Anne ' s Catholic Church, The Pledge of Allegiance was led by Councilwoman McGinnis. --000- The Mayor issued the following proclamations : "Zilpah Cousins Day in Beaumont" - September 6, 1977 and "Lamar University Cardinal Football Day in Beaumont" - September 10, 1977 . _000- The Minutes of the regular City Council session held August 30, 1977 , were approved on a motion made by Councilman Cash and seconded by Councilman Evans. Question : Ayes : All Nayes : None -000 Resolution 77-254 authorizing the award of bid and the execution of a one- year contract (September 6, 1977 through September 5, 1978) with Goodyear Tire and Rubber Company for furnishing tires for use by the Fleet Division was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Cash. Question : Ayes : All Nayes : '_None -000- Resolution 77-255 authorizing the award of bid for 4400' of underground wire for the Fair Park Arena, CAP 45-P-01 , 073-74-021 , to Graybar Electric in the amount of $2 , 655. 36, was approved on a motion made by Councilman Evans and seconded by Councilwoman McGinnis . Question : Ayes : All Nayes : None -000- Ordinance No. 77-95 appropriating $281 , 503 from Accounts 79-105 and 79-107 and the General Fund to the Fire Department 's Budget , Activity No. 34 to provide funds for nine (9) Grade I Firemen was considered: ORDINANCE NO. 77-95 ENTITLED AN ORDINANCE AMENDING THE BUDGET OF THE -CITY OF BEAUMONT FOR THE FISCAL PERIOD COMMENCING OCTOBER 1 , 1976, AND ENDING SEPTEMBER 30, 1977, BY APPROPRIATING -139- September 6, 1977 $125, 000 FROM ACCOUNT NO. 79-105, $23 ,400 FROM ACCOUNT NO. 79-107 AND $133 , 103 FROM THE UNAPPROPRIATED FUND BALANCE OF THE GENERAL FUND INTO THE FIRE DEPARTMENT ' S BUDGET ACTIVITY NO. 34. The ordinance was approved on a motion made by Councilman Evans and secon- ded by Councilwoman McGinnis . Question : Ayes : All Nayes : None -000- Ordinance No. 77-96 appropriating $133 , 070 from Accounts 79-105 and 79-107 to the Police Department ' s Budget , Activity No. 31 to provide funds for Police personnel who were replaced in the budget was considered : ORDINANCE NO. 77-96 ENTITLED AN ORDINANCE AMENDING THE BUDGET OF THE CITY OF BEAUMONT FOR THE FISCAL PERIOD COMMENCING OCTOBER 1 , 1976, AND ENDING SEPTEMBER 30, 1977 , BY APPROPRIATING $125, 000 FROM ACCOUNT NO. 79-105, AND $8, 970 FROM ACCOUNT NO. 79-107 INTO THE POLICE DEPARTMENT"S BUDGET ACTIVITY NO. 31 . The ordinance was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Cash. Question : Ayes : All Nayes : None -000- Resolution 77-256 authorizing the City Manager to submit an application to Urban Mass Transportation Administration for funding of the Orleans Mall Construction Project (CAP 45-ST-06) and purchase of various needed capital items for the new Transit Maintenance Facility was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Cash. Question : Ayes : All Nayes : None Public Hearing for this grant application was scheduled for October 18 , 1977 . --000- Ordinance No. 77-97 amending the existing City Ordinance, Chapter 37 , Section 37-58 . 1 , by adding a 20 mile-per-hour school zone was considered : ORDINANCE NO. 77-97 ENTITLED AN ORDINANCE AMENDING CHAPTER 37 , SECTION 37-58 . 1 OF THE CODE OF ORDINANCES TO ADD A SCHOOL ZONE ON A PORTION OF EAST CALDWOOD DRIVE ; PROVIDING FOR SEVERABILITY, PROVIDING FOR REPEAL AND PROVIDING FOR A PENALTY. The ordinance was approved on a motion made by Councilman Evans and seconded by Councilwoman McGinnis . Question : Ayes : All Nayes : None -000_ Ordinance No . 77-98 amending Chapter 9a of the Code of Ordinances, creating a Municipal Civil Defense Council was considered : ORDINANCE NO. 77-98 ENTITLED AN ORDINANCE AMENDING CHAPTER 9a OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT CREATING A MUNICIPAL CIVIL DEFENSE -140- September 6, 1977 COUNCIL; PROVIDING THE POWERS OF THAT COUNCIL; CREATING THE OFFICE OF CIVIL DE- FENSE DIRECTOR; CREATING AN OPERATIONAL ORGANIZATION; GRANTING NECESSARY POWERS TO COPE WITH EMERGENCIES THREATENING LIFE AND PROPERTY IN THE CITY OF BEAUMONT; AUTH- ORIZING COOPERATIVE AND MUTUAL AID AGREE- MENTS FOR RELIEF WORK BETWEEN THIS AND OTHER CITIES OR COUNTIES ; PROHIBITING UN- AUTHORIZED WARNING AND ALL-CLEAR SIGNALS ; REPEALING ORDINANCES INCONSISTENT HEREWITH; PROVIDING FOR SEVERABILITY; PRESCRIBING A PENALTY AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. The ordinance was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans . Question : Ayes : All Nayes : None -000- Resolution 77-257 granting a pipeline permit to Lyco Oil Corporation for a 2" oil pipeline across and along Comstock Road was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans. Question : Ayes : All Nayes : None -000- Resolution 77-258 reappointing Tom Livesay to the Electrical Board of Re- view for a one-year term was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Cash. Question : Ayes : All Nayes : None -000- Resolution 77-259 authorizing the City Manager to execute an amendment to the contract between the City of Beaumont and the International Association of Fire Fighters, Local #399 (51; pay increase and to dependent insurance coverage/1001/0 paid by City) was approved on a motion made by Councilman Cash and seconded by Councilman Evans. Question : Ayes : All Nayes : None -000- PUBLIC HEARING ON PROPOSED BUDGET FOR THE FISCAL YEAR 1977-78 was declared open. City Manager McDaniel made opening remarks concerning the proposed budget . Mr . Ben Rogers , 2030 Thomas Road, addressed Council to suggest that the City ask the State of Texas for the $6, 000, 000 City ' s share of the Lamar Freeway Project be retained by the City rather than transferred to the State until the project is begun so that the City can benefit from the earnings from interest . Mr. Don Kelly, 6650 Prutzman , 21C, representing the South East Texas Arts Council , addressed Council to request that consideration be given to di- recting the additional to Hotel/Motel Occupancy Tax to the South East Texas Arts Council . City Manager McDaniel requested that the Arts Council submit a budget prior to January 1st so that it can be considered at the same time. the Visitors and Tourism Bureau Budget is considered. Councilman Cash reminded that he requested that the entire 41 Hotel/Motel Occupancy Tax be considered in January before any commitments are made.
