Chaison Addition (requested by James Allred) was considered : March 14, 1978 ORDINANCE NO. 78-33 ENTITLED AN ORDINANCE AMENDING ORDINANCE NO. 78-20 BY INCLUDING THE VACATING AND ABANDONMENT OF A FIFTEEN FOOT (15 ' ) GENERAL UTILITY EASEMENT IN THE W. Question : Ayes: All Nayes : None -000- Resolution 78-91 granting a permit to Lamar University to place an electrical line along the City street right-of-way of East Virginia from University Drive to Callaghan Street was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans . Question : Ayes: All Nayes : None -000- Resolution 78-92 authorizing the City Manager to enter into an agreement with Phelan Investments to participate in the paving of Willow Bend Street and to enter into an agreement with Matt M. Racki, Civil Engineering Con- sultant , to perform the necessary engineering services for this street project (City share estimated at $30, 910. 30) was approved on a motion made by Councilman Cash and seconded by Councilwoman McGinnis. Question.: Ayes: All Nayes : None -000- Resolution 78-93 authorizing the employment of American Real Estate as ap- praiser for right-of-way work in conjunction with the Washington Boulevard Project (from IH-10 to Langham Road) cost not to exceed $4 , 500, and authori- zing staff to begin negotiations for acquisition of right-of-way was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans . Question : Ayes: All Nayes: None -000- Resolution 78-94 authorizing the City Attorney to institute proceedings in eminent domain against all parties owning an interest in the properties located at 1930, 1940, 1950, 1960, and 1970 Brooklyn Street was approved on a motion made by Councilman Evans and seconded by Councilman Cash. Question : Ayes: All I Nayes : None -000- Resolution 78-95 taking exception to the imposition of Part II of the EPA's proposed interim primary drinking water regulations was read in full : RESOLUTION .78-95 WHEREAS, the Environmental Protection Agency has proposed interim primary drinking water regulations designed to control organic contaminants in drinking water; and, WHEREAS, Part II of said regulations further provides that if any synthetic organic chemicals are present in drinking water, political subdi- visions must provide a treatment technique using granular activated carbon activated carbon filters, which said technique would have an economic impact on the City of Beaumont . NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City of Beaumont does not support Part II of the proposed regula- ties because said regulations do not establish a maximum contaminant level for synthetic organic chemicals, but merely provides that if any such syn- March 14, 1978 thetic organic chemicals are present in drinking water, cities are mandated to treat said drinking water by the use of granular activated carbon filters. The City believes that insufficient evidence exists to support the assumption that extremely low concentrations of synthetic organic chemicals pose a pub- lic health hazard or that the proposed treatment technique will provide ade- quate protection. Until such time as sufficient information is available to determine the cost effectiveness of the granular activated carbon filters and maximum contaminant levels applicable in the instance of synthetic organic chemicals in drinking water, the City of Beaumont must question the advisa- bility of imposing Part II of the regulations because such regulations will place an undue economic burden on the City of Beaumont . Question : Ayes: All Nayes: None -000- Resolution 78-96 authorizing Underwood, Neuhaus and Company as financial advisors for the sale of $7, 740, 000 in public improvement bonds and $1 , 000,000 in waterworks system revenue bonds was approved on a motion made by Council- man Cash and seconded by Councilwoman McGinnis . Question: Ayes : All Nayes : None -000- Ordinances authorizing the sale of $7, 740, 000 Public Improvement Bonds and $1 , 000,000_,Raterworks fiystem Revenue Bonds were held until a recommendation has been made by Staff and representatives of Underwood, Neuhaus and Company. -000- Mr. Martin Zoller , 655 Zavalla Drive, addressed Council to complain that a building permit had been issued for a home to be constructed on what he feels is an undersized lot in Highland Place Addition and requested that construction be stopped. Staff is to investigate and later report . Mr . L. P. Kinnear, 2395 Park Street , addressed Council to again complain about rates charged by Entex. Mr. Ed Rollins, 725 Zavalla, addressed Council in agreement with. commments made by Mr. Zoller. Mrs. J. W. Martin, 3895 Irving, addressed Council to complain about rates charged by Entex, the quality of the water in her area, and the poor con- ditions of her street . -000- Orr nance No. 78-34 authorizing the issuance of $1 , 000,000. 00 City of Beaumont , Texas, Waterworks System Revenue Bonds, Series 1978-A was con- sidered: ORDINANCE NO. 78-34 ORDINANCE AUTHORIZING THE ISSUANCE OF $1 ,000,000 CITY OF BEAUMONT, TEXAS , WATERWORKS SYSTEM REVENUE BONDS, SERIES 1978-A. The ordinance was approved on a motion made by Councilman Williams and seconded by Councilwoman McGinnis. Question : Ayes : All Nayes : None March 14, 1978 Ordinance No. 78-35 authorizing the issuance of $7 ,740, 000 Public Improve- ment Bonds was considered: ORDINANCE NO. 78-35 ORDINANCE AUTHORIZING THE ISSUANCE OF $7,740, 000 CITY OF BEAUMONT, TEXAS, PERMANENT IMPROVEMENT BONDS, SERIES 1978. The ordinance was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Cash.
