HELD DECEMBER 13 , 1977
BE IT REMEIMBERED that the City Council of the City of Beaumont , Texas,
met in regular session this the 13th day of December, 1977 , with the
following present :

The Invocation was given by the Reverend Earl Dawson, Forest Park United
�4ethodist Church.
The Pledge of Allegiance was led by Councilman Cash.

The Minutes of the regular City Council sessions held November 22 and
November 29, 1977 were approved on a motion made by Councilwoman McGinnis
and seconded by Councilman Cash.

Resolution 77-356 authorizing the award of bid to Eastman Kodak Company
for furnishing a microfilm reader printer for the Tax Division at a cost
of $3, 302. 85 was approved on a motion made by Councilman Cash and seconded
by Councilman Evans.

Resolution 77-357 authorizing the award of a contract to Olshan Demolish-
ing Company, Inc. for the demolition and removal of structures for the
Irving Street Underpass Project, No . 071-74-141 , (cost of contract is
$21 , 888 . 00) was approved on a motion made by Councilman Cash and seconded
by Councilwoman McGinnis.

Resolution 77-358 authorizing the award of bid to Westinghouse Electric
Corporation for furnishing five (5) well motor starters for the Loeb �'lell
at a cost of $55, 828 . 00 was approved on a motion made by Councilman Cash
and seconded by Councilwoman McGinnis.

Resolution 77-359 authorizing the reappointment of Clyde Vincent , Tilden
Nesmith, Charlotte Dezelle, Jack Greer , Floyd Dixon and Clifford Hardman
and appointing Ted Binks to replace Conrad r�2ang for two-year terms to the
Parks Advisory Commission ; the reappointment of Mack Fulbright , Betty
Byram, Harvey C. Smith, Mrs. Ralph 7ooster, Rex Goode , Reverend Joe S.
Barnes, Dr. Howard Wilcox and alternates Eddie Seniguar and Mrs. C. L.
Whittington for three-year terms to the Housing Board of Appeals; and
reappointment of Forrest Griffin , Mrs. Dora Nisby, Mrs. W. C. Tyrrell , Jr.
and Dr. Brock Brentlinger for two year terms to the Library Commission
was approved on a motion made by Councilman Evans and seconded by Council-
woman McGinnis.

Ordinance No. 77•-126 revising the speed limit on Fannett Road from Fourth
Street to St . James Boulevard by amending Section 37-58 . 2 of the Code of
Ordinances was considered :
ORDINANCE 210. 77-126
ENTITLED AN ORDINANCE XIIENDING SECTION 37-58 . 2
BY CHANGING THE SPEED LIMIT ON FANNETT ROAD
WHEN SIGNS ARE ERECTED GIVING NOTICE THEREOF;
PROVIDING A PENALTY; PROVIDING FOR SEVERABILITY
AND PROVIDING FOR REPEAL.
The ordinance was approved on a motion made by Councilman Cash and se-
conded by Councilman t'illiams.

Resolution 77-360 authorizing the execution of an agreement with the
State Department of Highways and Public Transportation for traffic signal
improvements at the intersection of North Pearl and North Streets was ap-
proved on a motion made by Councilman Evans and seconded by Councilwoman
McGinnis .

Resolution 77-361 authorizing the City manager to execute a release of
judgment against Alvin G. Randolph ($10. 00) was approved on a motion made
by Councilman Cash and seconded by Councilman Evans.

City Manager reminded Council of the bus tour of certain Census Tracts to
be considered for funding through the Community Development Block Grant .

Mrs. Bernice Hebert , 2020 Fillmore, addressed Council to request that
Yancey ' s Day Care Nursery at 4365 El Paso not be closed because of its
improper zoning use i,t the R-1 area.
Mrs. Phyllis Yancey, 4365 El Paso, told Council she was not aware of the
zoning restrictions when she received her license to operate the nursery.
A lengthy discusseo?. was held concerning the need for day care centers
and also the need to enforce the zoning ordinance. A special use permit
concept was discussed for nursery-day care centers in R-1 areas where the
location is probably needed more. Staff is to study this and was also
instructed to explain procedures for request of zone change to Mrs.
Yancey for the operation of her day care nursery.

Mr. Willard Hall , Beaumont Heritage Society, addressed Council to urge
that they give special attention to the McFarland Home which is being
considered for use as a Senior Citizens Center and also Census Tract
15J when making the tour today.

Mr. L. P. Kinnear, 2395 Park Street , addressed .Council against the sale
of alcoholic beverages on Lamar University Campus and also to complain
about Entex and their high utility rates.

Mr. J. C. Leggett , 1849 Washington Boulevard, addressed Council to com-
plain about the high rates charged by Entex, compliment Council on the
paving overlay of some City streets, and to ask that no new railroad
line be allowed down Blanchette Street .

There being no further business, the meeting was recessed before continu-
ing with the City Council Workshop Session.
