Lord Councilman, :yard II Calvin Williams Councilman, Ward III Wayne Turner Councilman, Ward IV Absent : Tom Combs, Jr . Councilman, Ward I Ray Riley City Manager Kenneth Wall City Attorney Myrtle Corgey City Clerk -000- The Invocation was given by the Reverend Don Siels, St . Matthews Episcopal Church. The Pledge of Allegiance was led by Councilman Turner . -000- The Mayor issued the following proclamations : "Salvation Army Week in Beau- mont" - May 12-18 , 1980; "Mental Health Month in Beaumont" - May, 1980; and "Preservation Week in Beaumont" - May 11-17, 1980. -000- The following items were considered as part of the Consent Agenda : The minutes of the regular City Council session held May 6, 1980; Resolution 80-159 accepting a sanitary sewer easement from Mr. H. K. Maxey; Resolution 80-160 accepting improvements for City maintenance in Somerset Village (Woodside Drive and Monica Drive) ; Westview Meadows (Jennifer Lane) and Evalon Court (Evalon Avenue) ; Resolution 80-161 authorizing payment of $4500. 00 for repairs to an Allis Chalmers HD-11-B dozer , Unit 5010, used at the landfill by World Wide Welding and Press Company; and Resolution 80-162 appointing Bob Burns , Neicy Baptiste, Raymond Chaison , Terry Carlton, Gertrude Cherry, Frank Comeaux, C. W. Conn, Jane Dunatchik, Dr. Paul Fortney, Agnes George, Meg Gloger , Dr. James Ivers, Margaret Jones, Judge Richard LeBlanc , John Lee, Mary Lopez, Marie Nesom, Edgar Perkins , Jr . , James Powell , Jr. , Doris Price, Brian Riddle , Frank Rojas, Reverend Dirley Sams, Commissioner Norman Troy, and Marguerite Willard to serve the Community Health Clinic Advisory Board. The above items of the Consent Agenda were approved on a motion made by Councilman Williams and seconded by Councilman Turner. Question : Ayes : All Nayes : None -000- A Public. Hearing for a proposed Zoning Ordinance Amendment was held. City Manager Riley told Council that the amendment would reduce the required number of publications to one rather than three for proposed changes in zon- ing classifications. There were no citizens wishing to address Council concerning this matter and the public hearing was closed. -000- -81- May 13 , 1980 Ordinance No. 80-47 amending provisions of the Zoning Ordinance regarding publication of notices of public hearings was considered : ORDINANCE NO. 80-47 ENTITLED AN ORDINANCE AMENDING SECTION 30-40 OF THE CODE OF ORDINANCES OF THE CITY OF BEAU- MONT BY REDUCING THE REQUIREMENT OF OFFICIAL PUBLISHED NOTICE OF AMENDMENTS TO THE ZONING ORDINANCE FROM THREE TIMES TO ONE TIME; PRO- VIDING FOR REPEAL; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR A PENALTY. The ordinance was approved on a motion made by Councilman Williams and se- conded by Councilman Lord. Question : Ayes : All Nayes : None -OQO- Ordinance No. 80-48 declaring West Chester Addition (Winston, Posey, Wor- cester, Bender and Irene Streets) improvements to be a public necessity; approving plans, specifications and cost estimates; authorizing advertis- ing for bids; directing the City Clerk to file notice of intent to assess with the County Clerk; setting a date for receipt of bids; and establish- ing methods of payments of assessments (estimated cost - $332 ,800 - pro- perty owners ' share $58, 900. 