HomeMy WebLinkAboutJUN 04 1974 REGULAR SESSION CITY COUNCIL - CITY OF BEAUMONT HELD JUNE 4 , 1974 BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 4th day of June, 1974 , with the following present: HONORABLE: Ken Ritter Mayor Don Cash Councilman, Ward I George Dishman, Jr. Councilman, Ward II Calvin Williams Councilman, Ward III Leroy Evans Councilman, Ward IV Appointed Officials: Kenneth Devero City Manager Myrtle Corgey City Clerk Lane Nichols Asst. City Attorney -000- The Invocation was given by Reverend James V. Thompson, Calvary Baptist Church. The Pledge of Allegiance was led by Councilman Williams. -000- Federal District Judge William Steger administered Oaths of Office for new terms to be served by the following: Mayor, Ken Ritter; Councilman, Ward I, Don S. Cash; Councilwoman, Ward II, Vi McGinnis; Councilman, Ward III, Calvin Williams; and Councilman, Ward IV, Leroy Evans. -000® Mr. Maurice Meyers, Tourism & Convention Bureau presented an "Info Board" to the Council. Mr. Meyers advised the Council that such Info Boards indicating things of interest in Beaumont were to be placed in restaurants, hotels, motels, and six (6) Texas Highway rest stops . -000® Mr. Larry Porter, Young Men' s Business League, presented Ties and Box Seat Tickets for the Y.M.B.L. Rodeo to be held June 6, 7 & 8 , 1974. -000- A motion to approve the minutes of the regular City Council session held may 28 , 1974 and the special session held May 30, 1974 was made by Councilman Williams and seconded by Councilman Cash. Question: Ayes : All Nayes : None -000® A resolution authorizing the award of bid for furnishing Sodium Silicofluoride for water fluoridation for the Water Production Department for a one year sup- ply, beginning June 1, 1974, to McKesson Chemical Company in the amount of $5, 575. 00, the only bidder, was approved on a motion made by Councilman Cash and seconded by Councilman Williams. Question: Ayes : All Nayes : None -000- A resolution authorizing the award of bid for furnishing irrigation materials for the Municipal Center Complex to Industrial Plastics in the amount of $3500. 45 for Group 1; to Universal Palestine in the amount of $2815.16 for Group No. 2, 4, 9, & 11; and to Hall Equip. & Supply in the amount of $1161.26 for Group No. 5, 6, 8, & 10, as the lowest and best bidders was approved on a motion made by Councilman Evans and seconded by Councilwoman McGinnis. Question: Ayes : All Nayes : None An ordinance regarding Planning Division File 211-OB, to abandon a portion of West Highland Drive which runs through Blocks 2 , 3 , 5, & 6 of the Annie T. Warren Subdivision, west of Virginia Estates, was considered: ORDINANCE NO. 74-40 ENTITLED AN ORDINANCE VACATING AND CLOSING THAT PORTION OF WEST HIGHLAND DRIVE FROM THE VIRGINIA ESTATES ADDITION WEST TO CARDINAL DRIVE, AS DESCRIBED HEREIN. The ordinance was approved on a motion made by Councilman Cash and seconded by Councilman Evans. Question: Ayes : All Nayes : None -000- An ordinance regarding Planning Division File .217-OB, for abandonment of one ten foot easement out of the A. Williams Survey Abstract 385 and acceptance of a new ten foot easement along the west ten feet of subject property was con- sidered: ORDINANCE NO. 74-41 ENTITLED AN ORDINANCE VACATING AND ABANDONING A TEN FOOT (10' ) WIDE EASEMENT STRIP OUT OF THE A. WILLIAMS SURVEY, ABSTRACT 385, JEFFERSON COUNTY, TEXAS. The ordinance was approved on a motion made by Councilman Williams and seconded by Councilman Evans. Question: Ayes : All Nayes : None A resolution authorizing release of tax judgment against Mitchell T. Evans , et al, in -the amount of $621.10, was approved on a motion made by Councilman Williams and seconded by Councilwoman McGinnis. Question: Ayes : All Nayes : None -000- The first reading of a franchise ordinance granting the Atchison, Topeka and Santa Fe Railway Company the right to maintain and operate a tract cross- ing Blanchette Street was held. The caption of said ordinance is as follows : AN ORDINANCE AN ORDINANCE GRANTING TO THE ATCHISON, TOPEKA AND SANTA FE RAILWAY COMPANY, A DELAWARE CORPORATION, ITS SUCCESSORS, ASSIGNS AND LESSEES, THE RIGHT AND PRIVILEGE TO MAINTAIN AND OPERATE ITS INDUSTRY LEAD TRACK NO. 85 FROM A POINT IN THE SOUTHEASTERLY LINE OF BLANCHETTE STREET TO A POINT IN THE NORTHEASTERLY LINE OF MAIN STREET AT A DISTANCE OF 110 FEET, MORE OR LESS, IN, . The ordinance was passed. to its second reading on a motion made by Councilman Evans and seconded by Councilman Cash. Question: Ayes: All Nayes : None -000- - resolution authorizing and directing the filing of Proceedings in Eminent Domain against Bryant, Bryam & Swain, a Partnership composed of Samuel L. Bryant, A. Lloyd Byram and David H. Swain to acquire through said proceedings an easement in, under and across a certain parcel of land out of Lots 3 & 4 of Block 4 of the Dishman Addition and across one-half of the abutting South- ern Pacific Railroad 100 ' right-of-way to the City of Beaumont, in the C. Williams Survey of Jefferson County, Texas, (CIP 12-SU-04) was