The Minutes of the regular City Council session held August 6, 1974 , were ap-
proved on a motion made by Councilwoman McGinnis and seconded by Councilman
Evans.

An ordinance prohibiting the sale, consumption and possession of alcoholic bev-
erages in city parks was considered:
ORDINANCE NO. 74-51
ENTITLED AN ORDINANCE AMENDING CHAPTER 25 OF
THE CODE OF ORDINANCES BY AMENDING SECTION
25-6, ADDING A NEW SUBSECTION THERETO, ENTITLED
SUBSECTION (h) ; PROHIBITING THE SALE, CONSUMP-
TION, OR POSSESSION OF ANY ALCOHOLIC BEVERAGE
WITHIN ANY PARK; PROVIDING FOR EXCEPTIONS; PRO-
VIDING A PENALTY; PROVIDING FOR SEVERABILITY;
AND PROVIDING FOR REPEAL.
The ordinance was approved on a motion made by Councilman Evans and Councilman
Cash.

An ordinance establishing school zones on 4th Street between Glenwood and South-
erland Streets was considered:
ORDINANCE NO. 74-52
ENTITLED AN ORDINANCE AMENDING CHAPTER 37,
SECTION 37-58 .1 BY ADDING TO THE STREETS
AND LOCATIONS THEREIN A 20 MILE PER HOUR
SCHOOL ZONE ON FOURTH STREET BETWEEN GLEN-
WOOD AND SOUTHERLAND STREETS; PROVIDING FOR
A PENALTY; PROVIDING FOR REPEAL; AND PROVID-
ING FOR SEVERABILITY.
The ordinance was approved on a motion made by Councilman Evans and seconded
by Councilman Cash.

Resolution No. R-74-277 accepting bus grant ($2,253 ,204 .00 - 80%) from UMTA
and authorizing the City Manager to execute the bus grant agreement (City's
share $563,301. 00) was approved on a motion made by Councilman Cash and se-
conded by Councilwoman McGinnis.

Resolution No. R-74-278 authorizing the City Manager to sign a statement of
grant awards for CJC Grants, Police Public Services Bureau (Grant No. AC-74-
A02-2397) in the amount of $68 , 016 and Planning and Research (Grant No. AC-74-
D5-1623) in the amount of $21, 000 was approved on a motion made by Councilman
Cash and seconded by Councilwoman McGinnis.

Resolution No. R-74-279 authorizing the City Manager to execute Change Order
No. 4 on CIP Project No. 11-B-02, Central Library Building, providing for ad-
ditional storm drain lanes ($1,890.00) and extra painting ($145.00) was ap-
proved on a motion made by Councilwoman McGinnis and seconded by Councilman
Evans.

Resolution No. R-74-280 directing the commencement of proceedings in eminent
domain to acquire title to a 384 .879 acre tract out of the James Drake Survey
in Beaumont, Jefferson County, Texas for sanitary landfill purposes was ap-
proved on a motion made by Councilman Evans and seconded by Councilwoman
McGinnis.

Resolution R-74-281 approving amendments to the by-laws of the South East Texas
Regional Planning Commission was approved on a motion made by Councilman Cash
and seconded by Councilman Evans.

An ordinance changing the zoning of a 10.268 acre tract located on the west
side of Major Drive between the LNVA Canal on the north and the City Limits
on the south, from A-1 to R-2, and repealing conflicting ordinances was con-
sidered:

ENTITLED AN ORDINANCE REPEALING ORDINANCE
NUMBER 74-46; AMENDING CHAPTER 42 OF THE
CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND
IN PARTICULAR THE BOUNDARIES OF THE ZONING
DISTRICTS AS INDICATED UPON THE ZONING MAP
OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS,
BY CHANGING THE CLASSIFICATION OF A PARCEL
OF LAND OUT OF THE EASLEY LEAGUE, IN THE CITY
OF BEAUMONT, JEFFERSON COUNTY, TEXAS, AS DE-
SCRIBED HEREIN, PRESENTLY ZONED 'A-1K, TO
"R-2"; PROVIDING FOR SEVERABILITY; AND PRO-
VIDING A PENALTY.
The ordinance was approved on a motion made by Councilman Cash and seconded by
Councilwoman McGinnis.

