CITY COUNCIL - CITY OF BEAUMONT
HELD FEBRUARY 6 , 1979
BE IT REMEMBERED that the City Council of the City of Beaumont , Texas , met
in regular session this the 6th day of February, 1979, with the following
present :

The Invocation was given by Mr . Famous 1 41. Byers , Ridgewood Church of
Christ .
The Pledge of Allegiance was led by Councilwoman McGinnis.

Mayor Meyers issued the following proclamation : ''Vocational Education
Week in Beaumont" - February 11-17, 1979.
Mayor Meyers welcomed representatives of the Forest Park High School
Orchestra and wished them well in State competition to be held in Fort
"forth, Texas on February 7 , 1979.

Resolution 79-50 authorizing the City Manager to amend the Housing Assist-
ance Plan, a part of the Fourth-year Community Development Block Grant
Program, for submission to the Department of Housing and Urban Develop-
ment (adding additional 90 units bringing total to 150) was approved on a
motion made by Councilwoman McGinnis and seconded by Councilman Evans.

Resolution 79-51 authorizing the purchase of five (5) tracts of land for
the West Virginia Project (071-77-041 -- Parcel #3 , $315. 00 and Parcel #4 ,
$400. 00) , CDBG Census Tract 17 (Parcel #7 , $150. 00) , the Florida-Highland
Project (071-94-082 -- Parcel #6 , $5 , 000. 00) , and Pearl Street Parking
(Police Parking - 40x120 ' -- $22 , 800) was approved on a motion made by
Councilman Evans and seconded by Councilwoman McGinnis.

Resolution 79-52 authorizing execution of an agreement with Dickson , Dick-
son and Bullock to provide architectural services for the Fair Park Coli-
seum Modifications Project for a fee of ten (100) percent of construction
costs was approved on a motion made by Councilwoman McGinnis and seconded
by Councilman Evans .

Resolution 79-,53 authorizing final payment of $3 , 315. 00 to Faviana Olivier
Galleria for providing tapestry for the City Council Chambers was approved
on a motion made by Councilman Evans and seconded by Councilwoman McGinnis .

Resolution 79-54 authorizing the execution of an agreement with Garrod &
Associates for engineering services for the design and construction of
Buford and Carroll Streets CAP Projects at a cost not to exceed $198 , 000
was approved on a motion made by Councilman Evans and seconded by Coun-
cilwoman McGinnis .

Resolution 79-_55 authorizing the sale of the remnant of Lot 1 , Calder
Courts Addition to Affiliates , Inc . (-M. L. Lefler , Jr . ) at a cost of
$15 , 675. 00 and authorizing the City Manager to enter into a lease agree-
ment with Affiliates, Inc. for the south parts of Lots 3 and 4 , Calder
Courts Addition on a month to month basis at a monthly rental rate of
$75. 00 .was approved on a motion made by Councilman Combs and seconded
by Councilman Evans.

Resolution 79-56 accepting the bid of Horner Flooring Company for furnish-
ing a portable dance floor for the Civic Center Exhibition Hall at a cost
of $1 , 995. 00 was approved on a motion made by Councilman Combs and seconded
by Councilman Evans.

Resolution 79-57 accepting the bid of Watson Distributing Company , Inc .
for furnishing two (2) patrol vehicles for the Traffic & Transportation
Department (Parking Meter and Parking Lot patrol ) at a cost of $8 , 594 . 00
was approved on a motion made by Councilman Evans and seconded by Council-
man Combs .

Resolution 79-58 authorizing advertising for bids for the construction
of a parking lot at the site of the City Hall Annex was approved on a mo-
tion made by Councilwoman McGinnis and seconded by Councilman Evans .

Resolution 79-59 accepting the bid of Austin 1111hite Lime Company on supply-
ing hydrated lime for the Water Utilities Department at a cost of $71 . 80
per ton for a one-year period from February 1 , 1979 through January 31 ,
1980 was approved on a motion made by Councilwoman McGinnis and seconded
by Councilman Evans .

