BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in
regular session on the 27th day of March, 1973, with the following present:

The Mayor issued four proclamations: "Week of the Young Child in Beaumont" -
April 1-7, 1973; "young Audiences Week in Beaumontl' —April 1-7, 1973; April
was designated "Cancer Control Month", and "Volunteer Week in Beaumont" -
April 1-7, 1973.

The Minutes of the regular meeting held on March 2Q, 1973, were approved on
a motion made by Councilman Cash and seconded by Councilman Evans.

In response to an advertisement previously published, the following bids for
furnishing one Cab & Chassis Truck for the Water Distribution Department were

The bids were referred to the Acting City Manager and staff for study and re-
commendations on a motion made by Councilman Dishman and seconded by Council-
man Evans. A representative from International Harvester stated that his
bid for this truck had been included with the kid for the h ton pickup truck
and asked that it be considered also. Councilman Cash made a motion to accept
the bids as amended and Councilman Dishman seconded it.

In response to an advertisement previously published, the following bids for
furnishing materials, equipment, superintendence and labor for the construc-
tion of Corley Avenue from 839 feet east of 23rd Street to 785 feet west of
23rd Street (excluding intersection) , and of Ocean street from Corley Avenue
south 145 feet were received:

The following resolution was introduced and read:
A RESOLUTION
WHEREAS, on March 13, 1973, the City received bids for furnishing new
truck and heavy equipment tires and tubes, steel cord or wire reinforced tires
and tubes, and passenger car tires and tubes for municipal. purposes .for the
City of Beaumont for the period beginning April 1. 1973, and ending March 31,
1974; and,
WHEREAS, White Tire Supply, Inc, submitted a bid for furnishing new
truck and heavy equipment tires and tubes, steel cord or wire reinforced
tires and tubes, and passenger car tires and tubes; and,
WHEREAS, the City Council is of the opinion that the bid submitted
by White Tire Supply, Inca is the lowest and best bid and should be accepted
and that a contract with White Tire Supply, Inc, for furnishing new truck
and heavy equipment tires and tubes, steel cord or wire reinforced tires and
tubes, and passenger car tires and tubes should be executed and that the said
new truck and heavy equipment tires and tubes, steel cord or wire reinforced
tires and tubes, and passenger car tires and tubes should be purchased from
White Tire Supply, Inc. under said contract;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
That the bid of White Tire Supply, Inc. be accepted and the Acting City Mana-
ger be, and he is hereby, authorized to execute on behalf of the City of Beau-
mont a contract with White Tire Supply, Inc. for furnishing new truck and
heavy equipment tires and tubes, steel cord or wire reinforced tires and
tubes, and passenger car tires and tubes for municipal purposes for the per-
iod beginning April 1, 1973, and ending March 31, 1974, at the unit prices
as quoted in their bid; and the City Clerk be, and she is hereby, authorized
to attest to said contract and to affix the seal of the City of Beaumont
thereto.

The following resolution was introduced and read:
A RESOLUTION
WHEREAS, on March 13, 1973, the City received bids for furnishing re-
capping, retreading and repair services for municipal purposes for the City
of Beaumont for the period beginning April 1, 1973, and ending March 31,
1974; and,
WHEREAS, Jack's 'dire Service Co. submitted a bid for furnishing re-
capping, retreading and repair services; and,
WHEREAS, the City Council is of the opinion} that the bid submitted by
Jack' s Tire Service .Co. is the lowest and best bid and should be accepted,
and that a contract with Jack's Tire Service Co. for furnishing recapping,.
retreading and repair services should be executed, and that the said recap-
ping, retreading and repair services should be purchased from Jack's Tire
Service Company under said contract
NOW, 'THEREFORE, BE IT, RESOLVED BY THE
CITY COUNCIL, OF THE CITY OF BEAUMONT
That the bid of Jack' s Tire Service Co. be accepted and the Acting City
Manager be, and he is hereby, authorized to execute -on behalf of the City of
Beaumont a contract with Jack's Tire Service Co. for furnishing recapping,
retreading and repair services for municipal purposes for the period begin-
ning April 1, 1973, and ending March 31, 1974, at the unit prices as quoted
in their bid; and the City Clerk be., and she is hereby, authorized to attest
to said contract and to affix the seal of the City of Beaumont thereto.

