Parkway, between Florida and Veatch. RECOMMENDATION The Administration recommends approval of a zone change from LI(Light Industrial)to GC-MD (General Commercial-Multiple Family Dwelling)District for property located on the west side of M.L.K. Parkway, between Florida and Veatch. BACKGROUND Campus Village Housing, LP, is requesting a zone change for property located on the west side of MLK Parkway, between Florida and Veatch. The zone change involves the rear portions of a 2.6 acre tract and 3.36 acre tract which are zoned LI. The front 190'of these two tracts are already zoned GC-MD. The 2.6 acre tract is vacant while the 3.36 acre tract is improved with a former night club building and related parking. In the development of the property, the night club will be demolished. The purpose for the zone change is to rezone the subject property so that the entire 5.86 acres can be developed into a luxury student housing development. Campus Village Housing has identified a demand for off-campus, luxury housing near Lamar University. The company states that it has a great deal of experience in the development of off-campus,luxury student housing and believes that Lamar University provides a growing market for such housing. BUDGETARY IMPACT None. PREVIOUS ACTION At a Joint Public Hearing held October 18, 2004,the Planning Commission voted 8:0:1 to approve a zone change from LI (Light Industrial) to GC-MD (General Commercial-Multiple Family Dwelling) District for property located on the west side of M.L.K. This means that in order to approve a zone change or specific use permit when the 20%rule has been invoked at least six Council members must vote in favor of the Ordinance. On File 1745-Z, a protest of 23%was received, therefore invoking the Rule on this case. I ORDINANCE NO. BACKGROUND Land Manor, Inc. is requesting a specific use permit to allow a residential care facility housing offenders at 1635 Avenue A(Franklin House South). Land Manor has operated a 45 bed indigent male and female substance abuse facility at this location since 1986. The facility, as currently operated, is permitted by-right. Land Manor is now requesting a modification to its Texas Department of Criminal Justice contract that will allow it to provide treatment to adult female parolees who have already participated in a 9 month in-prison Therapeutic Community for treatment of addiction. This facility will provide these females with additional chemical dependency treatment and assistance through the Department of Assistive and Rehabilitative Services. Franklin House South is licensed by the Department of State Health Services as a residential and outpatient substance abuse treatment facility. In addition to the existing 45 beds for male and female substance abusers, Franklin House South would offer residential services to 10 females and outpatient services to 16 females. Residential services would be for periods of from one to three months, dependent on the client's needs. Outpatient services may continue for one year. BUDGETARY IMPACT None. PREVIOUS ACTION At a Joint Public Hearing held October 18,2004,the Planning Commission voted 9:0 to approve a specific use permit to allow a residential care facility housing offenders in an RM-H (Residential Multiple Family Dwelling-Highest Density) District at 1635 Avenue A with a modification to the landscaping requirements along the north, east and south sides. Richardson, Planning Manager MEETING DATE: October 26, 2004 AGENDA MEMO DATE: October 12, 2004 REQUESTED ACTION: Council consider a request for a historic preservation loan for renovations at 2300 Harrison Street. RECOMMENDATION The Administration recommends denial ofthe request for a historic preservation loan for renovations at 2300 Harrison Street. BACKGROUND Charles and Vanessa Pickens are requesting$25,063 for renovations to their home at 2300 Harrison. Work to be done to the house includes the following: — New composition roof — Vinyl siding — House leveling/sill repair — Install ridgevents — Repair all decayed wood on flatroof, carport, breezeway and other areas — Install insulation. Credit reports were run on Mr. and Mrs. Pickens. Due to unfavorable information in those reports, the Planning Manager is recommending denial of this request. The Planning Manager discussed this information with Mrs. Pickens and she said that a period of unemployment for her husband resulted in some credit problems, including a number of delinquent accounts. Both Mr. and Mrs Pickens are currently employed and wish to proceed with the historic preservation loan request, despite the Planning Manager's recommendation. The property is not listed in SPARE Beaumont. BUDGETARY Il"ACT The Historic Preservation Loan program is funded with CDBG money. Currently, there is $33,053.61 available in the loan account. With a payout period of ten(10)years, monthly payments would be $208.85. PREVIOUS ACTION At a Regular Meeting held October 11, 2004, the Historic Landmark Commission voted 6:1 to approve the historic preservation loan for renovations at 2300 Harrison Street. The pay back on the loan will be over a period of 10 years. SUBSEQUENT ACTION None. RECOMMENDED BY City Manager, Public'Works Director, Finance Officer, Planning Manager. RECOMMENDATION Administration recommends approval for the purchase of 3,360 garbage containers at a unit price of$37.64 to Toter Inc. of Statesville, North Carolina for a total expenditure of$126,470.40. BACKGROUND The State of Texas Cooperative Purchasing Program provides contracted pricing on various commodities to all state, county, school district and municipal agencies within Texas. The Program is coordinated by the Texas Building and Procurement Commission (TBPC) in accordance with state bidding statutes. The City has approximately 33,000 of the 90-gallon containers currently in service, which are used in conjunction with