The ordinance failed to pass on a motion made by Councilman Combs and secon- ded by Mayor Meyers. Question : Ayes : Mayor Meyers Nayes : Councilman Lord Councilman Combs Councilman Williams Councilman Turner Four-fifths affirmative votes were -needed to approve this ordinance. -000- Ordinance No. 80-43 changing the zoning from R-1 to LR-1 for a 3 . 8 acre tract on the east side of Major Drive , 485 feet north of Dishman Road and extending north for 150 feet ; and from R-1 to R-2 for a 10. 5 acre tract on the east side of Major Drive, 635 feet north of Dishman Road and extending north for 350 feet (requested by Beaumont West Joint Venture) was considered : ORDINANCE NO. 80-43 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS , AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS , BY CHANGING A 3 . 8 ACRE TRACT OF LAND IN THE H. Question : Ayes : All Nayes : None -77- May 6 , 1980 Ordinance No . 80-44 appropriating funds from the Street System Improvement Fund for construction of Regina Lane between Howell and Belvedere (South Park School District to participate up to $100, 000 -- cost estimates for Project are $125, 000 to $140, 000) was considered : ORDINANCE NO. 80-44 ENTITLED AN ORDINANCE AMENDING THE BUDGET OF THE CITY OF BEAUMONT FOR THE FISCAL PERIOD COMMENCING OCTOBER 1 , 1979 AND ENDING SEPTEM- BER 30, 1980, BY ALLOCATING AND APPROPRIATING $40, 000 FROM THE STREET SYSTEM IMPROVEMENT FUND TO AN ACCOUNT FOR THE CONSTRUCTION OF REGINA STREET. The ordinance was approved on a motion made by Councilman Lord and seconded by Councilman Combs . Question : Ayes : All Nayes : None -000- (Councilman Williams left the meeting here . ) Resolution 80-155 confirming a purchase order for 8 , 000 tons of limestone to Delta Materials Corporation at approximately $64 ,240. 00 was approved on a motion made by Councilman Turner and seconded by Councilman Lord. Question : Ayes : All Nayes : None -000- Resolution 80-156 authorizing purchase of Parcel 3B for the proposed Cen- tral Fire Station site at a cost of $3 , 060. 00 (total acquisition - $124 , 710 . ) and commercial signs on Parcel 17 needed for the Spur 380/Lamar Freeway right-of-way from Holland Advertising, Inc . at $4 , 517 . 00 and William P. Terrell at $265 . 00 was approved on a motion made by Councilman Combs and seconded by Councilman Lord. Question : Ayes : All Nayes : None -000 (Councilman Williams returned. ) Ordinance No. 80-45 relating to the removal of junked motor vehicles was considered: ORDINANCE NO. 80-45 ENTITLED AN ORDINANCE AMENDING CHAPTER 13 , SECTION 13-15 BY ADDING DEFINITIONS; LIMITING EXCEPTIONS ; PROVIDING FOR NOTICE IF JUNKED MOTOR VEHICLES ARE ON PUBLIC PROPERTY; RE- QUIRING ADMINISTRATION BY CITY EMPLOYEES ; CHANGING RESPONSIBILITY FOR REMOVAL AND DIS- POSAL OF JUNKED MOTOR VEHICLES ; PROVIDING AN EFFECTIVE DATE ; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL; AND PROVIDING A PENALTY. The ordinance was approved on a motion made by Councilman Lord and seconded by Councilman Combs . Question : Ayes : All Nayes : None -000- Resolution 80-158 accepting bids for rehabilitation of 1151 Stewart Street by Homeowners Helper at $15 , 182 . 00 and the relocation of the house at 2340 Carroll Street to 2025 Leiper Street by J. R. Plake at $3 , 750. 00 as recom- mended by the Loan Advisory Board was approved on a motion made by Council- man Williams and seconded by Councilman Combs . Question : Ayes : All Nayes : None After discussion , it was decided that action be delayed for the rehabilita- tion of the structure at 1535 Herring Street for further information. -78- May 6 , 1980 (Councilman Williams left the meeting. ) The regular session was recessed before continuing with the public hearing on Dilapidated Structures . The public hearing was declared open . Mr. George Gardner, Urban Rehabilitation Administrator, told Council that all the below-listed structures are in violation of Article III , Sections 14-50 and 14-51 of the Dangerous Structures Ordinance of the City of Beau- mont and that all notification procedures have been met : 4304 Avenue _A (Garage) - South Park Columbus Club , owner (4 violations) , re- commendation to raze within 30 days; 4345 Avenue A - R. Fuentes, owner (11 violations) , recommendation to raze within 30 days ; 1764 Carroll - Reverend M. Washington, owner (15 violations) , recommendation to raze or repair within 30. days; 805 DeVilleneuve (Garage) - Jenkins Lyons , owner (11 violations) , recommendation to raze within 30 days ; 1745 Elgie - C. Councilman Combs made a motion to approve the recommendations of staff ; mo- tion was seconded by Councilman Lord. Question : Ayes : All Nayes : None The public hearing was closed. The regular City Council session was reconvened. Ordinance No. 80-46 declaring certain dilapidated structures to be public nuisances and requiring their repair or removal was considered : ORDINANCE NO. 80-46 ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES , ORDERING REPAIR OR DEMOL- ITION FOR CERTAIN STRUCTURES ; ORDERING DEMOLITION FOR CERTAIN STRUCTURES ; ORDERING DEMOLITION BY THE CITY UNDER CERTAIN CONDITIONS ; PROVIDING A PENALTY; AND PROVIDING FOR SEVERABILITY. The ordinance was approved on a motion made by Councilman Combs and seconded by Councilman Turner. Question : Ayes : All Nayes : None -000- (Councilman Williams returned . ) Resolution 80-157 entitled "RESOLUTION APPROVING THE CREATION OF BEAUMONT MULTI-FAMILY HOUSING FINANCE CORPORATION; APPROVING THE ARTICLES OF INCOR- PORATION THEREOF AND APPOINTING THE INITIAL DIRECTORS THEREOF; AND CONTAIN- ING OTHER PROVISIONS RELATING TO THE SUBJECT" was considered. The resolution also provides for the appointments of Maurice Meyers , Tom -79- May 6 , 1980 Combs, Jr. , Evelyn M. Lord, Calvin Williams and Wayne Turner to serve as members of the initial Board of Directors of the Corporation. Those speaking in favor of creating the Corporation were : Messrs. Smith, 427 Petroleum Building ; and Mrs. Betty Byram, 4045 Gladys ; members of the Board of Directors of the Beaumont Housing Finance Corporation , ad- dressed Council to request that action be delayed until the bond rating and sale of bonds for single-family residential financing had been finalized. Mr. Dick Haussner, 5955 Townhouse Lane, Greater Beaumont Real Estate Company, addressed Council in support of comments made by Board Members of the Beau- mont Housing Finance Corporation. The resolution was approved on a motion made by Councilman Combs and secon- ded by Councilman Turner.
