The Pledge of Allegiance was led by Councilwoman McGinnis. -000- - resolution authorizing the award of bid for furnishing lime feed equipment for the Water Utilities Production Division, to Wallace & Tiernan/Pennwalt Corporation, in the amount of $2,560.00, this being the only bid received, was approved on a motion made by Councilman Cash and seconded by Councilman Evans. Question: Ayes: All Nayes : None -000- - request for permission to advertise for bids for furnishing plant materials for the Library, Police Station and City Hall (funding from CIP Projects 11-B-02, 11-B-01 & General funds) was approved on a motion made by Councilman Evans and seconded by Councilwoman McGinnis. Question: Ayes : All Nayes: None -000- Permission to reject bids received for the yearly supply of hot-mix cold lay asphaltic concrete material was granted on a motion made by Councilman Cash and seconded by Councilman Evans. Question: Ayes: All Nayes: None -000- An ordinance concerning Planning Division File 514-Z, to change the zoning of a 10. 268 acre tract located on the west side of Major Drive between the LNVA Canal on the north and the City Limits on the south, from A-1 to R-2 was considered: ORDINANCE NO. 74-46 ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS , AND -144- July 30, 1974 IN PARTICULAR THE BOUNDARIES OF THE ZONING DIS- TRICTS AS INDICATED UPON THE ZONING MAP OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, BY CHANG- ING THE CLASSIFICATION OF A PORTION OF TRACTS 2 and 3 AND ALL OF TRACTS 4 and 5 OUT OF 71-RS-5 D, EASLEY LEAGUE, IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, PRESENTLY ZONED "A-1" TO "R-2"; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. Question: Ayes: All Nayes: None -000- A resolution authorizing execution of two permits for the Texoma Pipe Line Company for pipe lines crossing the Weiss Canal (1. The Weiss Canal, located in the Sarah Gray Survey, A-152; Crossing at Canal Station 397 + 40 +, more particularly shown on Drawing No. TO-PA-1-6-2A, Jasper County, Texas—& 2. The Weiss Canal, located in the J. G. Wescott Survey, A-209; Crossing at Canal Station 236 + 15 +, more particularly shown on Drawing No. TO-PA-1-6-29B, Orange County, Texas) was approved on a motion made by Councilman Evans and seconded by Councilman Williams. Question: Ayes: All Nayes: None -000- - resolution authorizing execution of an easement granting to Gulf States Util- ities Company the right to operate and maintain an electric distribution sys- tem serving the City of Beaumont Water Utilities Service Center (11-WU-01) was approved on a motion made by Councilman Evans and seconded by Councilwoman McGinnis. Question: Ayes : All Nayes: None -000- - resolution authorizing approval of Supplemental Agreement No. 2-Corley, Madi- son, Sycamore CIP Project 11-ST-05, in the amount of $25, 035.00 for removal and replacement of 2,700 square yards of concrete sidewalk (contractor--JCN Pavers) was approved on a motion made by Councilman Cash and seconded by Coun- cilman Evans. Question: Ayes : All Nayes: None -000- A resolution authorizing the City Manager to enter into an agreement amending the contract with Central City Development and providing $3,900.00 for archi- tectural services by Gruen & Associates, such as schematic floor plans, typi- cal elevations and cross-sections, & perspective renderings of the proposed Civil Center Complex was approved on a motion made by Councilman Cash and seconded by Councilwoman McGinnis. Question: Ayes: All Nayes: None -000- The City Manager reappointed Mr. Dewey Gonsoulin to the Civil Service Commis``- sion for a three year term. The appointment was confirmed by the City Council on a motion made by Councilman Williams and seconded by Councilman Evans. Question: Ayes : All Nayes: None -000- - public hearing on approximately twenty-five (25) dilapidated structures was set to be held August 13, 1974, on a motion made by Councilman Williams and seconded by Councilman Evans. Question: Ayes: All Nayes: None -000- The City Manager introduced Mr. C. L. Overman'; the City's new Traffic Safety Coordinator. -000- -146- July 30, 1974 The Manager reminded the Council of a Public Hearing to be held at 7 :00 p.m. , August 1, 1974, to consider a request by Southwestern Bell Telephone Company for a rate increase. -000- The Mayor and Council presented Mr. Sylven Ducote a "Certificate of