III Absent : Leroy Evans Councilman , Ward IV Ray Riley City Manager Lane Nichols Asst . City Attorney Myrtle Corgey City Clerk -000- The Invocation was given by Rabbi Norman Lipson, Temple Emanuel. The Pledge of Allegiance was led by Councilman Williams . -000 Mayor Meyers issued the following proclamation: "Runaway Youth Awareness Week in Beaumont" - January 27-February 3 , 1980. -000- The Minutes of the regular City Council session held January 22 , 1980, were approved on a motion made by Councilwoman McGinnis and seconded by Councilman Williams. Question : Ayes : All Nayes : None -000- Resolution 80-24 authorizing purchase of parcels #3 at $2 ,950. 00, #4 at $5,990. 00, #5 at $54 , 250. 00 and #34 at $58,229. 00 for the Spur 280 - Lamar Freeway - project (acquisition costs to be reimbursed by the State) was approved on a motion made by Councilman Combs and seconded by Council- woman McGinnis. Question : Ayes: All Nayes : None -000- Resolution 80-25 authorizing Jefferson County Title Company for title work and American Real Estate Company for appraisals for negotiations to obtain land needed for right-of-way to improve the Calder Avenue-Major Drive in- tersection was approved on a motion made by Councilwoman McGinnis and se- conded by Councilman Combs. Question : Ayes : All Nayes : None -000- A resolution authorizing execution of a contract with Billy Howell for engineering services in the preparation of a master plan for drainage was considered. Mayor Meyers made a motion to approve the resolution; motion died for lack of a second. -000- -11- January 29, 1980 Ordinance No. 80-7 amending the assessment paving policy to require prepayment by fifty percent of the property owners along street sections to be improved was considered: ORDINANCE NO. 80-7 ENTITLED AN ORDINANCE AMENDING CHAPTER 23 SECTION 23-11(6) TO REDUCE THE PREPAYMENT PERCENTAGE REQUIRED FOR AN ASSESSMENT PAVING PROJECT; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR REPEAL. The ordinance was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Combs . Question : Ayes : All Nayes : None -000- Resolution 80-26 approving $1 , 100,000 in additional securities pledged by the City depository bank, American National Bank, was approved on a motion made by Councilman Williams and seconded by Councilman Combs . Question : Ayes : All Nayes : None -000- Resolution 80-27 reappointing Richard Sibley, Herman Quinton , Ray Johnson and Roland Green to the Plumbing & Mechanical Board of Review; Wallace Domingue, Jr. , Tom Livesay, William Neild, H. E. Wyatt , and John Milling- ton to the Electrical Board of Review; Mrs. Tommie Byrd, Mrs. Julia Levy, Lum C. Edwards, Jr. , Ed Allen and Freddy Smith to the Charitable Solici- tations Commission; and Forrest Griffin, Mrs. IV. C. Tyrrell , Jr . , Mrs. Dora Nisby, and Dr. Brock Brentlinger to the Library Commission was ap- proved on a motion made by. Councilwoman McGinnis and seconded by Council- man Williams. Question : Ayes : All Nayes : None -000- Resolution 80-28 accepting a 12-foot wide utility easement from Mr. M.A. Phelan for installation of a water line approximately 500 feet south of Delaware Street was approved on a motion made by Councilman Combs and seconded by Councilwoman McGinnis . Question : Ayes : All Nayes : None -000- Resolution 80--29 authorizing the City Manager to sign CETA contracts was approved on a motion made by Councilman Combs and seconded by Councilwoman McGinnis. Question : Ayes : All Nayes : None -000-- Resolution 80-30 authorizing Gulf States Utilities Company to proceed with street lighting improvements on South Eleventh Street between College Street and Washington Boulevard at a cost of $8 , 398.45 was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Combs . Question : Ayes: All Nayes : None -000- Resolution 80-31 authorizing purchase of two (2) diesel cab/chassis with 31-cubic yard loader-type packer bodies for Solid Waste from Beaumont White Truck & Trailer, Inc. at $135,200. 00, one (1) 2-ton flatbed truck with metal bed and winch for Traffic and Transportation Department from GAIC Dixie Trucks , Inc . at $15, 014. 00 and two (2) pickups from GMC Dixie Trucks Inc. at $10, 886. 00, two (2) pickups from Raiford Motors at $11 ; 568. 56, two (2) pickups from Beaumont Motor Company at $11 , 920. 76 , three (3) pickups from Myron Gray Chrysler Center at $19,580.45 and four (4) pickups from Kinsel Ford, Inc . at $22 , 102. 08 was approved on a motion made by Council- man Combs and seconded by Councilman Williams. Question : Ayes : All Nayes : None -12- January 29, 1980 Resolution 80-32 authorizing purchasing of service saddles from Mickie Service Company at a cost of $3 , 084 . 35 , repair clamps and bolted couplings from Utility Supply Company at a cost of $10,306. 15 , 5/8" water meters from Rockwell International Corporation at a cost of $25. 90 less trade-in of $6 . 50, 11' water meters from Neptune water Meter Company at $54 . 00 less trade-in of $10. 00 , 1211 water meters from Carlon Meter Company at $131 . 00 less trade-in of $16. 00 and 2" water meters from Carlon Meter Company at $189. 00 less trade-in of $22 . 00 was approved on a motion made by Councilman Combs and seconded by Councilwoman McGinnis. Question : Ayes : All Nayes : None -000- Resolution 80-33 authorizing purchase of 141 tons of Oyster Shell for street maintenance from Keown Supply Company at $14 . 