CITY COUNCIL- CITY OF BEAUMONT
HELD APRIL 25, 1995 - 1:30 P.M.
BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session
this the 25th day of April, 1995, with the following present:

The Invocation was given by the Reverend Don Stabe, Cathedral in the Pines.
The Pledge of Allegiance was led by Public Works Director Tom Warner (whom Mayor Moore
announced was celebrating his 40th birthday).

Four Proclamations were issued: a proclamation honoring the 'Beaumont Kennel Club" and applauding
"Julia Brooks Lester" for her love of animals and tireless efforts in working with the Kennel Club
program; "Crime Victims' Rights Week" April 23-29, 1995; "National Credit Education Week,"
April 23-29, 1995; and "Oncology Nurses Day," April 26, 1995.

Convention and Tourism Director Jef Russell introduced and welcomed Mayor John Berthelot of
Gonzales, Louisiana, representative from the Gonzales City Council and the Tourism Department, along
with 40 plus citizens of Gonzales, who are in Beaumont promoting their annual Jambalaya Festival held
during the first full weekend of June.

Mayor Moore added his welcome to Mayor Berthelot and the Gonzales' visitors, said that he and Mrs.
Moore and Mayor and Mrs. Berthelot became acquainted at Texas Municipal League meetings and have
become good friends. Mayor Moore announced that following Council between 4:00 p.m. and 6:00
p.m., the citizens of Gonzales will share an expression of their hospitality by serving their special recipe
of Jambalaya and playing Cajun music representative of their Louisiana culture in the City Hall Plaza area.
Mayor and Mrs. Berthelot, Mr. Robert Petrie, president of the Jambalaya Association, Ms. Delores
Girard, president of the Tourist Commission of Gonzales, Councilman Larry Savell and Fire Chief Cobby
Walker presented gifts to Mayor and Mrs. Moore, Ms. Barbara Boudreau, Mayor Moore's secretary, and
City Councilmembers.
Councilmembers and Ms. Boudreau in turn reciprocated by making presentation to their counterparts in
Gonzales, and Mayor Moore presented honorary Beaumont citizenship cards, photographs, and gifts bags
to Mayor and Mrs. Berthelot and a key to the city to Mayor Berthelot that he said is given to special
dignitaries that come to Beaumont "that opens absolutely everything, especially our hearts!"

Citizen comment was invited on the Consent Agenda and Main Agenda Items 2 and 3.
Mr. Forrest F. "Ted" Posey, 3695 Edmonds, (age 85 and misunderstanding the restricted subjects)
addressed Council to again request consideration for public transportation on Sundays to allow senior
citizens a way to attend church.

The following Consent Agenda items were considered:
Approval of the Minutes of the regular City Council session held April 18, 1995;
Resolution No. 95-116 authorizing a License to Encroach agreement with the Sisters of Charity of
Incarnate Word on a 4.0 feet wide portion of the sixty foot Fourteenth Street right-of-way, 228 feet
north of the centerline of Calder Avenue and east of Block 13 of the Jarrett Addition, for a one-time fee
of$500.00; and
Resolution No. 95-117 authorizing settlement of the claim styled Charlene Busceme vs. City of
Beaumont in the amount of$4,940.00.
The Consent Agenda was approved on a motion made by Councilman Cokinos and seconded by
Councilman Goodson.

Ordinance No. 95-28 approving a Specific Use Permit for operation of an auto window tinting
business in the garage at 2540 Liberty in an area zoned RCR (Residential-Conservation and
Revitalization District) at the request of Ms. Connie Bass was considered:
ORDINANCE NO. 95-28
ENTITLED AN ORDINANCE GRANTING A SPECIFIC USE PERMIT TO ALLOW
AN AUTO WINDOW TINTING BUSINESS IN AN AREA ZONED RCR
(RESIDENTIAL CONSERVATION AND REVITALIZATION) DISTRICT FOR
PROPERTY LOCATED AT 2540 LIBERTY, IN THE CITY OF BEAUMONT,
JEFFERSON COUNTY, TEXAS.
Council questioned future sale of the property and continuance or voidance of the Specific Use Permit,
limits of permit to garage or entire property, other potential business ventures at the site, subsequent
conforming use under the Specific Use Permit without further Council action and amending the site plan
and discussed fencing, business signage, and parking in reference to the integrity of the neighborhood.
Ordinance No. 95-28 was approved with the site plan amended to reflect a requirement for
construction of an eight-foot privacy fence,prohibiting business signage on property, and driveway access
from Liberty to rear line of house not available for customer parking on a motion made by Councilman
Goodson and seconded by Councilman Smith.