approved on a motion made by Councilman Williams and seconded by Councilman Evans. Question: Ayes : All Nayes : None -000- A resolution authorizing the City Attorney to commence negotiations with land- owners for the right-of-way needed in the College and Fourth Street Project, C. T.P. Project 11-ST-02, was approved on a motion made by Councilwoman McGinnis and seconded- by Councilman Evans. Question: Ayes: All Nayes : None -000- - resolution approving plans and specifications and authorizing advertising for bids on College Street, C. I.P. Project 11-ST-02, was approved on a motion made by Councilman Williams and seconded by Councilman Cash. Question: Ayes : All Nayes : None -000- - resolution authorizing the City Manager to sign all documents necessary to subscribe to the Texas Municipal League ' s Workmen's Compensation Plan and au- thorizing payment of 1/12th of the estimated annual premium was approved on a motion made by Councilman Cash and seconded by Councilman Williams. Question: Ayes: All Nayes : None -000- - resolution authorizing the City Manager to execute an application with the Criminal Justice Council for Supplemental Model Recruiting and Selection Grant in the amount of $24, 750. 00, was approved on a motion made by Councilman Williams and seconded by . Councilman Evans. Question: Ayes: All Nayes : None -000- A resolution authorizing the City to pay the State $10, 500 as its supplemental share of the cost in the 11th Street Project M-5334 (2) was approved on a motion made by Councilman Cash and seconded by Councilwoman McGinnis. Question: Ayes : All Nayes : None -000- A resolution authorizing the City Manager to execute documents relative to the Comprehensive Manpower Plan as created by the Consortium agreement entered into -3- between the City of Beaumont and Jefferson, Orange, and Hardin Counties was ap- proved on a motion made by Councilman Williams and seconded by Councilman Evans. Question: Ayes : All Nayes : None -000- A resolution authorizing the purchase of a filter for a swimming pool at Liberia Park in the amount of $4, 018. 00 and authorizing transfer of necessary funds to the appropriate budget account was approved on a motion made by Councilman Cash and seconded by Councilman Evans. Question: Ayes: All Nayes : None -000- Dr. L. L. Melton, Family Y.M.C.A. , thanked the Council again for action taken May 14, 1974 , when Mayor Ritter proclaimed Dr. L. L. Melton Day - May 19, 1974 . -000- A short recess was taken before reconvening for the Dilapidated Structure Hear- ing to be held. DILAPIDATED STRUCTURE HEARING THOSE present for the Dilapidated Structure Hearing were as follows: Ken Ritter Mayor Don Cash Councilman, Ward I Vi McGinnis Councilwoman, Ward II Calvin Williams Councilman, Ward III Leroy Evans Councilman, Ward IV Lane Nichols Asst. City Attorney Leonard Hardy Dir. Environmental Control Myrtle Corgey City Clerk -000- 1000 Buford - In answer to questions asked by Mr. Lane Nichols, Asst. City At- torney, Mr. Hardy stated that this structure had 22 violations of the Dangerous Structure Ordinance and that all proper notices had been sent. He recommended that the structure by condemned and demolished immediately. Reverend W. N. McCarty, Starlight Baptist Church, and members of the church owning this struc- ture agreed with Mr. Hardy' s recommendation. A motion to condemn this structure was made by Councilman Williams and seconded by Councilman Evans. Question: Ayes : All Nayes : None -000- 1380 Buford Street - Mr. Hardy stated that all proper notices had been sent con- cerning this structure which was 33% dilapidated and definitely in violation of the Dangerous Structure Ordinance and he recommended it be condemned and demol- ished immediately. A- motion to condemn this structure was made by Councilman Williams and seconded by Councilman Evans. Question: Ayes: All Nayes: None -000- 830 Catalpa Street - Mr. Hardy stated that all proper notices had been sent con- cerning this structure which is definitely in violation of the Dangerous Struc- ture Ordinance; he recommended it be condemned and demolished immediately. A motion to condemn this structure was made by Councilman Cash and seconded by Councilman Williams. Question: Ayes : All Nayes : None -000- -4- 920 Crockett Street - Mr. Hardy stated that all proper notices had been sent concerning this structure which has 18 violations of the Dangerous Structure Ordinance. Mr. Hardy recommended this structure be condemned and demolished immediately. A motion to condemn this structure was made by Councilman Williams and seconded by Councilman Evans. Question: Ayes: All Nayes : None -000- 926 Crockett Street - Mr. Hardy stated that this structure had 14 violations of the Dangerous Structure Ordinance and all proper notices had been sent. He recommended it be condemned and demolished immediately. A motion to condemn this structure was made by Councilman Evans and seconded by Councilman Williams. Question: Ayes : All Nayes : None -000- 936 Crockett Street - Mr. Hardy stated that this structure