REQUESTED ACTION: Council consider payment of an invoice for an annual software
support agreement for a Motorola Mobile Data Communication
System (MDC).
RECOMMENDATION
Administration recommends payment of an invoice to Motorola in the amount of$34,544.35 for
software support for a period of one (1) year.
BACKGROUND
The software maintenance agreement provides for twenty-four (24) hour support and updates to
the vendor's software during the contract period. Currently, there are 118 MDC's installed in the
City's Police, Fire, and Emergency Medical Service vehicles.
In 1999, the City purchased the mobile data communication system for the Police Department.
An MDC is a wireless data communications system providing officers with direct access to the
host Computer Aided Dispatch (CAD) system. The system provides officers with the ability to
access information from the National Crime Information Center,Texas Crime Information Center,
and from the City's AS400 mainframe computer. Complete case files from the AS400 database
can be accessed providing field officers with detailed graphical images including fingerprints,
photographs, maps and diagrams.
This purchase is exempt from competitive bidding since it is available from only one (1) source
having exclusive rights to modify and maintain the software.
BUDGETARY IMPACT
Funds are available in the Information Services Division's operating budget.

REQUESTED ACTION: Council consider accepting a donation of property that will be used for the
construction of affordable housing.
RECOMMENDATION
The Administration recommends accepting a donation of property located at 1214 Trinidad that will be used
for the construction of affordable housing.
BACKGROUND
Mr. & Mrs. Gregory Beckett have expressed a desire to donate property located at 1214 Trinidad in
Beaumont's North End for the construction of affordable housing. The house on the lot,previously tagged
for demolition,has in fact been demolished. The Administration proposes that this lot,valued at$5,870,be
donated from Mr. & Mrs. Beckett to the Beaumont Community Housing Development Organization
("BCHDO")to construct new housing that will be sold to an eligible low/moderate income family. Mr. &
Mrs. Beckett own the property free and clear and are not delinquent on property taxes.

REQUESTED ACTION: Council consider a resolution authorizing the acceptance of a ten
foot (10') wide Sidewalk Easement along the north line of the
Delaware Street Extension adjacent to the Mobiloil Federal Credit
Union property.
RECOMMENDATION
Mobiloil Federal Credit Union has agreed to convey a ten foot (10') wide Sidewalk Easement to
the City of Beaumont. The property is described as out of an 11.335 acre tract of land in the
Hezekiah Williams Survey, Abstract 56, and is located along the north line of the Delaware Street
Extension, adjacent to the Mobiloil Federal Credit Union property and 150.3 feet from the west
line of Major Drive.
Administration recommends acceptance of the easement.
BACKGROUND
The sidewalk easement is adjacent to the new deceleration lane at the entrance to the Mobiloil
Federal Credit Union on Delaware.

REQUESTED ACTION: Consider reappointing the Chief Magistrate and one City Magistrate
to two-year terms.
RECOMMENDATION
Consider the reappointment ofTheodore Johns and James D.McNicholas as City Magistrates. James
D. McNicholas would be designated as Chief Magistrate.
The City Council met in Executive Session on November 23, 2004.
BACKGROUND
The City Charter states "there shall be one or more magistrates of said Municipal Court known as
City Magistrates,one of whom shall be designated Chief Magistrate." Chief Magistrate McNicholas
would be redesignated Chief Magistrate at a compensation of$300 for the first session and$200 for
any subsequent sessions per week. City Magistrate Theodore Johns would be reappointed at a
compensation of$200 per session. City Magistrate Craig Lively will be considered for reappointment
in January when his current term expires.

