Texas , met in regular session this 10th day of April , 1979, with the following present : HONORABLE : Tom Combs, Jr . Councilman, Ward I Vi McGinnis Mayor Pro Tem & Councilwoman, Ward II Calvin Williams Councilman, Ward III Leroy Evans Councilman, Ward IV Absent : Maurice Meyers Mayor Ray Riley City Manager Kenneth Wall City Attorney -000- The Invocation was given by Mr. R. E. Platt , Asst . City Manager. The Pledge of Allegiance was led by Councilman Williams. -000- The Minutes of the regular City Council sessions of March 27 , 1979 and April 3 , 1979 were approved on a motion made by Councilman Combs and seconded by Councilman Evans. Question : Ayes : All Nayes : Nome -000- Mayor Pro Tem McGinnis issued the following proclamation : "Cancer Control Month" - April , 1979 with "Cancer Control Day in Beaumont" - April 10 , 1979. -000- Resolution 79-132 authorizing the Legal Department to institute condemna- tion proceedings to acquire the following parcels of land for the Community Development Block Grant Project : Stewart Street - Parcels #2 & 8 ; Lamar Street - Parcels #16, 22, 25 & 26; and Schwarner - #31 , 37, 39 , 55 & 63 and authorizing purchase of the following for the CDBG project : Lamar Street : Parcels #27 at $1 , 780. 00 and #28 at $1 , 680. 00 and Schwarner Street : Parcels#36 at $12 , 290. 00 and #59 at $130. 00 was approved on a motion made by Councilman Evans and seconded by Councilman Combs . Question : Ayes : All Nayes : None -000- Resolution 79-133 authorizing amending the Group Health Insurance Plan to include pregnancy benefits for employees to comply with Public Law 95-555 at an increased cost to the City of $1 . 05 per month per employee was ap- proved on a motion made by Councilman Combs and seconded by Councilman Evans. Question : Ayes : All Nayes : None -000- Resolution 79-134 authorizing the retention of Jefferson County Title Company for title work and M. L. Lefler , Jr . and Willard J. Hall for appraisals of additional rights-of-way parcels for the Buford Street Project and the Carroll Street Project was approved on a motion made by Councilman Evans and seconded by Councilman Combs. Question : Ayes : All Nayes : None -57- April 10, 1979 Resolution 79-135 authorizing the purchase of the northern 20. 01 feet of Block 25, T. H. Langham Survey for the Washington Boulevard Project was approved on.'_a ,motion made by Councilman Combs and seconded by Councilman Williams . Question : Ayes : All Nayes : None -000® Resolution 79-136 authorizing payment to Edna LaBove, Court Reporter , of $1 , 800. 00 for services in arbitration proceedings between the City of Beaumont and the International Brotherhood of Police Officers , Local #491 was approved on a motion made by Councilman Evans and seconded by Council- man Combs. Question : Ayes - All Nayes : None -000- Resolution 79-137 accepting the bid of General Electric Company for fur- nishing radio equipment for various departments at a cost of $33 , 504 . 00 was approved on a motion made by Councilman Evans and seconded by Council- man Combs. Question: Ayes : All Nayes : None -000- Resolution 79-138 accepting the bid of Russco Paint Manufacturing Company for furnishing 165 gallons of white paint @ $7 . 60 per gallon , 20 gallons of tourquoise paint at $7. 60 per gallon and 20 gallons of paint thinner at $2 . 89 per gallon for the Parks and Recreation Department for swimming and wading pools was approved on a motion made by Councilman Evans and seconded by Councilman Combs . Question : Ayes : All Nayes : None -000-- Resolution 79-139 accepting the bid of Hi-Way Equipment Company , Inc . for furnishing a hydraulic telescoping boom--type excavating machine to be used by the Sewer Maintenance Division at a cost of $90,440. 00 was approved on a motion made by Councilman Evans and seconded by Councilman Combs . Question : Ayes : All Nayes : None -000- Resolution 79-140 accepting a ten-foot easement in the Gulf Terrace Addi- tion from Clarence R. and Peggy P. Moore was approved on a motion made by Councilman Combs and seconded by Councilman Williams . Question : Ayes - All Nayes : None -000- Resolution 79-141 authorizing the execution of a contract with Winter King Construction Company for the construction of a stolen property storage ad- dition to the Police Municipal Court Building at a cost of $65 , 068 . 00 was approved on a motion made by Councilman Evans and seconded by Councilman Combs. Question : Ayes : All Nayes : None -000- Resolution 79-142 rescinding an, award of bid to Jim Austin Chevrolet Com- pany for six (6) pickup trucks , two (2) one-half ton vans and one (1) 12-passenger van because of breach of contract by Jim Austin Chevrolet Company and authorizing bid awards to GMC Dixie Truck Center for six (6) pickup trucks @ $30, 276. 00,- Kinsbl Ford Company for one (1 ) 12-passenger van @ $7 , 522 . 48 and Donaldson IV1otor Company, Silsbee, for two (2) one- half ton vans @ $11 , 992 . 00 was approved on a motion made by Councilman Combs and seconded by Councilman Williams . Question : Ayes : All Nayes : None -58- April 10, 1979 I Resolution 79-143 authorizing an agreement with Texas Vehicle Information and Computer Services for a computerized parking ticket processing ser- vice for Municipal Court was approved on a motion made by Councilman Combs and seconded by Councilman Williams. Question : Ayes : All Nayes : None -000- Public Hearing for the 'Urban Mass Transportation Administration Grant Application for subsidy of the Mass Transit System operations , FY 1979 request $241 , 881 . 