BE IT REMEMBERED that the City Council of the City of Beaumont, Texas,
met in regular session this the 24th day of May, 1994, with the
following present:

Citizen comment was invited on the Consent Agenda and Main Agenda Items
1 and 3 through 7. No one wished to address these subjects.

The following Consent Agenda items were considered:
Approval of the Minutes of the regular City Council session held May 17,
1994;
Resolution No. 94-116 appointing Gene Vanmeter to the Electrical Board
of Review for a term expiring May 23, 1997;
Resolution No. 94-117 authorizing Ray A. Riley, Sara S. Culbreth, Kandy
Daniel and Kirby Richard as signatories on Escrow Account No. 480079700
at First Interstate Bank of Texas, N.A. so that funds may be drawn on
that account in installments to pay for construction of the Magnolia
Park Recreation Center;
Resolution No. 94-118 authorizing purchase of Parcel 7 : Lot 14, Block
2, Broadway Place Addition, from Mrs. Debra Sims for the appraised value

of $43, 000. 00 for improvements to West Lucas Drive from Phelan Boulevard
to Delaware Street; and
Resolution No. 94-119 authorizing purchase of a 75 HP diesel-driven
tractor slopemower (Ford New Holland Model 6640 with an Alamo 20 ft. ,
48 in. extendible boom arm mower) from Oil City Tractors in the amount
of $39, 274.00 for use by the Water Production Division.
The Consent Agenda was approved on a motion made by Councilman Cokinos
and seconded by Councilman Smith.

Ordinance No. 94-29 annexing 2,183.5 acres located in the Christian
Hillebrandt League, Abstract No. 28, located East and South of Tyrrell
Park and commonly referred to as "Cattail Marsh" was considered:

ENTITLED AN ORDINANCE ANNEXING THE HEREINAFTER
DESCRIBED TERRITORY TO THE CITY OF BEAUMONT,
JEFFERSON COUNTY, TEXAS, AND EXTENDING THE BOUNDARY
LIMITS OF SAID CITY SO AS TO INCLUDE THE SAID PROPERTY
WITHIN THE CITY LIMITS, AND GRANTING THE SAID TERRITORY
AND TO ALL INHABITANTS THEREOF ALL OF THE RIGHTS AND
PRIVILEGES OF OTHER CITIZENS; AND BINDING SAID
INHABITANTS BY ALL OF THE ACTS AND ORDINANCES OF SAID
CITY.
Ordinance No. 94-29 was approved on the second and final reading on a
motion made by Councilman Smith and seconded by Mayor Pro Tem Goodson.

Ordinance No. 94-30 authorizing a Specific Use Permit to allow a new
church and parking lot to be built at 4090 Pine Street in an area zoned
RS (Residential Single Family Dwelling District) and RCR (Residential
Conservation and Revitalization District) at the request of the Reverend
Allison Lacy was considered:

Ordinance No. 94-30 was approved on a motion made by Councilman Cokinos
and seconded by Councilman Davis.

Resolution No. 94-120 authorizing purchase of two AMZ Magnum trailer-
mounted patching machines for use by the Streets and Drainage Division
from Conley Lott Nichols Machinery at $48, 750. 00 each for a total of
$97, 500.00 was approved on a motion made by Mayor Pro Tem. Goodson and
seconded by Councilman Davis.

Mayor Pro Tem Goodson requested an update of the Capital Reserve Fund
after noting that four large items are being purchased from that fund.

Resolution No. 94-121 authorizing purchase of two one-ton trucks from
Atterbery Truck Sales in the amount of $57, 089 . 14 ($28, 544. 57 each) for
use by the Street and Drainage Division to haul street patching
equipment and material was approved on a motion made by Mayor Pro Tem
Goodson and seconded by Councilman Ames.

Resolution No. 94-122 authorizing purchase of a Chevrolet truck equipped
with a Versalift aerial device from Commercial Body Corporation in the
amount of $73,997. 00 for use by the Building Services Division was
approved on a motion made by Councilman Smith and seconded by Councilman
Ames.

Resolution No. 94-123 authorizing purchase of two 14-cubic-yard dump
trucks for use by the Streets and Drainage Division from Atterbery Truck
Sales at $62, 350.54 per unit for a total amount of $124, 701.08 was
approved on a motion made by Councilman Davis and seconded by Councilman
Cokinos.

Mr. Jude Paredez approached the podium to address Council, was told that
opportunity to address the Consent Agenda and Main Agenda Items 1 and 3-
7 was given earlier, but after Mr. Paredez complained that not enough
time was allowed then for him to come to the podium and speak, Mayor
Moore gave permission to dispense with policy and let Mr. Paredez speak.

Mr. Jude Paredez addressed Council in opposition to Agenda Item No. 7
authorizing purchase of lunches for the Summer Food Service Program
administered by the Parks and Recreation Department. Mr. Paredez said
higher priority should be given to hiring detectives to work on unsolved
murders and that federal funds, not local monies, should pay for a free
lunch program.

