The Pledge of Allegiance was led by Mayor Pro Tem Davis. -000- Citizen comment was invited on the Consent Agenda and Main Agenda Items 9 through 15. Mr. Jimmy Thomas, district manager for Entex, addressed Council in support of Agenda Item 14 suspending the Entex request to increase natural gas rates for ninety days for additional review time. -000- The following Consent Agenda items were considered: Approval of the Minutes of the regular City Council session held September 20, 1994; Resolution No. 94-259 authorizing a contract with Gissco, Inc. in the amount of $21,000.00 for demolition and removal of buildings at 2985 and 3095 Liberty Avenue for right-of-way clearance of obstructions for the Liberty-Laurel Overpass Project; -229- September 27, 1994 Resolution No. 94-260 authorizing acquisition of Parcel 167 C: 1 .018 acres out of the H. Williams Survey, Abstract 56 (on the east side of Major Drive north of Boy's Haven) for the appraised value of $11,707.00 from H. G. Nichols, Sr. and Parcel 168 B: 2.8784 acres out of the W. B. The Consent Agenda was approved on a motion made by Councilman Goodson and seconded by Mayor Pro Tem Davis. Question: Ayes: All Mayes: None -000- Mayor Moore announced that an executive session will be held in accordance with Section 551.071 of the Government Code to discuss contemplated or pending litigation: Kristinia Mae Standifer vs. City of Beaumont following the regular session of City Council. -000- - resolution authorizing release of a portion of Beaumont's five-mile Extraterritorial Jurisdiction to allow the Town of Rose Hill Acres to proceed with a proposed annexation of 148 acres abutting Rose Hill Acres to the east and extending east across U. S. Highway 69, 96 and 287 to the A. T. & S. F. Railroad right-of-way was denied on a motion made by Councilman Smith and seconded by Councilman Williams Question: Ayes: All Mayes: None -230- September 27, 1994 Ordinance No. 94-43 authorizing issuance of a specific use permit to allow construction of a single family residence at 1850 Thomas Road, Lot 30-A, Blue Star Addition and Tract 11-U, Plat D-25, H. Williams Survey, with a total height of 47" feet in an area zoned RS (Residential Single Family Dwelling) District was considered: ORDINANCE NO. 94-43 ENTITLED AN ORDINANCE GRANTING A SPECIFIC USE PERMIT TO ALLOW A SINGLE FAMILY RESIDENCE WITH A TOTAL HEIGHT OF 47 FEET ON LAND ZONED RS (RESIDENTIAL SINGLE FAMILY DWELLING DISTRICT) AT 1850 THOMAS ROAD IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS. Mr. Riley explained that the specific use applicant requested a total height of 47 feet, but at a Joint Public Hearing, the Planning Commission voted to approve a 42 foot height allowance for the residence. However, an actual survey revealed the exact height of the structure to be 42.71 feet. Councilman Williams made a motion, seconded by Mayor Pro Tem Davis, to amend the ordinance with a total height allowance of 43 feet. Further discussion raised questions concerning neighborhood privacy, specific height and type of fence or wall requirement and frosted windows on the back side of the residence. Councilman Williams withdrew his motion and Mayor Pro Tem Davis withdrew his second to the motion. Ordinance No. 94-43 was approved with an amendment for a 43-foot maximum height allowance, installation of at minimum a ten-foot tall fence or wall built of materials consistent with the residence under construction and installation of second-story frosted windows on the south side of the house on a motion made by Councilman Goodson and seconded by Councilman Williams. Question: Ayes: Mayor Moore Nayes: None Mayor Pro Tem Davis Councilman Cokinos Councilman Ames Councilman Goodson Councilman Williams Abstained: Councilman Smith Councilman Smith stated her reason for abstaining from the vote is because of her unhappiness that Council is put in this position time after time because of errors. She said this problem should never have -231- September 27, 1994 occurred; it is time to get a better handle on zoning regulations and that five such occurrences have taken place in her ward recently, and this is the only way she knows in which to protest. Councilman Goodson joined with Councilman Smith, said he understands Staff has a number of responsibilities and the coordination of permits and planning and zoning is not easily accomplished on every file, but Council has "taken a very active position to try to improve neighborhoods, particularly in Dr. Smith's ward where a number of efforts have been made for historical preservation and the improvement of the neighborhoods. " Councilman Goodson said Council would be backing down on their overall commitment if these things were allowed to go on unchecked, and that he hopes Staff will work to adopt some consolidated check-off procedure to insure all requirements are met before a specific use permit or variance is allowed. Councilman Smith added that the Planning Commission is also placed in an awkward position, and neither the Council or Commission should be