The First reading of an ordinance granting the Atchison, Topeka and Santa
Fe Railway Company a renewal franchise for Industry Spur Track No. 65
across Jirou Street and across its intersections with Long, Ashley and
Evalon Streets was held:

AN ORDINANCE GRANTING TO THE ATCHISON, TOPEKA AND
SANTA FE RAILWAY COMPANY, A DELAWARE CORPORATION,
ITS SUCCESSORS, ASSIGNS AND LESSEES , THE RIGHT AND
PRIVILEGE TO MAINTAIN AND OPERATE ITS I`ZDUSTRY SPUR
TRACT NO. 65 IN, UPON, OVER AND ACROSS JIROU STREET

AND ACROSS ITS INTERSECTION WITH LONG, ASHLEY AND
EVALON AVENUES IN McFADDIN',S FIRST ADDITION TO
THE CITY OF BEAUMONT, TEXAS , IN ACCORD T,WITH EXHIBIT
ATTACHED HERETO; PROVIDING THAT SAID TRACK SHALL BE
USED ONLY FOR THE PURPOSE OF LOADING, UNLOADING AND
SWITCHING TO INDUSTRIAL TRACKS SERVING COMMERCIAL AND
INDUSTRIAL ENTERPRISES ; PROVIDING REGULATIONS AND
RESTRICTIONS FOR THE USE OF SAID TRACKS ; PROVIDING
THAT SUCH MAINTENANCE AND OPERATION BE IN ACCORDANCE
WITH THE CHARTER AND ORDINANCES OF THE CITY AND THAT
CERTAIN MAINTENANCE WORK SHALL BE DONE AT THE DIRECTION

TRACK FRANCHISED HEREUNDER; PROVIDING FOR TERMINATION
OF THIS FRANCHISE ON APRIL 2 , 1983 AND THE RESTORATION
OF SAID STREETS ?WITHIN NINETY (90) DAYS THEREAFTER;
AND PROVIDING FOR INDEMNIFICATION OF THE CITY OF
BEAUMONT.
After a lengthy discussion , it was the Manager 's recommendation that this
ordinance be passed to its second reading but that further action be de-
ferred until such time as the railroad crossing at the intersection of
North at First Street be improved.
Councilman Evans made a motion to pass the ordinance to its second read-
ing; Councilwoman McGinnis seconded the motion .

The first reading of an ordinance granting the Atchison , Topeka and Santa
Fe Railway Company a renewal franchise for Industry Spur Track No. 10
crossing Fannin Street between City Blocks 56 and 57 was considered :
AN ORDINANCE
AN ORDINANCE GRANTING TO THE ATCHISON, TOPEKA AND SANTA FE
RAILWAY COMPANY, ITS SUCCESSORS, ASSIGNS AND LESSEES , THE
RIGHT AND PRIVILEGE TO MAINTAIN AND OPERATE AN INDUSTRY SPUR
TRACT NO. 10 CROSSING FANNIN STREET BETWEEN CITY BLOCKS 56
AND 67, IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, IN
ACCORD WITH EXHIBIT ATTACHED HERETO; PROVIDING THAT SAID
TRACK SHALL BE USED ONLY FOR THE PURPOSE OF LOADING, UNLOAD-
ING AND SWITCHING TO INDUSTRIAL TRACK SERVING COr:MERCIAL
ENTERPRISE PROVIDING REGULATIONS AND RESTRICTIONS FOR THE
USE OF SAID TRACK; PROVIDING THAT SUCH MAINTENANCE AND OPER-

Again the Manager recommended that this ordinance be passed to its second
reading but that further action be deffered until the railroad crossing
at North and First Streets be improved.
Councilman Evans made a motion to pass the ordinance to its second reading;
Councilwoman McGinnis seconded the motion .

Mrs. B. B. Young, Jr . , 10925 Fairfield, addressed Council to present a
petition containing approximately 45 signatures of residents of Pine Island
Bayou Estates asking that streets in the addition be paved and a railway
signal or crossing arm be place at the track intersection for the safety
of residents.
Messrs. Larry Engelmann, 6255 Oakcrest ; Albert Fumuso , 11225 Glenbrook and
Walter Hicks , 10980 Forrest Glen ; addressed Council in support of comments
made by Mrs . Young.
Mrs . Alice Jefferson Taylor and Mr. Marvin Durdin addressed Council to
ask the City for a letter of endorcement for Opportunity Industrializa-
tion Center of America" which is designed to train and place in productive
jobs unskilled or under-employed minorities .

There being no further business , the meeting was recessed before continu-
ing with the City Council Workshop Session.
