BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 26th day of July, 1994, with the following present: HONORABLE: John K. Riley City Manager Lane Nichols City Attorney Rosemarie Chiappetta City Clerk -000- The Invocation was given by the Reverend Dale Dailey, pastor of Southside Assembly of God. The Pledge of Allegiance was led by Councilman Cokinos and his nephew, Andre Cokinos. -000- Mayor Pro Tem Davis announced that Mayor Moore is in Washington, D.C. attending meetings with Congressional legislators. -000- Citizen comment was invited on the Consent Agenda and Main Agenda Items 2 and 3. No one wished to address these subjects. -000- The following Consent Agenda items were considered: Approval of the Minutes of the regular City Council session held July 19, 1994; Resolution No. 94-181 authorizing Texas Commerce Bank-Beaumont to pledge securities with a par value of $178,726.96 to be held at Bank -177- July 26, 1994 One-Dallas, effective July 26, 1994; Resolution No. 94-182 reappointing Bob Hadley to the Airport Advisory Committee and Virgil Hughes to the Plumbing and Mechanical Board of Review for terms expiring June 15, 1996; Resolution No. 94-183 approving a waiver of penalty and interest on the tax accounts of Scott Cook, Account No. 003970-004400, in the amount of $125.80 and Louis Broussard, Account No. 071069-002000, in the amount of $18.80 pursuant to Section 33 .011 of the Property Tax Code; Resolution No. 94-184 accepting improvements for maintenance in Pecan Place, Section One, Street and Storm Sewer Improvements: Pecan Drive from Major Drive approximately 656 feet east to and including the temporary cul-de-sac and Rosewood Street from Pecan Drive approximately 179 feet north to 3 type OM-4P markers and Water and Sanitary Sewer Improvements: Lots 1-12, Block 1 and 2 , contingent on filing of final plat complete with proper filings of dedication of all rights-of-way and easements required on the preliminary and final plats and installation of street lights; Resolution No. 94-185 authorizing acquisition of Parcel No. 12: 0.039 acres out of Lot 17, Block 1, and Lot 1, Block 2, Calder Highland Addition, 711 West Lucas Drive, from Mrs. Lera Bess Smith for the appraised value of $5,000.00 for the West Lucas Drive project right-of- way from Phelan Boulevard to Delaware; and Resolution No. 94-186 authorizing a one-year lease agreement for property located at 647 West Lucas with St. John Lutheran Church at $400.00 per month. The Consent Agenda was approved on a motion made by Councilman Cokinos and seconded by Councilman Ames. Question: Ayes: All Nayes: None -000- Ordinance No. 94-36 authorizing a zone change from RS (Residential Single Family Dwelling District) to NC (Neighborhood Commercial District) for property located at 1390 Brockman at Avenue A at the request of Mr. P. V. Morreale was considered: -178- July 26, 1994 ORDINANCE NO. 94-36 ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS, AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE ZONING OF PROPERTY PRESENTLY ZONED RS (RESIDENTIAL SINGLE FAMILY DWELLING DISTRICT) TO NC (NEIGHBORHOOD COMMERCIAL DISTRICT) FOR 1390 BROCKMAN STREET AT AVENUE A IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. Ordinance No. 94-36 was approved on a motion made by Councilman Cokinos and seconded by Councilman Goodson. Question: Ayes: All Nayes: None -000- Resolution No. 94-187 endorsing the Jefferson Theatre's Texas Department of Transportation - Statewide Transportation Enhancement Program grant application for funds to assist in renovation of their building's fire escapes, recommending this project for "enhancement funding" by the Texas Department of Transportation and guaranteeing 20% of the funds by the City of Beaumont was approved on a motion made by Councilman Smith and seconded by Councilman Ames. Question: Ayes: All Nayes: None -000- Resolution No. 94-188 designating the firm of Cook Shaver Parker & Williams, Certified Public Accountant's as independent auditors for the City of Beaumont for the fiscal period ending September 30, 1994 for a fee in an amount not to exceed $104,000.00 (audit based on actual hours billed) was approved on a motion made by Councilman Cokinos and seconded by Councilman Goodson. Question: Ayes: All Nayes: None -000- A