BE IT REMEMBERED that the City Council of the City of Beaumont , Texas,
met in regular session this the 13th day of June, 1978 , with the follow-
ing present :

The Invocation was given by the Reverend Perry Busby, Jr. , Borden Chapel
Baptist Church.
The Pledge of Allegiance was led by Councilwoman McGinnis.

The Minutes of the regular City Council session for June 6, 1978 , were
approved on a motion made by Councilwoman McGinnis and seconded by Coun-
cilman Combs.

Ordinance No . 78-66 appropriating $25,678 from the Airport Construction
Fund, authorizing the advertising for bids for construction of three (3)
taxiways , and authorizing the execution of two (2) lease agreements with
Delta Industrial Construction Company and T-Hangars , Inc . for new T-hangars
at the Municipal Airport was considered :

ENTITLED AN ORDINANCE AMENDING THE BUDGET
OF THE CITY OF BEAUMONT FOR THE FISCAL
PERIOD COMMENCING OCTOBER 1 , 1977 , AND
ENDING SEPTEMBER 30, 1978 , BY APPROPRIATING
$25, 678 FROM UNAPPROPRIATED AIRPORT CON-
STRUCTION FUNDS TO AN ACCOUNT FOR THE
MUNICIPAL AIRPORT; AUTHORIZING THE CITY
MANAGER TO EXECUTE TWO (2) LEASE AGREEMENTS
FOR THE CONSTRUCTION OF HANGARS, ONE WITH
DELTA INDUSTRIAL CONSTRUCTION COMPANY AND THE
OTHER WITH T-HANGARS , INC. FOR THE CONSTRUC-
TION OF HANGARS ; PROVIDING FOR SEVERABILITY
AND PROVIDING FOR REPEAL.
The ordinance was approved on a motion made by Councilman Evans and se-
conded by Councilwoman McGinnis .

Resolution 78-209 authorizing Change Order No. 10 in the amount of $1 , 523 .
to the H. A. Lott contract for the Civic Center Project (70-74-011) to
provide two 41' telephone conduits in lieu of 2" conduits (to provide video
tape capabilities) was approved on a motion made by Councilwoman McGinnis
and seconded by Councilman Evans .

Ordinance No. 78-68 allocating and appropriating $1 , 000 Unallocated Street
Construction Funds to the Pearl Street Overlay Project and authorizing final
payment to F. Gatlin Company, Inc . in the amount Of $18 , 545.46 was consid-
ered :

ENTITLED AN ORDINANCE AMENDING THE BUDGET
OF THE CITY OF BEAUMONT FOR THE FISCAL

Resolution 78-210 authorizing the acceptance for City maintenance the
street , water and sewer improvements in Beaumont Medical Plaza (Medical
Plaza & Hospital Drive) was approved on a motion made by Councilman Evans
and seconded by Councilwoman McGinnis .

Resolution 78-211 authorizing an amendment with Turner , Collie & Braden
for the design and construction pahse services for the Visual Approach
Slope Indicator (VASI ) system at the Beaumont Municipal Airport in an
amount not to exceed $5, 960. 00 (90% FAA - 10% local) was approved on a
motion made by Councilwoman McGinnis and seconded by Councilman Combs.

Resolution No . 78-212 approving proposed improvements at Fair Park to be
accomplished over the next three years by the YMBL in accordance with their
lease (approximate cost of improvements - $200, 000+) was approved on a
motion made by Councilman Williams and seconded by Councilman Evans .

Resolution 78-213 authorizing the City Manager to execute a cooperation
agreement with the Beaumont Housing Authority for participation and co-
operation to further low cost housing was approved on a motion made by
Councilwoman McGinnis and seconded by Councilman Combs .

Resolution 78-214 authorizing the City Manager to execute a fifteen (15)
year lease agreement with the Beaumont Boat Club for property presently
occupied by the Boat Club was approved on a motion made by Councilman
Evans and seconded by Councilman Combs.

Resolution 78-215 appointing Ed Dix, Mrs . Leonard (Suzie) Juncker , Kenneth
Baugh and Delores Lawless and reappointing Charles V. Hill , Carl Levy,
Shirley Gleason, A. B. Bernard, Jr. , R. E. Bistline, David Taylor and
Clarence Jackson to the Community Development Block Grant Advisory Com-
mittee for two-year terms was approved on a motion made by Councilwoman
McGinnis and seconded by Councilman Evans .

Resolution 78-216 authorizing payment to Westinghouse Electric Company in
the amount of $4, 800. 00 for emergency repairs to the 20 MGD raw sewage
pump was approved on a motion made by Councilman Evans and seconded by
Councilwoman McGinnis .

PUBLIC BENEFIT HEARING
STREET ASSESSMENT PAVING PROJECT
Mr . Earl Deland, Director of Public Works Department , reviewed the proposed
improvements to some streets in the Bob Street Addition & Pear Orchard
Estates Addition.
Mr . Lane Nichols, Assistant City Attorney, told Council all legal require-
ments had been met for the project .
Mr. Buddy Dedman, City Tax Department , stated to Council that he had re-
viewed the properties involved and that in no case does the assessment
exceed the enhancement to these properties .
Mrs. Brenda Spivey, 6010 Chandler Drive, addressed Council on behalf of
her father , Mr. Joe Harris, 1740 Rena. She told Council her father is
not opposed to the inclusion of his portion of the street in this pro-
ject but cannot afford the assessment because he is retired and on a
fixed income.
The public hearing was closed on a motion made by Councilwoman McGinnis
and seconded by Councilman Williams .

Ordinance No. 78-67 providing for the satisfaction of all stipulations in
connection with a benefit hearing on assessment paving was considered:

ENTITLED AN ORDINANCE CLOSING THE HEARING GIVEN TO
THE APPARENT ABUTTING PROPERTY OWNERS ON OPAL & RAVEN
STREET FROM RENA STREET TO VIRGINIA ( (DOM TERRACE) ,
LUCILLE & RENA STREETS FROM BOB STREET WESTWARD
THROUGH BLOCKS 1 & 2 (BOB STREET ADDITION) AND CADILLAC,
FLAMINGO AND PORTIONS OF RENA AND SARAH AS TO SPECIAL
BENEFITS TO ACCURE TO SAID PROPERTY AND THE TRUE OWNERS
THERE OF BY VIRTUE OF THE IMPROVEMENTS DESCRIBED HEREIN,
AND TO THE ACCURACY, SUFFICIENCY, REGULARITY, AND VAL-
IDITY OF THE PROCEEDINGS AND CONTRACTS IN CONNECTION
WITH SAID IMPROVEMENTS AND ASSESSMENTS , AND ANY "MANNER
OR THING CONNECTED THEREWITH; OVERRULING AND DENYING
ALL PROTESTS AND OBJECTIONS OFFERED, FINDING AND DE-
TERMINING SPECIAL BENEFITS TO EACH PARCEL OF PROPERTY
AND THE OWNERS THEREOF EQUAL TO OR EXCEEDING THE AMOUNT
OF THE RESPECTIVE ASSESSMENTS AGAINST THE SAME; FINDING
THE REGULARITY OF ALL PROCEEDINGS, AND THE PERFORMANCE
OF ALL PREREQUISITES TO FIXING THE ASSESSMENT LIENS ,
ASSESSMENT, FIXING A CHARGE AND LIEN AGAINST SAID
PROPERTIES SO ABUTTING SAID STREET AND THE TRUE OWNERS

seconded by Councilwoman McGinnis.

Mr. J. C. Leggett , 1849 Washington Blvd. , addressed Council to ask the
status of the Gulf States Utilities rate increase case.
