The Pledge of Allegiance was led by Councilwoman McGinnis. --000- Mayor Ritter issued one proclamation: Lamar University' s "Alpha Phi Omega Day in Beaumont" - December 16 , 1975 . -000-- Ordinance 75-73 requesting transfer of funds in the amount of $50,000 from Other Charges (79-415) to establish the Community Facilities Department, Ac- count No. 67 , was considered: ORDINANCE No. 75-73 ENTITLED AN ORDINANCE AMENDING THE BUDGET OF THE CITY OF BEAUMONT FOR THE FISCAL PERIOD BE- GINNING OCTOBER 1, 1975 AND ENDING SEPTEMBER 30, 1976, BY TRANSFERRING THE SUM OF $50,000 FROM OTHER CHARGES (79-415) TO THE NEW COMMUNITY FACILITIES DEPARTMENT ACCOUNT NO. 67 . The ordinance was approved on a motion made by Councilman Cash and seconded by Councilman Evans. Question: Ayes: All Nayes: None -000- Resolution 75-448 authorizing the reimbursement of $2 ,885. 00 to Robert L. Adams Oil Company (Amoco) for the removal of one oil line and adjustment of another 4" existing oil line in the Delaware Street Revenue Sharing Project was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans. Question: Ayes: All Nayes: None -000- Resolution 75-449 authorizing Change Order No. 3 , Contract III-B, in the addi- tion of $37 ,142. 08 ; Change Order No. 2, Contract II, in the deduction of $1,531.76; Change Order No. 1, Contract III-D, to deduct $3 ,640. 00; Change Or- der No. 1, Contract III-H, to deduct $28 , 890 . 40; those contracts under the CIP Sanitary Sewer Program with Holloway Sand & Gravel Company, was approved on a motion made by Councilman Cash and seconded by Councilman Evans. Question: Ayes: All Nayes: None -000- -205 December 16 , 1975 Resolution 75-450 authorizing the retention of M. L. Lefler, Jr. and Jack Aul- baugh for appraisal of property to be acquired for the Civic Center Complex, CAP 45-B-01 (appraisal not to exceed $4 ,000) was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Cash. Question: Ayes: All Nayes : None -000- Resolution 75-451 authorizing the City Manager to execute a renewal of the ex- isting lease, for five years, between the City of Beaumont and Neches Valley Producers Association for operation of Farmers Market at a rate of $1. 00 an- nually was approved on a motion made by Councilman Evans and seconded by Coun- cilwoman McGinnis. Question: Ayes : All Nayes : None -000- Resolution 75-452 authorizing the City Manager to apply to the Governor 's Office of Traffic Safety for continuation of the Selective Traffic Enforcement Program (100% funded) was approved on a motion made by Councilwoman McGinnis and se- conded by Councilman Cash. Question: Ayes: All Nayes: None -000- Resolution 75-453 accepting the improvements of Phase I of the Beaumont Muni- cipal Airport and authorizing final payment of $53 ,185. 97 to D. & D. Construc- tion Co. , Inc. was approved on a motion made by Councilman Evans and seconded by Councilman Cash. Question: Ayes : All Nayes: None -000- The first reading of an ordinance renewing the franchise for Tract No. 90 of the Atchison, Topeka & Santa Fe Railway Company which crosses near the inter- section of Blanchette and Neches Streets was considered: AN ORDINANCE AN ORDINANCE GRANTING TO THE ATCHISON, TOPEKA AND SANTA FE RAILWAY COMPANY, ITS SUCCESSORS, ASSIGNS AND LESSEES, THE RIGHT AND PRIVILEGE TO MAINTAIN AND OPERATE AN INDUSTRY SPUR TRACK NO. 90 ACROSS BLANCHETTE STREET AND NECHES STREET IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, IN ACCORD WITH EXHIBIT ATTACHED HERETO; PROVIDING THAT SAID TRACK SHALL BE USED ONLY FOR THE PURPOSE OF LOADING, UNLOADING AND SWITCHING TO INDUSTRIAL TRACK SERVING COMMERCIAL ENTERPRISE; PROVIDING REGULATIONS AND RESTRICTIONS FOR THE USE OF SAID TRACK; PRO- VIDING THAT SUCH MAINTENANCE AND OPERATION BE IN ACCORDANCE WITH THE CHARTER AND ORDINANCES OF THE CITY AND THAT CERTAIN MAINTENANCE WORK SHALL BE DONE AT THE DIRECTION OF THE CITY ENGINEER; PROVIDING FOR THE ACCEPTANCE AND FEE HEREUNDER; PRO- VIDING THAT THIS FRANCHISE IS SUBJECT TO THE CHARTER AND OR- DINANCES OF THE CITY OF BEAUMONT AND PROVIDING FOR TERMINATION FOR FAILURE TO USE THE TRACK FRANCHISED HEREUNDER; PROVIDING FOR TERMINATION OF THIS FRANCHISE ON JANUARY 1, 1977 AND THE RESTORATION OF SAID STREETS WITHIN NINETY (90) DAYS THEREAFTER; AND PROVIDING FOR INDEMNIFICATION OF THE CITY OF BEAUMONT. The ordinance was passed to its second reading on a motion made by Councilman Evans and seconded by Councilman Cash. Question: Ayes: All Nayes: None A discussion was held concerning the Railroad Companies lack of maintenance of some crossings. -000- -206- December 16, 1975 Mr. McDaniel announced an emergency session of Workshop to meet with architects for the Civic Center Complex would begin at 1 :30 p.m. today instead of the reg- ularly scheduled 3 : 00 p.m. session. -000- Mr. McDaniel reported that investigation into the complaint received last week concerning the Police Department screening procedures for employment with that Department had revealed the applicant was rejected because of deception during his polygraph examination. Mr. McDaniel further said the applicant had been advised of the areas of deception and had verified those areas to the examiner. -000- Representatives of the Y.M.B.L. presented a check to the City of Beaumont in the amount of $62, 049. 29, as the City's share of the proceeds from the South Texas State Fair in October in compliance with the lease agreement. -000- Mr. J. C.
