CITY COUNCIL - CITY OF BEAUMONT
HELD SEPTEMBER 21, 1993 - 1:30 P.M.
BE IT REMEMBERED that the City Council of the City of Beaumont, Texas,
met in regular session this 21st day of September, 1993, with the
following present:

The Invocation was given by the Reverend Knute Jacobson, Saint Steven's
Episcopal Church.
The Pledge of Allegiance was led by Councilman Alter.

One Proclamation was issued: "American Businesswomen's Day, " September
22, 1993 .

Citizen comment was invited on the Consent Agenda and Main Agenda Items
2-4. No one wished to address these topics.

The following Consent Agenda items were considered:
Approval of the Minutes of the regular City Council session held
September 14, 1993;
Resolution No. 93-239 authorizing First Interstate Bank of Texas, N.A.
to pledge of $5, 000, 000 in securities to be held at Texas Commerce Bank -
Houston, effective October 1, 1993 ;
Resolution No. 93-240 designating Rogers K. Coleman, Ross B. Snyder, Ray

A. Riley, Sterling Pruitt, Kandy Daniel and Sara S. Culbreth as
signatories on the temporary Blue Cross Insurance Claims Account No.
0470035510 at First Interstate Bank of Texas, N.A. for the purpose of
paying health insurance claims for City employees.
The Consent Agenda was approved on a motion made by Councilman Alter and
seconded by Councilman Moore.

Mayor Lord announced that an Executive Session will be held following
the Workshop Session in accordance with Section 2 (e) of the Texas Open
Meetings Act to discuss contemplated or pending litigation: Gwen Lewis
Gallien vs. City of Beaumont and Roberto Cruz Flores. Claim of Susan
Edd, and Etta Pearl Lewis vs. City of Beaumont, The Port of Beaumont,
and Industrial Development Authority.

An Ordinance authorizing a Specific Use Permit to allow a church on a
tract of land zoned RS (Residential Single Family Dwelling) at 1640 Pope
and legally described as .242 acres, more or less, Lot 17, Block 10,
Forrest Addition, to the Reverend Jay Reed, Sr. and the Holland
Missionary Baptist Church, with a recommendation from the Planning
Commission for denial, was considered:

ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE
PERMIT TO ALLOW A CHURCH ON .242 ACRES, MORE
OR LESS, BEING LOT 17, BLOCK 10, FORREST
ADDITION, BEAUMONT, JEFFERSON COUNTY, TEXAS.
Councilman Davis reported after viewing the dilapidated condition of the
existing structure, he feels it would be too big an undertaking and too
costly to attempt rehabilitation of the building and then possibly not
meet building code requirements.
The Ordinance was denied on a motion made by Councilman Davis and
seconded by Councilman Alter.

Resolution No. 93-241 authorizing renewal of depository agreements with
Lamar Bank, Nations Bank, Bank One-Beaumont, Parkdale Bank, Texas
Commerce Bank-Beaumont, Community Bank, and First Bank and Trust,
specifically for the purchase of time deposits for the period commencing
October 1, 1993 and ending September 30, 1995, was approved on a motion

made by Councilman Smith and seconded by Mayor Pro Tem Goodson.

Resolution No. 93-242 authorizing Community Bank to act as a collection
agent and depository of Water Utility payments for the City of Beaumont
was approved on a motion made by Mayor Pro Tem Goodson and seconded by
Councilman Smith.

Resolution No. 93-243 authorizing payment in the amount of $20, 071. 31 to
Mustang Tractor and Equipment for emergency repairs (equalizer bar and
suspension, track adjuster and final drive guard) to Unit 5061, a 1987
Caterpillar D7H landfill dozer was approved on a motion made by
Councilman Smith and seconded by Councilman Moore.

Councilman Moore reported a great time this morning at the Montagne
Center with third-graders attending the Chicken Club Rally--(an anti-
drug program established by the Beaumont Optimist Club and directed at
young adolescents, C.-cool H.-honest I.-intelligent C. -clear-headed K.-
keen E.-energetic N.-not interest in drugs) .
Mayor Pro Tem Goodson said there was a good turn-out of volunteers for
the eighth annual Texas Coastal Cleanup at McFaddin Beach and
complimented the Fire Department, the Fire Marshall 's office and the
Police Department for fast and efficient assistance in extinguishing a
fire last night in his neighbor's garage that could have been very
disastrous.

Councilman Smith called attention to October 27th, "Federal Mandate
Day, " and said the National League of Cities would like the cost of
these mandates highlighted for public knowledge.
Mayor Lord said the U. S. Conference of Mayors and the City Managers'
Association are combining efforts with the National League of Cities to
publicize these costs and press releases will be prepared with relative
statistics.
Also, Councilman Smith reported that members of the National League of
Cities Human Development Policy Committee were invited by President
Clinton to attend a meeting last Thursday at the White House to discuss
health care. She said they were able to express some of the important
issues concerning cities, and said they think this is a step in the
right direction, but are not sure of any significant, final passage, and
are concerned that this may develop into another Federal mandate.
Mayor Lord expressed appreciation that Councilman Smith was one of those
invited to attend the health care meeting and thanked Mayor Pro Tem
Goodson for conducting last week's Council meeting while she and
Councilmembers Davis and Moore were in Orange County at a meeting held
by Henry Cisneros, the Secretary of Federal Housing and Urban
Development.

Mr. Henry Dannenbaum, 2820 Pine Street, addressed Council to
congratulate Some Other Place for celebrating twenty-five years as a
mission outreach in Beaumont.

There being no further business, the Regular Session of City Council was
recessed to convene in Workshop Session.