18 per ton was approved on a motion made by Councilman Combs and seconded by Councilwoman McGinnis . Question : Ayes : All Nayes : None -000- Ordinance No. 80-8 amending Chapter 16 of the Code of Ordinances, provid- ing for late charges for Library materials was considered : ORDINANCE NO. 80-8 ENTITLED AN ORDINANCE AMENDING CHAPTER 16 OF THE CODE OF ORDINANCES TO PROVIDE FOR DAILY LATE CHARGES FOR LIBRARY MATERIAL; PROVIDING FOR A PROCESSING FEE ; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR REPEAL. The ordinance was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Combs. Question : Ayes : All Nayes : None -000- The regular session was recessed to call a public hearing for Dilapidated Structures. -000- Mayor Meyers declared the public hearing open : 2390 N. Lynwood - Mr . George Gardner , Urban Rehabilitation Administrator , told Council that complaints had been received from residents living near this structure. He told Council that a six-month extension had been granted, at the Dilapidated Structures Hearing held December 18th, with the provision that the trash and debris be removed from the premises and the structure be boarded according to requirements of the ordinance . Mrs. Billy Fountain, 2390 N. Lynwood and Mrs . Jack Cleveland, Jr . , 2370 N. Lynwood, addressed Council to say that nothing has been done to clean up the premises and the structure has not been boarded. They requested that Council reconsider the six-month extension for the safety and well- being of their neighborhood. After discussion with Mr. Gardner, Council instructed that contact be made with the owners and staff recommendation be presented for considera- tion at the next Council session (Tuesday, February 5th) . 2801 Pine Street - Mr. Gardner told Council this structure was first pre- sented for condemnation in March of 1979 and brought back December 18th. Mrs. Ed Smith, owner , requested an additional extension of time to allow her husband and sons to repair the structure. After a lengthy discussion , Councilman Combs made a motion to amend the original raze order to raze or repair and allow a 60-day extension for substantial progress toward bring the structure within compliance of the dangerous structures ordinance; the motion was seconded by Councilwoman McGinnis . Question : Ayes : All Nayes : None -13- January 29, 1980 Mr. Gardner stated that all of the below-listed structures are in violation of Article III , Sections 14-50 and 14-51 of the Dangerous Structures Ordi- nance of the City of Beaumont and that all notification procedures have been met : 1458/1460 Mariposa - Mr. Gardner told Council these structures were con- sidered at the hearing of November 20th. Council had granted six (6) weeks to allow the structures to be brought into compliance with the ordinance . Mr . Gardner recommended that a raze order be given at this time. Councilman Combs made a motion to order the structures razed within 30 days; Councilwoman McGinnis seconded the motion. Question : Ayes : All Nayes : None -000- 298 Jefferson Street - Johnny M. Smith, et ux, owner (19 violations - ap- proximately 80% destroyed by fire) , recommendation to raze within 30 days ; 920-930 Jefferson Alley - Mrs . Sadie Oxford, owner (24 violations) , recom- mendation to raze or repair within 30 days ; 1178 Gladys Street - Mr. Pressly Giles, owner (22 violations) , recommendation to raze within 30 days ; 2599 Cable Street - Mr . Dan Chance (being sold to S & S Enterprises) , owner (17 violations) , recommendation to raze or repair within 30 days ; 7727 Helbi._g - Villiam P. Terrell , owner (25 violations) , recommendation to raze within 30 days; 3179 (7 violations), 3181 Westmoreland (Rear , 16 violations, and garage, 5 violations) - Mary and Casey White , deceased, c/o Marion. J. Rein- stra, recommendation for the house is to raze or repair within 30 days and for the rear structure and garage the recommendation is to raze within 30 days ; 3627 Glenwood - A. J. Jackson in care of Mrs. Alberta Ozen , owner (10 violations) , recommendation to raze within 30 days; 4245 Usan - Clarence Breaux, owner (19 Violations) , recommendation to raze within 30 days ; 1825 Threadneedle (Garage) - Howard Rufus, owner (15 violations) , recommendation to raze within 30 days; and 1493 Ewing, Mr. Robert Pierre, owner (25 viola- tions) , recommendation to raze within 30 days. (Mr. Combs left the hearing during this portion of the discussion) Councilwoman McGinnis made a motion to approve the recommendations ; motion seconded by Councilman Williams . Question : Ayes : All Nayes : None -000- Meyers declared the public hearing closed and the regular session of City Council reopened. (Councilman Combs returned. ) Ordinance No. 80-9 declaring certain dilapidated structures to be public nuisances and requiring their repair or removal was considered : ORDINANCE NO. 80-9 ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES , ORDERING REPAIR OR DEMOL- ITION FOR CERTAIN STRUCTURES ; ORDERING DEMOLITION FOR CERTAIN STRUCTURES ; ORDERING DEMOLITION BY THE CITY UNDER CERTAIN CONDITIONS ; PROVIDING A PENALTY; AND PROVIDING FOR SEVERABILITY. The ordinance was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Williams . Question : Ayes : All Nayes : None -000- Dr. L. L. Melton, 3370 Posey, addressed Council to thank them for the action taken today lowering prepayment requirements for Assessment Paving projects. Mr. Don Coleman, 935 22nd Street , addressed Council to request that all rates of wrecker services be regulated by City Council . -14- January 29, 1980 Mr. Gene Braquet , Bra-K Wrecker Service, 9855 Washington Boulevard , addressed Council in opposition to suggestions that City Council regu- late all phases of wrecker service charges. -000- There being no further business, the meeting was recessed before continu- ing with the City Council Workshop Session. -000- I , Myrtle Corgey, City Clerk of the City of Beaumont , Texas , certify that the above is a true copy of the minutes of the regular City Council session held January 29, 1980.