Resolution No. 94-124 authorizing a contract with Regal Food Service,
Inc. to furnish approximately 1, 300 lunches for the Summer Food service
Program in the amount of $1. 58 per lunch to be administered by the Parks
and Recreation Department at Alice Keith Park, Bowie Junior High,
Carroll Street Park, Cottonwood Park, Magnolia Park, Pine Street Park,
Roberts Park and Sprott Park was considered.
Mayor Pro Tem Goodson verified that full reimbursement for the cost of
each lunch served is received from the Texas Department of Human
Services and that the City bears no expense for the lunches.
Councilman Smith noted the progress of the program over the past three
years, said she fully supports the program because it brings the
children into the parks for planned activities as well as feed them, and
all the City has to do is administer the program.
Councilman Davis said he also supports Mr. Paredez ' desire to solve
murders, but when an opportunity is given to administer a program that
doesn't cost the City any tax dollars, we should take advantage of that
opportunity. Councilman Davis said he thinks this is a wonderful
program and said there are children living in his Ward that might not
have a lunch if this program was not in place.
Mayor Moore added that while visiting the correction facility in Mid
County this morning with the Governor, she commented that a number of
youth go to TYC because it is the only place they can go to get three
meals and a bed to sleep in each day. He said this is a sad commentary
that he does not want placed upon the youth of our area.
Resolution No. 94-124 was approved on a motion made by Councilman Davis
and seconded by Councilman Smith.

listed dilapidated structures found to be in violation of the City of
Beaumont's Dangerous Structure Ordinance, Article III, Section 14-50:

raise all twenty-three (23) structures within 30 days.
The above-listed parcels of property have been inspected, are vacant and
have been found to be in violation of Article III, Section 14-50 of the
Code of Ordinances. Notices have been sent to owners by Certified Mail
and published in the Beaumont Enterprise.
The eighteen (18) structures listed below have been condemned by City
Council and the owners ordered to either raze or repair them within
specified time frames. Reinspection of these structures have revealed
non-compliance with the Council 's order. The Community Development
Division of the Administrative Services Department is requesting
authorization from the City Council to demolish these structures in
accordance with the Dangerous Structure Ordinance and charge the
property owners with the cost of demolition:
2555 Atlanta, 1595 Avenue A (Garage Apt. ) , 7427 Black Lane, 1392 Cable,
1410 Cable, 1745 Corley (Garage) , 735 Dixie, 96 5th (Garage Apt. ) , 2270
Franklin (Apts. ) , 1595 Grand, 1298 Gladys, 3080 Hollywood, 3250 Ledet
Road, 1428 Liberty, 63-65 Minor, 3955 Nathan, 3705 Usan, and 1666
Washington Boulevard.
There being no one to address Council, the Public Hearing was closed.
ORDINANCE NO. 94-31
ENTITLED AN ORDINANCE FINDING CERTAIN
STRUCTURES TO BE PUBLIC NUISANCES AND
ORDERING THEIR DEMOLITION AND / OR REPAIR;
PROVIDING FOR SEVERABILITY AND PROVIDING FOR
A PENALTY.
Ordinance No. 94-31 was approved on a motion made by Councilman Cokinos

Mayor Moore announced that an Executive session will be held at the
close of the Workshop Session in accordance with Section 551.071 of the
Government Code to discuss pending or contemplated litigation: the
Claim of Harry Jackson and the claim of Linda Jones, and in accordance
with Section 551. 074 of the Government Code to discuss appointment,
employment, evaluation, reassignment, duties, discipline or dismissal of
a public officer or employee: Discuss the filling of a vacancy in Ward
IV.

Councilman Davis extended an invitation to attend the Northend
Neighborhood Association meeting Wednesday evening at 7: 15 p.m. at St.
Pius Catholic Church.
Councilman Ames said she would like to thank everyone again that voted
for her, that she is happy to serve on Council and is looking forward to
her tenure.
Mayor Pro Tem Goodson reported that he has received a call from ACORN
(Amelia Coalition of Responsible Neighbors) , and they are going to have
a sign unveiling at Major Drive and McLean on Wednesday at 1:30 p.m.
Councilman Smith commented to Councilman Ames that Council Packets are
not usually as large as this first one she received.
Mayor Moore said this first week serving as mayor has been most
interesting and busy. Among his activities, he has attended DARE
graduations, read to Headstart students, welcomed Mobile Transportation
Units of the Army, celebrated with honor students, cut the ribbon for
the Cajun Fest, attended a barbecue cook-off where Mayor Pro Tem Goodson
won second place, the Port of Beaumont's memorial ceremony, a
fundraising event for the Southeast Texas Community Clinic and visited
with the children at Our Mother of Mercy. In addition, Mayor Moore
encouraged everyone to attend the Town Meeting at the Civic Center at
7:00 p.m. , said the Governor will be present at that meeting and that
this is an excellent opportunity to find out more about plans for our
area.

Mr. Tony Jones, 508 Garland, addressed Council to complain that he was
denied access at the Civic Center today because of his dog, even after
he explained that it was a seeing-eye dog. Mayor Moore told Mr. Jones
his problem would be acted upon promptly.

Ms. Jackie Doyle, 2660 Burgundy; Ms. Annie Bell, 170 South Parkway
Drive; Mr. Archie Land, 435 Langham Road; Ms. Paula Moore, 603 Palm, 3-
C; Mr. Calvin Taylor; and Ms. Sherry Noeller, 1002 Avenue A; addressed
Council regarding the closing of the Trinity Valley Emergency Shelter
for the Homeless on June 1st, the continued need for this service and
voiced support of formation of a task force to find a way to keep a
shelter of this type open.
After receiving affirmative answers from Councilmembers Cokinos and Ames
to serve as Council representatives, Mayor Moore asked social workers
from the various agencies to join with them and serve on a study group
to help compile alternatives that Council might consider in addressing
the homeless situation.
Mr. Henry Dannenbaum, 2880 Grand, addressed Council to support keeping
the shelter open and to discuss other social issues of importance to
him.

The presence of Representative Al Price, President Al Thomas of Prairie
View University and former Councilman Audwin Samuel was recognized, and
Mayor Moore took opportunity to thank the Police Department for their
ongoing investigation that led to a successful conclusion of the murder
of Mr. Bill Simpson.

recessed to conduct a workshop session.
