HELD JUNE 7, 1977
BE IT REMEMBERED that the City Council of the City of Beaumont , Texas, met
in regular session this the 7th day of June, 1977, with the following pre-
sent :

The Invocation was given by the Reverend Robert Lee Jones, Christ Gospel
Church.
The Pledge of Allegiance was led by Councilwoman McGinnis .

Mayor Ritter issued the following proclamations : "Miriam Widman Rowley
Day in Beaumont" - June 15, 1977; "Vocational Nurses Week in 'Beaumont"
June 12-18, 1977; and "New Beaumont Retirement Hotel Day in Beaumont"
June 9, 1977.

The Minutes of the regular City Council session held May 31, 1977, were
approved on a motion made by Councilman Cash and seconded by Councilwoman
McGinnis .

Resolution 77-162 authorizing the advertising for bids for the construction
of the Pearl/Orleans Connector (CAP 45-ST-03/071-74-151) was approved on a
motion made by Councilman Cash and seconded by Councilwoman McGinnis .

Resolution 77-163 authorizing the award of bid and the execution of a con-
tract with Keown Supply Company for furnishing oyster shell at a cost $5 . 65
per cubic yard from June 9, 1977 through April 20, 1978 was approved on a
motion made by Councilman Evans and seconded by Councilman Cash.

Resolution 77-164 authorizing the award of bid to Hi-Way Equipment Company
Inc . for furnishing one (1) excavator (mounted on a crawler) for use in
the Street Division and at a cost of $77, 520. 00 was approved on a motion
made by Councilman Williams and seconded by Councilwoman McGinnis .

Ordinance No. 77-59 adopting the rezoning of that portion of the City gener-
ally described as the "South End Rezoning Study" area was considered:

THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, IN
CONFORMITY WITH THAT CERTAIN MAP ENTITLED
"SOUTH END REZONING STUDY, SECTION 1" , DATED
MAY 16 , 1977, INSOFAR AS BOUNDARIES MAY BE
WITHIN T4E PERIMETERS OF SAID "SOUTH END RE-
ZONING STUDY, SECTION I" ITAP, SAVE- AND EXCEPT
A PORTION THEREOF AS DESCRIBED HEREIN; INCOR-
PORATING BY REFERENCE SAID MAP IN THIS ORDI-
NANCE; PROVIDING FOR SEVERABILITY; AND PROVID-
ING A PENALTY.

i,Jr. Anthony Brocato, attorney representing Mr . John Blackwell , owner of
43 acres presently zoned I-1 and excluded from the above ordinance, addressed
Council to request that he be allowed to address them in Workshop Session.

Resolution 77-165 authorizing the City Manager to enter into a contract
with Schaumburg & Polk, Inc to provide complete engineering services for
the replacement of water lines in Census Tract 17, Community Development
Block Grant program, was approved on a motion made by Councilwoman McGinnis
and seconded by Councilman Cash.

Resolution 77-166 authorizing the acceptance, for City maintenance, the
water, sanitary sewer, storm sewer, and concrete pavement improvements in
Marshall Place Addition Lots 1-5, Block 1 ; Lots 1-10, Block 2 ; and Lots 1-13 ,
Block 3 (Marshall Place Drive) was approved on a motion made by Councilwoman
McGinnis and seconded by Councilman Evans.

Resolution 77-167 authorizing the City Manager to sign a lien release to
D.P. and Ruby L. Aplon for the release of an assessment lien filed against
Lots 22 , 23 and the west one-half of Lot 21, Block 3 , Virginia Estates Ad-
dition under the City ' s Assessment Paving Program (lien - $1250. 00) was
approved on a motion made by Councilwoman McGinnis and seconded by Council-
man Williams .

Resolution 77-168 authorizing final payment of $2, 128 . 00 to American Fence
Company for fencing of tennis courts at Alice Keith Park was approved on a
motion made by Councilman Cash and seconded by Councilman Evans .

Resolution 77-169 authorizing final payment of $15, 890. 00 to Virginia Erec-
tion Corp for cleaning and painting the exterior of the elevated water stor-
age tank at 3705 E. Lucas Street was approved on a motion made by Council-
woman McGinnis and seconded by Councilman Cash.

Resolution 77-170 authorizing the execution of a release of judgment to
Sidney S . Harris ($401 . 50) was approved on a motion made by Councilwoman
McGinnis and seconded by Councilman Evans .

Resolution 77-171 appointing Myrtle Corgey, City Clerk, as City representa-
tive to the Economic Opportunity Commission Board of Directors to replace
Jim Thompson was approved on a motion made by Councilwoman McGinnis and
seconded by Councilman Cash.

Resolution 77-172 approving the plans and specifications for the construc-
tion of a creative playground donated by the Junior Leage at the Athletic
Complex (approximate cost of the playground - $35, 000. 00) was approved on
a motion made by Councilwoman McGinnis and seconded by Councilman Evans.

Ordinance No. 77-60 authorizing the -transfer of $1, 000 from the Contingency
Fund Account 79-420 to the Police Department Supplies Account 31-201 for
the purchase of emergency number stickers (in connection with Criminal
Justice Grant ) was considered:,

FOR THE CITY OF BEAUMONT FOR THE PERIOD COMMENCING
OCTOBER 1 , 1976, AND ENDING SEPTEMBER 30, 1977,
BY TRANSFERRING $1 , 000 FROM ACCOUNT NUMBER 79-420
TO ACCOUNT NUMBER 31-201 .
The ordinance was approved on a motion made by Councilman Cash and seconded
by Councilwoman McGinnis .

�Kayor Ritter mentioned that Mr. Henry Homberg, Manager of the Tyrrell Park
Municipal Golf Course, is this year ' s recipient of the "Golden Deeds Award".

Representatives to American Seating Company, Messrs. Giles Courtney (General
Sales Manager for Amusement Sales) , John Sherry (Vice President for Amuse-
ment Sales) , and Hoke Peacock (a Beaumont attorney) addressed Council to
express concern for allegations made by the Heywood-Wakefield Company that
bid specifications for seating for the Exhibition Hall were written to favor
American Seating Company.
Mr. Fred Stace, salesman for Krueger Seating Company, addressed Council in
defense of both the way the bid documents and specifications were prepared
and Mr. Lalor, the Civic Center Manager.
Mr . Thad Heartfield, Beaumont attorney representing Heywood-Wakefield, ad-
dressed Council again to question whether the bid procedure followed was
correct .
Mr. Jack Combs, a former auditorium manager in Maryland now living in Beau-
mont , addressed Council to object as a citizen to the consideration of the
Heywood-Wakefield Company bid because of an engineer now designing their
equipment . He said this engineer, at the time with another seating company,
had designed equipment used in a building he managed and that the equipment
was unsatisfactory and could not be corrected.

Mr . Charlie G. Pounders , 8075 Washington, addressed Council to complain
about the poor condition of Washington Boulevard and asked that it be
corrected.
Ar. J. C . Leggett , 1849 Washington, addressed Council to complain about
the poor condition of several streets in the City -- especially the 2400
block of Broadway.

There being no further business, the meeting was recessed before continu-
ing with the City Council Workshop Session.