put in the position to act after the fact. Mayor Moore supported Council comments, but pointed out that the positive side of the problem is that the neighbors have somewhat worked through the situation. He said the harmony of the neighborhood and community is important and not to be disrupted and instructed the City Manager to note that Council is uncomfortable with this and asked that it not come back in this form again. Councilman Williams commented that this discussion is about the pitfalls and downside of a specific use permit in an otherwise residential or otherwise commercial district, and said this was a concern of his when he previously served on Council. He concluded that he does not know if this can be avoided because this issue is dealing with a deviation from the norm, the norm being whatever the classification. Councilman Smith said a protest was made by the neighbors and allowed to languish while construction continued. Mayor Moore said that when the plan came to Staff for approval, the height should have been noted and not allowed. He said perhaps the Legal Department might need to look at the wording of the Building Code and the Planning and Zoning stipulations and bring back to Council for review. -000- An ordinance amending a specific use permit granted by Ordinance 93-24 to William H. Taft, President of Community Cemeteries, to expand an existing cemetery on a tract zoned RS (Residential Single Family Dwelling) District which would delete Condition 4 of the agreement to provide an 81x12' gate with an electric remote opener was considered: -232- September 27, 1994 ORDINANCE NO. ENTITLED AN ORDINANCE ISSUING AN AMENDED SPECIFIC USE PERMIT TO COMMUNITY CEMETERIES, INC. TO REMOVE ON OF SEVERAL CONDITIONS SET BY THE CITY COUNCIL IN THE ORIGINAL SPECIFIC USE PERMIT FOR EXPANSION OF AN EXISTING CEMETERY LOCATED WEST OF PINE STREET AND NORTH OF HALE STREET ON A 2 .26 ACRE TRACT OUT OF TAX PLAT D-20 IN THE A. WILLIAMS SURVEY ZONED RS (RESIDENTIAL SINGLE FAMILY DWELLING DISTRICT) BEAUMONT, JEFFERSON COUNTY, TEXAS. The ordinance was denied on a motion made by Mayor Pro Tem Davis and seconded by Councilman Ames. Question: Ayes: All Nayes: None -000- Ordinance No. 94-46 authorizing issuance of a specific use permit for operation of a real estate office at 2450 Laurel Avenue, described as Lot 18 and the east half of Lot 17, Block 25, Averill Addition, an area RCR (Residential Conservation and Revitalization) District, at the request of Emma M. Kyles, was considered: ORDINANCE NO. 94-46 ENTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMIT TO ALLOW A REAL ESTATE OFFICE IN AN AREA ZONED RCR (RESIDENTIAL CONSERVATION AND REVITALIZATION) FOR PROPERTY LOCATED AT 2450 LAUREL AVENUE IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS. Councilman Goodson stated he is in favor of passage of this ordinance, but said there was a question raised about the parking lot and understands the owner might acquire other property and install a circular drive. Mr. Richardson said the original plan was to build a circular drive on the subject property, but the Traffic Division was not in favor of this construction. Councilman Smith said this is a neighborhood where cement in the front yard is undesirable and perhaps the owner can purchase additional property for parking. Ordinance No. 94-46 was approved on a motion made by Councilman Cokinos and seconded by Mayor Pro Tem Davis. Question: Ayes: All Nayes: None -234- September 27, 1994 Ordinance No. 94-47 authorizing issuance of a specific use permit to allow a church on 2623 Hoover at Dollinger, described as Tracts 129, 129A and 183 , Tax Plat D-12, A. Williams Survey, Abstract No. 385, containing 1 .725 acres of land, in an area zoned LI (Light Industrial) District at the request of the Reverend Arturo Rabago, pastor of the Spanish United Pentecostal Church, was considered: ORDINANCE NO. 94-47 ENTITLED AN ORDINANCE GRANTING A SPECIFIC USE PERMIT TO ALLOW A CHURCH ON LAND ZONED LI (LIGHT INDUSTRIAL) DISTRICT FOR PROPERTY LOCATED AT 2623 HOOVER AT DOLLINGER ROAD, IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS. Ordinance No. 94-47 was approved on a motion made by Councilman Cokinos and seconded by Councilman Smith. Notices have been sent to owners by Certified Mail and published in the Beaumont Enterprise. -235- September 27, 1994 The thirteen (13) structures listed below have been condemned by City Council and the owners ordered to either raze or repair them within specified time frames. Reinspection of these structures have revealed non-compliance with the Council's order. The Community Development Division of the Administrative Services Department is requesting authorization from the City Council to demolish these structures in accordance with the Dangerous Structure Ordinance and charge the property owners with the cost of demolition: 4080 Agnes, 3094 Brenham, 265 Fletcher, 1165 Fulton, 290 Lethia, 570 Lethia, 1375 Lo 11 3940 Octavia, 2323 Pope, 2332 Pope, 3915 Scranton, 3915 Scranton (rear) , and 395 