CITY COUNCIL - CITY OF BEAUMONT
HELD APRIL 20, 1976
BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in
regular session this the 20th day of April, 1976, with the following present:

The Invocation was given by Dr. Dudley Wilson, pastor of Calder Baptist Church.
The Pledge of Allegiance was led by Councilman Cash.

Ordinance 76-53 canvassing the returns of the run-off election for Councilman,
Ward II, held April 17, 1976, was considered:
ORDINANCE NO. 76-53
ENTITLED AN ORDINANCE CANVASSING THE RETURNS
FOR THE OFFICER OF THE OFFICE OF COUNCILMAN
FOR WARD II OF THE CITY OF BEAUMONT OF THE
RUN-OFF ELECTION WHICH WAS HELD ON THE 17TH
DAY OF APRIL, 1976; PROVIDING FOR SEVERABILITY;
AND PROVIDING FOR REPEAL.
The ordinance was approved on a motion made by Councilman Williams and seconded
by Councilman Cash.

Oaths of office were administered to Council members elected for new terms on
April 3 and April 17 , 1976 by the Honorable Joe J. Fisher, U. S. District Judge.

Mayor Ritter issued the following proclamations: "Bicycle Safety Week in Beau-
mont" - April 19-24, 1976 and "Betty Ford Day in Beaumont" - April 21, 1976.

Councilman Williams - after serving as Mayor Pro Tem for six years because he
received the most votes in the last three elections - said he would like to
break with this tradition and nominate Councilwoman McGinnis Mayor Pro Tem.
The motion was seconded by Councilman Cash.

Ordinance 76-54 changing the zoning of a 2.92 acre tract of land from R-1 (Sin-
gle Family Dwelling) to R-2 (Two Family and Multiple Dwelling) - the tract is
described as Lots 11, 12, 13 and 14 , Block "A" , Mayfair Addition, and is located
at 1575 Major Drive (FM 364) - change requested by Valry Brown - was considered:

ENTITLED AN ORDINANCE AMENDING CHAPTER 42
OF THE CODE OF ORDINANCES OF BEAUMONT,
TEXAS, AND IN PARTIrTTLAR THE BOUNDARIES
OF THE ZONING DISTRICTS AS INDICATED UPON
THE ZONING MAP OF THE CODE OF ORDINANCES
OF BEAUMONT, TEXAS, BY CHANGING THE ZONING
CLASSIFICATION OF LOTS NOS. 11, 12 , 13 &
14, BLOCK NO. "A" , MAYFAIR 1ST ADDITION TO
THE CITY OF BEAUMONT, COUNTY OF JEFFERSON,
STATE OF TEXAS, ACCORDING TO THE MAP OR
PLAT OF SAID ADDITION ON FILE IN THE OFFICE
OF THE COUNTY CLERK OF JEFFERSON COUNTY,
TEXAS, PRESENTLY ZONED "R-1" , TO "R-211 ;
PROVIDING FOR SEVERABILITY; AND PROVIDING
FOR PENALTY.

by Councilman Cash.

Resolution 76-136 authorizing the City Attorney to file proceedings in eminent
domain against Fremin' s, Inc. and American National Bank of Beaumont, a lien-
holder, for the acquisition of Lot 573, Block 6 and Lot 579, Block 7 , all of
Market Street lying between Forsythe & Cypress Streets, all in the Original
Townsite of Beaumont, Jefferson County, Texas, (CAP 45-B-01) was approved on
a motion made by Councilwoman McGinnis and seconded by Councilman Cash.

Resolution 76-137 authorizing the City Attorney to file proceedings in eminent
domain against all parties of interest of the Thomas Lombardo Trust for the
acquisition of Lots 610, 611, 615 , and 616 of Block 18 of the Original Townsite
of Beaumont, Texas, (CAP 45-B-01) was approved on a motion made by Councilman
Cash and seconded by Councilwoman McGinnis.

Ordinance 76-55 amending the current Negligent Collision Ordinance redefining
the term "negligence" was considered:

ENTITLED AN ORDINANCE ESTABLISHING THE OFFENSE OF
NEGLIGENT COLLISION; PROVIDING FOR DEFINITIONS;
PROVIDING FOR A PRIMA FACIE PRESUMPTION OF NEGLI-
GENCE IN THE INSTANCE OF REAR END COLLISIONS; PRO-
VIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND
PROVIDING A PENALTY.
The ordinance was approved on a motion made by Councilwoman McGinnis and secon-
ded by Councilman Evans.

An ordinance regulating the buying, selling, and trading of junk, including new
and used scrap material, was held for action one week.

Resolution 76-138 authorizing negotiations with property owners -,cf,
way on the Pearl-Orleans Project (071-74-151) , (CAP 45-ST-03) for portions, of
Blocks 38 & 39 of the Old Townsite of Beaumont, was approved on a motion made
by Councilman Cash and seconded by Councilwoman McGinnis.

Mr. Ben Rogers, 2030 Thomas Road, addressed Council to discuss Beaumont' s need
for an in-depth Housing Program by government; procedures for collecting over-
due taxes by the Beaumont Tax Agency; the old TB Hospital be developed as a
joint County-City park; and the Jefferson Theatre be used as a Music Hall for
the City. He also said that 70% of the private property owners were committed
to the Orleans Plaza project and he hopes to have the entire project firmed up
by June 15th. He further said meetings were held in Chicago last week to dis-
cuss financing of a hotel for downtown Beaumont.
Mr. Leantha J. Redd, 2720 San Antonio, Executive Secretary for the Beaumont
Branch of the NAACP, addressed Council to commend Council members who have foucki,
for a healthy climate and reaction in the community.
Mr. W. E. Kinnear, 1810 Washington Boulevard and representing the Beaumont Chap-
ter of Texas Senior Citizens, addressed Council to ask that the Southern Pacify(-
Property that cuts Beaumont in half be acquired so that streets can be connecte=d
to form north/south thru-streets.

the Council workshop session.
