BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 19th day of April, 1994, with the following present: HONORABLE: Evelyn M. Lord Mayor Guy N. Moore Councilman, Ward IV Ray A. Riley City Manager Lane Nichols City Attorney Barbara Liming Deputy City Clerk -000- The Invocation was given by Father Francis Burlton, Assumption Church. The Pledge of Allegiance was led by Councilman Davis. -000- Two Proclamations were issued: "National Organ and Tissue Donor Awareness Week, " April 17-23, 1994 ; and "National Volunteer Week, " April 17-23, 1994. -000- Mobil Oil Corporation's Beaumont Refinery Manager, Mr. Tom Moeller, and Community Affairs Manager, Mrs. Jeannie Mitchell, on behalf of the Mobil Foundation, Inc. presented the City of Beaumont with a check in the amount of $34, 000. 00 to continue a summer youth employment program for 20 economically disadvantaged youth who have completed their junior year in high school. Mr. Moeller said the Mo-Beau Team is a good example of the working relationship that can exist between the private sector and local government for the welfare and betterment of the community. Also, Mr. Moeller acknowledged the leadership and coordination efforts of Glenda Lundy, Human Resources Director, and Rosa Thomas, Personnel Technician, for the City of Beaumont, as well as Central High School's Principal Sybil Comeaux and Eleventh Grade Counsellor Marie Maggio and Principal Paula Ainsworth and Eleventh Grade Counsellor Wilma Gibbs from Westbrook High School. -91- April 19, 1994 The Mayor and Council expressed appreciation to Mobil Corporation for their interest and investment in the youth of Beaumont, and Mayor Lord said that as a result of her working with the youth for several summers, "it has not only been a privilege to have these young people working with us, " but she has become acquainted with some "very, very fine young people through the program, " and it's been her pleasure now to write letters of recommendation for some of them as they enter college. She told Mr. Moeller, that these young people have been given "more than a helping hand, and more than a summer job. " -000- Citizen comment was invited on the Consent and Main Agendas. No one wished to address these subjects. -000- The following Consent Agenda items were considered: Approval of the Minutes of the regular City Council session held April 12, 1994; Resolution No. 94-88 appointing Myra Clay (fill unexpired term of Carla Nonette) for a term expiring October 12, 1994 and Jack Follmer for a term expiring April 18, 1996 to the Parks and Recreation Advisory Committee; Stephen Mayfield to the Convention and visitors Advisory Board for a term expiring November 23, 1994; and Bonnie Schmaltz to the Keep Beaumont Beautiful Commission for a term expiring April 18, 1996; and Resolution No. 94-89 authorizing renewal of a one-year contract with the Jefferson County Emergency Medical services District #1 in the amount of $4,027.50 for availability of the City of Beaumont's emergency medical services. The Consent Agenda was approved on a motion made by Councilman Cokinos and seconded by Councilman Alter. Question: Ayes: All Nayes: None -000- Resolution No. 94-90 declaring 82.23 acres (64.72 acres of Tract 5 and 17.51 acres out of Tract 4) of property at the end of Pine Street along the Neches River out of the 1,200-acre Collier's Ferry tract a City park (to allow enforcement of an ordinance prohibiting consumption of alcoholic beverages on City parks) was approved on a motion made by Councilman Alter and seconded by Councilman Davis. Question: Ayes: All Nayes: None -92- April 19, 1994 Resolution No. 94-91 authorizing Change Order No. 1 for installation of fabric underseal on Calder, South Caldwood, Central Caldwood, West Caldwood and Cross Street (+$40,700.88) and to reflect actual quantities used (-$18,858.40) for a total increase of $21,842 .48 resulting in a final contract price of $304,803 .94 for the 1994 Street Rehabilitation Program with Bo-Mac Contractors, Inc. and authorizing final payment in the amount of $297,717.40 was approved on a motion made by Councilman Cokinos and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Resolution No. 94-92 authorizing purchase of various size PVC pipe and fittings for the Public Utilities Department in the amount of $487,220. 66 from Golden Triangle Pipe and Water supply was approved on a motion made by Councilman Davis and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Resolution No. 94-93 authorizing an annual contract with Texaco Express Luba to provide routine maintenance for City automobiles, vans and pick up trucks at $14.99 per vehicle for an estimated annual cost of $30,579.60 was approved on a motion made by Councilman Alter and seconded by Councilman Smith. Question: Ayes: All Nayes: None -000- Resolution No. 94-94 authorizing an annual contract for limestone with Transit Mix Concrete and Materials Company in the amount of $10.20 per ton F.O.B. Plantsite and $12 . 35 per ton F.O.B. Jobsite, Zones 1-4, for an estimated annual cost of $75, 000. 00 was approved on a motion made by Councilman Cokinos and seconded by Councilman Moore. Question: Ayes; All Nayes: None -000- Councilman Moore congratulated all those who participated in the Clean Sweep activities Saturday morning, said it was a productive day with an exceptional participation by young people, and that again Neches River Festival activities were enjoyable. Councilman Alter echoed comments about weekend activities and congratulated Arlana LeBlanc for engineering the decoration of the City Council float for the parade. Mayor Lord said the Neches River Festival experience was a lot of fun and congratulated the new King (Hubert Oxford, III) and the new Man of the Year, and said she was sorry to give that title up because it has -93- April 19, 1994 provided more fun than anything since she was elected Outstanding Woman in Law School and was the only woman in law school! Mayor Lord said this has been an outstanding week recognizing volunteers. She said the J. C. Penney awards have been established in Beaumont this week with over $8, 000. 00 donated to the agency of the volunteer's choice. She said the locally recognized volunteers will advance to a national contest with an opportunity to win a $10,000 contribution for their charity. She said that is overwhelming to realize the thousands of volunteer hours provided our community and expressed commendations to all those who volunteer. -000- Mr. Henry Dannenbaum, 2880 Grand, addressed Council to compliment Council and various activities of the city including the Neches River Festival. Mr. Robert Lynn DeMary, 430 East Elgie, addressed Council to extend an invitation to attend the Beaumont Federation of Neighborhood Association meeting on Friday afternoon at 3 : 30 p.m. . Mayor Lord explained that Mr. DeMary has been the intern from Lamar University working on this concept and expressed appreciation for his assistance. Mr. Forrest F. (Ted) Posey, 3695 Edmonds Street, addressed Council saying he has been a citizen of Beaumont for over 70 years, applauded Mayor Lord by saying she will be hard to replace as mayor of Beaumont, and as a Senior Citizen, Mr. Posey expressed his respect and admiration for her service to Beaumont in his impromptu, poetic fashion by saying, "So-long, So-long, we're going to miss you, but deep down in our heart you'll always be a part of our. . .prayers and hope for your retirement to be one-hundred plus for the best of your life. " -000- Mayor Lord announced that an Executive Session will be held following the City Council meeting in accordance with Section 551. 074 of the Government Code to discuss appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a public officer or employee: Magistrate of the Municipal Court; and in accordance with Section 551. 071 of the Government Code to discuss contemplated or pending litigation: Sean Davis vs. The City of Beaumont. -000- There being no further business, the regular session of City Council was recessed to conduct the Executive Session. -000- I, Barbara Liming, Deputy City Clerk of the City of Beaumont, Texas, -94- April 19, 1994 certify that the above is a true copy of the Minutes of the regular City Council session held April 19, 1994 .
