BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met
in regular session on the 2nd day of October, 1973, with the following pre-

The Mayor issued two proclamations: "World Lion Service Week in Beaumont" -
October 8-14 , 1973 and "Country Music Month in Beaumont" - month of October.

The Minutes of the regular City Council sessions held September 18th and
September 21st were approved on a motion made by Councilman Evans and se-
Gonded by Councilman Cash.

In response to an advertisement previously published, the following bids for
furnishing necessary materials, equipment, superintendence, and labor for
paving and storm drainage for the construction of Eighth Street between Wash-
ington Boulevard and Terrell Street (Street Participation Program) were re-
ceived:

The following ordinance determining the necessity for and ordering that Blos-
som Drive, Parish Street and Procter Street in Fleetwood Addition be improved;
adopting and approving plans and specifications, providing that a part of the
cost be paid by the City and a part by assessment against the abutting pro-
perty owners; providing for advertising for bids, etc. was introduced and
read:
ORDINANCE NO. 73-65
ENTITLED AN ORDINANCE DETERMINING THE NECESSITY
FOR AND ORDERING THAT BLOSSOM DRIVE FROM WASHING-
TON BLVD. TO SOUTH LINE OF BLOCKS 1 AND 2 IN
FLEETWOOD ADDITION, AND OF PARISH AND PROCTER
STREETS FROM BLOSSOM DRIVE EAST TO END, PUBLIC
STREETS IN THE CITY OF BEAUMONT, TEXAS, SHALL
BE IMPROVED; ADOPTING AND APPROVING PLANS AND
SPECIFICATIONS FOR SUCH IMPROVEMENTS; LISTING
APPARENT PROPERTY OWNERS ABUTTING ON SAID PORTION
OF SAID STREETS; PROVIDING THAT A PART OF THE
COST SHALL BE PAID BY THE CITY AND A PART THERE-
OF SHALL BE PAID BY ASSESSMENTS AGAINST THE
ABUTTING PROPERTY AND THE OWNERS THEREOF; FIND-
ING AND DETERMINING THAT LOWER BIDS FOR SAID
CONSTRUCTION WILL BE RECEIVED IF THE CONTRACT
FOR THE WORK PROVIDES FOR PAYMENT IN CASH BY THE
CITY RATHER THAN PAYMENT BY PAVING CERTIFICATES;
PROVIDING FOR CITY FINANCING OF PAVING CERTIFI-
CATES ISSUED ON SAID PROJECT; PROVIDING FOR LEV-
YING ASSESSMENTS AGAINST ABUTTING PROPERTY; PRO-
VIDING THAT ALL AMOUNTS RECEIVED BY THE CITY
UNDER THIS PROJECT SHALL BE PAID INTO THE FUND
OR FUNDS FROM WHICH THE APPROPRIATION FOR THE
CONSTRUCTION CONTRACT WAS MADE; PROVIDING THE
TIME, TERMS AND CONDITIONS OF PAYMENT AND DEFAULTS
OF SAID ASSESSMENTS; DIRECTING THE CITY CLERK
TO FILE NOTICE OF INTENT TO ASSESS; DIRECTING
THE CITY CLERK TO ADVERTISE FOR BIDS FOR THIS
PROJECT; INVOKING THE PROCEDURE OF ARTICLE
1105b OF THE REVISED CIVIL STATUTES OF THE STATE
OF TEXAS; AND PROVIDING FOR SEVERABILITY.
The ordinance was passed on a motion made by Councilman Dishman and seconded
by Councilman Evans.

The following resolution was introduced and read;
A RESOLUTION
WHEREAS, the City of Beaumont and Gulf Coast Industrial Contractors,
Inc. executed a certain contract on August 8, 1973 , for the paving of Kingsley
Drive from Ohio Street to Dead End at a total contract price of $34 ,070. 00
based on estimated quantities; and,
WHEREAS, the sum of $17 ,483 .04 has previously been paid to Gulf Coast
Industrial Contractors, Inc. based on actual work performed; and
WHEREAS, the City Engineer has i spected the work and recommends its
acceptance and the final payment of $1,586. 96 to the contractor based on
actual work performed;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:

That the City of Beaumont hereby accepts the completion of the aforesaid con-
tract in all particulars and does further authorize the final payment of
$16, 586. 96 to the said contractor.

The following resolution was introduced and read:
A RESOLUTION
WHEREAS, the Texas Criminal Justice Council and the Office of the Gov-
ernor of Texas have seen fit to invite the City of Beaumont to participate,
along with five other Texas cities, in the Governor's Crime Prevention Pro-
gram; and,
WHEREAS, the City of Beaumont Police Department desires to establish
within its organization a crime prevention unit whose purpose will be the
reduction of the incidence of crimes against property, particularly burglary;
and,
WHEREAS, the City of Beaumont recognized participation in the Gover-
nor' s Crime Prevention Program to be a worthwhile undertaking; and,
WHEREAS, the Texas Criminal Justice Council has made available funds
for the establishment of a crime prevention unit within the Beaumont Police
Department in the amount of $53, 965, and the City of Beaumont is prepared to
commit $21, 262 in matching funds;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
That the City Council does hereby authorize the City Manager to execute an
application, to the Texas Criminal Justice Council, for funds to establish
a crime prevention unit within the Beaumont Police Department as required for
participation in the Governor ' s Crime Prevention Program, and be it further
resolved that the City Council of the City of Beaumont hereby ratifies any
action taken by the City Manager previous to this resolution in signing any
applications under this project.

