CITY COUNCIL - CITY OF BEAUMONT
HELD FEBRUARY" 25, 1975
BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in
regular session this the 25th day of February, 1975, with the following present:

The Invocation was given by Reverend Glen Moore, First Christian Church.
The Pledge of Allegiance was led by Councilman Williams.

Mayor Ritter issued one proclamation: `Beaumont Community Players Week" -
March 3-8 , 1975.

Mr. V. J. (Jerry) Panzo, .D:irector of information, Hawaiian Tourist Bureau,
presented a pineapple to Mayor Ritter as part of a promotion for the Hawaiian
Extravaganza scheduled for the- Houston Music Center March 12th. Mayor Ritter
presented Mr. Panzo with a key to the City of Beaumont.

The minutes of the regular session of the City Council held February 18, 1975,
were approved on a motion made by Councilwoman McGinnis and seconded by Coun-
cilman Evans,

Resolution 75-65 authorizing the award of bids for an annual contract to supply
hydrated lime for the Water Production Department to Austin White Lime, in the
amount of $47 .85 per ton, this being the best bid received, was approved on a
motion made by Councilman Evans and seconded by Councilman Williams .

Resolution 75-66 authorizing....the award of informal bids for furnishing one (1)
heavy duty sewing machine, for- the, Fire. Department to Jardell Sewing Machine
Exchange, Beaumont, in the amount of $1, 095.00, this being the best bid re-
ceived, was approved on a motion made by Councilman Williams and seconded by
Councilman Evans.

Resolution 75-67 authorizing the award of bids for furnishing one (1) Track
Paver used for l.ay.ing _ "hot mix" for the Street Department to R. B. Everett
Co. , Houston, in- the amount- of $5, 691.80, this being the lowest and best bid
received, was approved on a motion made by Councilwoman McGinnis and seconded
by Councilman Williams .

An ordinance amending section 42-20. 4 of the Code of Ordinances providing for
cluster housing was considered:

AN ORDINANCE AMENDING SECTION 42-20.4 OF THE
CODE OF ORDINANCES OF THE CITY OF BEAUMONT,
TEXAS, BY ADDING THERETO SUB-SECTIONS (e) ,
(f) , (g) and (h) ; PROVIDING FOR A DECLARATION
OF APPLICANT FOR CERTAIN COVENANTS RUNNING
WITH THE LAND; PROVIDING FOR THE CREATION OF
A CO-OWNERS ' ASSOCIATION; PROVIDING FOR ASSESS -
MENTS OF THE MAINTENANCE OF PRIVATE STREETS
AND UTILITIES , AND FOR THE PAYMENT OF UTILITIES
PROVIDED THE DEVELOPMENT; PROVIDING FOR LIENS
AGAINST THE PROPERTY FOR SAID ASSESSMENTS; PRO-
VIDING FOR THE ENFORCEMENT OF LIENS AND ASSESS-
MENTS; PROVIDING FOR OTHER LIENS AND ASSESSMEN'I'S

An ordinance providing for the issuance of a specific use permit for the develop-
ment of a cluster housing- project on the eastern portion of Tract 57, Plat SP-3 ,
H. Williams League, was considered:
ORDINANCE NO. 75-12
ENTITLED AN ORDINANCE FOR THE ISSUANCE OF A
SPECIFIC USE PERMIT FOR CLUSTER HOUSING DE-
VELOPMENT FOR AN 8. 505 ACRE TRACT IN ACCOR-
DANCE WITH A PLAN OF DEVELOPMENT; AND PRO-
VIDING FOR THE FILING OF A DECLARATION.
The ordinance was approved on a motion made by Councilman Evans and seconded by
Councilwoman McGinnis.

The application for a mass transit operating subsidy was not considered for
official action at this time.

Resolution 75-68 providing water and sanitary sewer facilities for the Mobil
Chemical Company located on U. S. 90 West of the Beaumont City limits was ap-
proved on a motion made by Councilwoman McGinnis and seconded by Councilman
Williams.

Resolution 75-69 authorizing the American National Bank to release $140, 000. 00
in securities was approved on a motion made by Councilman Evans and seconded
by Councilman Williams.

Resolution 75-70 authorizing payment in the amount of $264, 401. 52 to Miner-
Dedrick Construction Company (Police-Municipal Court Building - CIP 11-B-01)
was approved on a motion made by Councilwoman McGinnis and seconded by Coun-
cilman Williams.

Resolution 75-71 authorizing a change in the City Employee group insurance
coverage (Employee - $17 . 85; one dependent - $21. 30; and two or more depen-
dents - $36. 18) was approved on a motion made by Councilman Williams and se-
conded by Councilman Evans.

