HELD MAY 31 , 1977
BE IT REMEMBERED that the City Council of the City of Beaumont , Texas,
met in regular session this the 31st day of May, 1977, with the follow-
ing present :

The Invocation was given by the Reverend Phineas A. Washer, Westmiister
Presbyterian Church.
The Pledge of Allegiance was led by Councilman Cash.

Mayor Ritter issued the following proclamation : "National Tennis Week in
Beaumont" - June 18-26, 1977.

The Minutes of the regular City Council session held May 24, 1977, were
approved on a motion made by Councilwoman McGinnis and seconded by Council-
man Evans.

Resolution 77-153 authorizing the advertising for bids for the depository
of City funds for the period of October 1 , 1977 to September 30, 1979 was
approved on a motion made by Councilman Cash and seconded by Councilwoman
McGinnis.

Resolution 77-154 authorizing the award of bid to Centex Cement Corp. and
authorizing the execution of an annual contract (June 1 , 1977 through May
31 , 1978) for sacked cement at $2 .755 each for the Sewer Maintenance De-
partment was approved on a motion made by Councilwoman McGinnis and secon-
ded by Councilman Evans.

Resolution 77-155 authorizing the award of bids to Dixie Truck Center for
furnishing one (1) twin-boom wrecker for $10,270.00 and to Beaumont Motor
Company for furnishing one (1) six cubic yard dump truck for $14,030.80
for use in the Street Division was approved on a motion made by Council-
woman McGinnis and seconded by Councilman Evans.

Resolution 77-156 authorizing the award of bid to Benjamin Feld and Asso-
ciates for furnishing sixty-four (64) containers in various sizes for the
Solid Waste Division at a cost of $17, 527. 68 was approved on a motion made
by Councilman Cash and seconded by Councilwoman McGinnis.

An ordinance adopting the rezoning of that portion of the City generally
described as the "South End Rezoning Study" area was considered:
AN ORDINANCE
ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF
THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, IN
CONFORMITY WITH THAT CERTAIN MAP ENTITLED
"SOUTH END REZONING STUDY, SECTION 111 DATED
MAY 16, 1977, INSOFAR AS BOUNDARIES MAY BE
WITHIN THE PERIMETERS OF SAID "SOUTH END RE-
ZONING STUDY, SECTION MAP, SAVE AND EXCEPT
A PORTION THEREOF AS DESCRIBED HEREIN; INCOR-
PORATING BY REFERENCE SAID MAP IN THIS ORDI-
NANCE; PROVIDING FOR SEVERABILITY; AND PROVID-
ING A PENALTY.
Councilman Williams made a motion to approve the ordinance.
Mayor Ritter recognized citizens wishing to address Council concerning
this study and zoning changes proposed:
Mr. Charles Gibbs addressed Council to express his concern for zoning changes
that would not allow construction of apartment complexes in the South End
area and asked that action be defeirrad until further study.
Mr. John Blackwell addressed Council to request that his property located
at Washington Boulevard at IH-10 (43 acre tract) retain the I-1 zone so
that he can construct an "Industrial Office Park or Complex" . He said he
believes the C-2 will not allow such construction.
Mr. Gene VanMeter addressed Council to express his concern for zoning
changes that would not allow construction of apartments in the South End
area and requested Council defer action for further study.
Mr . Elray Wilson, 8275 Old Voth Road, expressed concern for the changes and
asked Council to defer action for further study.
Further discussion was held concerning this zoning study. The second to
Councilman Williams , motion was called for. Motion died for lack of a se-
cond.
Councilwoman McGinnis made a motion to table action for two weeks for fur-
ther study; Councilman Cash seconded the motion.

An ordinance establishing a moratorium on the issuance of building permits
pending a rezoning study of a portion of the south end rezoning area was
considered:
AN ORDINANCE
ENTITLED AN ORDINANCE PROHIBITING THE ISSUANCE .
OF BUILDING PERMITS OTHER THAN FOR USES ALLOWED
IN AN R-1 ZONE IN TWO AREAS AS HEREINAFTER DE-
SCRIBED FOR A PERIOD OF SIXTY -60) DAYS, OR UN-
TIL REZONING IS APPROVED BY THE CITY COUNCIL OF
THE CITY OF BEAUMONT; PROVIDING FOR REPEAL; AND
PROVIDING FOR SEVERABILITY.
Discussion was held concerning the Moratorium and it was informally decided
that action on this ordinance would be held for two weeks for further study.

Ordinance No. 77-58 authorizing the abandonment of a twenty foot (201 )
alley located between the rear lot line of Lots 1 , 2 and 3, and the east
lot line of Lot 4, Block 1 , Lucian Harris Addition was considered:

A TWENTY FOOT (201 ) ALLEY IN THE LUCIAN HARRIS
ADDITION IN THE CITY OF BEAUMONT, JEFFERSON
COUNTY, TEXAS, AS DESCRIBED HEREIN.
The ordinance was approved on a motion made by Councilwoman McGinnis and
seconded by Councilman Cash.

Resolution 77-157 authorizing the City Manager to submit an application
to the State Department of Highways and Public Transportation for second-
year (October 1 , 1977 through September 30, 1978) Safety Education Program
funding (100% grant - $35, 010. 00) was approved on a motion made by Council-
man Williams and seconded by Councilman Cash.

Resolution 77-158 authorizing the commencement of negotiations for a po
tion of the needed rights-of-way on the Irving Street underpass Projec
(071-74-141) was approved on a motion made by Councilman Evans and secon-
ded by Councilman Cash.

Resolution 77-159 authorizing payment to Fogle Equipment Company for addi-
tional repairs to HD 11 dozer #50-5010 and 12G dozer #664 was approved on a
motion made by Councilman Cash and seconded by Councilwoman McGinnis.

Resolution 77-160 authorizing final payment to Bella Company for the Pine
Street Interchange Project - relocation of water lines, $49,764.41 to be
refunded by the State - was approved on a motion made by Councilman Cash
and seconded by Councilwoman McGinnis.

Resolution 77-161 authorizing the release of the following weed liens

($75. 00) ; John Lisotta ($55. 00) ; Theadis Parks ($16.93) ; Mrs. Rhena Pattillo
($75. 00) ; A. M. Phelan ($55. 00); Rising Sun Baptist Church ($55.00) ; Don

($55. 00) was approved on a motion made by Councilman Cash and seconded by
Councilman Evans.

Driver of the Year awards were presented: Lester Tyler, Street Division.,
received the "Driver of the Year" award and was presented a watch and cita-
tion. Others receiving recognition and pen & pencil sets with their cita-
tions were: Jose Kennebrew, Solid Waste Department ; Cecil Brantley, Build-
ing Maintenance and Operations Department ; William M. Bozeman, Public Works
Department ; Shelby Bundick, Water Distribution; Robert Pinkston, Traffic &
Transportation; and Bernard Dixon, Parks & Recreation.

Mr. Thad Heartfield, Attorney representing Heywood-Wakefield - bidders on
seating for the Exhibition Hall , addressed Council to express his concern
for the ability of the committee appointed by the City Manager to study the
procedures for the preparation of bid specifications and the bids received
to render a fair decision .

There being no further business , the meeting was recessed before continuing
with the City Council workshop session.
