The Pledge of Allegiance was led by Councilman Cash. -000- The Mayor issued the following proclamation: Lions ' "Arts & Crafts Days in Beaumont" - September 3, 4, & 5, 1976. -000- The Minutes of the regular City Council session held August 24 , 1976 , were ap- proved on a motion made by Councilman Cash and seconded by Councilman Evans. Question: Ayes : All Nayes: None -000- Resolution 76-249 authorizing the advertising for bids for cleaning, repairing and waterproofing the exterior of the Tyrrell Historical Library building at 695 Pearl Street was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans. E. Brenner) was considered: ORDINANCE NO. 76-94 ENTITLED AN ORDINANCE VACATING AND ABAN- DONING A TWENTY FOOT (201 ) BY THREE HUN- DRED FOOT (3001 ) ALLEY EASEMENT IN THE MCFADDIN FIRST ADDITION IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, AS DE- SCRIBED HEREIN. The ordinance was approved on a motion made by Councilwoman McGinnis and se- conded by Councilman Evans. Question: Ayes : All Nayes : None -000- Ordinance No. 76-95 amending the 1975-76 budget, transferring funds in the a- mount of $1,800 from the General Fund Contingency Account to the Fleet Fund 98-407 to cover emergency rental of one dozer for the landfill was considered: ORDINANCE NO. 76-95 ENTITLED AN ORDINANCE AMENDING THE BUDGET OF THE CITY OF BEAUMONT FOR THE FISCAL PERIOD COMMENCING OCTOBER 1, 1975, AND ENDING SEPTEMBER 30, 1976, BY TRANSFERRING $1,800. 00 FROM THE GENERAL FUND CONTINGENCY ACCOUNT TO THE FLEET FUND ACCOUNT 98-407 FOR THE EMERGENCY RENTAL OF ONE BULL DOZER FOR THE LANDFILL. The ordinance was approved on a motion made by Councilwoman McGinnis and secon- ded by Councilman Cash. Question: Ayes: All Nayes: None -000- A motion authorizing emergency rental of one dozer for a six-day period from Trotti & Thomson in the approximate amount of $1,800 for the landfill was made by Councilwoman McGinnis and seconded by Councilman Evans. Question: Ayes : All Nayes : None -000- Resolution 76-250 appointing members to serve for one year on the Alcoholic Beverage Advisory Committee for the Civic Center Complex facilities f Patrizi - Chairman, Roland Chandley, Dr. Joseph B. Carlucci, A. G. Moncla, Father N. Perusina, Clarence Jackson, Ms. Charlene Kiker, Reverend Cecil Pemberton, and Wayne W. Lalor) was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans. Question: Ayes: All Nayes: None -000- Resolution 76-252 authorizing acceptance of the fiscal year 1977 Comprehensive Manpower Plan prepared by South East Texas Regional Planning Commission was approved on a motion made by Councilman Cash and seconded by Councilwoman McGinnis. Question: Ayes : All Nayes: None -137- August 31, 1976 Resolution 76-251 accepting a donation of a . 00004 acre tract of land from the New Hope Primitive Baptist Church for the extension of Crow Road between Eastex Freeway and Concord Road (CAP 45-ST-12) was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans. Question: Ayes : All Nayes : None -000- Resolution 76-253 authorizing the American National Bank to release $1,730 , 000 in securities and to pledge $1, 185, 000 in securities was approved on a motion made by Councilman Cash and seconded by Councilman Evans. Question: Ayes : All Nayes : None -000- Ordinance 76-96 transferring and appropriating funds to the Airport Construc- tion Fund was considered: ORDINANCE NO. 76-96 ENTITLED AN ORDINANCE AMENDING THE BUDGET OF THE CITY OF BEAUMONT FOR THE FISCAL PERIOD BEGINNING OCTOBER 1, 1975, AND ENDING SEPTEMBER 30, 1976, BY TRANSFERRING THE SUM OF $193 , 034 . 15 FROM THE GENERAL ACCOUNT TO AIRPORT CONSTRUCTION FUND NO. 70-76-011 FOR IMPROVEMENTS TO THE BEAUMONT MUNI- CIPAL AIRPORT. The ordinance was approved on a motion made by Councilman Cash and seconded by Councilman Evans. Question: Ayes : All Nayes: None -000- Mrs. James Haynes, 4240 S. 5th Street, urged Council to approve the contract award for the paving, etc. of Booker and S. 5th (Assessment Paving Project No. 8) . Mrs. Haynes presented a petition containing 61 signatures and entitled "We the undersigned citizens of Beaumont, Texas, hereby petition to have Books,,: Street, from Fourth Street to the Dead End and South 5th from Sarah to the Dead End, paved as requested and granted previously. We are requesting no change in the previous plans. " A discussion was held concerning the merits of the Assessment Paving Program,, The Booker & S. 5th Street Assessment Paving Project will be included in the Agenda for action Tuesday, September 7th. The following letter is being made a permanent part of the official Minutes of this meeting at the request of Mayor Ritter. -138- August 31, 1976 "August 30, 1976 Mr. Howard McDaniel City Manager Beaumont, Texas Dear Howard: After receiving your proposed alternative cuts for the 1976-77 budget, I would like to suggest that an attempt be made to fully fund the Police and Fire Departments and to reinstate those cuts originally proposed. It appears from the information provided by your office that other alter- natives are available for Council consideration. If the current and next year' s funding for the Assessment Paving Program were deleted, it would make availab-Le $582 , 000 for use in other programs. This amount represents ll� on the tax rate. By making available the above amount, the Police and Fire Department cuts as