A RESOLUTION
WHEREAS, on March 13, 1973 , the City received bids for furnishing cer-
tain cast iron pipe for municipal purposes for the City of Beaumont for the
period beginning April 1, 1973 and ending March 31, 1974; and,
WHEREAS, U. S. Pipe and Foundry Company submitted a bid for furnishing
such cast ,iron pipe; and,
WHEREAS, the City Council, is of the opinion that the bid submitted by
U. S. Pipe and Foundry Company is the lowest and best bid and should be ac-
cepted, and that a contract with V. S. Pipe and Foundry Companv for furnish-
ing cast iron pipe should be executed, and that the said cast iron pipe
should be purchased from U. S. Pipe and Foundry Company under said contract;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
That the bid of U. S. Pipe and Foundry Company be accepted and the City Mana-
ger be, and he is hereby, authorized to execute on behalf of the City of Beau-
mont a contract with U. S. Pipe and Foundry Company for furnishing cast iron
pipe for municipal purposes for the period beginning April 1, 1973 and end-

A RESOLUTION
WHEREAS , on March 13, 1973, the City received bids for furnishing cerr
tain cast iron pipe for municipal purposes for the City of Beaumont for the
period beginning April 1, 1973 and ending March 31, 1974; and,
WHEREAS, Lone Star Steel Company submitted a bid for furnishing such
cast iron pipe; and,
WHEREAS, the City Council is of the opinion that the bid submitted by
Lone Star Steel Company is the lowest and best bid and should be accepted, and
that a contract with Lone Star Steel Company for furnishing cast iron pipe
should be executed, and that the said cast iron pipe should be purchased from
Lone Star Steel Company under said contract;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
That the bid of Lone Star Steel Company be accepted and the City Manager be,
and he is hereby, authorized to execute on behalf of the City of Beaumont a
contract with Lone Star Steel Company for furnishing cast iron pipe for
municipal purposes for the period beginning April 1, 1973 and ending March 31,
1974 , at the unit prices as quoted in their bid; and the City Clerk be, and
she is hereby, authorized to attest to said contract and to affix the seal
of the City of Beaumont thereto.

The following resolution was introduced and read:
A RESOLUTION
WHEREAS, on March 13, 1973, the City received bids for furnishing cer-
tain asbestos cement pipe for municipal purposes for the City of Beaumont for
the period beginning April 1, 1973 and ending March 31, 1974; and,
WHEREAS , Mabry Foundry & Supply Company submitted a bid for furnishing
such asbestos cement pipe; and,
WHEREAS, the City Council . is of the opinion that the bid submitted by
Mabry Foundry & Supply Company is the lowest and best bid and should be ac-
cepted, and that a contract with Mabry Foundry & Supply Company for furnish-
ing asbestos cement pipe should be executed, and that the said asbestos cement
pipe should be purchased from Mabry Foundry & Supply Company under said con-
tract;
NOW, THEREF6RE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:

That the bid of Mabry Foundry & Supply Company be accepted and the City Mana-
ger be, and he is hereby, authorized to execute on behalf of the City of Beau-
mont a contract with Mabry Foundry & Supply Company for furnishing asbestos
cement pipe for municipal purposes for the period beginning April 1,1973
and ending March 31, 1974, at the unit prices as quoted in their bid; and the
City Clerk be, and she is hereby, authorized to attest to said contract and
to affix the seal of the City of Beaumont thereto.

A RESOLUTION
WHEREAS, the City received informal bids on March 19, -1973, for furnish-
ing fifty thousand (50, 000) four-part NCI Traffic Tickets for the Municipal
Court; and,
WHEREAS, Data Graphic Business Forms, Inc. submitted a bid for fur-
nishing fifty thousand (50, 000) four-part NCR Traffic Tickets; and,
WHEREAS, the City Council is of the opinion that the bid submitted
by Data Graphic Busyness Forms, Inc. is the .lowest and best bid and should
be accepted;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
That the bid of Data Graphic Business Forms, Inc.' in the amount of $1, 396. 00
be accepted by the City of Beaumont.

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT:
That the purchase of one (1) six inch Hersey Model FM-CT Full Flow Fire Line
Meter with three inch By-Pass Meter from Hersey Meter Company for the total
sum of One Thousand Six Hundred Forty-One and No/100 ($1,641. 00) Dollars be
approved.

nishing one Industrial Type Diesel Tractor for the Sewage Treatment Plant
on a motion made by Councilman Dishman and seconder by Councilman Evans.

The following resolution was introduced and read:
A RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT:
That the City Manager be, and he is hereby, authorized to execute for and on
behalf of the City of Beaumont a lease contract with the Beaumont Art League,
leasing to the said Beaumont Art League 0.449 acre out of the South Texas
State Fair Grounds, with improvements thereon, for a term beginning on April
1, 1973, and ending March 31, 1975, under the terms and conditions as con-
tained in said lease contract; and the City Clerk is hereby authorized to
attest to said- instrument and to affix the Seal of the City of Beaumont
thereto.

Mr. Robert Willis, Beaumont Art League, addressed the Council concerning the
favorable response to petitions for the Beaumont Art League and thanked the
Council for approving the contract.

A RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT, TEXAS :
That the City Manager be, and he is hereby, authorized to execute on behalf of
the City of Beaumont a lease contract with the Junior League of Beaumont, Texas
Inc. for the grounds and buildings known as the Fair Park for the purpose of

conducting the Spindletop Charity Horse Show on May 9, 10, 11 and 12 , 1973,
upon the terms and conditions and for the consideration set out in said lease;
said lease beginning April 9, 1973 to May 19, 1973 ; and the City Clerk is
hereby authorized to attest to said lease and to affix the Seal of the City of
Beaumont thereto.

The following resolution was introduced and read:
A RESOLUTION
WHEREAS, The City of Beaumont and the American National Bank of Beau-
mont, Texas, entered into a contract dated July 1, 1971, whereby it was pro-
vided that the said American National Bank of Beaumont would pledge with the
City Council of the City of Beaumont certain securities in lieu of giving
bond as City Depository; and,
WHEREAS, the American National Bank wishes to withdraw $1,100, 000
U. S. Treas® 7. 00% Notes, due 11-15-75, held under Receipt No. 118362;
$700, 000 U. S. Treas. 7. 00% Notes, due 11-15-75, held under Receipt No.
118947; and $1, 000, 000 U. S. Treas. 7, 00% Notes, due 11-15-75, held under
Receipt No. 119073 and wishes to pledge in lieu of same $2,800,000 U. S .
Treas. 6. 75% Bonds, due 2-15-93; and,
WHEREAS , after this withdrawal and pledge of additional Bonds , the
American National Bank of Beaumont will have sufficient securities still
remaining pledged to protect the deposits of the said City of Beaumont, Texas,
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT;
That the American National Bank of Beaumont, Texas , be permitted to withdraw
the securities above described from the Texas Commerce Bank of Houston, Texas,
and to pledge the above described securities with the said Texas Commerce
Bank of Houston, Texas, and a certified copy of this Resolution shall con-
stitute evidence of the authority of the American National Bank of Beaumont,
Texas, to make said withdrawal and pledge.

The following resolution was introduced and read:
A RESOLUTION
WHEREAS, by ordinance duly Passed on the 6th day of March, 1973, the
City Council of the City of Beaumont ordered the permanent improvements of
Corley Avenue from 839 ' East of 23rd Street to 785 ' West of 23rd Street (ex-
clusive of the 23rd Street intersection) and of Ocean Street from Corley
Avenue South 145 ' , in accordance with plans and specifications approved by
the City Council; and,

WHEREAS, pursuant to said ordinance, the City advertised for bids for
the construction of such improvements; and,
WHEREAS, the City Council of the City of Beaumont desires to set a
neighborhood meeting for the purpose of explanation to those affected by the
proposed paving of Corley Avenue and Ocean Street;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
That a neighborhood meeting is hereby set for 7 :30 p.m. April 3 , 1973 , in the
City Council Chambers, City Hall, Beaumont, Texas; and be it further resolved
that the Director of Public Works of the City of Beaumont be, and he is here-
by directed to prepare and file with the City Clerk estimates and rolls as re-
quired by law for each street unit to be so improved, showing thereon the
total estimated cost of the improvements in each such unit, and showing in
detail the description of each parcel Of Property abutting thereon, together
with the names of the apparent owners thereof, the number of front feet in
each parcel of property, and the amount to be assessed against the same, and
such other pertinent information as may be required by law.

The following ordinance considering setting a 2 :00 a.m. closing for establish-
ments serving alcoholic beverages was introduced and read:
ORDINANCE NO. 73-24
AN ORDINANCE ADOPTING HOURS PROVIDED BY STATE LAW FOR CON-
SUMPTION AND POSSESSION OF ALCOHOLIC BEVERAGES AND FOR THE
SALE OF BEER AND FOR THE SALE OF MIXED BEVERAGES IN COUNTIES
OF 300, 000 OR MORE POPULATION, ACCORDING TO LAST PRECEDING
FEDERAL CENSUS; PROVIDING FOR A FEE TO BE PAID BY THE HOLDER
OF A STATE RETAIL DEALER'S ON-PREMISES LATE HOURS LICENSE;
PROVIDING A PENALTY; PROVIDING FOR SEVERABILITY; AND REPEAL-
ING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH.
The ordinance was passed on a motion made by Councilman Dishman and seconded
by Councilman Williams.

Acting City Manager Howard McDaniel introduced two new employees with the
City - Mr. Earl Deland, City Engineer, and Mr. Harold Williams, Chief Accoun-
tant.

Mayor Ritter recognized Councilman Dishman who asked interested citizens to
write their Congressmen, both on the State & Federal level, concerning flood-
ing and sewer conditions in Beaumont. He stated that first we must have a
release of the funds for the Sewer Grants, the application of which was made
March 24 , 1971, and also the Taylors Bayou Drainage Project. Mayor Ritter
also mentioned contacting the Texas Water Quality Board in Austin.
