CITY COUNCIL - CITY OF BEAUMONT
HELD JULY 23 , 1974
BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in
regular session this the 23rd day of July, 1974 , with the following present:

The Invocation was given by Rev. Weldon Langley, Chaplain for Baptist Hospital.
The Pledge of Allegiance was led by Councilman Evans.

The Mayor issued one proclamation: "Water Utilities Public Awareness Week in
Beaumont" - July 26-August 2, 1974 .

The Minutes of the regular City Council session held July 16, 1974, were ap-
proved on a motion made by Councilman Cash and seconded by Councilman Evans.

A resolution authorizing the award of bid for furnishing one variable speed
drive unit for the 23rd Street Lift Station, Water Reclamation Division, to
Southern Engine & Pump Company in the amount of $4 , 995. 00, as the only bid
received, was approved on a motion made by Councilman Evans and seconded by
Councilman Williams.

A resolution authorizing award of bid for furnishing a tape logging recorder
for the Police Department to Dictaphone Corporation in the amount of $14,563.63,
as the best bid received, was approved on a motion made by Councilman Cash and
seconded by Councilman Williams.

Permission to advertise for bids on Florida Avenue, CIP 11-ST-08, was granted
on a motion made by Councilman Evans and seconded by Councilman Cash.

A resolution authorizing execution of an agreement with the Texas Highway De-
partment of the State of Texas for the ramp control device on IH-10 near Gate-
way Shopping Center was approved on a motion made by Councilman Williams and
seconded by Councilman Cash.

A resolution accepting the improvements for Clay Circle, Blue Lake Estates, a
Participation Paving Project, (the City's portion - $900. 00) was approved on a
motion made by Councilman Williams and seconded by Councilman Cash.

A resolution authorizing execution of an agreement with Don Streety, developer
of Dowlen West Addition, for the paving of Shakespeare Drive in Dowlen West
Addition, Units 9, 10 and 11, to a residential collector street width with a
12" water line, a Participation Paving Project, (Project amount $44,801.78 -
City' s portion $9,800.10) was approved on a motion made by Councilman Cash and
seconded by Councilman Evans.

- resolution providing a six month moratorium on the issuance of oil well dril-
ling permits was considered:
A RESOLUTION
WHEREAS, recent events have called into question the adequacy of the
present ordinance of the City of Beaumont dealing with the issuance of oil well
drilling permits to protect the health, welfare, safety and property values of
the citizens of this city; and,
WHEREAS, the City Council desires that the current oil well permit ordi-
nance, the same being Chapter 24 of the Code of Ordinances of the City of Beau-
mont, be studied by the Community Development Department and the Legal Depart-
ment in conjunction with modern trends in the designing, locating and land-
scaping of oil well drilling sites, so that a comprehensive oil well drilling
permit ordinance can be submitted to the City Council at a later date; and,
WHEREAS, such a study should be completed within six (6) months; and,
WHEREAS , in order to maintain the status quo during the period of time
necessary to adequately study this problem, a moratorium on the granting of
oil well drilling permits in Beaumont will be necessary for a six (6) month
period;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT in order to maintain the status quo, no oil well drilling permit as pro-
vided in Chapter 24 of the Code of Ordinances of the City of Beaumont shall be
issued during a six (6) month period, said period beginning July 23 , 1974 ,
and ending December 23 , 1974, and prior to December 23 , 1974, the Community De-
velopment Department and the Legal Department are directed to prepare and sub-
mit to the City Council a comprehensive ordinance controlling the drilling of
oil and gas wells in the City of Beaumont.

The third and final reading of a franchise ordinance granting the Atchison,
Topeka and Santa Fe Railway Company the right to maintain and operate a track
crossing Jirou Street was considered:

ORDINANCE NO. 74-45
AN ORDINANCE GRANTING TO THE ATCHISON, TOPEKA AND
SANTA FE RAILWAY COMPANY, ITS SUCCESSORS, ASSIGNS
LESSEES , THE RIGHT AND PRIVILEGE TO MAINTAIN AND
OPERATE INDUSTRY SPUR TRACK NO. 70, UPON AND ACROSS
JIROU STREET WESTERLY OF BLOCK NO. 2 OF MCFADDIN'S
FIRST ADDITION TO THE CITY OF BEAUMONT IN THE CITY
OF BEAUMONT, JEFFERSON COUNTY, TEXAS, IN ACCORD
WITH EXHIBIT ATTACHED HERETO; PROVIDING THAT SAID
TRACK SHALL BE USED ONLY FOR THE PURPOSE OF LOADING,
UNLOADING AND SWITCHING TO INDUSTRIAL TRACK SERVING
COMMERCIAL ENTERPRISES; PROVIDING REGULATIONS AND
RESTRICTIONS FOR THE USE OF SAID TRACK; PROVIDING
THAT SUCH MAINTENANCE AND OPERATION BE IN ACCORDANCE
WITH THE CHARTER AND ORDINANCES OF THE CITY AND THAT
CERTAIN MAINTENANCE WORK SHALL BE DONE AT THE DIRECTION
OF THE CITY ENGINEER; PROVIDING FOR THE ACCEPTANCE AND
FEE HEREUNDER; PROVIDING THAT THIS FRANCHISE IS SUBJECT
TO THE CHARTER AND ORDINANCES OF THE CITY OF BEAUMONT
AND PROVIDING FOR TERMINATION FOR FAILURE TO USE THE
TRACK FRANCHISED HEREUNDER; PROVIDING FOR TERMINATION
OF THIS FRANCHISE ON JULY 16, 1979 AND THE RESTORATION
OF SAID STREET WITHIN NINETY (90) DAYS THEREAFTER;
AND PROVIDING FOR INDEMNIFICATION OF THE CITY OF
BEAUMONT.
The ordinance was approved on a motion made by Councilman Evans and seconded by
Councilman Cash.
