The Pledge of Allegiance was led by Councilman Williams. -000- The Minutes of the regular City Council session held April 24, 1979, were approved on a motion made by Councilman Combs and seconded by Councilwoman McGinnis . Question : Ayes : All Nayes : None -000- Mayor Meyers issued the following proclamations : Golden Triangle Citizens for Decent Literature & Movies, Inc . of Southeast Texas "Awareness Week in Beaumont" - May 15-19, 1979; Law Days U. S .A. - May 1-4 , 1979; "Respect for Law Week in Beaumont" - May 1-7 , 1979; "Shrine News Day in Beaumont" - May 5, 1979; "A. B.W.A. Scholarship Month in Beaumont" - May , 1979 and "Single Parents Day in Beaumont" - May 5, 1979. -000- Resolution 79-165 authorizing the Legal Department to institute proceed- ings in eminent domain to acquire Parcel #49, Schwarner Street , for the Community Development Block Grant Project (estimated value - $1 , 585. 00) was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans . Question : Ayes : All Nayes : None --000- Resolution 79-166 appointing Louis Broussard, Charles Weinbaum, M. L. Lefler, Howell Cobb and Warren Goehringer and alternates Preston Shaw and Roger Hanks to the Board of Adjustment for two year terms expiring Decem- ber 31 , 1980 was approved on a motion made by Councilman Evans and seconded by Councilman Combs. Question Ayes : All Nayes : None -000- Ordinance No . 79-35 revising speed limits on Concord between East Lucas and Eastex Freeway (35 mph from E. Lucas to the centerline of Sour Lake Road and 40 mph from the Centerline of Sour Lake Road to the centerline of the east frontage road of U. S. Highways 69, 96 , & 287) was considered : -69- May 1 , 1979 ORDINANCE NO. 79-35 ENTITLED AN ORDINANCE AMENDING CHAPTER 26 , SECTION 26-23 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT BY ADDING A SPEED LIMIT FOR CONCORD ROAD; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL; AND PROVIDING A PENALTY. The ordinance was approved on a motion made by Councilman Williams and seconded by Councilman Combs. Question : Ayes : All Nayes : None -000- Resolution 79-167 accepting the bid of Dictaphone Corporation for furnish- ing a 40-track logging tape recorder/reproducer system, ninety (90) reels of tape and three (3) empty take-up reels for use at the Police Department at a cost of $28 ,451 . 00 was approved on a motion made by Councilman Combs and seconded by Councilman Evans. Question : Ayes : All Nayes : None -000- Resolution 79-168 accepting the bid of Graybar Electric Company for fur- nishing replacement lamps (24-1500 watt and 24-1000 watt) for the Athletic Complex at a cost of $2, 199. 60 was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans . Question : Ayes : All Nayes : None -000 Resolution 79-169 accepting the bid of AM International for furnishing a paper cutter for use by the Print Shop at a cost of $2 , 360. 00 was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Combs. Question : Ayes : All Nayes : None -000- Resolution 79-170 accepting the bid of Dixie Truck Center for furnishing a one-ton flatbed truck for use by the Fleet Maintenance Division at a cost of $6, 216. 00 (welding equipment to be mounted on this vehicle) was approved on a motion made by Councilman Evans and seconded by Council- woman McGinnis . Question : Ayes : 'All Nayes : None -000- Resolution 79-171 accepting the bids of Roland Angelle Pontiac , Inc . for furnishing five (5) four-door sedans for the Police Department in the amount of $28, 764 . 05 and Donaldson Motor Company of Silsbee in the amount of $7 , 020. 00, was considered. Councilman Evans made a motion to approve the resolution ; Mayor Meyers seconded the motion. A lengthy discussion concerning the bid of Kinsel Ford, Inc . in the amount of $7 , 045. 33 for the pickup and the Donaldson bid was held. Concern was expressed for the cost of man hours involved, etc. , in returning this ve- hicle to Silsbee for the warranty period for the $25. 