BE IT REMEMBERED that the City Council of the City of Beaumont , Texas , met
in regular session this the 23rd day of January , 1979 , with the following
present :

Church.

The ",linutes of the regular City Council session of January 16 , 1979 , were
approved on a motion made by Councilwoman McGinnis and seconded by Coun-
cilman Evans .

Ordinance No. 79-6 extending the boundaries of the French Trading Post
to include a 0. 397 acre-tract and designating the tract as having his-
torical and cultural significance (requested by the Beaumont Heritage
Society) was considered :

An ordinance authorizing a zoning change from R-3 to C-1 for a 0. 258 acre-
tract on the northeast corner of the intersection of Edgemore and Wall
Streets was considered:

Ordinance No . 79-7 authorizing a zoning change from R-1 to C-2 for a 13 . 17
acre-tract located in the 7000-7100 Block of Fannett Road (requested by

Resolution 79-27 authorizing a contract with the White Budd VanNess
Partnership for architectural services required for the design and coistruc-
tion of a facility for the storage of stolen property recovered by the
Police Department (estimated size 1100-1200 square foot at an approximate
cost of $55 , 000-65 , 000) in an amount not to exceed `>6 ,450. 00 was approved
on a motion made by Councilwoman McGinnis and seconded by Councilman Evans.

Resolution 79-28 authorizing payment of )1 , 500. 00 to Black Star Sound and
Lighting Company for an emergency purchase order for sound test equipment
used at the Fair Park Coliseum was approved on a motion made by Council-
woman McGinnis and seconded by Councilman Combs .

Resolution 79-29 approving; plans and specifications for the Nest Virginia
Street Project from South 4th to Mercantile as a 36 foot wide residential
collector and authorizing advertising for bids for construction of the
project was approved on a motion made by Councilwoman `ZcGinnis and seconded
by Councilman Evans .

Resolution 79-30 authorizing advertising for bids for two (2) 1500 GPM
pumper fire trucks (replacements for 1960 models at Fire Stations #3
and 5 but will be maintained as reserve pumpers)was approved on a motion
made by Councilwoman McGinnis and seconded by Councilman Evans .

Resolution 79-31 accepting the bid of Oshman ' s Snorting Goods for furnishing
six (6) basketball goals , posts and backboards for the Parks and Recreation
Department at a cost of $1 , 476 . 00 was approved on a motion made by Council-
man Evans and seconded by Councilman Combs.

Resolution 79-32 accepting the bids for annual contracts of Golden Triangle
Pipe and 'â–ºVater Supplies and Utility Supply Company for furnishing cast iron
bends , tees and valve boxes was approved on a motion made by Councilman Evans
and seconded by Councilwoman McGinnis .

Resolution 79-33 accepting the bid of Binswanger Glass Company for furnish-
ing and installing two (2) doors at the end of the entrance lobby in City
Hall at a cost of $1 , 172 . 00 was approved on a motion made by Councilwoman
McGinnis and seconded by Councilman Evans .

Resolution 79-34 accepting the bid of Harris Carpet and Interiors for fur-
nishing materials and labor to install floor covering at the Fire Training
Classroom and office ($1 , 579. 76 - 196 square yards at $8 . 06 per square yard
installed) was approved on a motion made by Councilman Evans and seconded
by Councilman Combs .

Resolution 79-35 accepting the bid of Sabine Industries , Inc . for furnish-
ing necessary repairs to a jet machine truck (Unit #4040 used to flush
storm sewers) in the Street Division at a cost of 41 , 380. 00 was approved on
a motion made by Councilman Evans and seconded by Councilwoman _McGinnis .

Resolution 79-36 accepting the bid of U.E. C. Equipment Company for furnish-
ing one (1 ) automatic crane to be mounted on an existing pickup truck for
the Water Reclamation Division at a cost of ;3 ,479. 00 was approved on a
motion made by Councilwoman McGinnis and seconded by Councilman Evans.

Ordinance No . 79-8 appropriating funds for the '.Municipal Complex ;projects
was considered :

ENTITLED AN ORDINANCE APPROPRIATING $15, 100 , 000
FROM THE 14UN I C I PAL COMPLEX FUND TO THE VARIOUS
CONSTRUCTION PROJECTS STATED HEREIN; AND PROVID-
ING FOR SEVERABILITY.
The ordinance was approved on a motion made by Councilman Evans and secon-
ded by Councilwoman ::McGinnis.

Resolution 79-37 authorizing an amendment to the agreement with Milton Bell
and D. Rex Goode for providing architectural services for the 'Municipal
Auditorium Project for a total fee of 10p0' of construction costs not to
exceed $225, 000 was approved on a motion made by Councilwoman McGinnis and
seconded by Councilman Evans .

Mrs. Delia Harrington , 815 Willow Street , addressed Council to compliment
the placement of a street light at '.North and Willow Streets and to complain
about a dilapidated structure at 898 Grand, a rotten tree in the 700 Block
of Grand and also requested that the 2500-2900 Blocks of Grand be resur-
faced.
Mrs . :~Mary Beth Doerr , 7720 Forest Park Drive, addressed Council as a rep-
resentative of the United Appeals to request support by Council of the
Beaumont Association for Senior Citizens and asked that their funding by
the City be continued.