REQUESTED ACTION: Council consider an annual contract for grounds maintenance and
litter removal services.
RECOMMENDATION
Administration recommends approval of a three (3) year contract beginning January 1, 2005 with
Beaumont Products and Services, Inc. (BPS) for basic grounds maintenance services at the City's
Downtown Municipal Complex and specified areas within Beaumont's Central Business District as
well as a Downtown Beautification Team to perform special projects as needed.
BACKGROUND
BPS has provided grounds maintenance and litter removal services for the past seven (7) years.
Grounds maintenance services include mowing,edging,sweeping and litter removal for the grounds
at City Hall, Civic Center,Beaumont Public Library,Police Building,Julie Rogers Theatre,Tyrrell
Historical Library, Delia Harrington Park,Henry Dannenbaum Transfer Facility, Riverfront Park,
and the Central Business District medians and boulevards.
Mowing and edging are performed on a weekly basis during the growing season, March 1 through
October 31. Biweekly mowing is required during the dormant season. At Riverfront and Delia
Harrington Parks, edging and sweeping of sidewalks and paved areas are performed at the time of
mowing. Sweeping of walkways around the municipal complex is performed three (3) times per
week. All other areas are swept in conjunction with mowing. Litter removal services are required
three (3) days per week for removal of trash and debris from all City facilities and parking lots.
The contract contains provisions for two (2) additional employees to work on the Downtown
Beautification Team as needed on an hourly rate basis. The primary function of the team is to
maintain the downtown areas by mowing vacant lots and rights-of-way, trimming and sweeping
sidewalks,removing litter, and providing assistance with special beautification projects as needed.

This contract is exempt from competitive bidding because the service is provided by a State certified
workshop. BPS is a private not-for-profit State certified workshop employing disabled individuals.
BUDGETARY IMPACT
The cost of these services and funding sources are as follows:

Consider amending Sec. 5-37 of the Code of Ordinances relating to Animal Health Advisory
Committee

REQUESTED ACTION: Consider an amendment to the existing animal control ordinance;Chapter
5; Sec. 5-37 (b)(c), which would expand the membership of the animal health advisory committee
from four (4) to six(6) members, extend their terms to two years, and specify that the committee
meet as needed instead of a minimum of three times a year.
RECOMMENDATION
Administration recommends adoption of the proposed amendment.
BACKGROUND
The Animal Health Advisory Committee was established to act in an advisory capacity to the city
council and the Health Department concerning rules and regulations pertaining to the animal shelter.
One of the functions of the committee is to make recommendations to the Health Director
concerning animal control in the city. Currently,the Committee consists of four(4)members which
include the city veterinarian, the director of health, the animal control supervisor and an individual
from the Humane Society, all of whom are appointed for one year. In order to effectively deal with
emerging animal control issues such as animal cruelty cases,vicious animals,etc., staff recommends
expanding the Committee to include a representative from the Police Department and one additional
member of the Humane Society. All six(6) committee members would be appointed to serve a two
year term. The Mayor will continue to make the appointments to the Animal Health Advisory
Committee.
BUDGETARY IMPACT
None.

ORDINANCE NO.
ENTITLED AN ORDINANCE AMENDING SECTION 5-37 OF
CHAPTER 5, ARTICLE III OF THE CODE OF ORDINANCES
OF THE CITY OF BEAUMONT,TEXAS, ESTABLISHING THE
ANIMAL HEALTH ADVISORY COMMITTEE; PROVIDING
FOR SEVERABILITY; PROVIDING FOR REPEAL; AND
PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Section 5-37 of Chapter 5, Article III of the Code of Ordinances of the City of
Beaumont, Texas be and the same is hereby amended to read as follows:
Sec. 5-37. Animal health advisory committee established.
(a) There is hereby established an animal health advisory committee of the city
to act in an advisory capacity to the city council and to the department of
health concerning rules and regulations pertaining to the operations of the
animal shelter and to make recommendations to the director of public health
concerning animal control by the city.
(b) Such committee shall consist of six (6) members composed of the city
veterinarian, the director of health, the city animal control supervisor, a
representative from the Beaumont Police Department and two (2) individuals
from the Humane Society all of whom shall be appointed for two (2)-year
terms.
(c) The advisory committee shall meet as needed.
Section 2.
That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of
same to a particular set of persons or circumstances, should for any reason be held to be invalid,
such invalidity shall not affect the remaining portions of this ordinance, and to such end the various
portions and provisions of this ordinance are declared to be severable.
Section 3.
That all ordinances or parts of ordinances in conflict herewith are repealed to the extent of the
conflict only.
Section 4.
That any person who violates any provision of this ordinance shall, upon conviction, be punished
as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.