City Manager, Kenneth Devero, presented the City Budget for the fiscal year
1974-75 to the Council. A Public Hearing for such was set for August 27, 1974 ,
on a motion made by Councilman Evans and seconded by Councilman Cash.

City Manager recognized Chief of Police, Willie Bauer, who introduced Lieuten-
ant James C. Smith as a current nominee to attend the Federal Bureau of Investi-
gation' s National Academy in Washington, D. C. (to be funded by the government)
and Lieutenant Gerald Waits who will attenu the Southern Police Institute in
Louisville, Kentucky (to be funded by Criminal Justice Council) .

The meeting was recessed before going into the Public Hearing on Dilapidated
Structures.

2100 Avenue A - In answer to questions by Asst. City Attorney, Lane Nichols, Mr.
Hardy described this structure as 50%+ deteriorated with 14 violations. He re-
commended it be condemned and demolished immediately. A motion to condemn and
demolish this structure was made by Councilman Evans and seconded by Councilwo-
man McGinnis.

2150 Avenue A - In answer to questions by Mr. Nichols, Mr. Hardy described this
structure as more than 50% deteriorated and was in definite violation of the
dilapidated structure ordinance. He recommended it be condemned and demolished
immediately. A motion to condemn and demolish this structure was made by Coun-
cilman Evans and seconded by Councilwoman McGinnis.

794 Beech Alley - In answer to questions by Mr. Nichols, Mr. Hardy described
this structure as having 21 violations to the dilapidated structure ordinance
and recommended it be condemned and demolished immediately. A motion to con-
demn and demolish was made by Councilwoman McGinnis and seconded by Councilman
Evans.

3845 Blodgett - In answer to questions by Mr. Nichols, Mr. Hardy described this
structure as more than 50% dilapidated with 17 violations of the dangerous
structure ordinance and recommended it be condemned and demolished immediately.
A motion to condemn was made by Councilwoman McGinnis and seconded by Council-
man Evans.

2289 Broadway - In answer to questions by Mr. Nichols, Mr. Hardy described this
structure as more than 50% deteriorated and stated that there had been no re-
sponse from Houston owners. He recommended this structure be condemned and de-
molished immediately. A motion to condemn and demolish this structure was made
by Councilman Evans and seconded by Councilwoman McGinnis.

2204 Carroll Street - In answer to questions by Mr. Nichols, Mr. Hardy described
this structure as beyond repair and stated that it had 22 violations to the dan-
gerous structure ordinance. He recommended it be condemned and demolished im-
mediately. A motion to condemn and demolish was made by Councilman Evans and
seconded by Councilwoman McGinnis.

2210 Carroll Street - In answer to questions by Mr. Nichols, Mr. Hardy stated
that he had had telephone communication from the owners attorney requesting
that additional time be given for possible refurbishing of this structure. Mr.
Hardy recommended the structure be condemned and the owner allowed 90 days ex-
tension. A motion to condemn and 90 days allowed was made by Councilman Evans
and seconded by Councilwoman McGinnis.

1463 Easy & 1463 Easy (Detached Shed) - In answer to questions by Mr. Nichols,
Mr. Hardy stated that these structures had more than 30 violations to the dan-
gerous structure ordinance and recommended they be condemned and demolished
immediately. A motion to condemn and demolish was made by Councilman Evans and
seconded by Councilwoman McGinnis.

that this structure was more than 50% deteriorated and had 22 violations to the
dangerous structure ordinance. He recommended it be condemned and demolished
immediately. A motion to condemn and demolish was made by Councilman Evans and
seconded by Councilwoman McGinnis.