E. Simmons. There being no one to address Council, the Public Hearing was closed. Ordinance No. 94-48 declaring certain dilapidated structures to be public nuisances and ordering their removal was considered: ORDINANCE NO. 94-48 ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES AND ORDERING THEIR DEMOLITION AND/OR REPAIR; PROVIDING FOR SEVERABILITY AND PROVIDING FOR A PENALTY. Ordinance No. 94-48 was approved on a motion made by Councilman Cokinos and seconded by Councilman Ames. Question: Ayes: All Nayes: None -000- Resolution No. 94-265 authorizing eminent domain proceedings to acquire Parcel 119: Lots 1 through 6, Block 35 of the Jarrett Addition (2905 Liberty) for the appraised value of $220,000 (Edna Elizabeth Marino, owner) for the Liberty-Laurel III project was approved on a motion made by Councilman Smith and seconded by Councilman Goodson. Question: Ayes: All Nayes: None -000- Resolution No. 94-266 authorizing purchase of an upgrade to the AS/400 computer system at the Police Department to provide sufficient capacity for future additions of mobile data terminals and an imaging system in the amount of $267,370.00 (to be paid from confiscated goods fund) from IBM Corporation was approved on a motion made by Councilman Cokinos and seconded by Councilman Goodson. Question: Ayes: All Nayes: None -236- September 27, 1994 Resolution No. 94-267 authorizing purchase of an upgrade to the disk units and disk controllers for the AS/400 computer system at City Hall to increase disk capacity to 25.6 gigabytes (13% increase) and the memory to 160 megabytes (25% increase) in the amount of $86,556.00 from IBM Corporation was approved on a motion made by Councilman Ames and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Resolution No. 94-268 authorizing annual contracts for water treatment chemicals with Coastal Products for aluminum sulfate at $109.97 per ton; CETCO Aquatec for fluorosilicic acid at $140 per ton; Jones Chemical for liquid chlorine at $461.50 per ton; and Weskem-Hall for aqua ammonia at $328.85 per ton and phosphate water treatment compound at $0.54 per pound; for an approximate annual expenditure of $272 ,731.00 was approved on a motion made by Councilman Cokinos and seconded by Mayor Pro Tem Davis. Question: Ayes: All Nayes: None -000- Resolution No. 94-269 authorizing Change Order No. 2 to reflect actual quantities used, reducing the original contract amount by $39,829. 22 for a revised total contract cost of $8,875,492.06, and authorizing final payment in the amount of $31, 341.00 to Crain Brothers, Inc. for the construction of Artificial Wetland Wastewater Treatment System was approved on a motion made by Councilman Smith and seconded by Councilman Goodson. Question: Ayes: All Nayes: None -000- Resolution No. 94-270 authorizing the City of Beaumont to suspend the proposed rate increase of Entex for 90 days from and after its effective date and a public hearing set for Tuesday, December 20, 1994, to consider the proposed rate increase was approved on a motion made by Councilman Cokinos and seconded by Councilman Goodson. Question: Ayes: All Nayes: None -000- Resolution No. 94-271 authorizing the City of Beaumont to join with other participating cities to review Gulf States Utilities' fuel filing and to intervene at the Public Utility Commission, subject to the right to act independently in the exercise of local regulatory authority, was considered. After a lengthy discussion, Council asked Ms. Dolly Johnson, Gulf division manager for Entergy-GSU to comment and answer questions -237- September 27, 1994 regarding their surcharge request. Ms. Johnson explained that a surcharge represents the difference between the estimated and actual cost they pay for fuel . An overcharge warrants a refund to consumers and undercharge a fuel surcharge to recoup losses. In response to other questions by Council, City Attorney Lane Nichols said that intervention gives opportunity for Beaumont to play a role in this case as the largest city in GSU's service area; cited instances when direct intervention has had positive and significant effects in rates and economic development by independent consultants uncovering ineligible requests; and explained that the Public Utility Commission staff hears many utility companies requests, are overworked, experiences a high turnover of employees that can result in the utility companies receiving the edge. He said independent counsel hired by the intervening cities are expert in that field and can finitely research for errors. Resolution No. 271 was approved on a motion made by Mayor Moore and seconded by Councilman Williams. Question: Ayes: Mayor Moore Nayes: Councilman Mayor Pro Tem Cokinos Davis Councilman Ames Councilman Smith Councilman Goodson Councilman Williams -000- Councilman Goodson announced that the next Tuesday the Tyrrell Park Neighborhood Association will meet at the City's Lafin Road facility at 7: 30 p.m. and the ACORN, Amelia Neighborhood Association, will meet October 3rd at 7:00 p.m. at the Forest Park United