BACKGROUND
The ISO has for many years done evaluations and ratings of the fire protection provided in
communities. This system is called the ISO Public Protection Classification program, or PPC. The
PPC process grades a community's fire protection on a scale of 1-10, based on the ISO's Fire
Suppression Rating Schedule(FSRS).
Because ISO is an independent statistical, rating and advisory organization that serves the property
and casualty insurance industry,many companies use their PPC evaluations as a factor in setting the
premiums they charge for property insurance;the better the community's PPC grade, the lower the
premiums the insurance company would charge for property insurance in that community. ISO's data
on fire losses indicates that communities with better fire protection as evaluated by the PPC do in fact
tend to have lower losses from fire damage than other communities.
ISO collects information on a community's public fire protection and analyzes the data using its
FSRS. ISO then assigns a public protection classification. Class 1 represents the best public
protection and Class 10 indicates no recognized protection. FSRS looks at a great deal of specific
data about the fire department,the water supply and the types of property in the community,and uses
a fairly complex process to evaluate that information. In general,the factors for calculating the rating
are the water supply, fire department equipment and personnel, training, types of property and the
community's alarm and paging system.

Even though there are a number other factors, insurers determine insurance premiums for both
commercial and residential properties using ISO's public protection classification rating. According
to industry data,lowering from a Class 4 to a Class 3 would potentially save 9%of the total premium
on a commercial structure and 4.8% on the residential total premium. If the class rating is lowered
from 4 to 2, the total premiums could be reduced by 11% and 120/6 respectively.
Due to the potential cost saving implications to the property owners within the city, Administration
is requesting that ISO evaluate the fire protection service. ISO usually evaluates cities with a
population greater than 25,000 every ten years. The City's last evaluation was completed in 1990
when it received a Class 4 rating.
To assist the City in preparing for the evaluation by ISO and to identify opportunities which will
ensure an improved rating, Administration is requesting that the City contract with an independent
consultant to assist with the review. The consultant's scope of work includes performing a mock
grading,which includes a fire station location study and preparation of a presurvey packet,to provide
the City with a list of suggested improvements which will result in a lower rating. The City may
institute those recommendations which are economically feasible and provide the greatest rating
impact. Once the recommendations are instituted, the consultant will assist the City in gathering
information for ISO and representing the City during the survey process. This guarantees the
seamless transfer of information from the City to the ISO representative. Total cost of the consulting
service is $19,950.
Mr. Pietsch, a registered engineer in Texas, has more than 26 years experience rating communities
under the ISO FSRS. His experience encompasses surveying more than 600 Texas communities
while an ISO employee. These communities range in population from less than 100 to the city of
Houston's 1.8 million. He lectures on the FSRS and has taught at ISO's annual training school in
Bethesda, Maryland. Administration feels that Mr. Pietsch is extremely qualified to assist the City
in improving its class rating.
If approved, the consultant would be available to commence the project in January. However, the
entire ISO survey process will take between 6 and 9 months to complete. ISO will issue a revised
Public Protection Classification notice at that time to its participating insurance companies.
BUDGETARY EWPACT
The $19,950 consulting fee is available in the Capital Improvement Fund

BACKGROUND
It has been determined that these structures meet the definition of a dangerous structure because
they have deteriorated such that they are no longer considered suitable for repair.
BUDGETARY IMPACT
City may incur the cost of demolition.
PREVIOUS ACTION
These structures have been inspected by the Clean Community Department and found to be
dangerous structures as defined by the City of Beaumont's Code of Ordinances, Article III,
Dangerous Structures, Section 14-50.
SUBSEQUENT ACTION
Clean Community Department will demolish or cause to be demolished said structures.

the effective date of this ordinance.

If the property owner(s) fail(s) to comply within days, Council orders that the

That if any section, subsection, sentence, clause or phrase of this ordinance, or the
application of same to a particular set of persons or circumstances should for any reason
be held to be invalid, such invalidity shall not affect the remaining portions of this
ordinance, and to such end the various portions and provisions of this ordinance are
declared to be severable.
Section 5.
That any person who violated any provision of this ordinance shall, upon conviction,
be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