1610 Avenue I - In answer to questions asked by Mr. Nichols, Mr. Hardy stated
that this structure had 13 violations to the dangerous structure ordinance and
recommended it be condemned and demolished immediately. A motion to condemn
and demolish was made by Councilwoman McGinnis and seconded by Councilman Evans.

2222 McFaddin Street - In answer to questions by Mr. Nichols, Mr. Hardy stated
that this structure had been partially burned and is in definite violation of
the dangerous structure ordinance. He recommended it be condemned and demol-
ished immediately. A motion to condemn and demolish was made by Councilwoman
McGinnis and seconded by Councilman Evans.

structure is partially dismantled and more than 50% dilapidated. He recommended
it be condemned and demolished immediately. A motion to condemn and demolish
was made by Councilman Evans and seconded by Councilwoman McGinnis.

that this structure is partially dismantled and has 18 violations to the dan-
gerous structure ordinance. He recommended it be condemned and demolished im-
mediately. A motion to condemn and demolish was made by Councilwoman McGinnis
and seconded by Councilman Evans.

that this structure is more than 50% deteriorated and is open and vacant; he
recommended it be condemned and demolished immediately. A motion to condemn
and demolish was made by Councilman Evans and seconded by Councilwoman McGinnis.

this structure is partially down and in definite violation to the dangerous
structure ordinance. He recommended it be condemned and demolished immediately.

Councilwoman McGinnis.

that this structure was open and vacant and had 15 violations to the dangerous
structure ordinance. He recommended it be condemned and demolished immediately.

Councilwoman McGinnis.

that this structure was more than 60% deteriorated and open and vacant. He re-
commended it be condemned and demolished immediately. A motion to condemn and
demolish was made by Councilwoman McGinnis and seconded by Councilman Evans.

1064 Sherman Street - In answer to questions by Mr. Nichols, Mr. Hardy stated
that this structure is open and vacant and has 15 violations to the dangerous
structure ordinance. He recommended it be condemned and demolished immediately-

Councilwoman McGinnis.

1464 Sherman Street - In answer to questions by Mr. Nichols, Mr. Hardy stated
that this structure is in poor condition and that both the front and back
porches were down. He further stated that he had had telephone communication
with the owner 's attorney requesting that additional time be given for possi-
ble refurbishing of this structure. He recommended it be condemned and the
owner allowed 90 days extension. A motion to condemn and all the 90 day ex-
tension was made by Councilman Evans and seconded by Councilwoman McGinnis.

structure was open and vacant and had 19 violations to the dangerous structure
ordinance. He recommended it be condemned and demolished immediately. A mo-
tion to condemn and demolish was made by Councilman Evans and seconded by Coun-
cilwoman McGinnis.

that this structure had 19 violations to the dangerous structure ordinance and
was abandoned by owners but was being used by someone. He recommended it be con-
demned and demolished immediately. A motion to condemn and demolish was made
by Councilwoman McGinnis and seconded by Councilman Evans.

structure was partially dismantled and had 22 violations to the dangerous struc-
ture ordinance. He recommended it be condemned and demolished immediately. A
motion to condemn and demolish was made by Councilman Evans and seconded by
Councilwoman McGinnis.

that'Eh-isstructure is closed at the present time and vacant for some time. He
further stated that it had 13 violations to our dangerous structure ordinance.
He recommended it be condemned and demolished immediately. A motion to condemn
and demolish was made by Councilman Evans and seconded by Councilwoman McGinnis.

this structure has 21, violations to the dangerous structure ordinance and re-
commended it be condemned and demolished immediately. A motion to condemn and
demolish was made by Councilman Evans and seconded by Councilwoman McGinnis.

that this structure is partially burned and more than 50% dilapidated and re-
commended it be condemned and demolished immediately. A motion to condemn and
demolish was made by Councilwoman McGinnis and seconded by Councilman Evans.

that tEls structure is more than 60% deteriorated and has 15 violations to the
dangerous structure ordinance. He recommended it be condemned and demolished

and seconded by Councilwoman McGinnis.
