HELD APRIL 22 , 1975
BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in
regular session this the 22nd day of April, 1975, with the following present:

The Pledge of Allegiance was led by Councilman Williams.

The Mayor issued the following proclamations : "Epsilon Sigma Alpha Week in
Beaumont" - April 28 - May 4 , 1975 and "Telephone Pioneers Week in Beaumont"
April 21-27, 1975.

The Minutes of the regular City Council session held April 15 , 1975, were
approved on a motion made by Councilman Cash and seconded by Councilwoman
McGinnis.

A motion authorizing the advertising for bids for furnishing plant materials
for landscaping at the Water Utilities Service Center (CIP 11-WU-01) was made
by Councilwoman McGinnis and seconded by Councilman Evans.

- motion to reject one and only bid received for furnishing a Combination Oil
Field Type Body for a 30 ,000 GVW Winch Truck for the Street Department, and
authorizing the readvertising for bids was made by Councilman Williams and

Resolution 75-156 authorizing the Mayor to execute release of weed lien in
the Thomas Road Addition against Paul B. Shaw and wife, Joy Shaw, was approved
on a motion made by Councilman Evans and seconded by Councilwoman McGinnis.

Resolution 75-157 accepting a conveyance of six (6) tracts of land, containing
a total of 2. 237 acres, for the University Street Project, CIP 11-ST-07, from
Lamar University was approved on a motion made by Councilman Cash and seconded
by Councilman Evans.

Ordinance 75-29 authorizing Southwestern Bell ' s installation of underground
fuel tanks (tanks to store emergency diesel fuel for generators) was considered:

ENTITLED AN ORDINANCE AUTHORIZING THE CITY MANAGER
TO EXECUTE A LICENSE TO SOUTHWESTERN BELL TELEPHONE
COMPANY AUTHORIZING THE INSTALLATION OF UNDERGROUND
FUEL TANKS IN AN ALLEY; PROVIDING FOR SEVERABILITY;
AND PROVIDING FOR REPEAL.
The ordinance was approved on a motion made by Councilman Evans and seconded by
Councilwoman McGinnis.

Ordinance 75-30 authorizing the Texas Municipal Retirement System to transfer
City' s contribution for transit system employees to the City' s principle ac-
count which covers all other City departments was considered:

MAL AND PRIOR SERVICE CONTRIBUTION RATES AND FOR
DETERMINATION OF FUNDING PERIODS OF CERTAIN OBLIGA-
TIONS TO TEXAS MUNICIPAL RETIREMENT SYSTEM.
The ordinance was approved on a motion made by Councilman Williams and se-
conded by Councilman Evans.

Resolution 75-158 authorizing acceptance of an easement granted by Patricia
Ann Phelan Milam, for the purpose of relocating sanitary sewer line in Block
15 of the Averill Addition was approved on a motion made by Councilman Evans
and seconded by Councilman Cash.

Resolution 75-159 authorizing acceptance of a 10 ' wide easement in Pine Is-
land Bayou Estates from Federal Land Corporation for general utilities pur-
poses (eventual service to Edgewater Drive) was approved on a motion made by
Councilman Evans and seconded by Councilwoman McGinnis.

Resolution 75-160 authorizing the City Manager to file an application for Tran-
sit Subsidy Assistance (UMTA form resolution required) was approved on a motion
made by Councilman Williams and seconded by Councilwoman McGinnis.

An amendatory ordinance regulating closing hours and holidays of local retail
package stores was considered:

LIQUOR AT CERTAIN TIMES AND ON CERTAIN DAYS; PRO-
VIDING FOR SEVERABILITY AND PROVIDING FOR REPEAL.
Councilman Williams made a motion to approve the ordinance because he said that,
at this time, it is evident that most package store dealers favor a return to
the 9 :00 p.m. closing set by state law and that the 8 : 00 p.m. curfew is an un-
fair restriction of competition in the interests of some and not others. The
motion failed for lack of a second.

City Manager reminded that Council was to meet with Architects - Dickson, Dick-
son, & Bullock - concerning Fair Park improvements.

Mayor Ritter announced that Councilman Don Cash had been recently elected Vice
Chairman of the South East Texas Regional Planning Commission Criminal Justice
Council.

Chief Bauer introduced Captain George Schuldt, Beaumont Police Department Train-
ing Officer, and said he has been nominated to attend Federal Bureau of Inves-
tigation' s National Academy at Quantico, Virginia, at no expense to the City.
Chief Bauer said Capt. Schuldt would be the 12th member of the Department to
attend.

Mayor Ritter recognized a student group in attendance. Mr. Steve Hutton, Hebert
High School, brought the rest of his government class who were unable to attend
last week' s session.

Mr. Gerald Buckley, 5750 Melsha Lane, urged Council to take action on the pro-
posed 5-member Study Board for various departments (proposed Police Review
Board) .
Mrs. P. G. Matthews & Mrs. Ezelle, Colonel George Moffett Chapter of the D.A.R. ,
addressed Council to request that the City participate with their group to make
necessary repairs and improvements to the Temple of the Brave located on Pipkin
Park so that it would be in good condition for the 1976 Bicentennial Celebra-
tions.
Mayor Ritter assured them that the City would take this project under considera-
tion.

Mr. H. K. Potter, 3550 South 6th Street, addressed the Council on behalf of the
package store owners opposing the 8 : 00 p.m. closing.
Mr. Leantha J. Redd, Executive Secretary of the Beaumont Chapter of N.A.A.C.P. ,
addressed Council to request action be considered for appointment of the
Study Committee for the Police Review Board.
Mr. J. F. Booker, 445 Adams, addressed Council to request parking facilities
be provided for Alice Keith Park for the convenience of senior citizens using
this facility.