Public Hearing was called to consider the twenty-six (26) below listed dilapidated structures found to be in violation of the City of Beaumont's Dangerous Structure Ordinance, Article III, Section 14-50: 3745 St. Helena - Wilson Idelbird, owner (24 violations) ; 2323 Pope - Indir R. Sanders, owner (22 violations) ; 2332 Pope - Nolan Hines, Sr. , owner (22 violations) ; 3220 Cleveland - Dan Sims, owner (22 violations) ; 2090 Primrose (18 violations) and 2090 Primrose, garage (7 violations) - -179- July 26, 1994 Darby Barr Kethan, owner of both structures; 3325 Texas - Claudette Gilbo, owner (25 violations) ; 1324 Harrison - Elvira Battle, owner (25 violations) ; 395 E. The above listed parcels of property have been inspected, are vacant and have been found to be in violation of Article III, Section 14-50 of the Code of Ordinances. Notices have been sent to owners by Certified Mail and published in the Beaumont Enterprise. Owners of eight of the above listed structures: 3745 St. Helena, 3325 Texas, 1324 Harrison, 2171 Liberty (Apts. ) , 2365 Irving, 2355 Park, 2750 Mashed O, and 4112 Ogden (Garage) have signed Demolition Consent Forms requesting the City to demolish these structures. The twenty-eight (28) structures listed below have been condemned by City Council and the owners ordered to either raze or repair them within specified time frames. Reinspection of these structures have revealed non-compliance with the Council's order. The Community Development Division of the Administrative Services Department is requesting authorization from the City Council to demolish these structures in accordance with the Dangerous Structure Ordinance and charge the property owners with the cost of demolition: 2755 Amarillo, 2360 Brooklyn, 1490 Center, 867 Concord, 873 Concord, 5530 Crestland Loop, 2020 Dexter, 3534 W. Euclid, 2790 S. 4th (Shed) , 3040 Grand, 970 Lincoln, 2145 Live Oak, 1330 Louisiana, 951 Magnolia, 961 Magnolia, 1359 Maple, 1363 Maple, 2885 Nora, 3055 Nora, 2054 Pear, 2475 St. Helena, 3645 Scranton, 2024 Tulane, 1945 Turon, 3550 Usan, 750 Van Buren, 1790 W. Virginia, and 1790 W. Virginia (Garage) . There being no one to address Council, the Public Hearing was closed. Ordinance No. 94-37 declaring certain dilapidated structures to be -180- July 26, 1994 public nuisances and ordering their repair or removal by the owners and authorizing the removal of certain other structures whose owners failed to comply with condemnation orders was considered: ORDINANCE NO. 94-37 ENTITLED AN ORDINANCE FINDING CERTAIN STRUCTURES TO BE PUBLIC NUISANCES AND ORDERING THEIR DEMOLITION AND/OR REPAIR; PROVIDING FOR SEVERABILITY AND PROVIDING FOR A PENALTY. Ordinance No. 94-37 was approved on a motion made by Councilman Cokinos and seconded by Councilman Cokinos. Question: Ayes: All Nayes: None -000- Mayor Pro Tem Davis announced that an executive session will be held following the regular City Council meeting in compliance with Section 551.071 of the Government Code to discuss contemplated or pending litigation: the Claim of Jacqueline Hebert, the Claim of Daniel Clark, the Claim of Linda Jones, and the Claim of Kevin White. -000- Mr. Henry Dannenbaum, 2880 Grand, addressed Council to compliment Councilman Cokinos and Councilman Ames for their leadership of the Task Force established to review alternate plans for the homeless shelter. Mr. Robert De Mary, 430 East Elgie, addressed Council to express appreciation for completion of repairs and opening of College Street, spoke in support of including installation of street lighting, utility poles, etc. in budget preparation, and announced that the South Park Neighborhood Association will meet Thursday evening and the North End Neighborhood Association on Wednesday evening and invited Council to attend. Councilman Goodson added that the ACORN group (Amelia Coalition for Responsible Neighbors) will meet on August 1st at 8:00 p.m. at the Forest Park United Methodist Church. -000- There being no other business, the regular session of City Council was recessed to reconvene in executive session. -000- I, Rosemarie Chiappetta, City Clerk of the City of Beaumont, Texas, -181- July 26, 1994 certify that the above is a true copy of the Minutes of the regular City Council session held July 26, 1994.
