CITY COUNCIL - CITY OF BEAUMONT
HELD JUNE 21, 1994 - 1:30 P.M.
BE IT REMEMBERED that the City Council of the City of Beaumont, Texas,
met in regular session this the 21st day of June, 1994 , with the
following present:

The Invocation was given by the Reverend Clarence Williams, Jr. , East
Mount Olive Baptist Church.
The Pledge of Allegiance was led by Natasha Duggins, assisted by her
mother, who is a member of the South Park Neighborhood Association.

Citizen comment was invited on the Consent and Main Agendas.
Mrs. Ruth Naumczik, 370 Giles, addressed Council as a reminder that the
South Park Neighborhood Association requested consideration of a city-
wide curfew a year ago and agreed to wait until the Community Oriented
Policing program was initiated. Mayor Moore advised Mrs. Naumczik that
a curfew ordinance is a topic on the workshop agenda for today.
Ms. Doris Price Neely, 1095 Goliad, addressed Council regarding the
Homeless Shelter on behalf of the Department of Nursing at Lamar
University and was advised by Mayor Moore that this subject is also an
item to be discussed during the workshop session.

The following Consent Agenda items were considered:

Approval of the Minutes of the regular City Council session held June
14, 1994;
Resolution No. 94-139 appointing Brian Alter to the Parks and Recreation
Advisory Committee for a term expiring July 12, 1995;
Resolution No. 94-140 accepting the bid of Utility Truck & Equipment Co.
for retrofitting above cab hydraulic steering units to two existing
trucks for the Solid Waste Management Department at $11,800. 00 each for
a total expenditure of $23 , 600. 00;
Resolution No. 94-141 authorizing a License to Encroach to Gregg J. and
Angela C. Busceme for a garage encroaching 10.8 feet for a distance of
24. 2 feet into a ten (10) foot utility easement on Lot 13, and the South
1/2 of Lot 12 , Block 9, and 1/2 of the adjacent alley, Ogden Addition
(2110 Victoria) for a one-time fee of Five Hundred Dollars ($500. 00) ;
Resolution No. 94-142 authorizing settlement of the claim of Iris
Thompson vs. City of Beaumont in the amount of $35, 000. 00;
Resolution No. 94-143 authorizing settlement of the claim of Harry
Jackson vs. City of Beaumont in the amount of $18, 500. 00;
Resolution No. 94-144 authorizing settlement of the claim of Frank
Taylor vs. City of Beaumont in the amount of $8,900. 00;
Resolution No. 94-145 authorizing settlement of the claim of James Lane
vs. City of Beaumont in the amount of $6,590.79; and
Resolution No. 94-146 authorizing settlement of the lawsuit of Pearl
Randle Jacobs and and Viola Knauth Cass vs. City of Beaumont for a total
of $330, 500. 00 (Pearl Randle Jacobs, $141, 500. 00 and Viola Knauth Cass,
$189,000. 00) .
The Consent Agenda was approved on a motion made by Councilman Cokinos
and seconded by Councilman Goodson.

Resolution No. 94-147 authorizing application for and acceptance of a
grant in the amount of $699, 553 . 00 from the Automobile Theft Prevention
Authority for the Auto Theft Task Force comprised of officers from the
Beaumont Police Department, Port Arthur Police Department and the
Jefferson County Sheriff' s Office was approved on a motion made by
Councilman Cokinos and seconded by Mayor Pro Tem Davis.
(Councilman William arrived before the vote. )

Resolution No. 94-148 authorizing acquisition of Parcel 3: Lot 10,
Block 2, Broadway Place Addition, 410 29th Street, from Mr. and Mrs.
Patrick A. Wallace at the appraised value of $89, 995.00 for improvements
to West Lucas Drive from Phelan Boulevard to Delaware Street was
approved on a motion made Mayor Pro Tem Davis and seconded by Councilman
Smith.
Mayor Pro Tem Davis questioned when he would receive a previously
requested report of a list of streets regarding possible maintenance,
and in answer to Councilman Williams inquiry, the City Manager explained
the comprehensive street plan and street user fee commitment.