Methodist Church. Mayor Pro Tem Davis commented that 1725, 1735 and 1745 Brooklyn are a row of houses that should be checked for demolition and is an advocate of street lighting as a deterrent to crime. He said he is concerned with the areas at I-10 and Lucas! Concord and the Neches River, Linson Street, Caldwell Street from IH-10 north and on Park Street in front of the Carroll-Wallace Funeral Home that need to be better lighted. Also, he said that Orange Street from Washington to Franklin was used extensively by trucks during recent construction and is now in need of repairs and asked that Staff would survey the situation. Mayor Moore said this might be a good time to ask Jim Cline and Staff to perform a street lighting overview on the streets mentioned regarding spacing and intensity of lights. The City Manager commented that in the comprehensive report, the City will add and upgrade 350 lights, and some may be in the areas of Mayor -238- September 27, 1994 Pro Tem Davis' concern, but Staff will take the current study and make a specific examination of that area. Mayor Moore thanked the community leaders and members of Council for holding a reception for him last week; thanked the citizens of Beaumont, City Staff--CVB and Fire Department, Councilman Ames and the Hilton Hotel, other members of Council who supported the National League of Cities Transportation and Communication Steering Committee meeting held in Beaumont beginning last Thursday. He said over 30 people were in attendance, the weather was beautiful, and citizens friendly. He said several people commented about the friendliness of citizens all throughout the city as spouses and members toured and shopped. Also, Mayor Moore congratulated the American Heart Association for an event with Indian dancers last Saturday, Coburn Supply for their groundbreaking of a new facility, and the Police Department for speedy and responsive police work in a recent sniper fatality. Mayor Moore said he has expressed condolences to family members and friends of the victim and reported to Council that yesterday he visited the Ball High School football player to check on his recovery and that he is back in school. -000- Mr. Roberto Flores, Jr. , 730 Central , commended Council for efforts in making city government accessible by conducting night meetings, reiterated past comments made to Council about responsibility accepted by endorsing the Beaumont Independent School District's bond issue, said the relationship between the City and BISD should always be optimum and partners to improve the city, and expressed dissatisfaction with BISD's "questionable decision to move some students" from one school location to another and asked for citizen assistance. Mr. Roberto Flores, Sr. , 2425 Buchanan, addressed Council to add comments of opposition to BISD temporarily relocating students to another school that requires busing and solicited Council assistance in assuring students the opportunity to walk to neighborhood schools. Mr. Lynn DeMary, 430 East Elgie, on behalf of the Beaumont Federation of Neighborhood Associations, displayed the winning logo of a recent contest. Mayor Moore questioned any symbolism of the chain links and the City Seal. Mr. DeMary said he has not conferred with the artist, but assumes it represents the racial unity that can be achieved throughout the city through neighborhood associations. Also, Mr. DeMary invited everyone to attend a neighborhood association in the northend tomorrow night (Wednesday) and in South Park Thursday night. Mr. Albert Roe, 6030 West Windemere, addressed Council regard a rumor that HUD is going to buy about 62 lots in his subdivision, asked if Council could substantiate any action and spoke in opposition to such a venture. -239- September 27, 1994 The Mayor and Council advised Mr. Roe they were not aware of HUD's intentions. Councilman Goodson said he received a call from a citizen relative to Mr. Roe's concern, was unable to reach Mrs. Neatherly at HUD, but spoke to a boardmember of Beaumont Housing Authority who said the Housing Authority is not negotiating at their level for purchase of the property. Councilman Goodson said he cannot confirm any action by HUD, but the issue can be pursued since HUD has an office in downtown Beaumont. Mayor Moore commented that he also made telephone calls regarding HUD's plan for the Windemere area, and he is not aware of any property purchases. He said HUD's policy has been to conduct a public hearing before making property purchases. Also, Mayor Moore commented that we in reference to being at a crossroads, that the crossroad is only as good as we are in terms of making progress. He confirmed Council did endorse the school bond issue that does affect everyone and said he is not insensitive to present issues. Mayor Moore reviewed information that a call to the BISD Administration revealed that some schools will close, some are overcrowded, some improperly staffed because of number changes, and some without adequate facilities to conduct class.