had 15 violations of the Dangerous Structure Ordinance and .all proper notices had been sent. He recommended it be condemned and demolished immediately. A motion to condemn this structure was made by Councilman Evans and seconded by Councilman Williams. Question: Ayes: All Nayes : None -000- 710 Cuniff Street - Mr. Hardy stated that this structure had been partially burned and had 14 violations of the Dangerous Structure Ordinance. He recom- mended it be condemned and demolished immediately. A motion to condemn this structure was made by Councilman Williams and seconded by Councilman Evans. Question: Ayes: All Nayes : None -000- 2055 Dexter Street - Mr. Hardy stated that this structure was 50% dilapidated and in definite violation of the Dangerous Structure Ordinance and recommended it be condemned and demolished immediately. A motion to condemn this structure was made by Councilman Evans and seconded by Councilman Williams. Question: Ayes: All Nayes: None -000- 2075 Dexter - Mr. Hardy stated that this structure had 14 violations of the Dangerous Structure Ordinance..and recommended it be condemned and demolished immediately. A motion to condemn this structure was made by Councilman Williams and seconded by Councilwoman McGinnis. Question: Ayes : All Nayes : None -000- 1570 Fulton Street - Mr. Hardy stated that this structure was 50% burned and in definite violation of the Dangerous Structure Ordinance. He recommended it be condemned. and demolished immediately. A motion to condemn this structure was made by Councilman Williams and seconded by Mayor Ritter. Question: Ayes : All Nayes : None -000- 897 Gladys Street Mr. Hardy stated that this structure had 16 violations of the Dangerous Structure Ordinance and recommended it be condemned and demolished immediately. A motion to condemn and demolish this structure was made by Coun- cilman Evans and seconded by Councilman Williams . Question: Ayes: All Nayes : None -000- -5- 1775 Grand Street - Mr. Hardy stated that this structure had 32 violations of the Dangerous Structure Ordinance and recommended it be condemned and demol- ished immediately. A motion to condemn this structure was made by Councilman Evans and seconded by Councilman Williams. Question: Ayes : All Nayes : None -000- 1170 Harriot Street - Mr. Hardy stated .that this structure had 21 violations of the Dangerous Structure Ordinance and recommended it be condemned and de- molished immediately. A motion to condemn this structure was made by Coun- cilman Williams and seconded by Councilman Cash. Question: Ayes: All Nayes : None -000- 1297 Avenue A - Mr. Hardy stated this structure has 12 violations of the Dan- gerous Structure Ordinance and recommended it be condemned and demolished immediately. A motion to condemn this structure was made by Councilman Wil- liams and seconded by Councilman Evans. Question: Ayes: All Nayes : None -000- 1445 Maple Street - Mr. Hardy stated that this structure had 14 violations of the Dangerous Structure Ordinance - a permit to .repair this structure was taken out in 1973 but no work was ever done. He recommended- this structure be con- demned and demolished immediately. A motion to condemn this structure was made by Councilman Evans and seconded by Councilman Williams. Question: Ayes: All Nayes : None -000- 530 Mary Street - Mr. Hardy stated that this structure is owned by McCabe Meth- odist Church and that no response had been given_ to _notices sent. He further stated that this structure .had .20+ violations of the Dangerous Structure Ordi- nance and recommended it be condemned and demolished immediately. A motion to condemn this _structure was made by Councilman Williams and seconded by Council- man EI(rans. Question: Ayes : All Nayes: None -000- 1780 Port Street - Mr. Hardy stated that the roof is completely down in this structure and it is very unstable. He recommended it be condemned and demol- ished immediately. A motion to condemn this structure was made by Councilman Evans and seconded by Councilman Williams . Question: Ayes : All Nayes : None -000- 3410 Roland Street - Mr. Hardy stated that this structure has been partially burned and hag'-24 violations of the Dangerous Structure Ordinance. He recom- mended it be condemned and demolished immediately. A motion to condemn this structure was made by Councilman Evans and seconded by Councilman Williams. Question: Ayes: All Nayes: None -000- 3290 St. James Boulevard - Mr. Hardy stated that this structure has 14 viola- tions of the Dangerous Structure Ordinance and is more .than 33% dilapidated and recommended it be .condemned and demolished immediately. A motion to con- demn this structure was made by Councilman Williams and seconded by Mayor Ritter. Question: Ayes : All Nayes : None -000- -6- 1025 VanBuren Street - Mr. Hardy stated that this structure had 14 violations of the Dangerous Structure Ordinance and recommended it be condemned and de- molished immediately. A motion to condemn this structure was made by Council- man Williams and seconded by Councilwoman McGinnis.
