HELD JUNE 27, 1978
BE IT REMEMBERED THAT the City Council of the City of Beaumont , Texas,
met in regular session this the 27th day of June, 1978 , with the fol-
lowing present :

The Invocation was given by the Reverend Tommy Long, First Church of God.
The Pledge of Allegiance was led by Councilman Combs.

The Minutes of the regular City Council session held June 20, 1978, were
approved on a motion made by Councilwoman McGinnis and seconded by Coun-
cilman Evans.

Mayor Meyers welcomed students from Nederland High School to the meeting.
Mayor Meyers issued the following proclamation : "Pete Yafer Day in Beau-
mont" - June 29, 1978 . (Mr. Yafer will be 108 years old on this day. )

Resolution 78-225 authorizing the award of bid to Keown Supply Company for
furnishing hot mixed cold laid asphaltic material on an annual contract
basis at $15 . 00 Per ton was approved on a motion made by Councilman Evans
and seconded by Councilman Combs .

Resolution 78-226 authorizing the award of bid to Gulf Coast Industrial
Contractors , Inc. in the amount of $397, 082. 75 for the construction of
the Riverfront Blvd. CAP Project 070-74-012 was approved on a motion made
by Councilwoman McGinnis and seconded by Councilman Evans.

Ordinance No . 78-71 abandoning a 30' x 157 ' alley located between Block 56
of the Cartwright Addition and the Southern Pacific Railroad and retaining
a general utility easement was considered :

ENTITLED AN ORDINANCE VACATING AND ABANDONING
A THIRTY FOOT (301 ) BY ONE HUNDRED FIFTY-
SEVEN FOOT (1571 ) ALLEY IN THE CART`'VRIGHT
ADDITION IN BEAUMONT, JEFFERSON COUNTY, TEXAS,
AS DESCRIBED HEREIN, PROVIDING THAT SUCH
ALLEY BE RETAINED AS A GENERAL UTILITY EASE-
MENT.

The ordinance was approved on a motion made by Councilwoman McGinnis and
seconded by Councilman Combs.

Ordinance No . 78-72 revising speed limits on Gladys Street between Dowlen
Road and Major Drive was considered:
ORDINANCE NO. 78-72
ENTITLED AN ORDINANCE AMENDING CHAPTER 37 ,
SECTION 37-58 . 2 TO CHANGE THE SPEED LIMIT
ON A PORTION OF GLADYS AVENUE; PROVIDING
FOR SEVERABILITY, PROVIDING FOR REPEAL
AND PROVIDING A PENALTY.
The ordinance was approved on a motion made by Councilman Combs and secon-
ded by Councilman Evans .

Resolution 78-227 authorizing the City to enter into an agreement with
Don Streety Enterprises to participate in the paving of Shakespeare Drive
and the construction of a 12-inch water line in Dowlen West , Unit XVII
Subdivision ; and to enter into an agreement with Schaumburg & Polk, Inc.
to perform the engineering services was approved on a motion made by
Councilman Evans and seconded by Councilman Combs .

Resolution 78-228 authorizing the acceptance for City maintenance the
water, street and sewer improvements in Calder Highlands Extension,
Blocks 39, 40, 43 , and 44 (portion of Coolidge) was approved on a motion
made by Councilwoman McGinnis and seconded by Councilman Evans .

Resolution 78-229 appointing Ken Parker to replace W. C. Ross , Jr. , as
a member to the Airport Advisory Committee was approved on a motion made
by Councilman Combs and seconded by Councilwoman McGinnis .

The third and final reading of Ordinance No. 78-73 granting the Atchison ,
Topeka and Santa Fe Railway Company a renewal franchise for Track No. 91
in Blanchette Street between Neches and Park was held :
ORDINANCE NO. 78-73
AN ORDINANCE GRANTING TO THE ATCHISON, TOPEKA AND SANTA FE
RAILWAY COMPANY, ITS SUCCESSORS , ASSIGNS AND LESSEES , THE
RIGHT AND PRIVILEGE TO MAINTAIN AND OPERATE AN INDUSTRY
TRACK FROM A POINT IN BLANCHETTE STREET SOUTHEASTERLY OF
BLOCK 69, OF THE OLD TOWN OF BEAUMONT CONNECTING WITH THE
PARALLEL TO THE MAIN TRACK OF THE ATCHISON, TOPEKA AND
SANTA FE RAILWAY COMPANY NOW CONSTRUCTED IN SAID STREET
AND RUNNING DOWN SAID BLANCHETTE STREET TO A POINT OPPOSITE
LOT NO. 357 IN SAID BLOCK IN THE CITY OF BEAUMONT, JEFFERSON
COUNTY, TEXAS, IN ACCORD WITH EXHIBIT ATTACHED HERETO; PRO-
VIDING THAT SAID TRACK SHALL BE USED ONLY FOR THE PURPOSE OF
LOADING, UNLOADING AND SWITCHING TO INDUSTRIAL TRACKS SERVING
COMMERCIAL ENTERPRISES ; PROVIDING REGULATIONS AND RESTRICTIONS

FOR THE USE OF SAID TRACK; PROVIDING THAT SUCH MAINTENANCE
AND OPERATION BE IN ACCORDANCE WITH THE CHARTER AND ORDI-
NANCES OF THE CITY AND THAT CERTAIN MAINTENANCE WORK SHALL
BE DONE AT THE DIRECTION OF THE CITY ENGINEER; PROVIDING
FOR THE ACCEPTANCE AND FEE HEREUNDER; PROVIDING THAT THIS
FRANCHISE IS SUBJECT TO THE CHARTER AND ORDINANCES OF THE
CITY OF BEAUMONT AND PROVIDING FOR TERMINATION AND FAILURE
TO USE THE TRACK FRANCHISED HEREUNDER; PROVIDING FOR TERMI-
NATION OF THIS FRANCHISE ON JUNE 14 , 1979 AND THE RESTORA-
TION OF SAID STREETS WITHIN NINETY (90) DAYS THEREAFTER;
AND PROVIDING FOR INDEMNIFICATION OF THE CITY OF BEAUMONT.
The ordinance was approved on a motion made by Councilman Evans and se-
conded by Councilman Combs.

Mr. Robert Williams, Sr. , 1022 Evalon, addressed Council to complain of
weeds , dilapidated structures , and ditches needing City attention .

There being no further business , the meeting was recessed before continu-
ing with the City Council Workshop Session.