Ordinance No. 94-32 amending Section 13-14 (2) of the Code of Ordinances
relating to noise to clarify "plainly audible" and changing the
effective hours to be twenty-four hours per day was considered:
ORDINANCE NO. 94-32
ENTITLED AN ORDINANCE AMENDING CHAPTER 13 OF THE
CODE OF ORDINANCES OF THE CITY OF BEAUMONT TO AMEND
A PORTION OF THE NOISE ORDINANCE TO CLARIFY THAT THE
PHRASE "PLAINLY AUDIBLE" DOES NOT REQUIRE THAT WORDS
OR PHRASES BE DISTINGUISHABLE AND THAT MERE BASS
REVERBERATIONS ARE SUFFICIENT; PROVIDING FOR
SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A
PENALTY.
Ordinance No. 94-32 was approved on a motion made by Councilman Goodson
and seconded by Councilman Smith.

Councilman Williams expressed appreciation to Richard Chappell and his
Staff for the promptness in answering his request for an update of the
Community Development Block Grant program. He said the report was very
comprehensive and well done.
Councilman Davis conveyed a message to Council from Ms. Linmarie Garsee
that she now has a better understanding of street parking guidelines and
appreciates Council ' s concern toward her problem and said that after
filling in for Mayor Moore while he was out of the Country, he has an
enhanced view of the mayor's schedule and obligations and extended God's
blessing upon him!
Councilman Ames thanked the various neighborhood associations for being
present in Council, expressed appreciation for the service they give to

the City and pointed out two neighborhood meetings scheduled in the
coming week.
Councilman Cokinos reported that the Zydeco party sponsored by Mobil Oil
Corp. at the Fair Park Coliseum last week was very good.
Mayor Moore thanked all of Council for their efforts and work,
especially Councilmen Cokinos and Ames for co-chairing a task force to
discuss possible alternatives for operation of the homeless shelter and
to Mayor Pro Tem Davis for filling in for him during his absence, and
said that the past two weeks have been very busy for him and that he had
a wonderful time representing Beaumont in a number of different places
including Beijing, China.

Mr. Roberto Flores, 2425 Buchanan, addressed Council to speak about the
single-mindedness of his son to become a police officer throughout life,
the pride he has in his son's service to the city and community,
commended the Police Department and said the community still backs them.
Mrs. Carla Nonette, 4355 Coolidge, addressed Council to support Mr.
Flores comments about the community backing the Police Department, again
mentioned a recent experience with an intruder attempting to break into
her home, expressed appreciation to the Police Department and 911 for
their quick responses when she has called them, particularly Officer
Roberto C. Flores, Jr. and Lt. Sonny Chambers.
Mr. Leo Flood, 5490 Greenbriar Lane, addressed Council regarding the
traffic near the Beaumont State Center on Fannin Street and said a
traffic light with a pedestrian control button is needed for the safety
of the citizens crossing the street at that location.
Ms. Brenda Gallo, 3610 Ector Street, addressed Council to complain about
flea infestation coming from sand deposited near her home about May 2nd
or 3rd by City crews involved with sewage and drainage repairs, said
she and her daughter have been to the doctor several times because of
flea bites and are still receiving medical attention, have incurred
medical bills and asked for any assistance the City can give her with
the problem. Mayor Moore suggested that Ms. Gallo meet with the City
Attorney after the meeting.
Ms. Doris Price Neely, 1095 Goliad, addressed Council regarding the
Homeless Shelter, said a long-term solution is needed to help the
homeless and there are model programs in other cities to follow and said
the Lamar University Department of Nursing wants to be involved in
helping.
Mr. Frank Messina, 2525 College Street, addressed Council representing
the College Street Corridor Association and said a shelter for the

homeless is needed, but there needs to be accountability,
responsibility, rules and regulations in it's operation and none have
existed in the past, and Mr. Messina said it has been more of a hangout
than a shelter.
Mr. Rex Johnson, 4350 Chaison, addressed Council to complain of one-
sided preferential concern of community needs for the city.
Mrs. Mary Reeder, 660 Calder, Executive Director of Habitat for Humanity
addressed Council to announce that on Sunday, June 26th, they will
dedicate the fourth house they have constructed in Habitat Park and said
they plan to build 18 homes there. Mrs. Reeder thanked Mr. Riley, Mr.
Richard Chappell, and Mr. John Beatty for their assistance with City
requirements and gratefully acknowledged the help of St. Andrew's
Presbyterian Church parishioners. Mrs. Reeder extended an invitation to
Councilman Williams to speak the dedication ceremony on Sunday.
Mr. Rob Demary, 430 East Elgie, addressed Council to announce a meeting
of the Beaumont Federation of Neighborhood Association on Friday, June
24th, at 3 : 30 p.m. in the Council Chambers.

There being no further business, the regular session of City Council was
recessed to conduct a workshop session.