A resolution authorizing the City Manager to apply for a Community Development
Block Grant was not considered at this time but will be considered at the
special City Council session scheduled for 7 : 00 p.m. Thursday, February 27 ,
1975.

Mayor Ritter reappointed Commissioners Hosea Rasberry and Rex E. Lee to the
Housing Authority Board of Commissioners.

Mrs. Charlotte Dezelle and Mr. Clifford Hardeman were reappointed and Mr. Floyd
Dixon appointed to the Parks Advisory Committee on a motion made by Councilman
Williams and seconded by Councilman Evans.

Resolution 75-72 appointing Messrs. Abe Millgram; Luke Honea; H. E. Brown, Jr. ;
Bills and Larry Spillman to the 1975 Tax Equalization Board was approved on` a
motion made by Councilman Evans and seconded by Councilwoman McGinnis.

An ordinance establishing the Traffic Safety Support Committee was considered:
ORDINANCE NO. 75-13
ENTITLED AN ORDINANCE CREATING A TRAFFIC SAFETY
SUPPORT COMMITTEE IN THE CITY OF BEAUMONT AND
PROVIDING. THE DUTIES FORSAID COMMITTEE; PRO-
VIDING FOR SEVERABILITY; AND PROVIDING FOR REPEAL.
The ordinance was approved on a motion made by Councilman Williams and secon-
ded by Councilwoman McGinnis.

Resolution 75-73 appointing members to the Traffic Safety Support Committee
(Joyce Naivar, Edward L. Parker, Frank Hinchey, Arthur G. McDonald, Lt. B. F.

for two year terms beginning February 25, 1975; and Ward McCurtain, R. L.

William G. Childs, et ux, State of Texas, etc. (CIP 11-ST-07 - University Drive)
was approved on a motion made by Councilwoman McGinnis and seconded by Council-

Resolution 75-75 authorizing filing of eminent domain proceedings against
William G. Childs, et ux, First Security National Bank, etc. (CIP 11-ST-07 -
University Drive) was approved on a motion made by Councilman Williams and

Clara Mae Muirhead, Lamar State Bank, etc. (CIP 11-ST-07 - University Drive)
was approved on a motion made by Councilman Evans and seconded by Councilman

Resolution 75-77 authorizing filing of eminent domain proceedings against R.O. '
Williams, Jr. , Lorayne Groves, etc. (CIP 11-ST-07 - University Drive) was ap-
proved on a motion made by Councilwoman McGinnis and seconded by Councilman
Evans.

Resolution 75-78 declaring the intent of the City of Beaumont to join with
other governments for the purpose of preparing and implementing a coordinated'
waste treatment management plan was approved on a motion made by Councilman
Williams and seconded by Councilman Evans.

A dilapidated structures hearing was scheduled for the City Council session
to be held March 11, 1975 on a motion made by Councilwoman McGinnis and se-
conded by Councilman Williams.

Mr. Leantha J. Redd, Executive Secretary of the Beaumont Chapter N.A.A.C.P. ,
addressed the Council to express his appreciation for the continuing con-
cern in relation to establishing a Citizens Council on Human Relations.

Mrs. Jean Sprawls, no address stated (assumed 1055 Elaine Drive) addressed
Council to read a letter stating in part (letter in permanent record) "we
(citizens attending the February 3rd meeting where detailed presentation
by the City Manager and staff was given concerning proposed construction of
Dowlen Road) do not want any provision made for six-lane thoroughfare on
Dowlen Road -- not now and not at any time in the future. " The letter fur-
ther stated that the greatest need on Dowlen Road is "a safe place for our
children to walk and ride their bikes. "

Mrs. Booker, 935 Dowlen Road, presented a petition containing over 7 30 names"
opposing proposed design on Dowlen Road and asking that a sidewalk and/or a
bike lane be included in plans.
Mrs. Paul Bross, 6535 Daisy; Reverend Sam Jernigan, minister of Westgate_
Church of Christ; Mrs. Roy Pastorick, addressed assumed to be 6410 Westgate
Drive; Mr. J. E. Booker, 935 Dowlen; and Mr. Dan Broussard, 64.20 Daisy; all
addressed the Council in opposition to the proposed design for Dowlen Road—
City Manager Devero stated that the design would be drawn by the State Highway
Department.
Councilman Williams said citizens ' wishes should guide Council action.
Councilman Evans stated, as far as he is concerned, boulevard construction
for Dowlen Road is out.

Mr. Walter Keneson, 4045 Rothwell, addressed the Council to thank them for his
recent appointment to the Bi-Centennial Commission and to ask Mr. Redd about
his proposal for a Citizens Council on Human Relations.
Mr. Redd would not give details for Mr. Keneson saying that it was being ne-
gotiated with Council.
