REGULAR SESSION CITY COUNCIL -- CITY OF BEAUMONT HELD AUGUST 19 , 1975 BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 19th day of August, 1975, with the following present: HONORABLE,. City Attorney -000- The Invocation was given by Reverend Claude Payne, St. Mark' s Episcopal Church. The Pledge of Allegiance was led by Councilwoman McGinnis. -000® The Minutes of the regular session of the City Council held August 12 , 1975, were approved on a motion made by Councilman Cash and seconded by Councilwoman McGinnis, Question-. Ayes: All Nayes : None -000- Resolution 75-287 authorizing award of contracts for furnishing road materials for all City Departments (Uvalde Rock Asphalt Company - 6 months for aggregate; White' s Mines - 6 months for Cold Mix Asphalt; Keown Supply Company ® 6 months for Limestone and annual contract for Hot Mix-Cold Lay; Jefferson Shell Company 90 days for Reef Oyster Shell; C & S Truck Lines, Inc. - annual contract for pit sand; and Gulf States Asphalt Company - ' 6 months for Liquid Asphalt) was approved on a motion made by Councilman Evans and seconded by Councilwoman McGinnis . Question Ayes : All Nayes : None Resolution 75-288 authorizing award of bids for Dictation Equipment for the Police Department to Lanier Business Products in the amount of $14 ,052030, thin being the best bid received (funded by CJC - grant AC-75-1305-3028) was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Cash. Question: Ayes: All Nayes : None -000- Ordinance 7552 for the abandonment of an alley abutting Lots 1-27 , Block 10, Ogden Addition (Victoria, Neches , Emma & Easy ®m 201 x 6601 to be retained as a utility easement) was considered: ORDINANCE NO. 75-52 ENTITLED AN ORDINANCE VACATING AND ABANDONING A TWENTY FOOT (201 ) BY SIX HUNDRED SIXTY FOOT (16601 ) ALLEY IN THE OGDEN ADDITION TO THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, AS DE- SCRIBED HEREIN, PROVIDING THAT A GENERAL UTILITY EASEMENT IS RETAINED, The ordinance was approved on a -motion made by Councilman Evans and seconded by Councilman Cash. Question,, Ayes: All Nayes : None -.143- August 19 , 1975 Authorization to take applications from banks to be selected as the depository of the funds of the City for the period of October 1, 1975, to September 30, 1977, was approved on a motion made by Councilman Williams and seconded by Councilman Cash. Question: Ayes : All Nayes: None -000- Resolution 75-289 authorizing acquisition of Parcel No. 9 , CIP 11-ST-122, Sarah Street at the true market value of $11,650. 00 was approved on a motion made by Councilman Williams and seconded by Councilwoman McGinnis. Question: Ayes: All Nayes: None -000- Resolution 75-290 authorizing acquisition of necessary right-of-way for Dela- ware Street Project, RS-T-12, was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans. Question: Ayes: All Nayes: None -000- Resolution 75-291 authorizing payment in the amount of $800.00 to Pitts, Phelps & White for reimburseable expenses in connection with acoustical consultation with Boner Associates (CAP 45-B-01) was approved on a motion made by Councilman Evans and seconded by Councilman Cash. Question: Ayes: All Nayes : None -000- Resolution 75-292 authorizing final payment to Bell Fence and Galvanizing Com- pany in the amount of $8 ,048 .33 on the portion of fence installed on the Water Department property on Pine Street necessitated by the widening of IH 10 was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Williams. Question: Ayes : All Nayes: None -000- Resolution 75-293 authorizing release of weed lien to Edgar F. Dodd, owner of Lot 9, Block 7, Bel Air Addition in the amount of $11. 97, was approved on a motion made by Councilman Williams and seconded by Councilman Evans. Question: Ayes: All Nayes : None -000- Resolution 75-294 authorizing the retention of a rate consultant for purposes of evaluating the Entex rate adjustment request (consulting firm - Shimek, Roming, Jacobs & Finklea -- not to exceed $7 ,200. 00) was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Cash. Question: Ayes : All Nayes : None -000- Resolution 75-295 appointing the following to the Planning & Zoning Commission: Wilmer Roberts; M. J. Conner, Jr. ; and Brack Jones to three (3) year terms beginning August 1, 1975 and Don Gonzales to fill the unexpired term of Jack King was approved on a moiton made by Councilwoman McGinnis and seconded by Councilman Williams. It was decided that selection of Chairman by Council would be discussed at a Workshop Session. Question: Ayes : All Nayes: None -000- Chief of Police Willie Bauer complimented the City Manager for his idea for Councilman Cash to act as liaison between Staff and Council and with the South East Texas Regional Planning Commission in the area of grants. -144- August 19, 1975 Mr. J. W. Faul, 4075 Howard, 833-8552, requested that consideration be given the traffic light at the intersection of Highland & Irby being moved to Highland & Lavaca and removal of stop signs on Lavaca to side streets. He also asked for interpretation of the ordinance governing garbage pick up stating that he placed his garbage in plastic bags as provided by ordinance and then placed the bags in a 55-gallon drum for protection from dogs and cats, which is not a proper container for garbage© He said the new garbage crews are not picking it up now.