00 difference in the two bids. Mayor Meyers withdrew his second to the motion . Councilman Evans made a motion to table the resolution; the motion died for lack of a second. Councilman Evans amended his original motion to award the bids to Roland Angelle Pontiac , Inc. and Kinsel Ford, Inc. ; Councilman Williams seconded the motion. Question : Ayes : All Nayes : None -000- -70- May 1 , 1979 Ordinance No. 79-36 declaring certain dilapidated structures to be public nuisances and requiring their repair or removal was considered : ORDINANCE NO. 79-36 ENTITLED AN ORDINANCE FINDING CERTAIN STRUC- TURES TO BE PUBLIC NUISANCES , ORDERING RE- PAIR OR DEMOLITION FOR CERTAIN STRUCTURES ; ORDERING DEMOLITION FOR CERTAIN STRUCTURES ; ORDERING DEMOLITION BY THE CITY UNDER CERTAIN CONDITIONS ; AND PROVIDING A PENALTY. A motion to approve the ordinance was made by Councilwoman McGinnis and seconded by Councilman Combs. Mr. George Gardner, Urban Rehabilitation Administrator , reported to Coun- cil that the property located at 680 Prince had not been brought into com- pliance and recommended it be included in Section 4 of the ordinance. Councilwoman McGinnis made a motion to amend the ordinance to include 680 Prince in Section 4; motion was seconded by Councilman Combs . Question : Ayes : All Nayes : None Motion to approve the ordinance was passed as follows : Question : Ayes : All Nayes : None -000- PUBLIC HEARING ENTEX RATE INCREASE APPLICATION Mayor Meyers declared the public hearing open . Those present for Entex were Messrs. L. A. Duffee, District Manager ; Howard Bell, Vice-President from Houston; Tom Tyson , Rate Engineer from Houston; and Allan Caldwell , Vice-President and Division Manager of Beaumont . Mr. Duffee and Mr. Bell explained Entex ' s "Statement of Intent to Change Rates. " The effect of this filing is to increase the charges to residential and small commercial customers. These proposed adjustments will increase the aggregate revenues less than two and one-half (22%) percent . Mayor Meyers mentioned for the record receipt of a "Petition to Intervene" in the rate change application of Entex from the East Texas Legal Services . Mayor Meyers invited citizens to address the public hearing : Mr. L. P. Kinnear , 2395 Park Street , addressed Council in opposition to the proposed rate increase. Mr . Gary A. Thomas , Executive Director of the East Texas Legal Services , told Council that the Petition to Intervene was presented on behalf of low income citizens and requested action by the City for this intervention . Mr. Bill Brooks, representative of the Economic Opportunity Commission , 447 Orleans, gave statistical information concerning the effects of this increase on low income families . Mr. Collis Cannon, 4735 Pine; Mr. Walter Swift , 1475 Avenue F; Mrs. Marie Nesom, Manager of the New Beaumont Retirement Center on Orleans ; and Mr . J. C. Leggett , 1849 Washington Boulevard, all addressed Council in opposi- tion to the proposed rate increase. There being no further business , the public hearing was closed. -000- -71- May 1 , 1979 Mr. Chuck Anderson, representing the Social Policy Course at Lamar University and a social worker major, addressed Council to give a preliminary report on health services to the indigent in Beaumont . He said his class would have the completed report by early summer. Mrs. Lessie Fontenot , Director of the National Association for the Advance- ment of People, addressed Council in opposition to the demolition of the structure located at 680 Prince. Mr . Walter Swift , 1475 Avenue F, asked Council to consider holding an occasional night session and also to complain about the safety hazards of a dead tree on Avenue E at Franklin Street . Mr . J. C. Leggett , 1849 Washington Boulevard, complained about the poor condition of Archie and Fannin Streets. -000- There being no further business , the meeting was recessed before continu- ing with the City Council Workshop Session. -000- _ , Myrtle Corgey, City Clerk of the City of Beaumont , Texas , certify that the above is a true copy of the minutes of the City Council session held May 1 , 1979.
