Williams Survey from R-2 to R-3, the property being located north of the Towne Oaks Npartments on the west side of Dowlen Road and south of a vacant tract of land. Council requested reading of the caption of this Ordinance: ORDINANCE NO, 73-22 ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, BY CHANGING THE CLASSIFICATION OF A 0.742 ACRE TRACT OF LAND OUT OF THE H. Question: Ayes : Councilman Dishman Nayes: Councilman Evans Councilman Cash Councilman Williams Mayor Ritter abstained from voting, Motion failed for lack of a majoiizy, -000 Mr. Harvey Smith, Chairman of the Housing Board of Appeals, gave a report to the City Council on the status of their work, Mr. Smith appealed to the City Council to exert whatever influence they might have in helping to alleviate some of the dangerous con- ditions that now exist with citizens i0ing in substandard housing such as bad floors, plumbing, and roofing that do not protect some citizens from the elements, Mr. Palmer, Environmental Control Direcror gave a brief report on the progress being made to alleviate substandard housing condirions in Beaumont; and called on civic groups for assistance, The following resolution was introduzed and read. Question: Ayes: All Nayes : None -000® The following resolution introduced and read: R E S 0 L U T 1 0 N WHEREAS, the City of Beaumont and Miner-Dederick Construction Corporation entered into a certain agreement to furnish all labor, superintendence, material and equipment and to perform all work necessary to construct a new police and municipal court faci- lity; and, WHEREAS, Change Order No. 1 to said contract has been proposed, under which said Change Order No, 1 certain changes will be made in the specifications to reinstate certain changes which were previously deleted from the original plans and specifica- tions in order to obtain a bid within budgetary limitations in the total amount of $70,1M50; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: That the Acting City Manager be, and he is hereby, authorized to execute on behalf of the City of Beaumont the above-described Change Order No. 1 to the original contract; and, BE IT FURTHER RESOLVED, That the City Clerk is hereby authorized to attest to same and to affix the Seal of the City of Beaumont thereto. COUNCIL OF THE CITY OF BEAUMONT: "Heat the Mayor be, and he is hereby, authorized to execute an agreement between the State of Texas and local governments in the area consisting of Jefferson Cotrity, Orange County, City of Beaumont, City of Port Arthur and City of Orange regarding the preparation and maintenance of an urban transportation study; and that the City Clerk be, and she is hereby, authorized to attest to said contract and to affix the Seal of the City of Beaumont thereto, PASSED by the City Council this 20th day of March, 1973. Question: Ayes : All Nayes : None ®000-- The following resolution introduced and read: A R E S 0 L U T 1 0 N WHEREAS, Chapter 42, Section 42-4S of the Code of Ordinances of the City of Beaumont, Texas, provides that City will pay all increased cost associated with the construction of residential collector streets to the extent said costs exceeds that necessary to build a residential street as defined; and, WHEREAS, Section 42645 also provides that the City will pay the difference in cost when a larger storm sewer pipe than adequate for a particular subdivision is required by the City; and, WHEREAS, the City Council of the City of Beaumont desires to establish a policy for administering said payments by the City; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: That the following policy is hereby adopted by which the City will arrive at the amount to be paid by the City for the construction of residential collector streets when re- quired by the City and the construction of drainage facilities when larger pipe size than adequate to serve a specific subdivision is required by the City. 'The City shat' pay for: Clearing in excess of 50, of width; 2 Width ,,-)f lime stabilization less than necessary for 26' face to face of curb; 3. (a) All concrete paving costs less that necessary for 261 face to face of curb; (b) One inch of concrete paving cost of the 261 face to face of curb width, said costs to be arrived at by dividing the cost of pavement by six; 7. 4e dCLJI All inlet pipe costs less that required for 261 face to face of curb; When inlet pipe also sei-i—es as drainage pipe, items "4(a) and "S" shall apply; S. Drainage Pipe: Cost of the pipe only, required by the City, less costs of pipe only that would serve the subdivision multiplied by two; 6a 10% of the City cost shall be added to cover cost of engineering. City will participate in the cost of projects outlined herein only when the notice and competitive bidding requirements and all other requirements of the Texas Statutes and of the Charter of The City of Beaumont are followed in arriving at a written con- tract for said construction. Bids received must be acceptable to both the City—and developer. If standard residential streets are being constructed by the developer within the subdivision where the residential collector street is constructed, owner shall make available to the City the unit bid prices of these streets. Items I through 6 above shall be separate bid items on any project. Question: Ayes : All Nayes : None -000- The following ordinance amending Chapter 42 of the Code of Ordinances of the City of Beaumont introduced and caption read: ORDINANCE NO. 73-23 ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT, TEXAS, BY AMENDING SECTION 42-4S(c) AND SECTION 42-45(e) TO PROVIDE THAT THE CITY, WHEN RESIDENTIAL COLLECTOR STREETS ARE REQUIRED, WILL PAY ALL INCREASED COST ASSOCIATED WITH THE CONSTRUCTION OF SAID STREET; AND PROVIDING THAT THE CITY WILL PAY DIFFERENT IN COST ASSOCIATED WITH INSTALLATION OF STORM SEWER PIPE WHEN LARGER STORM SEWER PIPE THAN ADEQUATE FOR A PARTICULAR SUBDIVISION IS REQUIRED BY THE CITY; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH, BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: Ordinance passed on a motion made by Cou�lcilman Dishman; seconded by Councilman Cash. Question: Ayes: All Nayes: None -00o- The f011owi-D9 resolution introduced and read: A R E S 0 L U T 1 0 N WHEREAS, under the Assessment Paving Program of the City of Beaumont, the Public Works Department has recommended Kingsley Drive from Ohio Street east to dead end be paved under the Assessment Paving Program; and, WHEREAS, the City Council of the City of Beaumont is of the opinion that this recommendation should be approved; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT." That the recommendation by the Public Works Department that Kingsley Drive fr6rh 'Ohl-6- Street east to dead end be paved under the Assessment Paving Progralh' is hereby approved and the Public Works Department is directed to prepare plans, specifications, and cost estimates with reference to this project for presentation to the City Council, PASSED by the City Council this the 20th day of March, 1973.