originally proposed could be reinstated along with other programs such as solid waste, airport, park improvements, etc. This would include all the per- sonnel in the Police Department, the purchase of two police cars, the personnel in the Fire Department and the ladder truck in the Fire Department. The net effect of these alternatives would be a fully funded Police and Fire Department which would provide the citizens of Beaumont the level of protective services they deserve. Melonson, 4445 Booker, addressed Council to request the bid award for the Booker & S. 5th Street Assessment Paving project be approved, Dr. John Gray, President of Lamar University, thanked Council for providing a good traffic pattern on West Virginia Street for Lamar University. Reverend Marvin Mosley, 8850 Moses, addressed Council in opposition to the sale of alcoholic beverages in the Civic Center. -000- There being no further business, the meeting was recessed before continuing with the Public Hearing on the Proposed Budget for Fiscal Year 1976-77. -000- PUBLIC HEARING PROPOSED 1976-77 BUDGET Those present for the public hearing were: HONORABLE: Ken Ritter Mayor Don Cash Councilman, Ward I Vi McGinnis Councilwoman, Ward II Leroy Evans Councilman, Ward IV Absent: Calvin Williams Councilman, Ward III -139- August 31, 1976 Howard McDaniel City Manager Lavon Jones Asst. City Attorney Myrtle Corgey City Clerk -000- The public hearing was opened for citizens to be heard concerning the proposed budget. Mr. James L. Trammell, 1517 East Drive, addressed Council to oppose proposed cuts in the Police Department saying he is for raising taxes rather than making these cuts. Mrs. Linda Boone, 463 Piney Point, addressed Council in support of the Police Public Service Unit and said she was opposed to cuts in the Police Department. Dr. John Gray, 102 Cardinal Drive, addressed Council in support of no cuts in the Police Department. Mr. Robert Layfield, 3155 French Road, Apt. 247, addressed Council to ask that the Police Department be maintained at the present level and further said he was opposed to other City personnel cuts. Mr. Herbert Davis (no address given) asked that projects such as the Civic Cen- ter be delayed so that it would not be necessary to make personnel cuts. Dr. Conrad Mang, 1215 Longfellow Drive, Apt. 18 , member of the Parks Advisory Committee, spoke in opposition to cuts in the Parks & Recreation Budget saying he agrees with the importance of Police but that parks fight crime too. Mr. Bill Neild, President of the Beaumont Economic Development Corporation, asked that the Economic Development Program not be cut from the proposed budget. Mrs. Delia Herrington, 815 Willow Street, asked that the City help in getting two locations cleaned up - 950 Hazel and 695 Pearl. In addition, Mrs. Herring- ton said she thought Police Officers should live in the City and that she was against the sale of alcoholic beverages in the Civic Center. Ms. Clara Benoit, 1253 Laurel Street, addressed Council to say she was in oppo- sition to cuts in the Police Department. Mr. Bob Griem, attorney for the International Brotherhood of Police Officers from Burbank, California, addressed Council to ask that Police Department strength be maintained at its present level. Detective Woody D. Bouillion, President of the I.B.P.O. Local 491, Box 3121, Beaumont, presented a petition containing 16 ,509 signatures and entitled "We, the undersigned citizens of Beaumont, Texas, in the interest of our health and safety, hereby petition the City Council to maintain the Beaumont Police Department at its present authorized strength. We feel that reducing the size of the police department during a period of increasing crime is illogical and would represent poor governmental planning. " Mr. Tom Combs, 6175 Navajo Trail, addressed Council to commend the Fire Depart- ment and urged that cutting be done in areas that do not involve lives and safety of the citizens of Beaumont saying that we cannot afford to cut Police or Fire Departments. Mr. Leslie Burnett, 3235 Ogden, addressed Council in support of maintaining the present level of both the Police and Fire Departments and said he is for increasing taxes rather than have these cuts. Mr. Gilbert I. "Buddy" Low, Attorney, 3855 Wheat Drive, addressed Council in opposition to the proposed cuts in the Police Department. Mrs. L. C. Coney, 4495 Booker Street, addressed Council to express her concern for a "budget of regression" and urged that the City do whatever is necessary to experience growth. She also spoke in favor of not cutting the Police De- partment and about the poor condition of Booker Street. -140- August 31, 1976 Mrs. M. J. Rienstra, 213 W. Caldwood Drive, addressed Council to request that funds be budgeted each year for the proper maintenance of the Tyrrell HistorIcai Library. Reverend Rayburn Newton, 3029 Terrell Avenue, pastor of Paradise Baptist Church, addressed Council in opposition to cuts in either the Police or Fire Departments, Mrs. James Haynes, 4240 S. 5th Street, addressed Council in support of no cuts in the Police Department. Mr. Whayne Moore, Executive Vice-President and General Manager of the Beaumont Chamber of Commerce, addressed Council to express his concern for cuts in the Fleet Maintenance Department and in support of the Police and Fire Departments. Mr. J. C.