The following resolution was introduced and read:
A RESOLUTION
WHEREAS, as part of the plans for the Delaware Project between Concord
Road and Dowlen Road, it will be necessary to relocate certain electric utility
poles; and,
WHEREAS, Gulf States Utilities will share the cost of relocation on a
50/50 basis with the City of Beaumont; and,

WHEREAS, the share of the City of Beaumont will be Fifteen Hundred
($1, 500. 00) Dollars if said relocation is done at this time; and,
WHEREAS, the City Council believes the relocation should be done at
this time;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
That a payment of $1, 500. 00 to Gulf States Utilities for the relocation of
certain electric utility poles as is necessary for the extension of Delaware
Street between Concord and Dowlen Road be and is hereby authorized.

The following resolution was introduced and read:
A RESOLUTION
WHEREAS, Mobil Chemical Company desires to place a 60" raw water line
across McKesson Drive, Spur 380, Vermont Street and Florida Street; and,
WHEREAS, . the City Council is of the opinion that a permit for this
crossing should be granted to Mobil Chemical Company;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
That the City Manager be, and he is hereby authorized to execute a permit to
Mobil Chemical Company to construct a 60" raw water line across McKesson Drive
Spur 380, Vermont Street and Florida Street in accordance with direction by
the City Engineer.

WHEREAS, on the 18th day of May, 1973, The City of Beaumont, Texas did
file with the County Clerk of Jefferson County, Texas, one certain lien in the
amount of $16. 51, including all costs of recording, covering Lots No. 25 and
26 in Block No. 16 of the WEST OAKLAND ADDITION to the City of Beaumont, Jef-
ferson County, Texas, which said lien is recorded in the M & L Records of said
County in Volume 1481 at Page 449; and,
WHEREAS, on the 31st day of May, 1973 , The City of Beaumont, Texas,
filed with the County Clerk of Jefferson County, Texas, one certain lien in
the amount of $20. 54, including all costs of recording, covering Lot Numbers
22, 23, and 24 in Block Number 12 of the SUNNYSIDE ADDITION to the City of
Beaumont, Jefferson County, Texas, which said lien is recorded in the M & L
Records of said County in Volume 1483 at Page 302; and,

WHEREAS, on the 31st day of May, 1973, The City of Beaumont, Texas, did
file with the County Clerk of Jefferson County, Texas, one certain lien in the
amount of $39.24, including all. costs of recording, covering Lot Number 27,
4. 5 acres, in Block Number 1 of the WESCALDER FIG ACRES ADDITION to the M & L
Records of said County in Volume 1483 at Page 312; and
WHEREAS, on the 31st day of May, 1973, The City of Beaumont, Texas,
filed with the County Clerk of Jefferson County, Texas, one certain lien in
the amount of $15. 41, including all costs of recording, covering Lot Number 13
in Block Number 20 of the BEL AIR ADDITION to the City of Beaumont, Jefferson
County, Texas, which said lien is recorded in the M & L Records of said County
in Volume 1483 at Page 290; and
WHEREAS, on the 31st day of May, 1973, The City of Beaumont, Texas, did
file with the County Clerk of Jefferson County, Texas, one certain lien in the
amount of $7 . 88, including all costs of recording, covering Lot Number 710 in
Block Number 31 of the BEAUMONT ADDITION to the City of Beaumont, Jefferson
County, Texas, which said lien is recorded in the M & L Records of said County
in Volume 1483 at Page 345; and
WHEREAS, MRS. MARY WARRICK, ROBERTA MOREAU, MRS . J. 0. ELLIS ESTATE,
A. F. STELLEY and EMMETT C. LANGHAM, the owners of said properties, respec-
tively, desires to pay to the City of Beaumont the monies represented by said
liens and have same released to them;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
That KEN RITTER, Mayor, be, and he is hereby authorized to execute and deliver
to the said MRS. MARY WARRICK, ROBERTA MOREAU, MRS. J. 0. ELLIS ESTATE, A. F.
STELLEY AND EMMETT C. LANGHAM a release of the above described liens, for and
in consideration of the sum aforementioned, receipt of which is hereby acknow-
ledged, and theCity Clerk is hereby authorized to attest to same and to affix
the Seal of the City of Beaumont thereto.

The second reading of a franchise ordinance granting Atchison, Topeka, and
Santa Fe Railway Company the right to construct a railway spur track across
Fannin Street just west of Railroad Avenue was given:

AN ORDINANCE GRANTING TO THE ATCHISON, TOPEKA AND
SANTA FE RAILWAY COMPANY, ITS SUCCESSORS, ASSIGNS
AND LESSEES, THE RIGHT AND PRIVILEGE TO MAINTAIN
AND OPERATE AN INDUSTRY SPUR TRACK NO. 10 CROSSING
FANNIN STREET BETWEEN CITY BLOCKS 56 AND 67 , IN
THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, IN
ACCORD WITH EXHIBIT ATTACHED HERETO; PROVIDING THAT
SAID TRACK SHALL BE USED ONLY FOR THE PURPOSE OF
LOADING, UNLOADING AND SWITCHING TO INDUSTRIAL TRACK
SERVING COMMERCIAL ENTERPRISE PROVIDING REGULATIONS

Williams and seconded by Councilman Evans.

The Mayor commented on his recent trip with the Chamber of Commerce to the
eastern part of the United States. He said he was enthusiastic and encouraged
about those industries who had expressed interest in our area and especially
in Beaumont, due largely to the fact that we don't have a local energy short-
age.

Mr. Burtis Hollis, 1140 Ivy Lane, from Beaumont State Center for Human De-
velopment, urged the Council to take action concerning the 10 acres of Cen-
tral Park property designated by the City to be used for the Center for
Human Development because funds are now available to go forward with their
plans.

Mrs. Sidney Broussard, 1940 May, addressed the Council on behalf of the
people of the Pear Orchard urging the Council to reconsider its decision
to make Fourth Street four-lane. She requested that Fourth Street be paved
two-lane with sidewalks on both sides.