Apprecia- tion" for his service on the Board of Equalization. -000- (In verbatim) Mayor Ritter: "Any other member of the Council have anything they would like to bring up? If not, I would just like to make a brief comment on a matter effecting County government in the last day or so and say that I concur with the Acting County Judge's position on street systems in Bevil Oaks and incor- porated areas of the County. I have for a long time, as many others in local city government, felt like the proportionate share of the tax funds for the County was not spent in the cities or areas where the greatest population is and also the greatest need occurs. So, I would just like to go on record as saying I don't know what can be done about that, Mr. Attorney, but I would like for us to look into the legality as well. There has been one legal opinion and it just doesn't seem fair to me that the residents of Beaumont and other incorporated cities, particularly the larger cities of the County, pay their share of County taxes and others areas have their streets maintained for them; not to mention the Library services that are provided the other areas of the County and not for Beaumont or Port Arthur for example. So, I think it is time that maybe the municipalities had some input into the County in this type of operation and I would just like to go on record as wholeheart- edly supporting Judge Leonard Giblin's position on that and wish that he would be backed by the majority of the Commissioners - in particular whose precincts the programs are involved with. " Councilwoman McGinnis: "I concur with you, Mayor, and I think there is a pro- blem there. I think there should be additional legal opinions on that and I think -- during our budget hearings we found there were several areas in which the City of Beaumont is carrying more than its share of County expenses and I would like to see this Council go forward and see if we can receive a little more fair type of system. " Councilman Cash: "Mayor, I would like to ask our City Attorney if he could check into whether this falls into our territorial jurisdiction?" Kenneth Wall, City Attorney: "This is an incorporated City, Councilman, and so it is separate. " Mayor Ritter: "Mr. Attorney, if you would do some checking and maybe bring a report to the Council -- not necessarily a legal opinion -- of whatever you think is. . . . " Mr. Wall : "I 'd be happy to, Mayor. " Mayor Ritter: "I think we 'd like to have some more information on it. . . " (End of Verbatim) -000- Mr. George Hunter, Jr. (known as Effie Dropbottom) Effie's Go Go, 2057 Sabine Pass, addressed the Council regarding activities, and in particular baseball tournaments, held at Carroll Street Park on Sundays at which those sponsoring the tournaments (night club owners) were accused of selling beer for consump- tion during the tournaments; also the parking of cars in prohibited areas of the Park. Mr. Hunter denied any knowledge of the sale of beer, stating that he had hired two uniformed policemen to patrol the park during the tournaments. The parking problem he said had been corrected when called to his attention. All of this he said had been discussed with Councilman Williams. -147- July 30, 1974 TO CORRECT MINUTES OF JULY 30, 1974 Councilman Williams commended Mr. Hunter on the baseball tournaments but said that he had personally observed people at the Park on Sunday consuming beer and opposed this very. strongly, Mr. Williams said that, as he did with all complaints, he referred the matter to the City Manager to investigate, Ccun- cilman Williams also stated that while he had not been opposed in the jAv .- to the sale of beer on Sunday and the extension of curfew time, he would iaQ- a firm stand in the future against the consumption and sale of alcoholic bev- erages in any park in the City of Beaumont, Mr. Devero, City Manager, stated he had obtained sworn statements from the two policemen on duty at the park and they said they had not observed the sale of beer, Mr. Devero said that he would need definite proof of allegations to curtail any activity. -000- There being no further business, the meeting was adjourned -, -000- 1 , Myrtle Corgey, City Clerk of the City of Beaumont, Texas, certify that the above is a true copy of the Minutes of the regular session of the City Coun- cil held July 30, 1974 , Myrtle Corgey City Clerk -i48-
