BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 9th day of August, 1994, with the following present: David W. Moore Mayor John K. Davis Mayor Pro Tem and Councilman, Ward III Andrew P. Cokinos Councilman-At-Large Becky Ames Councilman-At-Large Lulu L. Smith Councilman, Ward I Guy Goodson Councilman, Ward II Calvin Williams Councilman, Ward IV Ray A. Riley City Manager Lane Nichols City Attorney Rosemarie Chiappetta City Clerk -000- The Invocation was given by Dr. John Power, pastor of Calvary Baptist Church. The Pledge of Allegiance was led by Councilman Ames. -000- Mayor Moore called for citizen comments on items contained in the Consent Agenda and Main Agenda. No one wished to address Council. -000- Mayor Moore called an Executive Session in accordance with Section 551.074 of the Government Code to discuss appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a public officer or employee, specifically the magistrate of the Municipal Court, to be held immediately following the City Council Workshop. -183- August 9, 1994 The following Consent Agenda items were considered: Approval of the Minutes of the regular City Council session held July 26, 1994; Resolution No. 94-189 appointing James Oliver to the Sister City Commission, term expiring August 8, 1996; Resolution No. 94-190 accepting water and sanitary sewer improvements in Blackmon Lane Professional Plaza, described as Lots 1 through 4, 1.99 acre tract out of and part of Lots 3 and 4, Block 1, French Subdivision; Resolution No. 94-191 authorizing renewal of a lease agreement (Lease No. CL 880016) with the State of Texas for coastal public lands, specifically for 5,270 square feet public pier located on the Neches River at Riverfront Park for a term of five years commencing April 18, 1994 with no fees other than a $25.00 filing fee; Resolution No. 94-192 accepting 5-foot by 275-foot strip of land for additional street right-of-way for Wescalder Road out of Lot 1, Block 6, Wescalder Fig Acres Addition from Preston Jardell and Resolution No. 94-193 authorizing the settlement of a claim styled Kevin White vs. The City of Beaumont in the amount of$70,000. The Consent Agenda was approved on a motion made by Councilman Goodson and seconded by Mayor Pro Tem Davis. Question: Ayes: All Nayes: None -000- A resolution to include the City of Beaumont in the class action lawsuit: City of Port Arthur vs. Southwestern Bell Telephone Company, was considered: In answer to various questions and concerns expressed by Council, City Manager Riley and City Attorney Nichols stated that, if the City joins the suit, franchise fees would be held by the Court until settlement; that Southwestern Bell had refused on several occasions to provide requested information on revenues for audit but that disclosure of these revenues would be required through the lawsuit; that communication can only come if the city joins the lawsuit; that there is no risk for the City and that greater returns are expected to be realized by consumers and the City as a result of the lawsuit. -184- August 9, 1994 After further discussion, a motion to approve Resolution No. 94-194 to include the City of Beaumont in the class action lawsuit: City of Port Arthur vs. Southwestern Bell Telephone Company was made by Councilman Williams and seconded by Mayor Pro Tem Davis. Question: Ayes: Mayor Moore Nayes: None Mayor Pro Tem Davis Councilman Smith Councilman Williams Abstained: Councilman Cokinos Councilman Ames Councilman Goodson -000- Resolution No. 94-195 authorizing a contract with the Texas Department of Transportation for receipt of funds to subsidize the operating expense of the municipal transit system in the amount of $149,687.00 was approved on a motion made by Councilman Goodson and seconded by Councilman Davis. Question: Ayes: All Nayes: None -000- In addition to the earlier-called Executive Session to be held in accordance with Section 551.074, Mayor Moore called an Executive Session in accordance with Section 551.071 of the Government Code to discuss contemplated or pending litigation, specifically, the Claim of Andrew Scott, will be held immediately following the City Council Work Session. 000- Councilman Goodson reminded that there will be an organizational meeting of the Tyrrell Park Neighborhood Association Wednesday at 7:00 p.m. at the Tyrrell Park Community Center and expressed appreciation to the South Park and Amelia Neighborhood Associations for their assistance and said that representatives from each group will be present at this meeting. He further expressed his appreciation to Channel 6, the City and the Police Department for last Tuesday night's Crime Night Out saying it was very well attended and that he appreciated everyone's efforts. -185- August 9, 1994 Councilman Davis reported that he had received calls from citizens concerning their requests for extension of bus service on College Street because of the relocation of Entex from the downtown area. The City Manager responded saying that it had been determined that it would cost an estimated $100,000 to extend this service but further stated that it was possible to develop other bill-paying sites for Entex customers, such as City Hall or grocery stores or banks. Councilman Williams mentioned receipt of communication concerning the extension of the bus service on College Street near an apartment complex and the need for a traffic light in the area and complained about weeds and requested a report. Mayor Moore congratulated the Boy Scouts on their Distinguished Citizen Dinner that was held honoring Dr. Gray. In addition, he echoed Councilman Goodson's comments relative to Crime Night Out. He said the significant thing about Crime Night Out was that it was a nice event that afternoon at the Police Substation and that there were people from all over the community - from every one of the neighborhood associations. He thanked Councilman Cokinos for filling in for him Sunday at Fellowship Church and welcomed Pastor Tommy Williams to the Beaumont community. He reminded that a Public Safety Forum will be held Thursday, 6:30 p.m. at the Civic Center, to give citizens the opportunity to interact with Council for further understanding of City government as well as to specifically explain certain city ordinances such as the new Teen Curfew Ordinance. In closing, Mayor Moore offered Mayor Pro Tern Davis "well wishes" in his marriage to be held August 13, 1994. -000- Mr. Allen Burch, 4610 Barton Lane, addressed Council to complain about large sand and concrete trucks using Edson Street. Mr. Cleveland Nisby, 4520 Corley, addressed Council to complain of 18-wheelers and other large trucks using 23rd Street and requested enforcement of the "Local Delivery Trucks Only" signs that are posted on 23rd between College and Washington Blvd. Mr. Henry Dannenbaum, 2880 Grand, again reminded all to attend the Public Safety Forum to be held Thursday, August 11th in the Civic Center. Mr. Jude Paredez, 920 Wisteria, addressed Council to complain about the Teen Curfew and asked for its repeal. -186- August 9, 1994 There being no further business, the regular session of the City Council was recessed before continuing with the Work Session. -000- I, Rosemarie Chiappetta, City Clerk of the City of Beaumont, Texas, certify that the above is a true copy of the Minutes of the regular City Council session held August 9, 1994.