Resolution No. 95-118 authorizing a one-year contract with Duke's Sales & Service, Inc. for root
control treatment of sewer mains for the Water Utilities Department at $1.05 per linear foot for an
estimated 18,000 linear feet of 6" sewer main-418,900, 14,000 linear feet of 8" sewer main--$14,700, and
4,000 linear feet of 10" sewer main--$4,200 for an estimated total of$37,800.00 was approved on a
motion made by Councilman Cokinos and seconded by Councilman Ames.

Resolution No. 95-119 authorizing purchase of computer networking equipment from Digital
Solutions in the amount of$19,830.00 to interface with the Houston Area Library Automated Network
(HALAN) system to allow our libraries greater access to information from other library consortiums
across the country and reduce computer downtimes previously experienced was approved on a motion
made by Councilman Cokinos and seconded by Councilman Smith.

Mayor Moore announced there will not be a workshop session or executive session conducted today.

Councilman Goodson reported that the ACORN Neighborhood Association has become quite active as
have some other associations, and he has been asked by them to present a petition to Council. He read
a statement that said: "ACORN, your neighborhood association would like to present the following
petition to our City Councilman to present it to City Council, hopefully for their approval and funding of
a park in our neighborhood. Imagine ACORN Park, a place our children need to play, ride and be able
to have all of their events. Please get involved with ACORN and help our neighborhood come together
as friends and neighbors and to help improve the quality of life in our community." Councilman Goodson
said there are a large number of signatures attached to this request, said he told Carol Gauthier and the
Association that Council will try to work with them and that the Parks Department is aware this is a large
neighborhood without a community park and that grant assistance will be researched.
Councilman Smith said that Phase I of the M. L. Lefler Park in northeast Beaumont was dedicated in
honor of a former City Attorney. She said it is a lovely park in a wooded area that will be very nice for
the neighborhood, expressed appreciation to the Lefler family for donation of the land and hopes other
phases will be completed in the near future.
Councilman Ames announced that as a function of the Neches River Festival, Judge James Farris was
voted to receive the Citizen of the Year award.
Mayor Moore hailed the "weather warriors"who participated in an excellent Neches River Festival parade
Saturday, said the City's float was outstanding, congratulated King Dan Hallmark, said the spirit of
Beaumont was well expressed in the day's activities even though there were clouds and threats of rain.
Also, Mayor Moore commented that he was impressed with the number of people accessing the Miller
Library last Saturday afternoon, and congratulated Price Elementary for the program acknowledging
youth and Austin Middle School who conducted an excellent honor society induction program last
Thursday. Mayor Moore stated that Council is fortunate to combine efforts with neighborhood
associations for affective changes and improvements in the community. Lastly, Mayor Moore thanked
the Red Lobster Restaurant for allowing law enforcement officers to participate in the Tip-A-Cop
Program last evening where he was the official greeter and again reminded everyone to attend the
Jambalaya Festival between 4:00 p. m. and 6:00 p.m. sponsored by our friends from Gonzales, Louisiana.

Ms. Connie Bass, 2540 Liberty, addressed Council in appreciation for granting the Specific Use Permit
to allow operation of an auto window tinting business on her property.
Mr. Tony Sacker, 4635 Elmherst, addressed Council to express pleasure in being appointed to the Mayor's

Coalition for a Drug Free Beaumont by Councilman Cokinos and said he helped the late Mr. Jerry Ware
formulate the Jefferson County Drug Abuse Program.
Mr. Henry Rowe, 5825 Garner Road, addressed Council to complain about use of Halbouty Park late at
night,boys throwing rocks at his wife on their property, lack of response by the Police Department to a
call from a neighbor about boys loitering and throwing rocks and requested that better service be given
to citizen calls for assistance.
Mr. Robert Lynn DeMary, 430 East Elgie, addressed Council to report that the same concerns of Mr.
Rowe were expressed at the TACTIC Neighborhood Association meeting across from Central Ninth
Grade campus experiencing similar problems, expressed concern of neighborhood associations regarding
the Specific Use Permit process and protecting rights and integrity of neighborhoods, thanked Valspar
Paint Company for participating with neighborhood groups and the Clean Community Division in
sponsoring a Paint-A Thon, Saturday, April 29th.
