HELD OCTOBER 19, 1976
BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in
regular session this the 19th day of October, 1976, with the following present

The Invocation was given by the Reverend Warren E. Jackson, Memorial United
Methodist Church.
The Pledge of Allegiance was led by Councilwoman McGinnis.

Mayor Ritter issued the following proclamations : "United Nations Week in Beau-
mont" - October 24 - 30 , 1976 with special emphasis on "United Nations Day" -
October 24 , 1976 and "Hire a Veteran Day in Beaumont" - October 25 , 1976 .

The Minutes of the regular City Council session held October 12 , 1976 , were ap-
proved on a motion made by Councilwoman McGinnis and seconded by Councilman
Evans .

Authorization to advertise for bids to demolish and clear the Civic Center site
(Blocks 4-6 of Beaumont Original Townsite -- Old Police Building, Schmidt Build-
ing and Fremin° s) was granted on a motion made by Councilwoman McGinnis and
seconded by Councilman Cash.

Resolution 76-297 authorizing award of bids for furnishing road materials for
various City departments to Uvalde Rock Asphalt Company, Inc. , Keown Supply
Company and Gulf States Asphalt Company, Inc. , these being the lowest and best
bids received (six-month contracts for materials) was approved on a motion made
by Councilman Evans and seconded by Councilwoman McGinnis.

Resolution 76-298 authorizing repairs by Kinsel Ford, Inc. , to Police Car
#10-1050 in the amount of $1,974 . 32 was approved on a motion made by Council-
man Evans and seconded by Councilman Cash.

Ordinance No. 76-124 amending Section 8-1.1 through 8-1. 7 , Demolition Permits,
substituting "City Manager or Designee" in lieu of "Building Official" (to be
administered by Housing & Environmental Control Division) was considered:

SECTIONS 8-1.1, 8-1.2 , 8-1. 3, 8-1.4 , 8-1.5,
AND 8-1. 7 OF THE CODE OF ORDINANCES OF THE
CITY OF BEAUMONT, TEXAS, BY SUBSTITUTING
THE TERM "CITY MANAGER OR HIS DESIGNEE" FOR
THE TERM "BUILDING OFFICIAL" AS IS USED IN
SAID SECTION; PROVIDING FOR SEVERABILITY
AND PROVIDING FOR REPEAL.
The ordinance was approved on a motion made by Councilman Evans and seconded
by Councilwoman McGinnis.

Ordinance No. 76-125 amending Chapter 32, Section 32-9 , Paragraph 2, establish-
ing charges for sewer service to customers outside the City limits was con-
sidered:

ENTITLED AN ORDINANCE AMENDING CHAPTER 32,
SECTION 32-9 (2) OF THE CODE OF ORDINANCES
OF THE CITY OF BEAUMONT, TEXAS, TO INCREASE
THE MINIMUM CHARGE OUTSIDE THE CITY LIMITS
FROM $2. 00 TO $3. 00; PROVIDING FOR SEVER-
ABILITY AND PROVIDING FOR REPEAL.
The ordinance was approved on a motion made by Councilman Evans and seconded
by Councilman Cash.

Ordinance No. 76-126 amending Chapter 40, Section 40-9, Paragraph 2 , establish-
ing charges for water service to customers outside the City limits; and amend-
ing Chapter 40, Section 40-16 to increase the test fee, was considered:

ENTITLED AN ORDINANCE AMENDING CHAPTER 40,
SECTIONS 40-9 (2) AND 40-16 (a) OF THE CODE
OF ORDINANCES OF THE CITY OF BEAUMONT, TEXAS,
TO INCREASE THE MINIMUM CHARGE FOR SERVICE
OUTSIDE THE CITY LIMITS FROM $2. 00 TO $3. 00
PER MONTH; INCREASING THE TEST FEE; PROVIDING
FOR SEVERABILITY AND PROVIDING FOR REPEAL.
The ordinance was approved on a motion made by Councilman Cash and seconded by
Councilman Williams.

Resolution 76-299 authorizing and directing the City Attorney to file forcible
entry and detainer proceedings or such other proceedings as may be necessary
for the purpose of evicting Hatton Machine Works from City property located at
793 Main Street (Schmidt Building - Lots 569,570 & 571, Block 6 , Original Beau-
mont Townsite) was approved on a motion made by Councilman Cash and seconded
by Councilman Evans.

Ordinance No. 76-127 correcting Ordinance No. 0-76-8 , vacating and abandoning
a 60 ' x 350 ' portion of 17th Street was considered:

ENTITLED AN ORDINANCE CORRECTING ORDINANCE NO. 0-76-8
VACATING AND ABANDONING A 60 ' X 350 ' PORTION OF 17TH
STREET, IN THE VAN WORMER 2ND ADDITION IN BEAUMONT,
JEFFERSON COUNTY, TEXAS, AS DESCRIBED HEREIN, PROVID-
ING THAT SUCH PORTION OF THE STREET RIGHT-OF-WAY BE
RETAINED AS A GENERAL UTILITY EASEMENT.
The ordinance was approved on a motion made by Councilwoman McGinnis and se-
conded by Councilman Evans.

Ordinance No. 76-128 authorizing approval of revisions to the Pay and Classifi-
cation Plan was considered:

ENTITLED AN ORDINANCE AMENDING CHAPTER 12 ,
SECTION 12-35 ADOPTING A CLASSIFIq T'ION AND
PAY PLAN; PROVIDING FOR SEVERABILITy.;
Mrs. Charlotte Thibodeaux, 3430 South Major Drive, addressed Council to complain
that the Council Chambers P. A. System is inadequate for citizens at the meet-
ings.
Mrs. Earl Hudson, 1760 Terrell, addressed Council to question the duties and
need for the Planning & Research Unit in the Police Department and also ques-
tioned Mrs. Greenleaf' s educational background for the salary received. She
stated that College graduates receive less.
Mr. J. C. Leggett, 1849 Washington Blvd. , addressed Council to complain about
poor condition of Pennsylvania, Neches and Avenue A and about the old S.P.
Mainline crossing on 4th Street.
Reverend Warren E. Jackson addressed Council in answer to Mrs. Hudson' s state-
ments to say that education is important but experience is also important.

There being no further business, the meeting was recessed before continuing
with the Council Workshop Session.
