CITY COUNCIL - CITY OF BEAUMONT
HELD MARCH 15, 1977
BE IT REMEMBERED that the City Council of the City of Beaumont, Texas,
met in regular session this the 15th day of March, 1977 , with the follow-
ing present:

The Invocation was given by The Reverend Joseph C. Rodney, Rector of
Blessed Sacrament Catholic Church.
The Pledge of Allegiance was led by Councilman Williams.

Mayor Ritter issued the following proclamation: "Elsie Marsh Day in
Beaumont" (for Mobil Credit Union) - March 15, 1977.

Resolution 77-83 authorizing the award of bids for the construction and
fencing of two (2) tennis courts at Alice Keith Park to American Fence
Company ($2 ,128 . 00) and Cajun Concrete ($14 ,716.80) was approved on a
motion made by Councilman Williams and seconded by Councilwoman McGinnis.

Resolution 77-84 authorizing the award of bid for furnishing fifteen (15)
lawnmowers for the Parks and Recreation Department to Rayon's, Inc. at
a cost of $1,522. 50 was approved on a motion made by Councilman Evans and
seconded by Councilwoman McGinnis.

Resolution 77-85 authorizing the award of bid for furnishing ready mix
concrete for a ten-month period on an "as needed" basis (cost ranging from
$34. 00 to $36. 50 a cu yd) to Transit Mix was approved on a motion made by
Councilman Evans and seconded by Councilman Cash.

Resolution 77-86 authorizing the City Manager to commence negotiations with
Mobil Oil Corporation for a drainage easement to connect to a Drainage Dis-
trict 6 line across Mobil Oil Corporation's property (Community Development
Block Grant Program, Census Tract 17 , for the extension of Grant Street)
was approved on a motion made by Councilman Cash and seconded by Council-
woman McGinnis.

Ordinance No. 77-22 appropriating $180,000 from unappropriated funds to
the Dowlen Road CAP Project (#71-74-212) was considered:
ORDINANCE NO. 77-22
ENTITLED AN ORDINANCE AMENDING THE BUDGET OF
THE CITY OF BEAUMONT FOR THE FISCAL PERIOD
COMMENCING OCTOBER 1, 1976, AND ENDING
SEPTEMBER 30, 1977 , BY TRANSFERRING THE
AMOUNT OF $180,000 FROM C.A.P.-74 STREET CON-
STRUCTION FUNDS TO THE DOWLEN ROAD PROJECT
71-74-212.
The ordinance was approved on a motion made by Councilman Evans and secon-
ded by Councilwoman McGinnis.

Resolution 77-87 authorizing payment to the State Treasurer in the amount
of $729,400 for the City' s share of the estimated construction cost for
the Dowlen Road CAP Project (#71-74-212) was approved on a motion made by
Councilman Evans and seconded by Councilwoman McGinnis.

Resolution 77-88 authorizing the execution of a Quitclaim Deed to Anthony
M. Padilla ($500. 00 - Lot 7, Block 9 , Van Wormer Addition) was approved on
a motion made by Councilman Williams and seconded by Councilwoman McGinnis.

An ordinance appropriating and issuing a check to the Texas State Depart-
ment of Highways & Public Transportation in the amount of $7,500 as the
City' s share for the 24-inch water main across the Neches River was held
for additional information on a motion made by Councilwoman McGinnis and
seconded by Councilman Evans.

Resolution 77-89 authorizing the approval of the Cheek-Fannett Water Dis-
trict (West Jefferson County Municipal Water District) was approved on a
motion made by Councilwoman McGinnis and seconded by Councilman Evans.

A dilapidated structures hearing was scheduled for March 29 , 1977 on a mo-
tion made by Councilman Williams and seconded by Councilwoman McGinnis.

The first reading of an ordinance granting Atchison, Topeka & Santa Fe Rail-
way Company a renewal franchise for Tract No. 5 which crosses Bowie Street,
just west of Railroad Avenue, was considered:

AN ORDINANCE
AN ORDINANCE GRANTING TO THE ATCHISON, TOPEKA
AND SANTA FE RAILWAY COMPANY, ITS SUCCESSORS, ASSIGNS
AND LESSEES, THE RIGHT AND PRIVILEGE TO MAINTAIN AND
OPERATE INDUSTRIAL SPUR TRACK NO 5 FROM A POINT IN
THE SOUTHEASTERLY LINE OF BLOCK NO. 55 OF THE VAN
WORMER ADDITION TO THE CITY OF BEAUMONT, JEFFERSON
COUNTY, TEXAS, IN, OVER, UPON AND ACROSS BOWIE STREET
TO THE NORTHWESTERLY LINE OF BLOCK 56 OF THE SAID VAN
WORMER ADDITION, IN ACCORD WITH EXHIBIT ATTACHED HERETO;
PROVIDING THAT SAID TRACK SHALL BE USED ONLY FOR THE PUR-
POSE OF LOADING, UNLOADING, AND SWITCHING TO INDUSTRIAL
TRACKS SERVING COMMERCIAL ENTERPRISES; PROVIDING REGULA-
TIONS AND RESTRICTIONS FOR THE USE OF SAID TRACK; PRO-
VIDING THAT SUCH MAINTENANCE AND OPERATION BE IN ACCORD-
ANCE WITH THE CHARTER AND ORDINANCES OF THE CITY AND
THAT CERTAIN MAINTENANCE WORK SHALL BE DONE AT THE
DIRECTION OF THE CITY ENGINEER; PROVIDING FOR THE ACCEPT-
ANCE AND FEE HEREUNDER; PROVIDING THAT THIS FRANCHISE IS
SUBJECT TO THE CHARTER AND ORDINANCES OF THE CITY OF
BEAUMONT AND PROVIDING FOR TERMINATION FOR FAILURE TO
USE THE TRACK FRANCHISED HEREUNDER; PROVIDING FOR THE
TERMINATION OF THIS FRANCHISE ON MARCH 15, 1982 AND
THE RESTORATION OF SAID STREETS WITHIN NINETY (90)
DAYS THEREAFTER; AND PROVIDING FOR INDEMNIFICATION OF
THE CITY OF BEAUMONT.
The ordinance was passed to its second reading on a motion made by Coun-
cilman Evans and seconded by Councilwoman McGinnis.

Mayor Ritter declared a public hearing on the proposed Revenue Sharing
budget.

City Manager McDaniel gave a summary report of the proposed ,Revenue Sharing
budget for January 1 , 1977 to September 30, 1980. (Copy attached for permanent record)
Council briefly discussed the proposed budget. Mayor Ritter called for
citizens wishing to address Council concerning the proposed budget.
No citizens spoke.
The public hearing was closed.

There being no further business, the meeting was recessed before continu-
ing with the City Council Workshop Session.