00) was considered: ORDINANCE NO. 80-48 ENTITLED AN ORDINANCE DETERMINING THE NECESSITY OF AND ORDERING THAT WINSTON, POSEY, WORCESTER, BENDER, AND IRENE STREETS, PUBLIC STREETS IN THE CITY OF BEAUMONT, TEXAS, SHALL BE IMPROVED; ADOPTING AND AP- PROVIDING PLANS AND SPECIFICATIONS FOR SUCH IMPROVE- MENTS; LISTING APPARENT PROPERTY OWNERS ABUTTING ON SAID PORTION OF SAID STREETS; PROVIDING THAT A PART OF THE COST SHALL BE PAID BY THE CITY AND A PART THEREOF SHALL BE PAID BY ASSESSMENTS. AGAINST THE ABUTTING PROPERTY AND THE OWNERS THEREOF; FINDING AND DETERMINING THAT LOWER BIDS FOR SAID CONSTRUCTION WILL BE RECEIVED IF THE CONTRACT FOR THE WORK PROVIDES FOR THE PAYMENT IN CASH BY THE CITY RATHER THAN PAY- MENT BY PAVING CERTIFICATES; PROVIDING FOR CITY FINAN- CING OF PAVING CERTIFICATES ISSUED ON SAID PROJECT; PROVIDING FOR LEVYING ASSESSMENTS AGAINST ABUTTING PROPERTY; PROVIDING THAT ALL AMOUNTS RECEIVED BY THE CITY UNDER THIS PROJECT SHALL BE PAID INTO THE FUND OR FUNDS FROM WHICH THE APPROPRIATION FOR THE CON- STRUCTION CONTRACT WAS MADE; PROVIDING THE TITHE, TERMS AND CONDITIONS OF PAYMENT AND DEFAULTS OF SAID ASSESS- MENTS; DIRECTING THE CITY CLERK TO ADVERTISE FOR BIDS FOR THIS PROJECT; INVOKING THE PROCEDURE OF ARTICLE 1105b OF THE REVISED CIVIL STATUTES OF THE STATE OF TEXAS ; AND PROVIDING FOR SEVERABILITY. The ordinance was approved On a motion made by Councilman Williams and se- conded by Councilman Turner. Question : Ayes : All Nayes : None -000- Resolution 80-163 accepting Minute Order 77275 of the Texas Department of Highways and Public Transportation for a project to widen and improve the intersection of Calder Avenue and Major Drive (FM 364) by providing left and right turning lanes was approved on a motion made by Councilman Lord and se- conded by Councilman Williams. Question : Ayes : All Nayes : None -82 May 13 , 1980 Resolution 80-164 authorizing execution of a contract for the purchase of 25. 5 acres south of Lafin Drive and north of the LNVA Canal from the McFad- din interests for the proposed service center site at a cost of $160,000 was approved on a motion made by Councilman Turner and seconded by Council- man Williams . Question : Ayes : All Nayes: None -000- Resolution 80-165 authorizing final payment of $28,437 . 90 to John Bankston Construction and Equipment Rental , Inc. for the 24" water transmission main from Well #3 (total cost - $245,875. 00) was approved on a motion made by Councilman Lord and seconded by Councilman Williams. Question : Ayes : All Nayes : None -000- Resolution 80-166 awarding a construction contract to Shackelford-Gonzales Constructors, Inc. , for covered play areas on Liberia and Pine Street Parks at a cost. of $73,000. 00 using Community Development Block Grant funds was approved on a motion made by Councilman Turner and seconded by Councilman Williams. Question : Ayes : All Nayes : None -000- Resolution 90-167 authorizing the City Manager to execute a contract with the Jefferson Theatre Preservation Society for the use of $150,000. 00 in Community Development Block Grant funds for Phase I Restoration of the Jefferson Theatre was approved On a motion made by Councilman Lord and se- conded by Councilman Williams. Question : Ayes: All Nayes : None -000- An ordinance abandoning a 15' x 100' alley in Block 3 , Flowers Addition was considered: (applicant for abandonment - Mr . Jerry Jackson) AN ORDINANCE ENTITLED AN ORDINANCE VACATING AND ABANDON- ING AN ALLEY LOCATED IN BLOCK 3 OF THE FLOWERS ADDITION, BEAUMONT, JEFFERSON COUNTY, TEXAS, AS DESCRIBED HEREIN. The ordinance was tabled one week on a motion made by Councilman Williams and seconded by Councilman Turner. Question: Ayes: All Nayes : None .-.000 Mrs. Delia Harrington, 815 Willow Street , addressed .Council to request that the structures located at 3024, 3030, and 3040 Grand be considered for cleaning or repair. Mr. J. C. Leggett , 1849 Washington Blvd. , again addressed Council to request solution to drainage problems on Washington Blvd. between Avenue E to the railroad tracks and Emile to the railroad tracks. Mr. Albert Harrison, 1163 Avalon, addressed Council to request that tennis courts be upgraded at the Weiss Street Park (Magnolia Park) . -000- There being no further business, the meeting was recessed before continu- ing with the City Council Workshop Session.