00, was declared open foil, citizen comments . No citizens wished to address Council concerning the grant application. Public Hearing was closed. -000-- Mrs. Delia Harrington, 815 Willow Street , addressed Council to again request that the 2800/2900 Block of Grand Avenue be included in the street rehabilitation and resurfacing program. -000- There being no further business, the meeting was recessed before continu- ing with the City Council Workshop Session , -000- I , Rosemarie Chiappetta, Deputy City Clerk of the City of Beaumont , Texas, certify that the above is a true copy of the Minutes of the regular City Council session held April 10, 1979. Rosemarie Chiappetta Deputy City Clerk -09- April 10, 1979 EXCERPT FROM REGULAR CITY COUNCIL SESSION HELD APRIL 10, 1979 PUBLIC HEARING URBAN MASS TRANSPORTATION ADMINISTRATION GPANT APPLICATION THOSE present for the public hearing were : Tom Combs , Jr . Councilman , Ward I Vi McGinnis Mayor. Pro Tem and Calvin Williams Councilwoman , Ward II Councilman , Ward III Leroy Evans Councilman , Ward IV Absent : Maurice Meyers Absent Ray Riley City Manager Kenneth Wall City Attorney -000- MAYOR PRO TEM McGINNIS : We now call a public hearing. CITY MANAGER RILEY: Yes , ma ' am. As a result of our application to the federal government under the Urban Mass Transportation Act , there is a public hearing which should be conducted in order for interested parties to comment concerning the City ' s application for federal assistance with regard to the operation of the Mass Transit System. The difference in this application and the past is primarily the time the application be made. In past years , the City made application upon completion of the then current fiscal period for fifty ( 501/,)) percent of the deficit in the operation of the system. We currently have applications pending for fiscal year 1978 . The law was changed in the past Congress to provide that because of the amount of monies that the City could in eCfect have to invest for long periods of time, we may not make application during the current fiscal year for the estimated deficit from operations . The grant which is being requested for fiscal year for 1979 is $241 , 881 . 00. Under the law, we may now make application; they will pay a major por- tion of it , I believe 80 to 90%, during the fiscal year and then, upon the completion of the year, we total up and reconcile those differences . It is of significant benefit to the City in that we will be receiving funds as we are expending them during the fiscal year as opposed to some twelve to eighteen months at the conclusion of the fiscal year . And , this amount , even if these funds were invested at say 9 to 10% over a period of a year means somewhere close to $25, 000 to $30 , 000 additional EXCERPT FROM REGULAR CITY COUNCIL SESSION HELD APRIL 10 , 1979 Page 2 CITY MANAGER cont ' d : operating funds available to us by the use of our own cash . So , the public hearing has been scheduled and the proper notification and adver- tisement made to allow interested citizens an opportunity to comment on the application . . . the grant process . MAYOR PRO TEM MCGINNIS : So , at this time if there are any citizens who wish to comment on this application , feel .free. to come Forward , give your name and address . If not . . . . . . COUNCILMAN WILLIAMS : Vi , I would like to urge one thing that .the staff person responsible for the Transportation Advisiory Committee , that person has not done so , to activate that Committee and at least try to have more meetiJlvs than what this Committee has had apparently over the past . And , I think also will give us an opportunity to discover those committee members whoopee- � hap: no longer would like to serve in order that we. could appoint else in their place. But , I think it is important that this committee does meet in order that there would be some input into the City especially as the City continues to grow there might be a need for additional bus services in areas that are not now covered or maybe modification of routes that we already have and I think the only way we can really get this and find this out is that the Committee become a little bit more active than what it has been . MAYOR PRO TEM MCGINNIS : I think we have all been notified of appointments that are due but I hadn 't done anything about it because I knew the Committee wasn ' t meeting anyhow. You kind of hate to ask someone to serve if it ' s not going to do anything . COUNCILMAN COMBS : Also , while we are on the subject , when does our new advertising program go into effect? Has that started yet? ASST. CITY MANAGER, R. E. PLATT : I don' t know if it has started yet or not . MAYOR PRO TEM MCGINNIS : Are you talking about on the buses? CITY MANAGER : A contract has been negotiated with a local advertiser to do advertisinn on the buses . That will be a contract between the Management firm and the Advertiser . COUNCILMAN COMBS : Did they give any kind of estimates as far as revenue? ASST. CITY MANAGER: I don ' t know. COUNCILMAN WILLIAMS : What about bus sheds? Has this construction program begun yet? The sheds for the buses , the waiting areas? MAYOR PRO TEM MCGINNIS : Shelters . . . ? CITY MANAGER : . . . construction. . . We ' ve awarded the bid for the purchase of the materials two weeks ago, I believe, and they have not been delivered yet . But , all of the contracts for acquisition of the bus shelters , benches , and signs have all been made. MAYOR PRO TEM MCGINNIS : Do we have any other questions or any comments from the public on Mass Transit . . . . . . we ' ll get to your part in just a moment , firs . Harrington.
