CITY COUNCIL - CITY OF BEAUMONT
HELD JUNE 11, 1974
BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in
regular session this the 11th day of June, 1974 , with the following present:
HONORABLE: Ken Ritter Mayor

Absent: Don Cash Councilman, Ward I

ThE Invocation was given by Dr. Mouzon Biggs, Trinity United Methodist Church.
The Pledge of Allegiance was led by Councilwoman McGinnis.

The Mayor issued one proclamation: "Flag Day in Beaumont" - June 14 , 1974 .

A motion to approve the minutes of the regular City Council session held
June 4, 1974, was made by Councilwoman McGinnis and seconded by Councilman
Evans.

A resolution authorizing the award of bid for furnishing one 10-ton, 120, 000
BTU air conditioning unit to Lindy Dennis Air Conditioning Company in the
amount of $1,176. 00 as the lowest and best of informal bids received was ap-
proved on a motion made by Councilman Evans and seconded by Councilwoman
McGinnis.

Authorization for bids to be taken on properties condemned by the City Council
on February 19, 1974, was given on a motion made by Councilwoman McGinnis and
seconded by Councilman Evans.

Mr. Walter Kenneson, Manager of the Building Trades Union, addressed the Coun-
cil to suggest that some of these contractors might want to donate lumber from
these dilapidated structures to be used in refurbishing of substandard houses
by citizen groups.

A resolution approving specifications and authorizing the advertising for bids
for providing furnishings for the Police-Municipal Court Building was approved
on a motion made by Councilman Evans and seconded by Councilwoman McGinnis.

A resolution authorizing the City Manager to sign an agreement between the State
of Texas and the City of Beaumont concerning the placement of a 24" water line
across the Neches River Bridge was approved on a motion made by Councilman
Evans and seconded by Councilwoman McGinnis.

A resolution authorizing the American National Bank to release $1, 035, 000 in
securities was approved on a motion made by Councilwoman McGinnis and seconded
by Councilman Evans.

A resolution authorizing release of weed lien ($16. 53) to Gabriel Duriso on
Lots 32 and 33, Block 2, Virginia Estates Addition, was approved on a motion
made by Councilwoman McGinnis and seconded by Councilman Evans.

An ordinance authorizing installation of parking meters on the new city parkins
lot was considered:
ORDINANCE NO. 74-42
ENTITLED AN ORDINANCE AMENDING CHAPTER 37, SECTION
37-124 BY ADDING A NEW SUBSECTION 37-124 (c) ; PROVID-
ING FOR THE INSTALLATION OF PARKING METERS ON CITY
OWNED LAND BOUNDED BY MAIN, WALL, MARKET AND COLLEGE
STREETS; PROVIDING FOR REPEAL; AND PROVIDING FOR
SEVERABILITY.
The ordinance was approved on a motion made by Councilman Evans and seconded by
Councilwoman McGinnis.

A resolution accepting the resignation of Mr. Sylven Ducote from the Board of
Equalization and appointing Mr. William C. Key as a replacement was approved
on a motion made by Councilwoman McGinnis and seconded by Councilman Evans.

A motion appointing Robert L. Thomas as Chief Magistrate and Wendell C. Radford
as Deputy Magistrate for Municipal Court was made by Councilwoman McGinnis and
seconded by Councilman Evans. (These terms are for two (2) years. )

The second reading of a franchise ordinance granting the Atchison, Topeka and
Santa Fe Railway Company the right to maintain and operate a tract crossing
Blanchette Street was held. The caption of said ordinance is as follows:

AN ORDINANCE GRANTING TO THE ATCHISON, TOPEKA AND
SANTA FE RAILWAY COMPANY, A DELAWARE CORPORATION,
ITS SUCCESSORS, ASSIGNS AND LESSEES , THE RIGHT AND
PRIVILEGE TO MAINTAIN AND OPERATE ITS INDUSTRY LEAD
TRACK NO. 85 FROM A POINT IN THE SOUTHEASTERLY LINE
OF BLANCHETTE STREET TO A POINT IN THE NORTHEASTERLY
LINE OF MAIN STREET AT A DISTANCE OF 110 FEET, MORE
OR LESS, IN, OVER AND ACROSS SAID STREETS IN THE
CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, IN ACCORD
WITH EXHIBIT ATTACHED HERETO; PROVIDING THAT SAID
TRACK SHALL BE USED ONLY FOR THE PURPOSE OF LOADING,
UNLOADING AND SWITCHING TO INDUSTRIAL TRACKS SERVING
COMMERCIAL ENTERPRISES; PROVIDING REGULATIONS AND
RESTRICTIONS FOR THE USE OF SAID TRACK; PROVIDING

THAT SUCH MAINTENANCE AND OPERATION BE IN ACCORDANCE
WITH THE CHARTER AND ORDINANCES OF THE CITY AND THAT
CERTAIN MAINTENANCE [STORK SHALE BE DONE AT THE DIREC-
TION OF THE CITY ENGINEER; PROVIDING FOR THE ACCEPT-
ANCE AND FEE HEREUNDER; PROVIDING THAT THIS FRANCHISE
IS SUBJECT TO THE CHARTER AND ORDINANCES OF
THE CITY OF BEAUMONT AND PROVIDING FOR TERMINATION
FOR FAILURE TO USE THE TRACK FRANCHISED HEREUNDER,
PROVIDING FOR TERMINATION OF THIS FRANCHISE ON
JUNE 24, 1975 AND THE RESTORATION OF SAID STREETS
WITHIN NINETY (90) DAYS THEREAFTER; AND PRO'V'IDING
FOR INDEMNIFICATION OF THE CITY OF BEAUMONT.

The Mayor reported that he had attended the Annual Conference for Mayors and
Councilmen sponsored by the Texas Municipal League and held in Corpus Christi,
Texas.

Mr. Walter Kenneson, Manager of the Building Trades Union, addressed the Coun-
cil to say that the demolition project of dangerous structures would provide
good summer jobs for local teenagers. Mayor Ritter told Mr. Kenneson that
the Staff would look into this possibility.
