HELD JULY 9, 1974
BE TT REMEMBERED that the City Council of the City of Beaumont, Texas, met in
regular session this the 9th day of July, 1974 , with the following present:

The Invocation was given by Rev. Douglas Fincher, Fletcher Emanuel Baptist Church.
The Pledge of Allegiance was led by Councilwoman McGinnis.

The Mint4tes of the regular City Council session held July 2, 1974, were approved
on. 4 motion made by Councilman Williams and seconded by Councilwoman McGinnis.

A resolution authorizing the award of bid for furnishing Municipal Court benches
to Garnett Church Furniture & Mftg. Co. in the amount of $5,539 (CIP Project No.
11-B701) was approved on a motion made by Councilman Cash and seconded by Coun-
cilman Evans.

- resolution authorizing the award of bid for the construction of backstop fenc-
ing for two new tennis courts at Sprott Park to Allied Supply in the amount of
$5,789. 88, as the lowest and best bid received, was approved on a motion made
by Councilwoman McGinnis and seconded by Councilman Cash.

A resolution accepting street, storm sewer, water line and sanitary sewer im-
provements in Western Hills, Unit 4 Subdivision (The streets included in the
subdivision are as follows : Forrest Glade from north lot line of Lot 22 ,
Block l to Ridge Oak Street; Ridge Oak from Western Trail Street to Forrest
Glade Street; Western Trail from the north lot line of Lot 23, Block 4 to
Ridge Oak Street; and Indian Trail from the north lot line of Lot 14, Block 3
to the south lot line of Lot 30, Block 1. ) was approved on a motion made by
GotinQi.lman Williams and seconded by Councilman Evans.

A resolution authorizing Beaumont Well Works Company, Inc. , to install a 1-12''
air line and a 1" water line under Archie Street in the vicinity of their of-
fice buildings was approved on a motion made by Councilwoman McGinnis and se-
conded by Councilman Cash.

A' resoï¿œution authorizing American National Bank to release $2, 900, 000 in U.S .
Treasury Bills and substitute $1, 000, 000 project notes for collateral was ap-
proved on a motion made by Councilman Cash and seconded by Councilwoman Mc-
Ginnis.

A resolution authorizing -t I tie City Manager to execute a lease with El Mina Temple
AAONMS of Galveston County, Texas, for the use of the Arena Area of Fair Park
to stage a public circus August 24 & 25, 1974 , was approved on a motion made by
Councilman Evans and seconded by Councilman Williams.

A resolution authorizing release of a weed lien against Palm Branch Court in
the. amount of $7. 08 was approved on a motion made by Councilwoman McGinnis and
seconded by Councilman Evans.

A resolution approving the urban system streets and authorizing the Mayor to
sign tho official map showing the urban system street network was approved on
a motion made by Councilman Williams and seconded by Councilwoman McGinnis.

Mr. Eddie Whitnell, Director of Traffic & Transportation, presented a Map showing
streets that would be included in proposed federal funding and he further ex-
plained that this system would replace TOPICS and the Metro System.

A resolution appointing Mrs. David W. Granitz to the Planning and Zoning Com-
mispip'n to fill the unexpired term vacated by Mrs. Vi McGinnis to July 31, 1974
and to serve a new three (3) year term was approved on a motion made by Council-
woman McGinnis and seconded by Councilman Cash.

A Public Hearing regarding a request for a rate increase by Southwestern Bell
Telephone Company was scheduled to be held August 1, 1974 , at 7 : 00 p.m. , on
a motion made by Councilwoman McGinnis and seconded by Councilman Williams.