automated refuse trucks. The majority of the cans in service were purchased in 1989 with an anticipated useful life of seven(7) years. Due to aging and wear, the existing containers are in varying stages of deterioration. The Clean Community Division anticipates the eventual replacement of the entire container inventory over a period of years. The City purchased 1,260 containers from Toter during fiscal year 2004, with that being the first significant acquisition of cans since the inception of the automated trash system. Council Agenda Item TO: City Council FROM: Kyle Hayes, City Manager PREPARED BY: Kirby Richard, Internal Services Director MEETING DATE: October 26, 2004 AGENDA MEMO DATE: October 21, 2004 REQUESTED ACTION: Council consider leasing forty(40)photocopiers. RECOMMENDATION Administration recommends a sixty-month(60) lease for forty (40) Imagistics brand photocopiers from Better Business Machines of Beaumont, Texas for use by various City Departments in the amount of$64,524 per year. BACKGROUND The City of Beaumont currently has eighty-two(82)photocopiers located throughout the City. Forty (40)copiers were identified for replacement based on copier age, maintenance costs, and rental fees. Copiers selected for replacement include seven (7) older copiers with higher than average maintenance costs, twelve (12) rented copiers, and twenty-one (21) copiers on the Teleserve maintenance insurance plan. Leasing these forty (40) copiers will alleviate the need to purchase replacement copiers for the older equipment in the near future as well as eliminate the risk of rising maintenance costs. Newer copiers less than six (6) years old, copiers on fixed term leases, and copiers currently in minimal use environments were not considered for replacement at this time. Proposals were solicited from eight (8) vendors for a sixty-month (60) supplies and maintenance inclusive lease. Specifications included precise details about the capabilities and features required on each copier. Copy speeds ranging from twenty-five (25) to fifty-five (55) copies per minute (CPM)were requested in various quantities based on users' needs. Industry standard features such as bypass trays, automatic duplexing, enlargement and reduction capabilities, and finisher/staplers were required on all copiers. The proposal specifications also included provisions to allow the City to add copiers to the lease during the initial term should the City desire to do so. While twelve (12) proposals were received, eight (8) proposals failed to meet the minimum specifications as indicated on the following page: PHOTOCOPIER LEASE October 21,2004 Page 2 VENDOR BRAND ANNUAL SPECIFICATION COST COMPLIANCE Better Business Machines, #1 Imagistics $ 60,132 Exceeds minimum copy speed on Beaumont, TX four(4) copiers Better Business Machines, #2 Imagistics $ 64,524 Exceeds minimum copy speeds on Beaumont, TX twenty-five (25) copiers Star Graphics - Toshiba Toshiba $ 67,680 Proposed copiers failed to meet Beaumont, TX minimum specifications Ikon Office Solutions, #2 Canon $ 72,066 Proposed copiers failed to meet Beaumont, TX minimum specifications Star Graphics - Konica Konica $ 80,784 Proposed copiers failed to meet Beaumont, TX minimum specifications Ikon Office Solutions, #1 Canon $ 82,019 Proposed copiers failed to meet Beaumont, TX minimum specifications Copy& Camera, #2 Canon $ 86,199 Proposed copiers failed to meet Beaumont, TX minimum specifications Copy& Camera, #3 Canon $ 89,978 Proposed copiers failed to meet Beaumont, TX minimum specifications Star Graphics - Sharp Sharp $ 90,156 Proposed copiers failed to meet Beaumont, TX minimum specifications Advance Office Products Savin $ 97,908 Proposed copiers failed to meet Lake Charles, LA minimum specifications Xerox Xerox $101,287 Met minimum specifications Beaumont, TX Copy& Camera, #1 Canon $113,523 Met minimum specifications Beaumont, TX PHOTOCOPIER LEASE October 21,2004 Page 3 The known current annual costs that would be eliminated by leasing forty(40)copiers are as follows: DESCRIPTION ESTIMATED ANNUAL COST Teleserve maintenance insurance $24,834 Rental fees for 12 copiers $29,248 Estimated annual supplies and maintenance costs $ 7,856 TOTAL ESTIMATED ANNUAL COST SAVINGS: $61,938 Better Business Machines submitted both of the lowest proposals. While the City would realize an estimated annual cost savings of $1,806 over current costs by selecting the lowest proposal, Administration recommends the second lowest proposal in the amount of$64,524 per year. This selection would cost the City approximately$2,586 extra per year over current costs but will provide the best value. The second proposal includes twenty-five (25) copiers that exceed the minimum required copy speeds. The vendor will provide 35 copy per minute (CPM) copiers and 55 CPM copiers as indicated below. Offering only two(2)copier models in addition to the color copier will make a supplies inventory simple to order and maintain. While the potential cost savings and additional costs resulting from either proposal can only be estimated because of supply and maintenance variables, the second proposal from Better Business Machines offers the City the greatest overall value. Details of the second proposal are as follows: NUMBER REQUIRED BETTER BUSINESS COST EACH PER OF MINIMUM MACHINES MONTH COPIERS SPEED PROPOSAL#2 21 25 CPM 35 CPM $119 10 35 CPM 35 CPM $119 1 35 CPM with 55 CPM with $170 legal numbering system legal numbering system 3 45 CPM 55 CPM $170 4 55 CPM 55 CPM $170 1 25 - 35 CPM color 31CPM $328 S1 12 R VV S64,524 I PHOTOCOPIER LEASE October 21,2004 Page 4 BUDGETARYIMPACT Funds are available from the following sources: NUMBER OF COPIERS FUNDING SOURCE ANNUAL AMOUNT 1 Solid Waste Fund $ 1,428 1 Hotel Occupancy Tax Fund $ 2,040 3 Fleet Fund $ 4,284 4 Water Fund $ 5,712 31 General Fund $51,060 TOTAL: $64,524 PREVIOUS ACTION None.
