly High School , are
most happy to bring gifts honoring the Beaumont City Council for its
support of education in Beaumont and , in particular , for its support and
assistance to Kelly High School .

Former Councilwoman Vi McGinnis was the first to help students become
on the spot learners of citizenship in Beaumont . She held debriefing
sessions after our attendance at Council meetings , arranged for us to
meet City officials , taught our teachers a few of the ropes that you don ' t
learn in the classrooms , and , yes , she even rode with us in our hot , un-
airconditioned bus around the City trying to figure out what to do next .
Since that time , the City Council and the City government has been an in-
valuable aid to our teaching at Kelly . Councilwoman Lord graciously ar-
ranges our presence with this small army occasionally and manages to greet
us with a smile . Councilman Evans provides blunt , honest , and always in-
structive answers on the telephone and Mayor Meyers was gracious enough on
very short notice to show up for our Hostage Celebration .
In honor of that , then , we bring you special greetings from our School
Board , from our Principal , Sister Jane Meyer , from our Assistant Principal,
Mary Gagne. We would also like to present you with a basket of fruit which
signifies our impression of you which is that you nurture the community .
We 'd also like to present you some rainbow lapel pins .
Our theme at Kelly this year is that we would like people to reach out and
touch each other and make the world a better place. And , the rainbow
symbolizes to us an old thing - a tradition which is something that never
changes and never loses its brightness in color . From the bottom of our
hearts , we thank you .

Approval of the Minutes of the regular City Council session held Jan-
uary 27 , 1981 ;
Resolution 81-34 appointing Reggie Newton to fill the unexpired term of
Charles Upham on the Senior Citizens Advisory Board ;
Resolution 81-35 appointing Larry Porter , Jr . , to the Beaumont Clean
Community Commission , term to expire September 1 , 1982 ;
Resolution 81-36 reappointing Dewey Gonsoulin and appointing Gayle Yar-
brough and Robert Edwards to the Civil Service Commission for three-year
terms to expire January 31 , 1984 ;
Resolution 81-37 authorizing purchase of uniforms from Factory Sales Com-
pany ($35 , 938 . 60) and Kaufman Uniform Company ($10 , 224 . 00) for the Police
and Fire Departments ;
Resolution 81-38 authorizing purchase of water meters ( 1" at $55 . 10 each ;
112" at $132 . 95 each ; 2" at $168. 60 each) from Carlon Meter Company ;
Resolution 81-39 authorizing purchase of a paint striping machine from
Southwestern Materials Company at a cost of $7 ,385 . 00 to be used by the
Traffic & Transportation Department ;
Resolution 81-40 authorizing purchase of a Hurst Rescue Tool from Texas
Fire Fighters Equipment Company at a cost of $6 ,488 . 40 ;
Resolution 81-41 authorizing the sale of two lots - Tract 27 , Plat H ,
D . Brown Survey , vacant property in the 1100 Block of Grant Street to
Eunice A. Bias at $100. 00 and Tract 43 out of Tract 6 , Plat D-11 , A. Wil-
liams Survey , located in the 2100 Block of Caldwell to Ruby Nell Petry
at $200. 00 - property acquired through delinquent tax suits ;
Resolution 81-42 appointing Lulu L. Smith , M. D. as City Health Officer ;
and
Resolution 81-43 opposing consolidation of the U . S . Customs Districts
of Houston , Galveston and Port Arthur , Texas under the Houston District .
Statements were made by Mayor Meyers and Councilmen Lord and Turner
stressing their strong opposition to the consolidation of these districts .
The Consent Agenda was approved on a motion made by Councilman Turner
and seconded by Councilman Lord.

An ordinance changing the zoning from R-1 to R-2M for a 4 . 39 acre tract
in the 7700 Block of Tram Road was considered :

An ordinance changing the zoning from R-1 to LR-1 for 3 . 31 acres , Lots
6-1.2 and 16-18 , Pin Oaks Plots Annex Addition ; Lots 1-7 , Block 174 , Pine-
crest Addition ; and a 53 x 160-foot parcel south of Lots 16-18 , Pin Oaks
Plots Annex Addition at 3395 Cleveland at Primrose was tabled at the ap-
plicant ' s request on a motion made by Councilman Lord and seconded by
Councilman Turner.