680 Prince , Front & Rear : In answer to questions by `.fir . Nichols , Mr.
Gardner stated the structures do meet the criteria of dilapidated struc-
ture as defined in the Dangerous Structures ordinance and recommended
they be demolished within 30 days.
Mrs . Fontenot , representing the National Association for Advancement of
People - owners, addressed Council to request that time be given her group
to demolish the front structure and repair the rear structure with salvage
materials.
After a lengthy discussion , Councilwoman McGinnis made a motion finding
the structure to be in violation of the dangerous structures ordinance
and ordering notification of the owner to either demolish or repair the
structure in 30 days ; Councilman Evans seconded the motion .

270 Orange (old Viaduct Furniture Company) . Mr. Gardner told Council this
structure does meet the definition of a dangerous structure and recommended
it be demolished in thirty (30) days.
Mrs. C. P. Rouse , owner , told Council she is in the process of obtaining
estimates for rehabilitation and demolition of the structure . She said
she would prefer to rehabilitate the structure for warehousing.
After a lengthy discussion , Councilman Combs made a motion finding the
structure to be in violation of the dangerous structures ordinance and
ordering notification of the owner to either demolish or repair the
structure in 30 days ; Councilwoman McGinnis seconded the motion .

865, 870 & 875 Peach : Mr . Gardner told Council all three structures meet
the criteria of dangerous structures as defined in the dangerous structure
ordinance. Ile said all three structures can be rehabilitated within 45
days . Mr . Gardner also told Council that all three houses were vacant when
posted but 865 Peach is now occupied. Ile said Reverend Hendricks for the
property owner , First Union rdissionary ,Baptist Church , has been contacted
about the non-compliance of the structures and told about violation of oc-
cupying posted structure.
Ile said Reverend Hendrick said it is the church ' s plan to demolish 870 Peach
and use salvage materials to bring, the other two into compliance within min-
imum standards .
After a lengthy discussion , Councilman Evans made a motion finding the
structures to be in violation of the dangerous structures ordinance and
ordering notification of the owner to either demolish or repair them within
45 days; Councilman Combs seconded the motion.

3425 Dickinson : 'Mr . Jardner told Council that the structure does meet the
definition of a dangerous structure and recommended demolition in thirty
(30) days . An affidavit received from one of the two owners stated that
they are financially unable to rehabilitate or demolish the structure.
Councilman Evans made a motion finding the structure in violation of the
dangerous structures ordinance and ordering the owner to demolish it and
authorizing city forces to demolish after 30 days ; Councilman Combs secon-
ded the motion .

857 Wiess : Mr. Gardner told Council this structure does meet the defini-
tion of a dangerous structure but can be rehabilitated in thirty to forty-
five (30 to 45) days .
After a lengthy discussion , Councilman Evans made a motion to condemn the
structure and allow forty-five days to rehabilitate it into compliance.
Mayor Meyers seconded the motion.

Motion failed to pass .
Councilman Evans amended his motion finding the structure to be in viola-
tion of the dangerous structures ordinance and ordering notification of
the owner to either demolish or repair the structure within forty-five (45)
days ; Councilman Combs seconded the motion .

2195 2.atcliff : Mr. Gardner stated this structure does meet the definition of
dangerous structure but can be rehabilitated within forty-five (45) days.
After a brief discussion , Councilwoman McGinnis made a motion finding the
structure to be in violation of the dangerous structures ordinance and or-
dering notification of the owner to either demolish or repair the structure
within thirty (30) days ; motion was seconded by Councilman Combs .

1482 & 1486 Concord : Mr. Gardner stated both structures meet the defini-
tion of dangerous structure but both can be rehabilitated; however , a
letter from property owners , Mr. & Mrs . DeWitt Bennett , states they are
not financially able to demolish or repair these structures.
After a brief discussion , Councilwoman McGinnis made a motion finding the
structures in violation of the dangerous structures ordinance and ordering
the owner to demolish it and authorizing city forces to demolish after
thirty (30) days. Councilman Evans seconded the motion.

1327 & 1337 Laurel : Mr . Gardner stated both structures meet the definition
of dangerous structure. He stated violations notices dated back to the
Fall of 1976 and two work permits have been issued. Mr . Nichols told Coun-
cil that tor . J. J. DeFatta, owner , had asked him to request more time be
granted before demolition.
After a brief discussion, Council.E,ijman McGinnis made a motion finding the
structures in violation of the dangerous structures ordinance and ordering
the owner to demolish them and authorizing city forces to demolish after
thirty (30) days. Councilman Combs seconded the motion.

2356 Pennsylvania: Mr. Gardner told Council the structure has been more
than fifty (.500) percent destroyed by fire and does meet the definition
of dangerous structure. He said the owner has been given a demolition
permit and recommended it be demolished within thirty (30) days.
Councilwoman "McGinnis made a motion finding the structure in violation of
the dangerous structures ordinance, ordering the owner to demolish it and
authorizing city forces to demolish after thirty (30) days ; Councilman
Evans seconded the motion..

3090 Donahue: '.'fir. Gardner told Council this structure has been destroyed
by fire and does meet the definition of dangerous structure . He said the
owner has obtained a demolition permit and that demolition should be com-
pleted within thirty (30) days.
Councilwoman McGinnis made a motion finding the structure in violation of
the dangerous structures ordinance, ordering the owner to demolish it and
authorizing city forces to demolish after thirty (30) days ; Councilman Combs
seconded the motion.