The third and final reading of a franchise ordinance granting Atchison, Topeka
and $antA Fe Railway Company the right to maintain and operate a track crossing
Blanchette Street was considered:
ORDINANCE NO. 74-44
AN ORDINANCE GRANTING TO THE ATCHISON, TOPEKA AND
SANTA FE RAILWAY COMPANY, A DELAWARE CORPORATION,
ITS SUCCESSORS, ASSIGNS AND LESSEES, THE RIGHT AND
PRIVILEGE TO MAINTAIN AND OPERATE ITS INDUSTRY LEAD
TRACK NO. 85 FROM A POINT IN THE SOUTHEASTERLY LINE
OF BLANCHETTE STREET TO A POINT IN THE NORTHEASTERLY
LINE OF MAIN STREET AT A DISTANCE OF 110 FEET, MORE
OR LESS, IN, OVER AND ACROSS SAID STREET IN THE
CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS , IN ACCORD
WITH EXHIBIT ATTACHED HERETO: PROVIDING THAT SAID
TRACK SHALL BE USED ONLY FOR THE PURPOSE OF LOADING,
UNLOADING AND SWITCHING TO INDUSTRIAL TRACKS SERVING
COMMERCIAL ENTERPRISES; PROVIDING REGULATIONS AND
RESTRICTIONS FOR THE USE OF SAID TRACK; PROVIDING
THAT SUCH MAINTENANCE AND OPERATION BE IN ACCORDANCE
WITH THE CHARTER AND ORDINANCES OF THE CITY AND THAT
CERTAIN MAINTENANCE WORK SHALL BE DONE AT THE
DIRECTION OF THE CITY ENGINEER; PROVIDING FOR THE
ACCEPTANCE AND FEE HEREUNDER; PROVIDING THAT THIS
FRANCHISE IS SUBJECT TO THE CHARTER AND ORDINANCES
OF THE CITY OF BEAUMONT AND PROVIDING FOR TERMINATION

PROVIDING FOR TERMINATION OF THIS FRANCHISE ON
JUNE 24, 1975 AND THE RESTORATION OF SAID STREETS
WITHIN NINETY (90) DAYS THEREAFTER; AND PROVIDING
FOR INDEMNIFICATION OF THE CITY OF BEAUMONT.
The ordinance was approved on a motion made by Councilman Cash and seconded by
Councilwoman McGinnis.

A Vesolution ratifying the execution of a contract with Charles Kuralt desig-
nating him dedicatory speaker at the official Library opening, scheduled to
be September 22, 1974, at 2 : 00 p.m. , was approved on a motion made by Council-
man Evans and seconded by Councilwoman McGinnis.

Mr, Joe Bob Kinsel, Sr. , addressed the Council to present the Citizen's Acti-
vities Program Steering Committee ' s recommended program of improvements, a
$26, 000, 000 bond package, which is as follows :
I. Civic Center Complex (and including five alternatives) .
II. Thoroughfare Improvements Related to Development of CBD
and Southeast Beaumont Industrial Complex. This includes
Lamar Freeway, Orleans-Pearl Connector, Orleans Modifica-
tions, Blanchette, Riverfront Boulevard, Buford, Carroll
and Signal System Downtown.
III. Other Streets and Thoroughfares to include : West Lucas,
Dowlen Road, Fourth Street, Concord Road and Live Oak,
Live Oak and Mariposa (Gulf to IH-10) , Crow Road, Twenty-
third (Washington to Phelan) , Delaware-Pine to Concord,
and East Caldwood and Lindbergh.
IV. Fair Park.
V. Beaumont Transit,
VI. Beaumont Municipal Airport.
VII. School Safety and Sidewalk Program.

Mr. David Allardyce, West End Family YMCA, asked that the widening of Dowlen
Road near the West End YMCA be included in the CAP recommendations because
the members are concerned about the safety of the 4, 000 children who use the
fadility' and ride bikes on Dowlen Road.
Mrs. Andrew Johnson, 2093 Central, addressed the Council in support of Mr.
Allardyce' s request to widen Dowlen.
Mr. Walter Kaczmarz, 8755 Homer Drive, addressed the Council to voice his
opinion on a proposed bond issue for several million dollars saying that we
should pay as we go rather than pay interest on borrowed money.
Mr. Ben Rogers addressed the Council to request, along with CAP proposals,
that POwlen Road be completed from Gladys to Parkdale and that access streets
be prgv*ded for Parkdale. He stated that future expansion can not be accom-
plished until access to the shopping center is provided.