Resolution 81-44 authorizing and directing the City Attorney to _file a
lawsuit in Federal District Court , challenging the preliminary 1980 Cen-
sus count for the City of Beaumont was approved on a motion made by Coun-
cilman Turner and seconded by Councilman Lord .

Ordinance No . 81-8 amending the Precious Metals Ordinance was considered :

ENTITLED AN ORDINANCE REPEALING ORDINANCE
80-68 AND AMENDING CHAPTER 7 OF THE CODE
OF ORDINANCES BY ADDING A NEW ARTICLE IV
REGULATING CERTAIN PURCHASES OR EXCHANGES
OF USED JEWELRY AND PRECIOUS METALS ;
PROVIDING DEFINITIONS ; ESTABLISHING A
PERMIT PROCESS , ESTABLISHING A PERMIT
FEE; PROVIDING FOR DISPLAY OF PERMIT ;
REQUIRING CERTAIN RECORDS TO BE KEPT BY
PURCHASERS ; PROVIDING ADDITIONAL
REQUIREMENTS FOR CERTAIN PURCHASES AT
TEMPORARY LOCATIONS ; PROVIDING FOR
SEVERABILITY; PROVIDING FOR REPEAL; AND
PROVIDING A PENALTY.

Resolution 81-45 authorizing filing an application with the Urban Mass
Transportation Administration for transit operating assistance funds and
setting the date of March 10 , 1981 for a public hearing was approved on a
motion made by Councilman Turner and seconded by Councilman Lord .

Resolution 81-46 authorizing execution of a lease/purchase agreement with
Cenval Leasing for 60-month financing on various fleet equipment at an
annual interest cost not to exceed 9. 5% was approved on a motion made by
Councilman Turner and seconded by Councilman Lord .

Ordinance No. 81-9 transferring funds from the contingent appropriation
for payment to the Jefferson County Appraisal District was considered :

ENTITLED AN ORDINANCE AMENDING THE BUDGET
OF THE CITY OF BEAUMONT FOR THE FISCAL PERIOD
COMMENCING OCTOBER 1 , 1980 AND ENDING SEPTEM-
BER 30 , 1981 BY ALLOCATING AND APPROPRIATING
$143 , 000. 00 FROM THE CONTINGENT APPROPRIATION
TO LINE ITEM 79-40 ; AND AUTHORIZING A PAYMENT
OF THE PORTION OF THE JEFFERSON COUNTY APPRAISAL
DISTRICT BUDGET ASSESSED AGAINST THE CITY.
The ordinance was approved on a motion made by Councilman Turner and
seconded by Councilman Lord.

Resolution 81-47 authorizing a cost participation agreement for construc-
tion of a sanitary sewer line in the Blackmon Lane vicinity in an amount
not to exceed $18 , 000. 00 was approved on a motion made by Councilman
Lord and .seconded by Councilman Turner .

Ordinance No. 81-10 establishing an industrial district as the basis for
a contract for payment in lieu of taxes by Pennwalt Corporation was
considered :

ENTITLED AN ORDINANCE DESIGNATING A PART
OF THE AREA LOCATED IN THE EXTRATERRITORIAL
JURISDICTION OF THE CITY OF BEAUMONT AS AN
INDUSTRIAL DISTRICT AS AUTHORIZED BY THE
MUNICIPAL ANNEXATION ACT ; PROVIDING THE
PURPOSE OF SUCH DISTRICT; PROVIDING THAT
SUCH DISTRICT SHALL BE KNOWN AS THE "CITY
OF BEAUMONT INDUSTRIAL DISTRICT NO. 14" ;
AND AUTHORIZING EXECUTION OF AN INDUSTRIAL
DISTRICT AGREEMENT.

mission to include five more positions was considered :

80-88 TO INCREASE THE SIZE OF THE CLEAN
COMMUNITY COMMISSION FROM FIFTEEN ( 15)
MEMBERS TO TWENTY (20) MEMBERS ; PROVIDING
FOR SEVERABILITY; AND PROVIDING FOR REPEAL.
The ordinance was approved on a motion made by Councilman Turner and se-
conded by Councilman Lord .

Councilman Lord recognized Boy Scout Rust in attendance at today ' s meeting
who is working toward his Communications Badge .

Mr. Jack Farley , 2270 Gladys , addressed Council to commend them for their
support of the Convention and Visitors Bureau.
Mr . Rudolph Antoine , 4640 St . Louis , addressed Council in support of the
Clean Community Commission .

ing with the City Council Workshop Session.
